CONSERVATION AND LAND MANAGEMENT ACT 1984Purnululu BungleBungle NationalPark

Accessto the Park Airstrip-CompatibleOperationsNoticeMadeby the ExecutiveDirector of the Departmentof Conservationand Land Managementundersection 33A of the Conservationand Land ManagementAct 1984 with referenceto compatibleoperations.

ReservenumberA39897, known as Bungle Bungle, is to be namedthe Purnululu National Park.The Department of Conservationand Land Managementhasbeenapproachedby the Kimberleytravel industryto make the nationalpark’s airstrip available for tourist flights.

The Department proposesto call for expressionsof interest which may allow two commercialoperatorsto use the park’s airstrip on a trial basis for 12 months,Any flights using the airstripmay also allow the visitors to camp overnight in the park.

A final managementplan for the nationalpark is in progressbut has beensubstantiallydelayed.It is thereforeintendedto seekto allow useof the airstrip under thecompatibleoperationspowersof the Conservationand Land ManagementAct which apply when there is no managementplanfor operationscompatible with the purposeof the park.

Before any expressionsof interest are decidedupon, the proposal is being publicly notified andpublic submissionsare invited up until 31 March 1992. Details of the proposalmay be obtainedfrom-

Sections44 1 and2The FinanceBrokers SupervisoryBoardhasfixed the following scheduleto bethe maximum amounts of remuneration for services rendered by personscarrying on the businessof a FinanceBroker. The Scheduleshall apply in thecase of contractsmade on or after the date of publication of this notice andreplacesthe schedulepublished in the GovernmentGazetteon 20 April 1990.

Schedule

1. Application Fee:1 For loans up to $50 000:

$100 non refundablefor each loan. The Application fee is a paymentagainst the eventualBrokeragecharge.

ii For loans over $50 000:Fee establishmentby prior mutual agreementin writing betweentheclient and broker,

2. InspectionFees:i Initial Inspection:

Up to 30 Kilometres radius-$85.Over 30 Kilometres radius-$85 plus $85 per hour spentoutside the30 kilometre radius with a maximum of $200 per half day or partthereofor $400 per day.

ii SubsequentInspections:a For progressadvancesfor residentialpropertieswithin 30 kilo-

metresradius $85 per inspectionwith a maximum of $200 perproperty.

b For progressadvancesfor residential propertiesbeyond 30 kilo-metresradiusand commercialpropertiesin the courseof erectionby negotiationwith the client.

3. BrokerageFees:i Local Money Loans:

a For loans up to $100 000-2%.

b For loans over $100 000-

Feeestablishedby prior mutualagreementin writing betweentheparties.

ii Bridging Loans:On loans of 6 months or less $100 plus 1 per cent.

Over 6 months-normalrates.

iii Interstateand OverseasLoans:Ratessubjectto prior written agreementbetweenbroker andclient. Ifinterim Bridging Finance also arrangedadditional brokerageof 1 percent to be charged.Subject to loans in excessof $100 000 being bynegotiationbetweenparties.

iv Conditionsof BrokerageCharges:a Brokerage should NOT be charged by a selling agent where a

Contractof Sale or Mortgage to Vendor is arranged.The agentBrokermay, however,chargeon a time basis for consultationsandwork done seemiscellaneouscharges.

b Wherethe selling agent is also thebroker a separatewritten LoanApplication is also requiredbefore brokeragecan be charged.

c No brokerageor other fees shall be chargedby a broker in respectof aBuilding Societyloan expresslyfor the purposeof financing thepurchaseof the borrower’s principal place of residence.

4. Transfer of MortgagebetweenInvestor Clients:Standardscaleof fees plus out of pockets,payableby the Transferor.

5. Extension of Mortgages:

Two-fifths standardbrokerageinclusive of any reinspection,but revaluations, solicitors costs, stamp duty andregistration should be in addition.

121 Except as otherwiseprovided in subclause2 and 3, a boatlicensedto operatein the fisheryshall haveall otter boardsstowedon board and trawl nets unshackledfrom the otter boards andlowered on deck while moving through or anchoringin-a an area of the fishery in which the boat is not authorisedto

operate;

or

b a part of the fishery which is closed to the taking of prawnsunderclause 10.

2 A boat which is authorisedto operatein area1 of the fishery ispermitted to move through or anchor in the Ashburton Nurseryprovidedthat the otterboardsand trawl netsare securelyattachedto the boat and kept clear of the water at all times.

3 A boat referredto in subclause1 may be rigged to commencetrawling 24 hoursprior to the openingof an areaprovided that-

a the boat is not in a nursery which is closed to the taking ofprawns;

b the otter boardsand trawl nets are securely attachedto theboat and kept clear of the water at all times; and

c the boat is in an areaof the fishery in which it is licensedtooperate.

4 Boats licensedto operate in the Fishery are exempted from theprovisionsof this clausewhenthey are trialling gear in the watersdescribedin schedule5 provided that-

a the codendis open whennets are being trialled;

b no prawns are being held on board the boat; and

c trials are only being undertakenduring the hours of daylight.

Clause 14 is amended

6. Clause 14 of the principal notice is amended-

a in subclause1 by inserting after the paragraphcommencing"underdecktonnage"the following paragraph-"boat units" meansthe numberof units calculatedby the formula-

Area 1 being the waters of the Fishery boundedby the high water mark onthe mainlandand a line drawn northerly from the high water mark at BeadonPoint, to the highwater mark of the southernmostextremity of DirectionIsland;thence along the high water mark of that island on its easternshore to itsnorthernmostpoint thence westerly to the high water mark at the northernmost point of Serrurier Island; thencesoutherly alongthe high water mark ofthat island on its westernshoreto its southernmostpoint; thencesoutheasterlyto the high watermark of the southernmost extremity of Locker Island; thencedue south to the high water mark of the mainland.

2. Area 2 being the waters of the Fishery west of a line commencingat thehigh water mark on the mainland at RobePoint at the mouth of the northernarm of Robe River drawn northerly to the lighthouseat BeagleIsland; thencenorthwesterlyto the high water mark at Town Point on Barrow Island; thencealongthe high water mark of the easternshoreof that island to CapeDupuy;thence duenorth, but not including the waters of Area 1.

3. Area 3 being the watersof the Fishery eastof aline commencingat thehighwater mark of the mainland at Robe Point at the mouth of the northern armof Robe River drawn northerly to the lighthouseat Beagle Island; thencenorthwesterlyto the high water mark at Town Point on Barrow Island; thencealongthe high water mark of the easternshoreof that island to CapeDupuy; thencedue north.
