The Samiti considered the proposals of the following Colleges/Institutes for finalization of fee structure for the students who joined the course started during Academic Year 2013-14. After

deliberations, The Samiti decides to approve the final fee structure of the following Colleges/Institutes for the students who joined the course started during Academic Year 2013-14, subject to final approval/affiliation/permissions from respective Authorities. Figures are arrived at after considering the calculations drawn in the worksheet - calculation sheets of the respective colleges/institutes prepared by a Chartered Accountant. The students admitted in Academic Year 2013-14 and there after continuing their studies will pay an enhanced fee of 8% each successive year as per the norms for 2013-14 till completion of the course. For example if the fee approved is Rs. 1,00,000/- then from 11" years onward till completion of the course i.e. say 11, I11 and IV year the fees will be Rs. 1,08,000/- per @. I n case the students take V th years for completing the course then he shall pay the fee approved in that year. I n case a student joins the course direct in second year, then he shall be required to pay Rs. 1,08,000/-. Worksheet - Calculation sheets are available in the office.

After deliberations, The Samiti decides to approve the final fee structure of the following Colleges/Institutes for the students who joined the course started during Academic Year 2013-14, subject to final approval/affiliation/permissions from respective Authorities. Heard both side. Notice as per our resolution was given . It is produced. 1 student and 1 parent are present . The fee approved for the course started during 2012-13 was Rs. 91,000/-. The fee approved for the course started during 2013-14 was Rs. 74,300/-. It is challenged.

The main point argued is in respect of the creditors of earlier years who were not shown to be paid. Hence there was disallowance. However it is pointed out that it has been paid, but after 31/3/2013 as creditors were to be paid during 2010-11. It has been stated that delay of payment was due to differences between the Creditors and the management which have been sorted out and the payments made. The receipts are verified by us and can be considered. The 2"d point is respect of repair and maintenance, which was disallowed 75%. I n this regard management pointed out that in repair and maintenance there are many service contracts amounting to Rs. 85,00,000/- and have been clubbed and this may be deducted and the balance repairs and maintenance cost which was capital in nature be allowed. Only 50 O/O can be allowed. No other point was raised. The Institute has also given a letter dated 3/12/2013 that its fee may be approved at Rs. 91,500/- for the course started during 2013-14. It is quite reasonable. It is also accepted by the other side. Hence we confirm the same. Office to declare it.

Item No. 41 21: EN 3197- Fr. C. Rodriques Institute of Technoloav.

Heard the Institute. The Notice as per our resolution was given, but none is present on behalf of the students/parents.

The fee approved for the course started during 2012-13 was Rs. 90,000/-. Fee approved for the course started during 2013-14 was Rs. 99,000/-. It is challenged on the ground that the disallowance of 17% in salary was not justified. But ultimately it was accepted that some percentage can be deducted. We have also pointed out various other difficulties in their accounts at the time of hearing. The institute has originally demanded fee of Rs. 1,13,960/-. However after hearing, letter dated 3/12/2013 is given stating that the fee may be approved at Rs. 1,02,000/-. We approve the same. Office to declare it.

Considered the letter of the college dated 31/10/2013. There is error in our declaration dated 14/10/2013 . Serial No. 51 item No. 3(a) Engineering, it is corrected as under:

Considered the letter dated 19/11/2013 received from the institute. It is clarified as under, for example i f a student joins first year say in 2012-13 and fee approved is Rs. 80,000/-. He goes in the second year in 2013-14. His fee in the 2" year would be 80,000+8% in the year 2013-14. I f a student joins 2" year directly say in 2013-14, then he will be required to pay Rs. 80,000 + 8% i.e. Rs. 86,400/- only. Thus if a student joins 2 year directly then he will be required to pay the same fee as his other colleagues i.e. Rs. 864001-. The basic principle is all students of a class should pay the same fee. Hence we approve the example 'A' in the letter and reject 'B' and 'C'.

A. Rs. 88,5601- (i.e. Final Fee for previous A.Y. 2012-13 Rs. 820001-plus 8% Rs. 65601-). B. Rs.96,521/- (Rs. 88,500/- in A above plus Additional Fee for 2013-14 Rs. 7961). C. Rs. 90,000/- (Fee approved for the A.Y. 2013-14) .

Item No. 5(c): To consider and decide on the letter dated 21/11/2013 received from NCRD's Sterlins Institute of Manasement Studies reauestinq to confirm the amount of final fees for MMS batch AY J2013-14).

Considered the letter dated 15/11/2013 of the institute. The Institute wanted finalization of fee for MMS course for 2013-14. It is not possible for us. The reason was given in the Item No. 6 (iv) approved by the Samit in the meeting dated 7/11/2013. It is as under :

It is not possible for the Samiti to declare or approve the fee in view of the judgment of the Supreme Court reported in 2013 AIR/SCW 3360- Association of Management of Private Colleges Vs A I n E & others and further followed by the High Court of Bombay. The Institute may approach the D. 725 b r further explanation / clarification. Office to communicate.

I n view thereof no further action is possible by the Samiti. Office to inform.

Item No. 6 : To consider and decide on the letters dated 30/10/2013.1/11/2013, 6/11/2013 received from N.V. Kulkarni. Social Activist complainins improper implementation of AICTE rules and recrulations in Shivaiirao S. Jondhale Colleae of Enqineerinq, Dombivli, Dist. Thane.

Considered 3 letters dated 30/10/2013, 1/11/2013, 6/11/2013 written by Mr. N.V. Kulkarr~i, Social Activist . They are in respect of Shivajirao S. Jondhale College of Engineering, Dombivli, Dist. Thane. It is not possible for this Samiti to take cognizance of the grievances made therein. This may be possible for D.T.E. Accordingly noted.

Item No. 7 : Anv other matter with the permission of the chair.

1) The office in future to take care to ask the concerned colleges/ students & parents to submit their complaint on affidavit and to submit such affidavit in the office personally and only thereafter the Samiti will consider it.

2) Considered the letter dated 14/11/2013 received from Higher and Technical Education , Department, Mantralya, Government of Maharashtra. The points mentioned therein are not

concerned with Samiti. Hence the letter is only noted.
