    a a pharmaceutical chemist, medical practitioner ordentist, for human internal use shall comply withthat regulationif it is labelled with -

    i the words "Keep out of reachof children";

    ii the nameof the patient;

    iii a date of dispensing,and a number identifyingthe prescription or supply which correspondsto -

    I the entry in the Prescription Bookreferred to in regulation36 3 c, in thecaseof a pharmaceuticalchemist;or

    II the patient’s records, in the case of amedicalpractitioner or dentist;

    iv the name and address of the pharmacy, ormedical or dental surgery, from which it issupplied;and

    v the instructions given on the prescription, ifdispensed by a pharmaceutical chemist, ordirections for use, if supplied by a medicalpractitioner or dentist;

    b a pharmaceutical chemist, medical practitioner ordentist, for human external use shall comply withthat regulation if it is labelled in accordancewithparagrapha, together with the words "Not to betaken";

    c a pharmaceuticalchemist or veterinary surgeon, foruse on any animal shall comply with that regulationif it is labelledwith -

    i the words "Keep out of reachof children";

    ii the owner’s surnameandthe speciesof animal;

    iii instructions for the use of that medicine orpreparation;

    5. Regulation3 of the principal regulationsis repealedand the followingregulationis substituted-

    3. 1 A licence to procure, manufacture and supply bywholesaledealing poisons other than drugs of addiction shallauthorize the licensee to procure, manufacture and supplyaccording to the endorsementthereon by wholesale dealinsubstancesas specified in the licence from the premisesdescribein the licence,and shall be in the form of Form 1 in Appendix A.

    2 In addition to any other conditionsrequired under theseregulations the licence shall be subject to the followingconditions-

    a the manufactureshall be carriedout -

    i by a qualified person whose name appearsonthe licence;or

    ii by an experienced person acting under thepersonal supervision of a qualified personwhosenameappearson the licence; and

    b the supply shall be carriedout -

    i by a qualified person whose name appears onthe licence;or

    ii by an experiencedpersonwhose name appearson the licence,

    but where the personwhose name appearson the licence ceasesto be employedor is unableto exercisethe necessarysupervision,the chief executive officer may authorize, in writing, anotherpersonwho holds the requiredqualifications to act in hs stead.

    Regulation35AA inserted

    6. After regulation35A of the principal regulationsthe following regulationis inserted-

    " Nystatin for vaginaluse

    35AA. A supplier shall ensure that nystatin referred to in theThird Schedule shall not be sold in products for vaginal useunlessaccompaniedby guidelinesapprovedby the chiefexecutiveofficer.

Perth Lots 1034 and 1035 form part ofthe Precinct.The two lots are connectedby PerthLots 1036 and 1037.The Minister for Landshasgrantedto BluegateNomineesPty Ltd "Bluegate"a leaseof PerthLots1034 and 1035 "Brewery Land" to permit Bluegateto restoreandpreservethe buildings erectedon the Brewery Land "Brewery Buildings" as a placeof historical significance and to use themfor the purposespermittedunderthe Lease"Lease" dated18 June1992, betweenthe Minister forLands,Bluegateand Multiplex ConstructionsPty Ltd.Under the terms of the Lease,following the satisfactionof certain conditionsBluegateis obligedto carryout certainworks in respectof the BreweryLand "ConservationWorks". Detailed plans and specificationshave not yet been submitted to theHeritageCouncil.The HeritageCouncil of WesternAustralia has determinedthat the conservationof the BreweryBuildings pursuantto the ConservationWorks is likely to require the making of an Order undersection38 of the Act in the following terms "ProposedOrder":

    "1. In this Order:"Council" meansthe HeritageCouncil of WesternAustralia;"Building Works" meansthe construction,extensionor alterationof a building;"licensing authority" beansthe meaninggiven to that expressionby the Liquor Licensing

    Act 1988;"restaurantlicence"bears the meaninggiven to that expressionby the Liquor Licensing

    Act 1988.2.1 The Liquor Licensing Act 1988 shall apply to Pei?th Let 1035 subject to the specifiedamendmentsset out in items 2.2 to 2.4 of this Order.2.2 The Council may issuerestaurantlicencesin respectof premisescomprisingpart of PerthLot 1035.

    2.3 It shall not be necessaryfor a person applying to the Council for a restaurantlicence tocomply with the provisionsof Division 7 of Part 3 of the Liquor LicensingAct 1988 unlesstheCouncil directs that such provisionsor any specified provision must be complied with.2.4 The Council may, at its discretion,exercisethe powersconferredon the licensingauthoritypursuantto sections62 and 64 of the Liquor LicensingAct 1988.3.1 The HealthAct 1911 shall apply to Perth Lot 1035 subjectto the specifiedamendmentssetout in items 3.2 to 3.3 of this Order.3.2 Section 176 of the Health Act 1911, shall not apply to any Building Works on Perth Lot1035 if the Council has approvedthose Building Works.3.3 The Council may issuea certificateof approvalfor the purposeof section178 of the HealthAct 1911 in relation to any building on PerthLot 1035.4.1 The Health Public Buildings Regulations1992 shall apply to Perth Lot 1035 subject tothe specified amendmentsset out in item 4.2 of this Order.4.2 The Council may issueany approval,grantany exemptionor makeany decisionwhich maybe issued, granted or made by the local authority under the Health Public BuildingsRegulations1992 in respectof PerthLot 1035."

    The HeritageCouncil of WesternAustralia gives notice of the following:1. The objective of the Council in formulating the measuresproposedis:

    a to provide an incentive to the conservationof the Brewery Buildings;b to permit the conservationof the BreweryBuildings by permittingthe carrying out of

    the ConservationWorks; andc to permit the ConservationWorks to be carriedout as soonas is practicable.

    2. The land likely to be affected by the ProposedOrder is PerthLot 1035. It is contemplatedthat the land situate betweenLot 1035 and MountsBay Road will be incorporatedin theland the subject of the Leasein which casethe Order will extendto that land.

    3. The effect of the ProposedOrder will be to permit the Heritage Council of WesternAustralia:a to issue restaurantlicencesunderthe Liquor LicensingAct 1988 to restaurantssituate

    at Perth Lot 1035;b to approvethe construction,extensionor alterationof any public building to be erected

    at Perth Lot 1035;

    c to issuecertificatesof approvalin relation to the purposeor purposesfor which a publicbuilding situateat Perth Lot 1035 may be usedand the maximum numberof personsthe building may be used to accommodate;

    d to issue any approval,grantany exemptionor makeany decisionwhich maybe issued,grantedor madeby the local authorityunderthe HealthPublic BuildingsRegulations1992 in respectof Perth Lot 1035.
