    The Environmental Protection Agency(EPA) bears the responsibility for carryingout the regulations set forth inCongressional legislation but also wieldsthe authority to promulgate additional

    regulations of its own. These regulationsimpact the depth and course of streams,plant life, wildlife habitats, animals, soilquality, air quality, water quality, control of

    hazardous waste, limits on greenhousegas emissions, and effects on recreationallocations.

    However, compliance with environmentalregulations usually requires the expenditure of

    significantly increased overhead forbusinesses. In an attempt to avoid theseadditional costs, some businesses will refuseto comply with the regulations. Sometimes,businesses openly refuse to comply and will

    pay governmental fines rather than pay thecompliance costs, which surpass the totalcosts of the fines. Other businesses, however,will try to hide their noncompliance, such asby dumping hazardous waste into rivers,

    streams, oceans, or otherwise secluded areasrather than paying to have it taken to achemical treatment plant.

    Other common types of environmentallaw violations include littering; improper

    waste disposal; the use of illegalpesticides in agriculture; releasingparticulates, sulfur dioxide, nitrogendioxide, carbon monoxide, and ozone in

    amounts surpassing the regulatory caps;oil spills; the destruction of wetlands;burning garbage; improperly removingand disposing of asbestos; falsifying lab

    data pertaining to environmentalregulations; smuggling illegal chemicalsinto the country; and committing fraudrelating to environmental regulations

    The criminal law characterizes an

    environmental law violation as a formof white-collar crime. If convicted,violators face fines, probation, jail

    time, or some combination thereof.Typically, a sentence of jail time isused when dealing with individuals,while corporations face stiff fines. Thefines endeavor to offset the financialgain of conducting the illegal activity.

    Bentonville, Arkansas based Wal-MartStores, the worlds largest retailer, has

    been fined over$ 81 million forreckless and illegal hazardous wasteviolations which threatened both the

    public and the environment,according to the U.S. EnvironmentalProtection Agency (EPA).

    The retailer pleaded guilty in casesfiled by federal prosecutors in Los

    Angeles and San Francisco to sixcounts of violating the Clean WaterAct by illegally handling and disposing

    of hazardous materials at its retailstores across the U.S

    The company also pleaded guilty inKansas City, Missouri to violating the

    Federal Insecticide, Fungicide andRodenticide Act (FIFRA) by failing toproperly handle pesticides that had

    been returned by customers at itsstores across the country.

    PenalisedThis tough financial penalty holds Wal-Mart accountable for itsreckless and illegal business practices that threatened both the

    public and the environment, said Tammy Dickinson, U.S.Attorney for the Western District of Missouri. Truckloads ofhazardous products, including more than two million pounds ofpesticides, were improperly handled under Wal-Marts contract.

    Todays criminal fine should send a message to companies of all

    sizes that they will be held accountable to follow federalenvironmental laws, she added.

    Ignacia S. Moreno, Assistant Attorney General for the JusticeDepartments Environment and Natural Resources Division also

    chastised the retailers behaviour: By improperly handlinghazardous waste, pesticides and other materials in violation offederal laws, Wal-Mart put the public and the environment at riskand gained an unfair economic advantage over othercompanies.
