PHED Committee #2 October 26,2009 MEMORANDUM October 22, 2009 TO : Planning, Housing, and Economic Development Committee FROM: Jeff zyont( (giSlative Attorney SUBJECT: Zoning Text Amendment 09-07, Life Sciences Center (LSC) Zone - Revision s On October 5, 2009 the Committee came to the following conclusions: 1) Revise the LSC zone instead of using other mixed-use zones (3-0) 2) Do not revise the purpose clause to ad d in environmental considerations (2-1 ; Councilmember EIrich dissenting) 3) Do not revise the maximum FAR (2-1; Councilmember EIrich dissenting) 4) Do not add a minimum setback to residential zones 5) Delete the footnotes concerning density and height (3-0) 6) Do not revise the text concerning density limits for land under common ownership 7) Do not revise the proposed maximum building height o f 150 feet (2-0; Councilmember EIrich reserving judgment) 8) Delete the word "substantial" from the findings required for "substantial consistency"(3-0) The Committee requested the advice o f the Director of the Department o f Economic Development on the definitions of life sciences and high technology; the percentage of large tracts that should be life sciences; and whether life sciences should be exempt from purchasing building lot termination easements (BLTs)} The Committee agreed to determine how permitted land uses should be shown in the zone (land use table or in a footnote) after it determines the issues above. The Director o f Economic Development, Steve Silverman, made 4 recommendations for the Committee's considera tion: 1) a definition of life science, 2) a modification to the definition of research and development, 3) a provision to require a minimum amount o f research and development under certain circumstances, and 4) an exemption from the requirement to purchase BL T easements for life science uses. I Testimony suggested that the economic analysis to the BLT provision was flawed and that BLT should not be required for any development. Sta ff does not a gree.
