EXECUTIVE SUMMARY

INTRODUCTION The Signature Group is involved in the prospective subdivision and residential development of a site at 103 Tallawong Road Rouse Hill NSW. NG Child & Associates has undertaken a Preliminary Site Investigation of the property, to a standard and in in a form suitable for submission to Blacktown City Council, the local government consent authority at interest, as part of a Development Application submission for the residential subdivision initially proposed. Noel Child is a suitably qualified and experienced person to undertake the Preliminary Site Investigation required. His CV has been included for reference at Appendix E. This document presents the finding and recommendations of the Preliminary Site Investigation undertaken.

APPROACH The site investigation and assessment was completed in accordance with all relevant guidelines and protocols, including those provided by in the NSW EPA document Guidelines for Consultants Reporting on Contaminated Sites (1997, reprinted 2000 & 2011), and included in particular:

A detailed review and consideration of the history and past uses of the site, based on a search of available title and ownership records; and

A thorough physical inspection of the site and surrounding properties.

SITE HISTORY Based on the review of past site uses summarised above, it appears that the only land use likely to have resulted in any contamination would have been the residential and hobby farm use since 1961. That land use is considered to involve minimal risk of contamination, given the apparent absence of any intensive form of market gardening, or other application likely to have involved significant chemical application and use. It is noted that ownership and use of the land since 1965, and up until the present time, has resided with the Kaczorowski family. While the use of the land is understood to have been rural residential during this period, it is apparent from the site inspection described in Section 7 of this report that a significant amount of general rubbish has been accumulated at the site during the latter part of that period. This issue is addressed in the following section of the report. From the viewpoint of the suitability of 103 Tallawong Road Rouse Hill site for the residential sub-division and redevelopment purpose now proposed, and subject to confirmation to appropriate clean -up actions, past uses of the site do not appear to have had any significant negative impact on the property from a future residential use perspective. Accordingly, the review of site history and past uses has not identified any environmental or contamination constraints to the proposed use of the land for residential sub-division and redevelopment purposes.

SITE INSPECTION & OVERALL FINDINGS Based on the site inspections undertaken, the general environmental condition of the 103 Tallawong Road site is considered to be sound, and a detailed physical inspection of the site has not indicated any fundamental environmental or contamination issues prejudicial to the residential subdivision and development use understood to be proposed for the site. However, the following observations and comments apply:

The existing dwelling present at the site appears likely to contain significant quantities of cladding, sheeting and possibly other materials containing asbestos;

Various sheds and outbuildings of unknown construction and composition are present at the

site, together with quantities of waste materials positioned at various points throughout the site;

It is possible that hazardous or potentially hazardous materials may be present in these buildings and wastes, and that some impact on the site may have occurred as a consequence that is unable to be determined within the limited scope of this preliminary site assessment; and

Wastes and other materials stored at the site may include materials containing asbestos.

RECOMMENDATIONS These findings are made subject to the following recommendations:

That any demolition and clean-up work required at the site prior to the proposed subdivision are undertaken in accordance with relevant Australian Standards, WorkSafe NSW guidelines and any other applicable requirements;

That any items suspected of containing asbestos are to be validated and appropriately removed

from the site, in accordance with all applicable asbestos handling and disposal protocols, prior to subdivision works commencing at the site; and

That an appropriate “Unexpected Finds Protocol” is established in the general form indicated in

Section 8 of this report prior to the commencement of any demolition, clean-up, sub-division or residential development works at the site.

On the basis of the findings of this Preliminary or Stage 1 Site Investigation and Assessment, and subject to the above recommendations, the site is considered suitable or able to be readily made suitable in environmental and contamination terms, for the residential land use proposed.

Mr Tanmay Siddharth of the Signature Group has engaged NG Child & Associates to undertake a Preliminary Site Investigation of the property, to a scope and in a form suitable for submission to Blacktown City Council, the local government consent authority at interest, as part of the Development Application (DA) for the project. NG Child & Associates has considerable experience in the evaluation and assessment of residential developments. Noel Child is a suitably qualified and experienced person to undertake the investigation required. His CV has been included for reference at Appendix D. This document describes the Preliminary Site Investigation undertaken, and presents the findings and recommendations of that investigation.

2 SITE & ASSESSMENT DETAILS

2.1 LOCATION The location of 103 Tallawong Road Rouse Hill is shown highlighted in blue in Figure 2.1 below. The direction of north is towards the top of the diagram, and an approximate indication of scale is included below.

The nearest significant thoroughfares intersecting Tallawong Road is Macquarie Road to the north east, almost opposite the site, and Schofields Road to the south. The site adjoined by other existing acreage properties. A recent photograph of the 103 Tallawong Road site is provided in Figure 2.3, on the following page.

2.2 LAND DETAILS & ZONING The proposed site falls within the local government area of Blacktown City Council, and relevant local government consents and approvals regarding site and the proposed development reside with that Council. Zoning details applicable to the site and nearby areas are provided in Figure 2.4, on the following page, based on information available from the Blacktown Local Environment Plan 2015. The 103 Tallawong Road site is shown at the centre of the diagram, outlined and shaded in yellow... The land is formally defined as Lot 35 in Deposited Plan Number 30186. The bulk of the land is zoned R3, Medium Density Residential. A small portion of land zoned SP2 Infrastructure, and required for drainage works, is present in the south-west or rear of the site, as shown in Figure 2.4.

4 ASSESSMENT GUIDELINES

4.1 PRELIMINARY SITE INVESTIGATION & SALINITY 4.1.1 Introduction Guidelines for the environmental and contamination assessment of land have been established by relevant NSW Government agencies and departments, and these guidelines inform the assessment requirements of local government. The requirements of these guidelines have been considered, along with other relevant guidelines, in the assessment proposal presented in this document.

4.1.2 NSW Government Requirements NSW Environment Protection Authority The NSW Environment Protection Authority (now a division of the NSW Department of Planning) provide guidelines and protocols for the environmental assessment of land on both a preliminary and detailed assessment basis. These guidelines and protocols are summarised in the guideline NSW EPA document Guidelines for Consultants Reporting on Contaminated Sites (first published 1997; reprinted September 2000, reprinted with updated agency details and references August 2011), and provide the appropriate basis for environmental site assessment undertaken in support of a Development Application to a local government authority in NSW. This assessment has been completed in strict accordance with those guidelines. Planning NSW Planning NSW’s State Environmental Planning Policy 55 requires that an assessment of soil quality is required in cases where land previously used for non-residential purposes is proposed for residential development. While the provisions of SEPP 55 typically apply to the use of former commercial or industrial land for residential purposes, it is appropriate that the requirements of the policy are considered in this case. Low density residential developments are among the most sensitive land uses from a site contamination perspective, and maximum care and a precautionary approach regarding site assessment is considered appropriate.

4.1.3 Typical Investigation & Assessment Requirements The following considerations typically apply to the approach of local government in NSW to environmental and contamination site investigations and assessments, and are considered relevant to the assessment presented in this document, and to the level of investigation and assessment detail provided. Pursuant to the provisions of the Environmental Planning and Assessment Act 1979 (as amended), Councils have a duty of care, when considering Rezoning, Development and Complying Development Certificate Applications, to consider fully the possibility of land contamination and the implications it has for any proposed future use of land. In recognition of this duty of care, Councils typically (and not unreasonably) adopt a precautionary approach to the consideration of applications involving contaminated or potentially contaminated land. The object of this approach is to enable any land contamination issues to be identified and dealt with at an early stage in the planning process. This approach can, as in this case, involve the requirement for a detailed environmental site investigation.

Councils will typically have regard for the sensitivity of a proposed land use in addition to any technical standards or requirements published by:

(a) The NSW Environment Protection Authority (EPA) (incorporated into the NSW Department of Environment and Conservation);

(b) The Australian and New Zealand Environment Conservation Council (ANZECC);

(c) The National Health and Medical Research Council (NH&MRC);

(d) The National Environment Protection Council (NEPC); and

(e) Any other relevant authority. The processes of identifying, evaluating and remediating contaminated land are documented in the ANZECC and NH&MRC publication entitled "Guidelines for the Assessment and Management of Contaminated Sites" (January 1992). Councils typically consider these guidelines to be a mandatory reference for consultants assessing contamination levels and undertaking remediation works. Councils also generally require that consultants preparing contamination reports should also have a practical working knowledge of the various Environment Protection Authority and NEPC publications on contaminated land including:

(1) Environment Protection Authority (EPA), 1994, Contaminated Sites: Guidelines for Assessing Service Station Sites;

(2) EPA, 1995, Contaminated Sites: Sampling Design Guidelines; (3) EPA, 1995, Contaminated Sites: Guidelines for the Vertical Mixing of Soil on Former Broad-

Acre Agricultural Land; (4) EPA, 1997, Guidelines for Consultants Reporting on Contaminated Sites; (5) EPA, 1998, Guidelines for the NSW Auditor Scheme; and (6) NEPC, 1999, Draft National Environmental Protection Measure - Assessment of

Contaminated Sites. Contaminated land is generally defined as land in, on or under which any substance is present at a concentration above that naturally present in, on or under the land and that poses, or is likely to pose, an immediate or long-term risk to human health or the environment (Environmental Planning & Assessment Act 1979, as amended). Contamination can result from many past and/or present occurrences, such as:

(a) The controlled or uncontrolled disposal of wastes, including sewage;

(b) Accidental leakage; (c) Leakage during plant operation, storage or transportation of materials, products or wastes; (d) The corrosion of underground tanks; (e) The emission of particulate matter into the atmosphere; (f) The migration of contaminants into a site from neighboring land, either as vapour, leachate

or movement of liquids through the soil; and (g) The use of agricultural chemicals.

In accordance with the NSW EPA guidelines included at Appendix A, four stages or levels of environmental or contamination assessment are identified, as follows:

In this case, a Stage 1 or Preliminary Site Investigation is required.

4.1.4 Blacktown City Council Contamination Assessment Guidelines Guidelines for the environmental and contamination assessment of land within the Blacktown City Council local government area are described in the Blacktown Development Control Plan (DCP) 2006, Part Q Contaminated Land Guidelines. Relevant sections of Part Q of the 2006 DCP have been included below for reference purposes. The requirements of these guidelines have been considered, along with other relevant guidelines, in the assessment proposal presented in this document.

Blacktown Development Control Plan 2006 Part Q Contaminated Land Guidelines 1.0 Introduction Pursuant to the provisions of the Environmental Planning and Assessment Act 1979 (as amended), Council has a duty of care, when considering Rezoning, Development and Complying Development Certificate Applications, to consider fully the possibility of land contamination and the implications it has for any proposed future use of land. In recognition of its duty of care, Blacktown City Council will adopt a precautionary approach to its consideration of applications involving contaminated or potentially contaminated land. The object of this approach is to enable any land contamination issues to be identified and dealt with at an early stage in the planning process. For this to occur, Council has developed a set of procedures to be followed for rezoning proposals, Development Application (DAs) and for Complying Development Certificate Applications (CDCs). These procedures allow for a merit-based consideration of land contamination issues, i.e. in considering the implications of contamination,

Council will have regard for the sensitivity of a proposed land use in addition to any technical standards or requirements published by: (f) the NSW Environment Protection Authority (EPA) (incorporated into the NSW Department of

Environment and Conservation); (g) the Australian and New Zealand Environment Conservation Council (ANZECC); (h) the National Health and Medical Research Council (NH&MRC); (i) the National Environment Protection Council (NEPC); or (j) any other relevant authority. The procedural principles which apply to all development proposals in Blacktown are spelt out in section 2.1 of this Part of Blacktown Development Control Plan (DCP) 2006. Specific procedures for rezoning applications and for DAs/CDCs are outlined in sections 3.0 and 4.0 respectively. The processes of identifying, evaluating and remediating contaminated land are documented in the ANZECC and NH&MRC publication entitled "Guidelines for the Assessment and Management of Contaminated Sites" (January 1992). Council considers these guidelines to be a mandatory reference for consultants assessing contamination levels and undertaking remediation works. Consultants preparing contamination reports should also have a practical working knowledge of the various Environment Protection Authority and NEPC publications on contaminated land including:

Sites. Contaminated land means land in, on or under which any substance is present at a concentration above that naturally present in, on or under the land and that poses, or is likely to pose, an immediate or long-term risk to human health or the environment (Environmental Planning & Assessment Act 1979, as amended). Contamination can result from many past and/or present occurrences, such as:

(h) the controlled or uncontrolled disposal of wastes, including sewage; (i) accidental leakage; (j) leakage during plant operation, storage or transportation of raw materials, finished products

or wastes; (k) the corrosion of underground tanks; (l) the emission of particulate matter into the atmosphere; (m) the migration of contaminants into a site from neighboring land, either as vapour, leachate

or movement of liquids through the soil; and (n) the use of agricultural chemicals.

The Table at Appendix A provides a reference to some activities that may cause contamination. The Table should be consulted as part of the initial enquiry process undertaken prior to the lodgment of an application with Council. The list of activities in the Table is a guide only to potentially contaminating sources. It should not be used as an exhaustive list.

Council views contamination as a subset of general pollution and will seek, in its assessment and determination of all applications, to ensure the continued compatibility of all development by minimising the potential for polluting discharges, fugitive emissions and controlled spillages by appropriate site management techniques. It is incumbent upon all developers to design and manage their sites in a manner consistent with this objective. Council does not favour site remediation which requires ongoing monitoring of capped contamination. This Part of the DCP is based on the provisions of the State Government's Planning Guidelines for Managing Land Contamination (1998) and State Environmental Planning Policy (SEPP) No. 55 - Remediation of Land (as amended by Amendment 1). Both documents, as well as the Contaminated Land Management (CLM) Act 1997, should be consulted in the preparation and assessment of site contamination reports.

2.0 Necessary Information in the Decision-Making

Four stages or levels of contamination assessment are identified, as follows:

2.1.1 Stage 1 – Preliminary Investigation 2.1.2 Stage 2 – Detailed Investigation 2.1.3 Stage 3 – Site Remedial Action Plan 2.1.4 Stage 4 – Validation and Monitoring

In this case, a Stage 1 or preliminary investigation is required. 2.1.1 Stage 1 - Preliminary Investigation

This stage involves the investigation and reporting of the site history and is typically based on readily available information such as historical records of land use, aerial photographs, consultations with previous occupants and relevant authorities and a site inspection. Where contaminating activities are suspected to have had an impact on the land, some initial sampling and analysis will need to be undertaken, by a suitably qualified environmental consultant and in accordance with Environment Protection Authority guidelines, to confirm and support any conclusions reached from the site history appraisal.

2.2 Investigation Report

A Stage 1 - Preliminary Investigation report (including site history information and documentation of known or potential sources of contamination) is required to be submitted to Council in the following circumstances at the nominated time.

2.2.1 Rezoning Applications

Where land is part of an investigation area under Part 3 of the Contaminated Land Management Act 1997, where the land has been used for an activity listed at Appendix A or where there are incomplete records regarding the historical use of the land and it is proposed to be rezoned for residential, education, recreational, child care or hospital purposes.

Nominated Time: At the time of lodging the Rezoning Application with Council.

2.2.2 Development/Complying Development Certificate Applications

Where a change of land use is proposed and where the subject, or immediately adjacent, land is suspected of contamination because it has historically been used for an activity listed at Appendix A.

Nominated Time: As part of the documentation included with the relevant application to Council.

APPENDIX A - Some Activities That May Cause Contamination

Agricultural/Horticultural Activities

Land heavily treated with persistent chemicals such as arsenic and organochlorine based chemicals (e.g. banana plantations, cotton and sugar cane fields, local orchards and horticultural plantations and market gardens), and organophosphate-based chemicals.

4.2 ASSESSMENT CONSIDERATIONS & CRITERIA The assessment considerations and criteria that appear to apply in this case, considering our own professional experience; our understanding of Blacktown City Council’s general requirements regarding the environmental assessment of land, and NSW Government requirements and guidelines are summarised below.

4.2.1 Stage 1 or Preliminary Site Assessment To ensure that all relevant environmental issues are dealt with in the assessment, a preliminary environmental and contamination assessment of the site is required. This type of site inspection and review, generally referred to as a Stage 1 or Preliminary Site Investigation, forms an important part the environmental assessment process, and the guidelines and protocols for environmental assessment defined by the NSW Office of Environment and Heritage (OEH), and the NSW Environmental Protection Authority that resides within the NSW OEH. A site inspection and general environmental assessment, describing the site and the location, and providing a review and consideration of all potential environmental risk and exposure issues, including relevant site history and consideration of nearby properties and activities, identifying any potential environmental impacts, including any potential hazardous risk issues. A general inspection and review of this type provides an important input to any relevant design considerations based on environmental and associated safety/risk factors. This preliminary investigation has considered all readily identifiable issues in relation to potentially hazardous material or structural issues.

4.2.2 Any Other Relevant Environmental Issues In addition to the specific assessment criteria discussed in 4.2.1 and 4.2.2 above, and in accordance with sound professional practice, any other matters of potential environmental relevance and significance that might emerge during the assessment process will also be considered as part of the proposed preliminary site investigation and salinity assessment to be undertaken at the site.

5 PURPOSE & SCOPE OF THE ASSESSMENT

5.1 OVERALL OBJECTIVE The overall objective of this assessment has been to provide a preliminary but reliable assessment of relevant general environmental and potential contamination issues at the 103 Tallawong Road site, and to prepare and provide an appropriate report.

5.2 GENERAL APPROACH TO THE ASSESSMENT The general approach to this investigation and assessment has involved a careful review of the issues that, in our professional opinion, and in terms of all relevant assessment guidelines and protocols as summarised in Section 3 of this report, require observation, consideration and assessment in order to determine whether the general environmental condition of the site is appropriate for the residential subdivision and subsequent residential development proposed; whether it complies with relevant guidelines and criteria, and whether any remedial actions may be required to achieve these outcomes. The assessment has taken into account regulatory approval, due diligence and any known or potential environmental and environmental health related issues, and has involved the following:

Use of the best available data regarding the background environment at and in the vicinity of the proposed development site;

Consideration of all other known and relevant information in relation to the various environmental issues involved in the assessment;

Consideration of all known and identifiable sources of actual or potential environmental impact, and the effects of any such potential impacts;

Detailed inspection of the site and its immediate environs; and

Review and consideration of site history.

5.3 SCOPE OF THIS ASSESSMENT The three key areas of the assessment presented in this report are summarised in 5.3.1, 5.3.2 and 5.3.3 below.

5.3.1 Review of Site History Past activities and land uses can influence the environmental condition of land, and can result in the contamination of soils. To ensure as far as practicable that past uses of the 103 Tallawong Road Rouse Hill site are fully investigated and assessed, a detailed search of property, title and ownership records has been undertaken. The results of this aspect of the site assessment are presented in Section 6.

5.3.2 General Site Inspection & Assessment To ensure that all relevant environmental and contamination issues are dealt with in the assessment, a thorough physical inspection of the site and surrounding areas has been undertaken. This type of site inspection forms an important part the environmental assessment process, and the guidelines and protocols for environmental assessment provided by the NSW EPA in its guideline document Guidelines for Consultants Reporting on Contaminated Sites.

The outcomes and results are reported in Section 7 of this report.

5.3.3 Any Other Relevant Environmental Issues In addition to the specific assessment tasks discussed in 4.3.1 and 4.3.2 above, and in accordance with sound professional practice, any other matters of potential environmental relevance and significance noted during the assessment process have also been taken fully into account in the assessment and reporting process.

6 SITE HISTORY & PAST USE

6.1 PROPERTY SEARCH A detailed property and title search of the property now known as 103 Tallawong Road Rouse Hill was undertaken as part of this assessment. Detailed results of this property and title search have been provided for reference in Appendices B, C and D to this document. Summaries are provided below, together with any environmental or contamination implications arising from the history and past use of the site.

6.2 HISTORY & PAST USE The property search provided details of ownership (and indications of use) dating back to 1901. From an environmental and contamination viewpoint, this is considered to be a more than adequate review period. Prior to 1901, it is assumed that the site was either crown land, or formed part of a larger agricultural holding that was originally crown land. 1901 - 1948 From 1901 to 1948, the parcel of land constituting the current site formed part of a larger portion of approximately 630 acres registered in the name of Edwin Stephen Rouse esquire, and land use is understood to have been for agricultural/grazing purposes. 1948 - 1956 Between 1948 and 1956 the land, still comprising some 630 acres, was owned by Nina Beatrice Terry, a married woman and daughter of the original owner Edwin Stephen Rouse. Land use is understood to have continued to be for agricultural/grazing purposes. 1956 - 1960 Between 1960 and 1961, following the death of their mother Nina Beatrice Terry, the ownership of the 630-acre portion of land transferred to Roderick, Edwin and Gerald Terry. Land use is understood to have continued to be for agricultural/grazing purposes. 1960 - 1961 Between 1960 and 1961, the current parcel of land (of approximately 20,000 square metres), as part of an aggregation of other lands, was created by the sub-division of the original 630-acre portion, and continued in the ownership of Roderick, Edwin and Gerald Terry, with land use understood to have continued to be for agricultural purposes. 1961 - 1962 Between 1961 and 1962 this smaller portion of land (the current land) continued in the ownership of Roderick, Edwin and Gerald Terry, grandsons of the original owner Edwin Stephen Rouse. Land use is understood to have continued to be for agricultural/grazing purposes. 1962 – 1965 In 1962 the land transferred to the ownership of Horace James Chilvers, contractor, and use of the property is understood to have been as a residence and small-scale hobby farm

1965 – 1986 In 1965 the land was purchased by Waclaw Kaczorowski, the father of the current owner, and the use of the land continued to be rural residential. 1986 – Present The ownership of the property transferred to Zbigniew Herman Kaczorowski and Narelle Joy Kaczorowski, and land use continued to be rural residential.

6.4 IMPLICATIONS OF SITE HISTORY & PAST USE Based on the review of past site uses summarised above, it appears that the only land use likely to have resulted in any contamination would have been the residential and hobby farm use since 1961. That land use is considered to involve minimal risk of contamination, given the apparent absence of any intensive form of market gardening, or other application likely to have involved significant chemical application and use. It is noted that ownership and use of the land since 1965, and up until the present time, has resided with the Kaczorowski family. While the use of the land is understood to have been rural residential during this period, it is apparent from the site inspection described in Section 7 of this report that a significant amount of general rubbish has been accumulated at the site during the latter part of that period. This issue is addressed in the following section of the report. From the viewpoint of the suitability of 103 Tallawong Road Rouse Hill site for the residential sub-division and redevelopment purpose now proposed, and subject to confirmation to appropriate clean -up actions, past uses of the site do not appear to have had any significant negative impact on the property from a future residential use perspective. Accordingly, the review of site history and past uses has not identified any environmental or contamination constraints to the proposed use of the land for residential sub-division and redevelopment purposes.

7 SITE INSPECTION & ASSOCIATED ISSUES

7.1 INTRODUCTION This assessment report deals with a number of important general environmental issues, and considers those issues generally considered in what are frequently referred to as “Preliminary Environmental Site Assessments” or “Stage 1 Contamination Assessments”. This section of the report summarises the findings of inspections of the 103 Tallawong Road site and surrounding areas undertaken by Noel Child of NG Child & Associates during September 2017.

7.2 PRELIMINARY (STAGE 1) ENVIRONMENTAL SITE ASSESSMENT The preliminary investigation undertaken has involved a detailed inspection of the proposed site and its immediate surroundings, taking into account the general environmental condition of the site, and including a review and assessment of past and current activities at the site; structural and engineering elements that may be relevant to the proposed development; nearby activities and operations, and any associated environmental risks, impacts or implications, and in accordance with relevant assessment guidelines including: General Definition of the Site Boundaries: A description of the proposed site, including the

preparation of appropriate diagrams showing the location of the site in relation to existing streets and other relevant references (refer Section 2).

Site Photographs: Representative photographs of the site, and nearby properties and civilities, illustrating relevant features.

Site Activities: A description of present activities and operations at and in the immediate vicinity of the site, noting any existing or potential environmental risks associated with these activities and operations.

Adjacent Activities: A consideration and description of the general nature of nearby property activities, including relevant comment on existing or potential environmental risks or exposures associated with these activities and operations.

Site History: A summary, to the extent that it can reasonably be obtained from local government and other sources, of the history of the past use of the proposed site, including appropriate consideration of any past operations or activities that may involve environmental risks or impacts (refer Section 5).

Hazardous Goods & Materials. An assessment of risks and potential risks associated with any hazardous goods or materials identified at or in the immediate vicinity the site.

Possible Hazards Associated with Building and Construction Materials or Structural Elements. Provision of general comments and relevant advice regarding any obvious or apparent issues in relation to building or construction materials, or structural elements, at or in the immediate vicinity of the proposed residential subdivision.

Soil Contamination. Physical inspection and assessment of soils for indications of contamination, including staining and odour, including consideration of the physical condition of soil samples collected by hand augur for salinity testing for the companion report Preliminary Geotechnical & Salinity Assessment: Proposed Residential Subdivision 103 Tallawong Road Rouse Hill NSW (September 29th, 2017).

Road Traffic Impacts. A general consideration of the potential environmental impacts of road traffic activities in the immediate vicinity of the site (excluding acoustic impacts), taking into account any impacts that these activities might have on the site

Equipment and Infrastructure. A review of any plant, equipment and infrastructure items at or in the immediate vicinity of the proposed site, and a review of any potential environmental risks or impacts.

Telephony, Power Distribution Infrastructure & other Potential EMF Sources. A review of any significant items of mobile telephone, electrical power distribution infrastructure, or any other potential electromagnetic field sources at or in the immediate vicinity of the site, with a view to identifying any potential environmental impacts or possible health risk exposures.

Acoustic & Air Quality Issues: General and preliminary consideration of acoustic and air quality issues, based on a physical inspection of the site and surrounding areas; and

Any Other Matters of Environmental Relevance: Comment and advice on any other matters of an environmental nature considered relevant in terms of providing a thorough and complete environmental assessment of the proposed development.

This preliminary site investigation is intended to provide a concise but thorough review of all general environmental and contamination issues, impacts and risks associated with the site.

7.3 SITE HISTORY Refer specific review provided in Section 5 and associated appendices.

7.4 SITE & IMMEDIATE SURROUNDINGS The site comprises land of approximate area 20,000 square metres with frontage to Tallawong Road. The nearest significant thoroughfares intersecting Tallawong Road is Macquarie Road to the north east, almost opposite the site, and Schofields Road to the south. The site adjoined by other existing small acreage properties. Other land uses in the general vicinity of the subject site are typically rural residential or agricultural, although it is apparent that a significant amount of land in the general area of the site is also being considered for low and medium density residential re-development. The general condition of vegetation at the 103 Tallawong Road site is healthy, as indicated by the photograph provided at Figure 7.1,

The site and its immediate surroundings are shown in Figure 7.2 below, with the subject site highlighted in blue at the approximate centre of the diagram.

Figure 7.2 – Site & Surrounding Area (September 7th, 2017) While the subject site and those in its immediate vicinity remain in small agricultural or rural residential use, the effects of residential re-development and urbanisation can be seen in the north-west rail line infrastructure under development to the south of the site, and existing residential development to the south-west, and further to the south, on the opposite side of Schofields Road.

7.6 PHYSICAL INDICATIONS OF CONTAMINATION OR POLLUTION The 103 Tallawong Road site comprises a rectangular portion of land. General inspections of the site were undertaken during late September 2017 to identify any visible evidence of pollution or contamination. The results of these site inspections are summarised below: Site condition and general standards of housekeeping The property was found to be in generally sound environmental condition, however a wide range of objects and materials were present at various locations throughout the site that could include hazardous or potentially hazardous materials. This is illustrated generally in Figures 7.8 to 7.12 on subsequent pages, as follows

No significant fuel, lubricant or chemical storage facilities were noted at or in the immediate vicinity of the site, and no bulk chemical, fuel or lubricant storage facilities were noted. However, smaller quantities of these materials may be among the materials present throughout the site, including within the various storage sheds and containers identified at the site (refer Section 7.5).

Visible staining on the ground, or in the vicinity of drainage systems

Some staining of surface areas of the site was noted, particularly near some of the materials stored/positioned at the site.

Evidence of waste disposal on or from the site

There was no indication of waste or waste disposal issues at or in the immediate vicinity of the site, other than for any implications arising from the various materials stored/positioned at the site.

Odours

No unusual odours were noted near any drains in the vicinity of the site, although odour was noted in association with the existing poultry farming facility adjoining the subject site to the south (refer Section 7.17 & 7.18).

Likelihood of spillages associated with site practices

No current practices or activities were noted at or in the vicinity of the site that could be considered likely to give rise to the possibility of significant spillages of fuels, chemicals or other potentially hazardous goods, although it is noted that such spillages could have occurred in the past in association with the various materials currently positioned at the site (refer photographs above).

7.7 SURFACE WATER & DRAINAGE There were no indications of any significant or atypical problems or issues regarding surface water or surface water drainage at and in the immediate vicinity of site. It is noted that provision has been made in Council planning for the installation of drainage infrastructure on a small area of land along the rear or south-western boundary of the site (refer Section 2). A number of water storage facilities and associated water courses are present in the general area of the site, as indicated in Figure 7.13, below.

This dam is illustrated in Figure 7.14, on the following page.

7.8 GROUNDWATER A preliminary search of the WaterNSW on-line database was undertaken to identify groundwater wells (bores) within the general vicinity of the 103 Tallawong Road property. The search revealed several wells within a 1000 metres radius of the property. These wells typically indicate the possible presence of viable and clean groundwater within alluvial sediments at approximately 15 – 20 metres below ground level (BGL), and that perched groundwater may be encountered nearer the surface. While the limited scope of this preliminary assessment did include a further or more detailed consideration of groundwater characteristics at or near the site, this review of available information indicates that groundwater quality near the site is unlikely to present a significant constraint to the residential land use proposed.

7.9 HAZARDOUS GOODS No significant quantities of hazardous or potentially hazardous goods were noted at or in the vicinity of the site. Refer 7.6 above and 7.14 and 7.15 below re the possible presence of hazardous building materials and/or wastes at the site.

7.10 ACTIVITIES POSING POTENTIAL ENVIRONMENTAL RISK General In general terms, no practices or activities representing potential environmental risks or hazards were noted at, or in the vicinity of the site. Plant, Equipment and Store Rooms No plant, equipment or other potentially hazardous store rooms or storage facilities were noted at or in the immediate vicinity of the site, over and above any possible risks associated with the materials stored at the site generally, and as previously described. Operating Plant No items of plant and equipment were noted in operation in the general area of the site.

7.11 NSW EPA CONTAMINATED SITE RECORDS A search of the NSW EPA Register of Contaminated Sites indicated that no portion of the 103 Tallawong Road Rouse Hill site was listed as contaminated or potentially contaminated, and no notices in this regard were noted. The search did not indicate the presence of any currently or previously contaminated sites in the immediate vicinity of the subject site, although it is noted that these records are indicative only, and not necessarily complete.

7.12 WORKCOVER NSW RECORDS OF UNDERGROUND STORAGE TANKS A search of SafeWork NSW (formerly WorkCover NSW) records of underground storage tanks did not indicate the presence of any underground fuel or chemical storage tanks at or in the immediate vicinity of the site. While these SafeWork NSW records are known to be incomplete, a detailed inspection did not indicate the presence of any such items at the site.

7.13 ACID SULPHATE SOILS The landform of the 103 Tallawong Road site is identified by soil maps as being free of identified acid sulphate soil (ASS) risk, however this finding is indicative only, as a detailed consideration of acid sulphate soil risk was not included in the scope of this preliminary assessment, and would require additional and more detailed work.

7.14 BUILDING & CONSTRUCTION MATERIALS While no specific environmental risks or exposures were noted in relation to building and construction materials at or in the immediate vicinity of the site, the following observations and comments apply:

An existing dwelling and various sheds and outbuildings of unknown construction and composition are present at the site, together with quantities of waste materials positioned at various points throughout the site;

Based on a physical inspection, the existing dwelling at the site appeared to include a significant amount of construction material, in particular cladding and sheeting, likely to contain asbestos;

It is possible that hazardous or potentially hazardous materials may be present in the buildings, sheds and materials stored and present at the site, and that some environmental impact on the site may have occurred as a consequence that is unable to be determined within the limited scope of this preliminary site assessment;

That any demolition and clean-up work required at the site prior to the proposed subdivision are undertaken in accordance with relevant Australian Standards, WorkSafe NSW guidelines and any other applicable requirements;

That any items suspected of containing asbestos are to be validated and appropriately removed

from the site, in accordance with all applicable asbestos handling and disposal protocols, prior to subdivision works commencing at the site; and

That an appropriate “Unexpected Finds Protocol” is established in the general form indicated in

Section 8 of this report prior to the commencement of any demolition, clean-up, sub-division or residential development works at the site.

7.15 ASBESTOS As indicated in 7.14 above, the scope of this preliminary assessment did not include the conduct of a detailed hazardous materials survey or assessment. Refer to Section 7.14 re the possible presence of materials containing asbestos in various structures at the site, and possibly among waste materials and general rubbish stored at the site at the time of this inspection. at the site. As an example, a quantity of broken storage pipes considered likely to contain asbestos were noted near the front or Tallawong Road property boundary, as shown in Figure 7.15, below.

7.16 SEPP 55 & SOIL CONTAMINATION CONSIDERATIONS Soil quality and potential soil contamination/SEPP 55 issues beyond those generally discussed above, including the sampling and analysis of soil, did not form part of the scope of this preliminary investigation.

7.17 NEARBY BUILDINGS AND ACTIVITIES No significant environmental issues, exposures or risks of a general nature were noted in relation to any nearby buildings and activities, with the exception of possible air quality issues associated with the poultry farming facility noted on the southern boundary of the subject site (refer Section 7.18).

7.18 AIR QUALITY In general, no obvious issues in relation to air quality are identified in this report, and on the basis of this preliminary assessment and associated observations, air quality at and in the vicinity of the 103 Tallawong Road site is assessed as complying with relevant NSW EPA air quality standards and goals, and as not presenting any significant or specific environmental or contamination risk. However, what appeared to be an existing poultry farming facility was noted on the property adjoin the subject site to the immediate south, as illustrated in Figure 7.16, below.

Inquiries indicated that this adjoining facility has been sold for residential development, and that the past (and apparent current) poultry operations will cease.

It is noted that while further investigation of this adjoining property was not included in the scope of this preliminary investigation, any continuation of poultry farming activities on that property could involve an unacceptable odour impact risk for any future residential use proposed for the 103 Tallawong Road property.

7.19 ELECTROMAGNETIC FIELD The site does not appear to be subject to any unusual or atypical electromagnetic field influences or impacts.

7.20 OTHER No other significant environmental issues, exposures or impacts of a general nature were noted during the site inspection and assessment process.

7.21 KEY FINDINGS & RECOMMENDATIONS Based on the site inspections undertaken, the general environmental condition of the 103 Tallawong Road site site is considered to be sound, and a detailed physical inspection of the site has not indicated any fundamental environmental or contamination issues prejudicial to the residential subdivision and development use understood to be proposed for the site. However, the following observations and comments apply:

The existing dwelling present at the site appears highly likely to contain significant quantities of cladding, sheeting and possibly other materials containing asbestos;

Various sheds and outbuildings of unknown construction and composition are present at the site, together with quantities of waste materials positioned at various points throughout the site;

It is possible that hazardous or potentially hazardous materials may be present in these buildings and wastes, and that some impact on the site may have occurred as a consequence that is unable to be determined within the limited scope of this preliminary site assessment;

Wastes and other materials stored at the site may include materials containing asbestos, including the broken pipes referred to in Section 7.15 above;

That any demolition and clean-up work required at the site prior to the proposed subdivision are undertaken in accordance with relevant Australian Standards, WorkSafe NSW guidelines and any other applicable requirements;

That any items suspected of containing asbestos are to be validated and appropriately removed

from the site, in accordance with all applicable asbestos handling and disposal protocols, prior to subdivision works commencing at the site; and

That an appropriate “Unexpected Finds Protocol” is established in the general form indicated in

Section 8 of this report prior to the commencement of any demolition, clean-up, sub-division or residential development works at the site.

8 UNEXPECTED FINDS & CONTINGENCIES

8.1 INTRODUCTION The general findings of this site inspection and assessment process indicate the possibility that unexpected finds may be made during prospective site preparation, subdivision and residential development works at the site. To accommodate this possibility, and to facilitate the effective management of any such finds, an “unexpected finds protocol” will be of benefit. The general form of such a protocol is summarised below.

8.2 UNEXPECTED FINDS PROTOCOL All personnel and contractors involved in the demolition, clean-up, subdivision and residential development works at the site should be inducted into their responsibilities under an appropriate Unexpected Finds Protocol (UFP). Under such a protocol, all personnel and contractors involved in such works will be required to report any unexpected circumstance or finds the following to the person responsible for site management, if any unexpected circumstances or finds are observed or occur during the course of the works. Should signs of concern be observed, the Site Manager will, as soon as practical:

Place barricades around the affected area (the Potential Area of Environmental Concern – PAEC) and cease work in that area;

Notify relevant authorities in cases where emergency response is considered necessary;

Notify the nominated owner’s or developer’s representative of the occurrence;

If appropriate, notify the site owner’s or developer’s appointed environmental consultant, to obtain further advice and guidance if required. Environmental Consultant (refer Section 4); and

The owner’s or developer’s representative will determine the requirement to notify any of the authorities which are legally required to be advised, depending on the nature of the unexpected find (e.g. EPA, SafeWork NSW, the local Council or others as relevant).

Full details, including relevant personnel and contact details, should be incorporated into the Protocol.

8.3 CONTINGENCY PLAN A contingency plan incorporating the following key elements is recommended for development and implementation following the immediate response in the UFP:

The Environmental Consultant will inspect the PAEC and determine the nature of the issue, whether it comprises an Area of Concern (AEC), and the appropriate approach to assessing or (if appropriate) managing the issue;

The Environmental Consultant will undertake an assessment considered necessary to

determine the management strategy for the AEC;

If contamination is found and remediation action is considered necessary, a remediation strategy for the AEC will be identified, approved by the owner’s or developer’s representative, and implemented.

9 OVERALL FINDINGS & RECOMMENDATIONS This report presents the results of a Preliminary Site Investigation undertaken in relation to a proposed residential subdivision at 103 Tallawong Road Rouse Hill NSW.

9.1 FINDINGS Based on the site inspections undertaken, the general environmental condition of the 103 Tallawong Road site is considered to be sound, and a detailed physical inspection of the site has not indicated any fundamental environmental or contamination issues prejudicial to the residential subdivision and development use understood to be proposed for the site. However, the following observations and comments apply:

The existing dwelling present at the site appears likely to contain significant quantities of cladding, sheeting and possibly other materials containing asbestos;

Various sheds and outbuildings of unknown construction and composition are present at the site, together with quantities of waste materials positioned at various points throughout the site;

It is possible that hazardous or potentially hazardous materials may be present in these buildings and wastes, and that some impact on the site may have occurred as a consequence that is unable to be determined within the limited scope of this preliminary site assessment; and

Wastes and other materials stored at the site may include materials containing asbestos.

9.2 RECOMMENDATIONS

These findings are made subject to the following recommendations:

That any demolition and clean-up work required at the site prior to the proposed subdivision are undertaken in accordance with relevant Australian Standards, WorkSafe NSW guidelines and any other applicable requirements;

That any items suspected of containing asbestos are to be validated and appropriately removed from the site, in accordance with all applicable asbestos handling and disposal protocols, prior to subdivision works commencing at the site; and

That an appropriate “Unexpected Finds Protocol” is established in the general form indicated in Section 8 of this report prior to the commencement of any demolition, clean-up, sub-division or residential development works at the site.

On the basis of the findings of this Preliminary or Stage 1 Site Investigation and Assessment, and subject to the above recommendations, the site is considered suitable or able to be readily made suitable in environmental and contamination terms, for the residential land use proposed.

2 CAPABILITY AND EXPERIENCE - SHORT SUMMARY Noel Child is a successful and experienced commercial and technical professional with over 30 years’ experience in a variety of senior level appointments and assignments, within both the corporate and private sectors, with a particular focus on strategic, infrastructure and environmental applications.

Noel’s experience includes senior management at both the State and National levels in the Australian petroleum industry, and a number of senior consultancies for both government and corporate clients. His record reflects the ability to develop and achieve positive commercial outcomes through effective planning and communication; critical and objective analysis; and quality task completion and delivery at both the personal and team level.

His management responsibilities have included transport, environmental, safety, and general operational activities at a national level, while his formal professional training includes strategic management, environmental, engineering and business disciplines. He has undertaken a number of senior corporate appointments with distinction, and been successfully involved in the ownership and operation of a major petroleum distribution and marketing company in regional Australia. More recently, working through his own businesses Environment Australia and NG Child & Associates, he has applied his knowledge and experience in the areas of strategic management, infrastructure development, energy and the environment on a consultancy and contractual basis to a number of private and public sector clients, both nationally and internationally.

Noel has had post-graduate training in several technical and commercial disciplines, and provides specialised teaching input, by invitation, to post graduate engineering and business management courses conducted by the Faculties of Business and Engineering at Sydney's University of Technology. He has strong affiliations with a number of international corporations and agencies, and has worked closely with both the regulators and the regulated in a number of aspects of environmental management, assessment and performance. He has also been recognised as an independent expert on engineering, and environmental issues by the Land and Environment Court of NSW.

Noel has a detailed understanding of environmental engineering and associated processes, and has specific experience and expertise in the fields of acoustics, air quality, electromagnetic field assessment, electrolysis and stray current assessment, contaminated site assessment, and liquid and solid waste management.
