Kalb's Q&A for Contractors By Shauna Krause & David Kalb, Capitol Services, Inc.

It’s ‘Bond,’ contractor’s Bond that, like fictional super-spy 007, be-comes the target for our first ‘shot’ in answering questions this edition. Another contractor ‘assumes’ responsibility for his answer and we alert all contractors to a phone scam to beware of right now…

Q: The assets of our company were sold and your firm assisted us with obtaining new licenses in CA, nV, and AZ. Can we cancel the bonds that we have on file for the old company, or are we required to keep them active for a period of time?

A: Once the licenses are cancelled, you should contact your insurance company and request that the Bonds be cancelled as well. We’re not aware of any requirement for them to remain on file. This being said, in CA for instance, consumers can make a claim against the Bond for up to two years after cancellation. Q: My insurance company did not renew my Contractor’s Bond and now my license is suspended. I contacted them and they are going to write a new Bond. This means my license will show a suspension for these past weeks and this makes me nervous. Do you know if they can backdate the Bond so there is no break?

A: I can tell you that the CSLB will accept a “backdated” Bond if it is re-ceived within 90 days of the expiration date. They will retroactively lift the suspension, which means it will not show on your record. Whether your bonding company will backdate the Bond is up to them.

Q: We currently have a Joint Venture (JV) license made up of three entities and we would like to remove one. I assume that when we remove that entity we will also need to amend the name of the JV to remove that com-pany’s business name. Is this possible and how is it done? A: Joint Ventures are treated the same as Partnerships, which means when you remove an entity (partner) from the license the license is cancelled. So, in order to do business as the Joint Venture with just the two remaining entities, you would need to apply for a new license. Also, you are correct that when you apply for the new license you will need to amend the business name. As you may already know, an acceptable Joint Venture business name must include the full business name of each entity listed, part of each entity’s business name, or a completely fictitious name.

Both California and Nevada Issue an “Industry Alert”

nevada and California want to give contractors a heads-up on a situation they’re dealing with in both States. This Industry Alert warns of a scam targeting existing licensees as well as new license applicants.

According to CSLB Registrar Steve Sands at least one “unscrupulous company is using information from CSLB’s website to contact licensees or applicants to mislead and scam them”. According to Mr. Sands, the caller leads the licensee or applicant to believe he or she works for the Contrac-tors Board and needs to pay money over the phone to get continuing educa-tion credit, renew a license or to schedule a licensing exam.”

There is nO law requiring continuing education in CA or nV. Further, CSLB and nevada License Board staff will never ask for credit card information over the phone, nor do they have the authority to process any payment by phone.

The CSLB has begun putting warnings in place on letters sent to ap-plicants and with their renewal notifications. Both agencies have also prominently placed warnings on their web sites. Beware.

SACRAMEnTO – The Contractors State License Board (CSLB) is urging California home owners to be vigilant when it comes to contracting for cleanup or repairs from this weekend’s heavy rain and high winds. Sometimes what appears to be the cheapest solution to repair flood damage, remove a fallen tree, fix a downed fence, or patch a leaky roof may not be the best choice.

“Anyone who needs to repair post-storm damage should be looking for a legitimate, qualified tradesperson — especially in an urgent situation,” said CSLB Registrar Steve Sands. “A licensed contractor who is skilled in the specific trade you’re seeking is insured and bonded, and is not likely to leave you in the lurch when it comes to properly completing the job at a fair price.”

Consumers can use CSLB’s online resources, available at www.cslb.ca.gov orCheckTheLicenseFirst.com, to review the license status of a contractor they plan to hire, and to get tips on the best approach to home repair projects. Any construction job valued at $500 or more in labor and materials must be done by a state-licensed contractor. California Business and Professions (B&P) Code requires licensees to carry workers’ compensation insurance coverage for their employees, and to be bonded.

For tree trimming and removal jobs where the tree is 15 feet or higher and the job is more than $500, the contractor must be state-licensed. The B&P Code allows a gardener who does not have a state license to work on incidental tree pruning if the tree is less than 15 feet and the job costs less than $500.

State law requires all Roofing (C-39) contractors to carry workers’ compensation insurance, even if they do not have employees, to ensure that consumers are protected in the event of an accident or injury on the homeowner’s property.

CSLB urges consumers to follow these tips when soliciting bids from any home improvement contractor:• Hire only licensed contractors, and ask to see the license and

photo identification.• Don’t rush into repairs, no matter how badly they’re needed.• Be careful when using online bulletin boards like craigslist.

org. Unlicensed operators may try to mislead you into thinking they are licensed.

• Don’t pay more than 10 percent or $1,000, whichever is less, as a down payment.

• Don’t pay in cash, and don’t let the payments get ahead of the work.

• Get at least three bids, check references, and get a written contract.

Always wearing safety goggles or glasses may seem like a pain, but the alternative could be much worse. There are so many eye hazards on a construction site that leaving your eyes unprotected even for a short time is extremely risky.

Eye Injuries Are a Serious Threat Protect your eyes on the job

There are countless eye hazards on a construction site, including particles (wood chips, dust, cement chips, metal shavings, etc.) that have been ejected from a tool or blown by the wind. Chemical splashes and swinging objects can also be eye hazards on a worksite. However, most eye injuries are preventable if you follow simple safety precautions, and always wear your safety goggles! Use Protective Eyewear It’s a proven fact that the best thing you can do to protect your vision on the job is to wear safety glasses or goggles. Even if you do have your safety glasses on, keep in mind that there are a variety of ways you can get debris in your eyes. Some accidents happen by simply taking off your safety glasses or goggles and wiping your face; particles can easily fall out of eyebrows or hair and into your eyes. Safety glasses should rest firmly on top of the nose and close to – but not against – the face. If they are uncomfortable, foggy or sight-restrictive, then find a different pair. Don’t let excuses get in the way of protecting your eyes. They may not always be convenient to wear, but the right eyewear will ensure your eyes and vision are safe while doing your job. find a Good fit You can find many ways to make safety glasses or goggles work for you, such as:

• If you find safety glasses uncomfortable, experiment with different sizes or styles.

• Make sure glasses are fit well while you are also wearing your hard hat and other protective equipment.

• Wear glasses or goggles that are properly ventilated for the work you are performing. Unless you are working near splash hazards, use goggles that have plenty of side ventilation.

• If you wear prescription glasses, wear goggles designed to fit over your glasses or safety glasses made with your prescription.

• If your goggles fog up, try a model with more ventilation or coat them with an anti-fog liquid.

• Wear a sweatband or handkerchief around your head to keep sweat off your goggles.

• Always keep your safety glasses clean. Scratched and dirty glasses or goggles can reduce vision, cause glare and may contribute to accidents.

Safety first It takes only one accident to cause partial or complete blindness. Even tasks that you don’t consider dangerous may present a risk for eye injury. Take a moment to think about possible eye hazards around each job site, and then take the necessary precautions to help prevent potential accidents and injuries.
