AN ORDINANCE REORGANIZING THE COMPOSITION OF THE CITY OF SANTA ROSA COUNCIL FOR THE WELFARE OF PERSONS WITH DISABI LITIES AND THE ESTABUSHMENT OF THE PERSONS WITH DISABILITIES AFFAIRS OFFICE (PDAO) IN THE CITY OF SANTA ROSA, LAGUNA PURSUANT TO REPUBUC ACT NO. 7277, OTHERWISE KNOWN AS THE "MAGNA CARTA FOR DISABLED PERSONS", AS AMENDED BY REPUBU C ACT NO. 9442 AND AS FURTHER AMENDED BY REPUBUC 10070 AND APPROPRIATING FUNDS FOR ITS OPERATION AND MAINTENANCE, AMENDING FOR THAT PURPOSE CITY ORDINANCE NO. 1552-2008, AND FOR OTHER PURPOSES.

WHEREAS, pertinent provisions of the 1987 Philippine Constitution require the government to provide essential services to persons with disabilities for their empowerment and upliftment of their lives;

WHEREAS, Article 13 Section 2 of the same Constitution includes disable persons as one of the priority sectors to be given access to essential goods and services at affordable cost;

WHEREAS, further, Article 13 Section 13 of the aforesaid Constitution similarly provides that the state shall establish a special agency for disabled person for their rehabilitation, self-development and self-reliance, and their integration into the mainstream of society;

WHEREAS, toward this end, the Congress of the Philippine enacted in 1992 RA 7277, otherwise known as the Magna carta for Disabled persons, as amended by RA 9442 and as further amended by RA 10070 directing national and local government agencies to implement programs and services to ensures the full participation of Persons with Disabilities (PDWs) in all aspects to community life;

WHEREAS, the 5angguniang Panlunqsod is mandated by the Local Government Code of 1991 CR, A. 7160) Sec. 458 lxiy) to "provide for the care of disabled persons. paupers, the

paged. the sick, persons of unsound mind. abandoned minors. juvenile delinquent. drug dependents. abused children. and other needy and disadvantaged persons, particular1y children and youth below eighteen {18) years of age, and subject to availability of funds. establish and provide for the operation of centers and facilities for them;

WHEREAS, the Office of the President issued Proclamation No. 240 Declaring the Period from the Year 2003 to the Year 2012 as Toe Philippine Decade of Persons with Disabilities where the funds necessary to carry out this Proclamation shall be sourced out by the concerned agencies from their annual appropriation, the amount of which shall be less than 1 % of each agency's total budget for the year equivalent to the amount provided for in the General Appropriation Act of 2002;

WHEREAS, in order to sustain and continuously carry out the task of monitoring, evaluating, data gathering, needs assessment, planning, establishment of production center, creation of job opportunities and advocacy in the city as the case maybe, the need for reorganizing the composition of the City of Santa Rosa Council for the Welfare of Persons with Disabilities and the establishment of the Persons with Disabilities Affairs Office (PDAO) in the City of Santa Rosa, to serve as its structural organization for the implementation of the abovementioned purposes is heretofore highly recommended;

NOW, THEREFORE, on a motion of SP Member Honorable Edward F. S. Tiongco duly seconded by SP Member Aala and SP Member Algabre, AS IT IS HEREBY ORDAINED BY THE SANGGUNIANG PANLUNGSOD, in ascension duly assembled, that;

SECTION 1. Title - AN ORDINANCE REORGANIZING THE COMPOSmON OF THE QTY OF SANTA ROSA COUNCIL FOR THE WELFARE OF PERSONS WITH DISABILITIES AND THE ESTABUSHMENT OF THE PERSONS WITH DISABILITIES AFFAIRS OFFICE (PDAO) IN THE CITY OF SANTA ROSA, LAGUNA PURSUANT TO REPUBUC ACT NO. 7277, OTHERWISE KNOWN AS THE "MAGNA CARTA FOR DISABLED PERSONS", AS AMENDED BY REPUBUC ACT NO. 9442 AND AS FURTHER AMENDED BY REPUBUC 10070 AND APPROPRIATING FUNDS FOR rrs OPERATION AND MAINTENANCE. AMENDING FOR THAT PURPOSE CITY ORDINANCE NO. 1552-2008. ANO FOR OTHER PURPOSES.

SECTION 2. Composition of the City of Santa Rosa Council for the Welfare of Persons with Disabilities - The City of Santa Rosa Council for the Welfare of Persons with Disabilities shall be composed of the following:

SECTION 3. Powers and Functions of the Council - This amended ordinance for the reorganization of the City of Santa Rosa Council for the Welfare of persons with Disabilities and the establishment of the Persons with Disabilities Affairs Office (PDAO) in the City of Santa Rosa, Laguna has the following powers and functions:

(a) Disabled persons are part of Philippine society, thus the City shall give full support to the improvement of the total well-being of disabled persons and their integration into the mainstream of society. Toward this end, the City shall adopt policies ensuring the rehabilitation, self-development and self-reliance of disabled persons. It shall develop their skills and potentials to enable them to compete favorably for available opportunities.

(b) Disabled persons have the same rights as other people to take their proper place in society. They should be able to live freely and as independently as possible. This must be the concern of everyone - the family, community and all government and non-government organizations. Disabled persons' rights must never be perceived as welfare services by the Government.

( c) The rehabilitation of the disabled persons shall be the concern of the Government in order to foster their capacity to attain a more meaningful, productive and satisfying life. To reach out to a greater number of disabled persons, the rehabilitation services and benefits shall be expanded beyond the traditional urban-based centers to community based programs, that will ensure full participation of different sectors as supported by national and local government agencies.

(d) The City also recognizes the role of the private sector in promoting the welfare of disabled persons and shall encourage partnership in programs that address their needs and concerns.

(e) To facilitate integration of disabled persons into the mainstream of society, the City shall advocate for and encourage respect for disabled persons. The City shall exert all efforts to remove all social, cultural, economic, environmental and attitudinal barriers that are prejudicial to disabled persons.

SECTION 4. The Persons with Disabilities Affairs Office (PDAO)- There shall be established the Persons with Disabilities Affairs Office (PDAO) in the City of Santa Rosa, Laguna.

SECTION 5. Nature of the Office - The PDAO shall be under the Office of the City Mayor.

SECTION 6. Powers and Functions of the PDAO - The power and functions of the PDAO shall be the following:

1. Implement the provision of Magna Carta for Disabled Persons RA 7277, RA 9442, RA 10070, Batas Pambansa Big. 344 and other relevant laws at local level;

2. Establish data gathering center for statistics of PWDs, training and job opportunities and serve as information center of the city.

3. Establish a resource center for independent living of PWDs in their respective community.

4. Establish production and livelihood sheltered workshop for PWDs including group homes and training center that will accommodate severely handicapped people.

5. Gather and compile relevant data on PWDs in the City;

6. Assist PWDs to have access to voting precincts local and national elections.

7. Ensure that policies, plans and programs for the promotion of the welfare of PWDs are funded by both the National and Local Government;

8. Represent PWD in meetings of the Local Development Councils and other special bodies.

9. Deputized NGOs, POs for monitoring implementation of Magna carta and B. P. 344.

10. Submits reports to the Office of the City Mayor on the implementation of programs and services relative to the promotion of the welfare of the disabled persons in the city;

11. Recommend and enjoin the participation of Non-Government Organization (NGOs) and People's Organization (POs) in implementation of all disability related laws and policies;

12. Disseminate information including, but not limited to, programs and activities for PWDs, statistics on PWDs, including children with disability, and training and employment opportunities for PWDs;

13. Monitor fund raising activities being conducted for the benefit of PWDs; and seek donations in cash or in kind from local or foreign donors to implement an approved work plan for PWDs, in accordance with existing laws and regulations; and

14. Perform such other functions as may be necessary for the promotion and protection of the welfare of the PWDs.

SECITON 7. Qualification of the PDAO Officer - The PDAO shall be headed by a PDAO Officer to be appointed by the City Mayor, who shall have the following qualifications:

1. A Filipino Citizen and resident of the city for at least one (1) year immediately preceding the appointment;

2. A registered voter in the city;

3. Able to read and write, and

4. Must be a bonafide member of a duly accredited PWD organization in the city with a track record of at least three (3) years.

The nominees for the PDAO Officer shall be chosen or recommended in a general assembly by and among the accredited PWD organizations in the city. The list of nominees shall be submitted to the Sangguniang Panlungsod, which shall be choose the three (3) nominees to be forwarded to the Office of the City Mayor.

SECITON 8. Term of Office of the PDAO Officer - The PDAO Officer shall have a term of three (3) years and may be reappointed for another term based on the Sanggunian selection process. In case of resignation, incapacity, death or removal from office, the remaining tenn shall be served by the new appointee who has undergone the selection process.

SECITON 9. Office of the PDAO - The PDAO shall have its office at the City Social Welfare and Development Office, located at the New Government Center, City of Santa Rosa, Laguna.

SECTION 10. Appropriation - The City Social Welfare and Development Office shall prepare the budget estimate for the operations of the PDAO for the first year immediately following its establishment. However, it shall be the responsibility of the PDAO to prepare and submit to the Office of the City Mayor its proposed budget for the succeeding years. The Sangguniang Panlungsod shall determine the amount necessary to carry out the functions of PDAO, taking into account the following:

1. Income of the city;

2. The number of the PWDs identified as against the total population; and

3. Magnitude of the implementation of the programs and services of the PDAO.

SECITON 11. Repealing Clause - All administrative and Executive Orders, Ordinances, Rules and Regulations or portions thereof contrary to or inconsistent with this Ordinance are hereby repealed accordingly.

SECITON 12. Separability Clause - If for any reasons whatsoever, any part of provisions of this ordinance shall be declared unconstitutional or invalid, other parts hereof which are not affected thereby shall continue to be in full force and effect.

SECITON 13. Effectivity - This amended Ordinance shall take effect thirty (30) days from the date of completion of its review by the Sangguniang Panlalawigan and its publication in a newspaper of local circulation.
