Dear Fellow M.B.A. Members,

It has been a remarkable year! I can’t believe my term as President of our Association has come to

an end. I would like to express my sincere gratitude and appreciation to the entire Board of Directors

and M.B.A. staff for all we have accomplished over this past year. I would also like to congratulate

incoming M.B.A. President Jeff Mertel. Jeff will continue our momentum while honoring our mission

by promoting high ethical and professional standards, providing quality services to our members, and

working responsibly with our community for the enhancement of the building industry.

Over the past year, the Marin Builders Association has taken an innovative approach to advance

our Association and member businesses by increasing their presence through social media and the

launching of Marin Home – The Essential Home Resource, our new magazine publication that will

reach 40,000 households over the next year and elevate the exposure of our members and their

services.

Despite these challenging economic times, we have worked together to sustain our membership

numbers and created new opportunities for our members now and in the years ahead. These oppor-

tunities will pay off both for our existing members and new ones that join us as the economy improves

and more construction businesses want to take advantage of all that M.B.A. has to offer.

I have been so proud to have served such quality members. Throughout my term as President, I

remained committed and dedicated to doing big things that will pay long-term dividends. I believe

we’ve done a great deal over the past year and I know a bright future for our Association lies ahead.

I will remain active with the M.B.A. as Editor-in-Chief for two years to ensure Marin Home magazine is

MBA Project #650 includes a retrofit of Alexander Avenue Overhead substructure, constructing a seismic approach at the abutments, an infill wall at bent 2 and adding additional reinforcing and concrete to the columns and bent caps at bents 3-7. Repairs will also be made to the existing structure to restore its original capacity. The Engineer’s estimate is $1,400,000 and the DBE goal is 9.1%.

Plans and specifications are on file in the Larkspur Depart-ment of Public Works, 400 Magnolia Avenue, and may be obtained at a cost of $50.00, which is not refundable. Plans and specifications are also available in the MBA Plan Room and may be viewed on-line by subscribers to MBA’s On Line Plan Service.

Kalb's Q&A for Contractors By Shauna Krause & David Kalb, Capitol Services, Inc.

Duplication of effort is always frustrating, especially when your license is at risk as a result, as our first contractor dem-onstrates. While a college degree is great preparation, if you want a ‘general’ engineering license in California you are going to have to spend some time in the trenches, so to speak. Sparks may fly when we plug in a couple answers every electrical con-tractor should know… Q: We are a large company with a General Building license in CA. We keep running into the same issue where our Responsible Man-aging Employee (RME) leaves the company and then we are stuck rushing to replace him so that our license doesn’t lapse. Can I, as an Officer of the company, take a class to pass the exams so that we can avoid having to go through this every time someone leaves? I have been in the business for many years but have never framed or built a house. A: We understand your frustration; it can certainly be a hassle when your Qualifying individual terminates his/her employment unex-pectedly. While you don’t have the “hands-on” work background, if you can show at least four years of experience supervising/managing your company’s General Building projects, then you can apply to become the Responsible Managing Officer (RMO) for your company. If you can show that you’ve been acting in a supervisory capacity for the company for the past 5 of 7 years, then you may be able request a Waiver of the examination. Please contact us if you have further questions or would like assistance with this process. Q: I have a degree in Engineering. Will that suffice for qualifica-tion to obtain a General Engineering contractor’s license in CA? A: In order to qualify for a General Engineering contractor’s license, you’re required to show at least 4 years of experience. The CSLB will give you up to three years of work experience credit for your Engineering degree, so you would need to show another year of Journeyman level or above work experience to sit for the exam. Q: We currently have a “C-10” license with an RME. He also has an electrical certification with the Department of Industrial Rela-tions, Division of Apprenticeship Standards (DAS). Of course we are waiting until the last minute, but his electrical certification expires very soon. Is that going to cause our “C-10” contractor’s license to go suspended? A: If it weren’t for the last minute many of us wouldn’t get any-

thing done, right? Lucky for you, the “C-10” contractor or Quali-fier does not need to hold an Electrical certification. If you have employees that work under your license then they need to get certi-fied, but your RME is not required to keep his DAS registration. Q: As you know, you are helping us get our “C-7” (low voltage) contractor’s license in CA. When we get the CA license squared away we plan to apply for a Waiver in nevada and take the Busi-ness and Law exam only. Any reason this wouldn’t work that way? A: Unfortunately, there are two reasons why it won’t work that way. First of all, the reciprocal agreement between CA and nV allows you to waive the trade exam and experience requirements only if you have been licensed for 5 out of the last 7 years in CA, AZ, or UT. Since you will be newly licensed in CA, you won’t meet the 5-year requirement. Secondly, nevada doesn’t reciprocate for elec-trical. Since the “C-7” is part of the electrical classification, even after five years you still won’t qualify for a Waiver of the trade test. Sorry if this has ‘shorted out’ your plan! The governor’s deadline for acting on all of the 767 (or

thereabouts) bills that were sent to him by the Legislature ended

this past Sunday evening at Midnight. While there were some

bills that I would have preferred he had not signed, I must say that

for the most part his final actions were more towards the lines of

a moderate Republican rather than a liberal Democrat! not bad

for the old guy (and the state)!!! now about the ones I question his

actions on....

Watch for my annual Year End Legislative report which will

be sent to you later this month. Besides providing you with an

“insider’s view” of the actions of the Legislature, Governor and

the myriad regulatory agencies that affect your business, it also

gives you my assessment of what needs to change to get this

state back on track. Besides this important and very informative

(if I say) view of the “real world,” it also provides you with the

information on ALL of the important legislation that will impact

your world starting in January of 2013. now, if I can only find the

time to write the thing!

Effect of California workers’ comp overhaul hinges on new rules

The Sacramento Bee reports: “The Legislature’s overhaul of

California’s workers’ compensation system (SB 863) - which

provides benefits to workers for job-related illnesses and injuries

- will reduce employers’ costs, but how much will depend on how

Gov. Jerry Brown’s administration implements the new rules, the

Workers’ Compensation Insurance Rating Bureau says.

With pre-reform losses to workers’ compensation insurers

still mounting, the organization says, it’s impossible to make

a recommendation to the state insurance commissioner on

how premiums should be adjusted, if at all. Therefore, it’s

recommending that no changes in premiums be made next year

until the reforms are implemented and their effect can be weighed.

The wait-and-see attitude is expressed in a filing that the WCIRB

made with Insurance Commissioner Dave Jones this week. In

August, the agency had recommended a “pure premium” rate of

$2.68 per $100 of payroll for 2013, a 12.6 percent increase over the

average rate being charged by insurers at that time. Since then, the

WCIRB said in its filing, insurers losses on workers’ comp policies

had continue to mount, but the Legislature has enacted Senate Bill

863, which both increases cash benefits to permanently disabled

workers and tightens other expenses and benefit eligibility.

The WCIRB’s preliminary indication is that the legislation,

worked out during months of negotiations between employers

and unions, will reduce losses and expenses by 4.9 percent,

which would moderate the projected increase in premiums, but

not enough to completely offset insurer’ losses. However, “given

the high level of uncertainty surrounding SB 863,” including the

shape of regulations to be issued by the Brown administration, the

WCIRB is telling Jones that insurance premiums should remain

unchanged until the regulations “take shape over the next several

months...”

The bottom line? The Insurance Commissioner will be

conducting a hearing to decide what the recommended workers’

comp rates for next year should be. Remember, however, the

commissioner’s recommendation is not binding on workers’ comp

carriers - they can decide what the rate will be for their company,

BUT you can bet that all the carriers will be watching each other.

Competition is a GOOD thing!

I also attended an all-day meeting in Oakland yesterday that was

called by the Department of Industrial Relations (DIR) to begin

the development of the myriad regulations that will ultimately

be the major drivers of what the long term savings will be due

to the reform (as discussed in the article above). In addition, I

still expect the Applicant Attorneys to file lawsuits challenging

at least some of the reform components which also could have

a major impact on what the ultimate savings are. Stay tuned

as developments unfold. There’s still lots of “water that must

go under the bridge” but once again I remain optimistic that

employers will see some meaningful savings while providing more

money to the truly injured workers.

Always wearing safety goggles or glasses may seem like a pain, but the alternative could be much worse. There are so many eye hazards on a construction site that leaving your eyes unprotected even for a short time is extremely risky.

Eye Injuries Are a Serious Threat Protect your eyes on the job

There are countless eye hazards on a construction site, including particles (wood chips, dust, cement chips, metal shavings, etc.) that have been ejected from a tool or blown by the wind. Chemical splashes and swinging objects can also be eye hazards on a worksite. However, most eye injuries are preventable if you follow simple safety precautions, and always wear your safety goggles! Use Protective Eyewear It’s a proven fact that the best thing you can do to protect your vision on the job is to wear safety glasses or goggles. Even if you do have your safety glasses on, keep in mind that there are a variety of ways you can get debris in your eyes. Some accidents happen by simply taking off your safety glasses or goggles and wiping your face; particles can easily fall out of eyebrows or hair and into your eyes. Safety glasses should rest firmly on top of the nose and close to – but not against – the face. If they are uncomfortable, foggy or sight-restrictive, then find a different pair. Don’t let excuses get in the way of protecting your eyes. They may not always be convenient to wear, but the right eyewear will ensure your eyes and vision are safe while doing your job. Find a Good Fit You can find many ways to make safety glasses or goggles work for you, such as:

• If you find safety glasses uncomfortable, experiment with different sizes or styles.

• Make sure glasses are fit well while you are also wearing your hard hat and other protective equipment.

• Wear glasses or goggles that are properly ventilated for the work you are performing. Unless you are working near splash hazards, use goggles that have plenty of side ventilation.

• If you wear prescription glasses, wear goggles designed to fit over your glasses or safety glasses made with your prescription.

• If your goggles fog up, try a model with more ventilation or coat them with an anti-fog liquid.

• Wear a sweatband or handkerchief around your head to keep sweat off your goggles.

• Always keep your safety glasses clean. Scratched and dirty glasses or goggles can reduce vision, cause glare and may contribute to accidents.

Safety First It takes only one accident to cause partial or complete blindness. Even tasks that you don’t consider dangerous may present a risk for eye injury. Take a moment to think about possible eye hazards around each job site, and then take the necessary precautions to help prevent potential accidents and injuries.

Las salpicaduras químicas y los objetos giratorios también pueden ser un riesgo para los ojos en el lugar de trabajo. Sin embargo, la mayoría de las lesiones oculares se pueden prevenir si respeta las sencillas precauciones de seguridad y siempre usa sus gafas de seguridad. Use gafas de protección Es un hecho probado que lo mejor que puede hacer para proteger su vista en el trabajo es usar gafas o anteojos de seguridad. Incluso si tiene puestos sus anteojos de seguridad, recuerde que existe una variedad de maneras en las que pueden introducirse desechos en sus ojos.
