Present: Osterink, Burnside, DeWard, Lemke, Haagsma, VanderStel Absent with notice: Fryling Assistant Planner McKernan was also present Opening prayer was given by Clerk Burnside and the Pledge of Allegiance was recited

• Connie Pennock-Wood spoke about the Living Waters Ministry house. • Chief Sheely gave a first quarter report on the Cutlerville Fire Department.

A. Annual Mud Run – road closure request

Motion by Haagsma and supported Burnside by to approve the request of Never the Same Mud Run for the closure of Ridgebrook Dr. south of 60th and north of Eastport Dr. on August 24, 2019 from 4:00 a.m. to 5:00 p.m.

B. Office Copiers/Printers

Motion by Burnside and supported by Haagsma to approve the new annual contract with Advanced Imaging Solutions.

C. LED lighting upgrade to Township Office

Motion by Lemke and supported by Haagsma to approve the contract with Meekhof Electric to retro-fit the Township Office main floor with LED lighting for $3,645.88.

D. Resolution to Purchase property for the Byron/Gaines Utility Authority

Motion by Burnside and supported by Haagsma to adopt the resolution to execute the closing documents related to the purchase of 7173 Patterson Ave for the Byron/Gaines Utility Authority.

RE: Tax Rate Request

Attached you will find the 2019 Tax Rate Request. As calculated, the maximum allowable millage levy asprovided under MCL Sec 211.24e and MCL Sec 211.34 for 2019 is 0.8452 mills. This is “rolled back” from0.8546 mills. This is the result of the assessed values increasing at a greater rate than the rate ofinflation over the previous year.

The law states that units requesting to levy a millage in excess of one mill are required to hold a publichearing. We levy less than one mill; therefore, a hearing is not necessary. However, the adoption of the2019 millage rate of 0.8452 is required.

TRUTH IN TAXATION NOTICE

INSTRUCTIONS TO LOCAL GOVERNMENTS

STARTING IN 1996, this notice is not required if the local taxing unit complies withsection 16 of the Uniform Budgeting and Accounting Act, PA 2 of 1978 as amended, beingsection 141.436 of the Michigan Compiled Laws. If a local taxing unit does not comply wiffsection 16 of the Uniform Budgeting and Accounting Act, the following instructions stillapply.

MCL, Section 211 .24e as amended by P.A. 75 of 1991 requires that notice of a public hearingbe published by a local taxing unit which proposes to increase operating tax levies over themaximum amount allowed to be levied without a hearing. Notice may be published alone orincluded with the notice of public hearing on a unit’s budget held pursuant to MCL, Section141.412. The preceding model notice fulfills the requirements under MCL, Section 211 .24e.

It can be completed with all the information provided and forwarded to the appropriate newspaper for publication.

Other pertinent information can be included in the notice. This sample notice form meets minimum legal requirements.

In addition to publishing requirements, the notice must be posted at the principal office of thetaxing unit.

The notice must be published in a newspaper of general circulation in the taxing unit. Publication must occur ~ or more days before the public hearing.

The proposed additional millage rate must be established by a resolution adopted by the governing body of the taxing unit before it conducts the public hearing.

Not more than ten days after public hearing, a taxing unit may approve the levy of an additionamillage rate equal to or less than the proposed additional millage rate that was published andon which a public hearing has been held.

REQUEST SUMMARY: The developer, Allen Edwin Homes, has requested a Street Lighting District be created to cover the costs associated with maintenance and operation after installation of street lights, to be located within the South Creek North Platted Subdivision. Consumers Energy has provided cost estimates for the installation and material costs for standard Consumers Energy poles and fixtures, which Westview Capital, LLC has committed to reimbursing the Township for. Enclosed is a resolution for the Board to consider which schedules back to back public hearings. The first to hear comments and objections for the proposed street light improvements and a second hearing to hear comments and objections to the special assessment roll. The Township has received a letter of commitment from Westview Capital, LLC to reimburse the Township for the costs of the installation, publication, staff time and postage. BOARD ACTION: Consider adoption of the attached resolution which establishes the date of the public hearings for the proposed special assessment district and directs notices for the hearings be posted and mailed. The resolution establishes the date and time of the hearings to be June 10, 2019 at 7:10 P.M.

Westview Capital, I.LC willreimburse the township for the installation and material costs of standard Consumers Energy poles andfixtures. All other costs associated with maintenance and operation after installation will be theresponsibility of Gaines Township and members of South Creek North community.

RESOLUTION NO. 19-___ DECLARATION OF INTENT TO MAKE PUBLIC IMPROVEMENTS; TENTATIVE DESIGNATION OF

SPECIAL ASSESSMENT DISTRICT; FILING OF SPECIAL ASSESSMENT ROLL; NOTICE OF PUBLIC HEARINGS

Minutes of a regular meeting of the Township Board of the Charter Township of Gaines, Kent

County, Michigan, held at the Township Offices in said Township on the 13th of May 2019, at 7:10 p.m..,

local time.

The following resolution was offered by Member ______ and supported by Member ________:

WHEREAS, Section 3 of Act 188 of the Public Acts of Michigan of 1954, as amended ("Act 188")

provides that the Township Board may proceed and exercise the powers granted by Act 188 upon the

filing with the Township Clerk of petitions signed by record owners of land constituting more than 50%

of the land area in a special assessment district as finally hereafter established by the Township Board;

and

WHEREAS, the Clerk has received petitions to make certain public improvements consisting of

installing, operating, and maintaining street lighting (the "Improvements") in the South Creek North Plat

development, and has verified that the petitions have been signed by the record owners of land

constituting more than 50% of the land area in the proposed special assessment district; and

WHEREAS, there exists a need for the Improvements in the Township; and

WHEREAS, the Township Supervisor has tentatively made a special assessment roll for the

parcels benefited by said Improvements and contained in the special assessment district determined for

said improvements, and, in addition, the Township Supervisor has reported said roll to the Township

Board.

NOW, THEREFORE, BE IT HEREBY RESOLVED AS FOLLOWS:

1. That the Township Board intends to proceed on the petitions filed pursuant to Act 188 to make

the Improvements.

2. That the Township Supervisor has caused preliminary plans to be prepared showing the

Improvements and an estimate of the cost thereof.

3. That said plans and estimate have been filed with the Township Clerk.

4. That the Township Board hereby tentatively designates a special assessment district known as

South Creek North Special Assessment District consisting of certain parcels of land, the

descriptions of which are set forth in the Notice of Hearing attached as Exhibit A hereto, which

descriptions are incorporated herein by reference for the District, and against which parcels all

or a portion of the cost of said Improvements shall be assessed.

5. That the tentative special assessment roll for the District attached as Exhibit B hereto (the

"Special Assessment Roll"), as reported to the Township Board by the Township Supervisor, shall

be filed in the office of the Township Clerk and shall be available for public inspection during the

normal working hours of the Township office.

6. That the Township Board shall hold a public hearing on the 10th day of June 2019, at 7:10 p.m.,

local time, at the Township Offices, in said Township, to hear and consider objections to the

petitions, the proposed Improvements, the special assessment district tentatively designated

herein, and to all other matters relating to the Improvements.

7. That the Township Board shall hold a public hearing on the 10th day of June 2019, at 7:10 p.m.,

local time, at the Township Offices immediately after the public hearing provided for in

Paragraph 6, at 7:10 p.m., local time, to hear and consider comments and objections to the

Special Assessment Roll.

8. That the Township Clerk shall cause to be published one notice of the hearings in a

newspaper(s) of general circulation within the Township, totaling at least two publication times

prior to the hearing. The first publication shall be at least ten days prior to the hearing and

proof of publication of such notice shall be filed with the Township Board.

9. That the Township Clerk, at least ten days prior to the date of the hearing, shall send a notice of

the hearing by first class mail addressed to each record owner of or party in interest in each

parcel of land to be assessed, at the address shown for such record owner or party in interest

upon the last Township tax assessment roll for ad valorem tax purposes which was reviewed by

the Township Board of Review, as supplemented by any subsequent changes in the names or

addresses of the owners or parties listed thereon except in the case of railroad companies,

which shall be mailed a notice of the hearing by registered mail within five days after the first

publication of the notice in Paragraph 8, above); provided, that if a record owner's name does

not appear on the Township tax assessment records, then the notice required by this paragraph

shall be given to the record owner at the address shown by the records of the County Register of

Deeds.

10. That the form of the notice of the hearing to be mailed and published as set forth herein shall be

substantially as set forth in Exhibit A hereto.

11. That all actions heretofore taken by Township officials, employees, and agents with respect to

the Improvements and proceedings under Act 188 are hereby ratified and confirmed.

12. That all resolutions or parts of resolutions in conflict herewith are hereby rescinded.
