The Board of Pilot Commissioners for the Port of Corpus Christi Authority (the “Pilot Board”) met on Tuesday, April 17, 2018, at 8:00 a.m., at the Congressman Solomon P. Ortiz International Center (Nueces Room), 402 Harbor Drive, Corpus Christi, Texas.

Action: On motion made by Mr. Engel and seconded by Ms. Canales, the Pilot Board approved the minutes of the November 14, 2017 Pilot Board meeting, in the form presented to the meeting.

4. Public Comments: Roger TenNapel of Flint Hills commented that item 5e on this agenda, amendment of the Pilot Bylaws, were not properly reviewed and should not be considered by the Pilot Board until a proper review was conducted.

Ms. Michelle Morlan, Ingleside on the Bay resident, brought to the attention of the Pilot Board problems of vessels traveling at an excessive rate of speed.

5. Open Agenda:

5a. License Renewal of Captain Douglas Stinchcomb: Staff recommended approval of the renewal of Captain Douglas Stinchcomb’s expiring Branch Pilot’s license to the Governor per Texas Transportation Code Sec. 70.040.

Action: On motion made by Ms. Canales and seconded by Mr. Squires, the Pilot Board approved Staff’s recommendation.

5b. 4th Quarter Aransas-Corpus Christi Pilot Work-Rest Hours Audit Report: Captain Mike Kershaw presented the 4th Quarter Aransas-Corpus Christi Pilot Work-Rest Hours Audit Report performed January 10, 2018, per Section V of the Rules and Regulations Governing Pilots and Pilotage on the Corpus Christi Ship Channel.

Action: On motion duly made and seconded, the Pilot Board approved the 4thQuarter Aransas-Corpus Christi Pilot Work-Rest Hours Audit Report performed January 10, 2018 in the form presented to the meeting.

5c. 1st Quarter Aransas-Corpus Christi Pilot Work Rest Hours Audit Report: Captain Mike Kershaw presented the 1st Quarter Aransas-Corpus Christi Pilot Work-Rest Hours Audit Report performed April 4, 2018 per Sec V of the Rules and Regulations Governing Pilots and Pilotage on the Corpus Christi Ship Channel.

Action: On motion duly made and seconded, the Pilot Board approved the 1st

Quarter Aransas-Corpus Christi Pilot Work-Rest Hours Audit Report performed April 4, 2018 in the form presented to the meeting.

5d. Revision to Section VI of Pilot Board’s Rule and Regulations: Staff recommended approval of revisions to Section VI of the Pilot Board’s Rules and Regulations Governing Pilots and Pilotage on the Corpus Christi Ship Channel regarding Combined Beam Restriction in the vicinity of ADM Grain Elevator and CITGO Dock #1.

Action: On motion made by Mr. Squires and seconded by Mr. Engel, the Pilot Board approved Staff’s recommendation.

5e. Resolution Approving Amended Pilot Review Board Bylaws: Staff recommended adoption of a resolution approving amended Pilot Review Board Bylaws.

Action: On motion made by Mr. Squires and seconded by Ms. Canales, the Pilot Board adopted the following resolution:

RESOLUTION APPROVING AMENDED BYLAWS OF THE PILOT REIVEW BOARD

WHEREAS, Amended Bylaws of the Pilot Review Board for the Port of Corpus Christi (“Amended Bylaws”) have been presented to the Board of Pilot Commissioners for the Port of Corpus Christi (“Pilot Board”) for approval; and

WHEREAS, Texas Transportation Code § 70.018 states that the Pilot Board shall establish a Pilot Review Board to hear and review complaints against pilots and to make recommendations to the Pilot Board concerning complaints; and

WHEREAS, in 1995 the Pilot Board established the “Pilot Advisory Panel” and adopted bylaws governing membership and investigation procedures; and

WHEREAS, the Pilot Advisory Panel bylaws were last amended in 1997; and

WHEREAS, on April 6, 2018, Amended Bylaws were presented to the Pilot Advisory Panel for consideration and the Panel voted unanimously to recommend the Amended Bylaws to the Pilot Board for consideration; and

WHEREAS, the Amended Bylaws update and clarify various provisions including membership requirements, meeting schedule, pilot complaint filing process, and complaint hearing procedures; and

WEHREAS, the Amended Bylaws rename the Pilot Advisory Panel the “Pilot Review Board” to be consistent with Texas Transportation Code § 70.018.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PILOT COMMISSIONERS FOR THE PORT OF CORPUS CHRISTI THAT:

Section 1. The Pilot Board hereby finds and determines that it is necessary and advisable to adopt the Amended Bylaws in substantially the form presented to this meeting.

Section 2. The Amended Bylaws, in substantially the form presented to this meeting, are hereby approved.

Section 3. This Resolution is hereby adopted by the Pilot Board on April 17, 2018.

5f. Commendation for Captain Jay Rivera: Captain Hahn with the U.S. Coast Guard presented a commendation to Captain Jay Rivera of the Aransas-Corpus Christi Pilots Association.

SUMMARY: The Aransas-Corpus Christi Pilots have selected Capt. Ryan Miller from the Deputy Pilot Pool. The applicant was vetted by the Application Review Committee, which is made up of two Aransas-Corpus Christi Pilot representatives and one Port of Corpus Christi representative. The Aransas-Corpus Christi Pilots have followed the application procedures previously adopted by the Pilot Board. Staff recommends the appointment of Capt. Ryan Miller to the trainee program.

BACKGROUND: The Pilot Board for the Port of Corpus Christi Authority implementedminimum standards that an applicant must meet to enter into the pool of qualified applicants and be eligible for consideration. The Pilot Board established on March 15, 2016 an Application Review Committee, made up of two Aransas-Corpus Christi Pilot representatives and one Port of Corpus Christi representative to review the applicants and determine if the applicant meets the necessary standards to enter the Deputy Pilot Pool. Pursuant to Chapter 70 of the Texas Transportation Code, Deputy Branch Pilots are selected by Branch Pilots, subject to examination and approval by the Pilot Board. The Aransas-Corpus Christi Pilots have selected Capt. Ryan Miller from the Deputy Pilot Pool.

The Aransas-Corpus Christi Pilots have selected Capt. Ryan Miller and Capt. Ryan Read from the pool of eligible candidates of the Application Review Committee for the Pilot Board of the Port of Corpus Christi Authority. We respectfully request that the Pilot Board place both selectees on the agenda for the next scheduled Port Commission meeting so their qualifications can be presented. We also respectfully request that the Port of Corpus Christi Authority perform a criminal background check, as required by the Deputy Pilot Applicant procedure, prior to their appointment from the Deputy Branch Pilot Pool to the Deputy Branch Pilot Training Program. Once the Pilot Board has completed these steps, we will submit a letter to the United States Coast Guard (USCG) stating Capt. Miller’ and Capt. Read’s acceptance into our observation/training program so that they may be allowed to sit for their First-Class Pilot examination. Upon successful completion of USCG testing and initial 120-day riding observer period, we will present to the Board a formal request for recommendation that the Pilot Board approve Capt. Miller and Capt. Read as a Deputy Branch Pilots. Respectfully submitted,

SUMMARY: On July 12, 2018 Capt. F. Mike Kershaw, a Port/Pilot Liaison consultant, reviewed the Pilot’s master work hours’ logbook for the second quarter of 2018 as required by Section V of the Rules and Regulations Governing Pilots and Pilotage on the Corpus Christi Ship Channel adopted October 1, 2014.

BACKGROUND: Section V of the Rules and Regulations Governing Pilots and Pilotage on the Corpus Christi Ship Channel, adopted October 1, 2014, defines the work-rest requirements for Aransas-Corpus Christi Pilots. Section V states that the pilots will keep a master logbook for all pilots and make it available for inspection by the Pilot Board or its representatives upon request. On July 12, 2018 Capt. Kershaw reviewed the Pilot’s master work hours’ logbook during the 2nd quarter of 2017. Attached is Capt. Kershaw’s report summarizing his inspection.

Pilot Work/Rest Review 2nd Qt 2018

Present: Capt. F. M. Kershaw, Capt. Jay Rivera, Capt Kevin Monaco and Staff as needed.

The ACC Pilots presented computer generated vessel movement logs for the Determination of Compliance with POCCA Pilot Board Rules, Sec. 70:017, State of Texas Transporation Code for 2nd Qt,2018

A random review of 14 ACC Pilots as well as a total review of all movements preformed by two additional pilots for a total of 365 of 1297 vessel Assignments was preformed. One overage of .1 hr. was observed.

As this overage occurred while on a vessel along side a berth while in the process of HEAVING OVER LINES of an adjacent ship and as it was the last vessel to be piloted (of three) this I do not consider this overage to be in noncompliance.

SUMMARY: Due to an injury Captain Jay Rivera suffered while piloting a vessel in August 2016, Captain Rivera is unable to maintain his USCG license and, therefore, is prohibited from serving as a pilot on state waters.

BACKGROUND: Texas Transportation Code Section 61.011 states that a person may not act as a state-commissioned pilot of a vessel in any water in Texas unless the person is licensed under Title 46, United States Code. Due to an injury Captain Rivera suffered while piloting a vessel in August 2016, Captain Rivera is unable to maintain his USCG license and, therefore, is prohibited from serving as a pilot on state waters.

CONFORMITY TO PORT POLICY: Chapter 70 of the Texas Transportation Code provides the Port Corpus Christi Commissioners serve as the Board of Pilot Commissioners for their Ports, with exclusive jurisdiction over the Aransas-Corpus Christi Pilots.

STAFF RECOMMENDATION: Staff recommends the Pilot Board revoke the Branch Pilot License of Captain Jay Rivera effective July 31, 2018.

Strawbridge Secretary of the Pilot Board Port of Corpus Christi Authority 222 Power Street Corpus Christi, Texas 78401 Dear Mr. Strawbridge, As the members of the board are aware, I have been struggling with an ongoing injury that happened aboard a ship I was piloting in August 2016. Unfortunately, I have been unable to pass my U.S. Coast Guard physical examination due to that injury and have exhausted my time for recovery with the Aransas-Corpus Christi Pilots. As you know, the Texas Transportation Code sections 61 and 70 require pilots to maintain a valid U.S. Coast Guard license, and mine has now been determined to be invalid. Therefore, with great sadness, I am providing notice to the Board of Pilot Commissioners that as of July 31, 2018, I can no longer be a State Commissioned Aransas-Corpus Christi Pilot and will no longer act as the Presiding Officer of the Aransas Corpus Christi Pilots. I request that the Board take action and consideration on my State Commission.

In light of the tragic incident to Capt. Louis Adams and my physical inability to act as a Pilot, the Aransas Corpus Christi Pilots have selected two deputy pilots to replace Capt. Adams and myself. I will send separate requests for their nominations.

In closing, serving as Presiding Officer for the Pilots and assisting the Port with the unprecedented economic growth we have experienced has been the highlight of my professional career. I will miss working with all of you.
