cannot remember the last time anyone made a mistake, or a problem occurred because of an error or omissions then you can stop reading now. This article does not apply to you. And congratulations!
If you’re like most of us, however, you don’t see many days go by without something going wrong. Sometimes these things are minor annoyances that simply cost us a little time, a little work, or a little money. Sometimes they can cause us heartache, a lost client, a claim tendered to our insurer or a bar complaint. Whether major or minor however, most folks spend too much time dealing with the fallout instead of preventing the mistake from happening again. When talking with colleagues, I’m surprised by how many don’t have a formal compliance system.
Whether your mistakes or problems are big or small, every firm needs a system in place so you are not making the same mistakes or encountering the same problems a second time. In the collection industry, we call it a Compliance Management System but regardless of what it is called, it is about detecting nonconformities (mistakes), performing a root-cause analysis and creating policies, procedures and work instructions designed from prevent future nonconformities. It is about continuous improvement of work processes to ensure quality control.
How does your staff know how to do the things they do? If your office is anything like my clients’ it is often tribal knowledge. Do you have employees upon whom you depend, because they know how to do “everything”? Having written Policies, Procedures and Work Instructions should enable a new employee to walk in the door and work on many tasks on day one because you are able to provide them with step-by-step instructions. If you don’t have step-by-step instructions, why not?
A good management system
should address every aspect of your business; management responsibilities, client issues and satisfaction, document and data control, purchasing, process control, audits and testing, identifying nonconformities, corrective actions, preventive actions, continuous improvements, records management, training and many more.
Most industries have a management system certification to demonstrate to their customers they have a system in place to ensure compliance and quality. In the legal industry it is, apparently, the ISO 21007. I’m not saying you need this certification. I am saying, you need a system that does not rely solely on word of mouth and fire extinguishers. �

The Holidays are really upon us, although Costco has had Christmas decorations up since September!!! I have ordered my Thanksgiving turkey and the holiday wreaths for Christmas. Maybe you have already started purchasing holiday gifts. I am not that far along. I haven’t made my own wish list, let alone started picking out items for others.
But the end of the year is rapidly approaching. Now is the time to think about your end of year financial gifts. I am asking that you consider a gift to the Legal Foundation of Washington through its Campaign for Equal Justice and support justice and civil legal aid. The Campaign for Equal Justice and the Legal Foundation of Washington raise funds to provide free civil legal aid to low-income families in Washington State. Unlike criminal cases, where a lawyer is guaranteed if you cannot afford one, individuals often face civil issues with potentially life changing consequences without an attorney. Civil issues include domestic violence, eviction, immigration and debt collections. Last year, the Legal Foundation funded 35 legal aid programs, which helped 30,000 families across the State resolve legal problems. Since 1984, the Legal Foundation, with its yearly Campaign for Equal Justice fundraising programs, has been ensuring justice is a reality for all people in Washington.
Many of you may have received a phone call in October during our yearly Snohomish County Phone-a-thon. So far, we have raised $14,970 from 86 donors. That is already more that we raised in 2016! And we are still continuing to receive donations. I want to thank several individuals who helped during the Phone-a-thon: Jen Gonyer, Lynn Adrian, Rory Hardy, Nicole Franklin, Deane Minor, Robert O’Neil, Ben Haslam and Ben Franklin all made tons of phone calls. Anderson Hunter Law Firm, P.S. lent us their beautiful conference room and Judge Bowden and Judge Bui fed and encouraged us. It would be great to get to over 100 donors by the end of the year.
If you haven’t already given, there are several easy ways to give. Firstly, you can go online to a secure giving site at www.legalfoundation.org. Secondly, you should be receiving an end of the year letter from
the Campaign if you haven’t already given. Just send your gift back in the envelope. Finally, you can give to the Legal Foundation when you renew your 2018 Bar Due. On the back page of your License Renewal Form, you can make an automatic charitable donation of $50.00 to the Campaign for Equal Justice. Join with me—take a stand and invest in justice for all.
And a Very Big Thank you to Everyone who has already given generously to the Campaign this year. �

This month we are introducing a new column, answering questions about ethical issues that may arise in your everyday legal practice. This month’s column addresses the question: Random audit of your trust account- what happens, and what are the chances it will happen to you?
If you are in private practice, and you handle client funds, you likely have a trust (IOLTA) account. The Office of Disciplinary Counsel (ODC) of the Washington State Bar Association is authorized to examine the books and records of any lawyer or law firm, selected at random, to determine whether the lawyers are in compliance with the Rules of Professional Conduct (RPC) related to trust accounts. ODC currently employs three auditors who work both to investigate grievances and to conduct random examinations of lawyer’s trust accounts.
A random examination involves a review of the procedures used by the lawyer to account for money or property as required by RPC 1.15A, and a review of the records the lawyer or law firm keeps as required by RPC 1.15B. You must cooperate with the examination. The auditor may visit your law firm in person, or simply review records you send to them. At the conclusion of the examination, ODC will issue a report, and could recommend that a disciplinary grievance be opened. That said, the auditors will generally work with you to informally resolve any minor issues with your recordkeeping.
The odds of you being selected for a random audit are low; in 2016, there were 31,549 active licensed lawyers in Washington and just 80 random examinations. If your “number” is drawn, your entire law firm will be examined. But if you or the firm have already been subject to a random examination in the preceding seven years, you will not be subject to another.
