It hardly seems possible that we are into the month of February. We are all hoping for a successful and peaceful 2011. MBA is here to help you any way we can.

MBA has made some very exciting changes the last couple of months. One of these is the Bulletin you are reading right now. Our new “look “is user friendly and we hope you will find it much easier to navigate to the sections you are interested in. If you want to print any, or all, of the bulletin you can do that as well!

Very big news! If you haven’t heard MBA has purchased the Marin Home Show! We have completely re-invented the show with all new management, new look and brand new enthusiasm. The new name is “The Marin Home and Garden Expo”. Give us a call if you would like to be a sponsor, exhibitor or volunteer on the weekend of the big show.

In planning our yearly calendar we always put our membership first!

We start the year by hosting our Annual Crab Feed, which was held Friday, February 11. We have open enrollment in February for our health plans. nOVAtONovato City planning commission on breakThe Novato planning commission has had no meetings for months due to slow economy.The Planning Commission last met on Oct. 4. All of its meetings since then have been cancelled. The reason is because there’s no new development for the commission to consider. City staff claim the department has never seen such slow times.

City’s planners are keeping busy working on the controversial affordable housing issue. Novato needs to zone for 676 units of affordable housing to meet state and regional mandates.

sAn RAFAeLMarin Sanitary Service to offer Food CompostingMonday, the San Rafael City Council unanimously passed a policy that will increase rates for garbage to pay for a new residential food-waste pickup service.

Marin Sanitary Service customers can now add food scraps to green waste bins, which will be hauled by the San Rafael-based Marin Sanitary Service weekly. By law, MSS has to pick up more frequently if food scraps are left out in the trash bins.

The new service is scheduled to roll out in various jurisdictions, including San Rafael, starting March 1.

To offer this service MSS will need to increase the number of trucks and drivers to cover weekly collections. from 2010 and franchise fees. The changes mean that the cost of a 32-gallon garbage can will increase from $24.95 to $27.67.

A year ago there was no food-scrap recycling in Marin County. But last year, MSS began testing a pilot program in various Marin jurisdictions.

City officials said they hoped this was a step toward zero waste. The new rates are effective retroactively to Jan. 1.

Central San Rafael SMART StationBefore the San Rafael SMART station is built the agency must solve some issues. The plan is to build the station at the Whistlestop location, but the senior program will have to relocate due to lack of parking.

The downtown San Rafael station will include a two-platform design with the southbound platform about eight feet from Tamalpais Avenue. This leaves no space for street parking, which is essential for Whistlestop clientele.

Whistlestop, provides food programs and other services to seniors with disabilities and has been located at 930 Tamalpais Ave. for 40 years. It serves over 5,000 people annually, many of them traveling by car.

SAFETY TOPICTraffic Control Safety

When road workers build, maintain, repair, or conduct other work on public streets or highways, they must be protected from traffic or haulage hazards. A variety of traffic control measures such as signs, lights, and other devices, along with continuous patrol, detours, and barricades can be used as traffic control measures, depending on the type of road and the work being done.

Cal/OSHA requires road workers to choose traffic control measures that meet the requirements of the California Vehicle Code, Section 21400, and comply with the "California Manual on Uniform Traffic Control Devices for Streets and Highways," (September 26, 2006).

When you start work near a road, evaluate the work site for hazards. look for blind corners, how heavy the traffic is, and how fast it flows. note the weather, temperature, and visibility and how they will affect the work that you are doing and how motorists will respond. Plan and draw out a diagram of your work site layout including the staging area, buffer area, transition area, and work area. Determine, based on the road type and the typical vehicle speeds, how many advanced warning signs you will need and how long the buffer area and tapers need to be.

Use at least one warning sign before the road work area begins to inform motorists that they are approaching an area where workers may be in the road. you may need more signs depending on sight distance along the road. Use a tapered line of cones to establish and separate the work area and redirect traffic away from workers. Use clean, unbroken, and highly visible safety cones to outline traffic lanes. Inspect all signs, signals, and lights to make sure they are working properly.

notify law enforcement if you are going to be controlling traffic and request an enforcement zone if necessary. you can also notify and request the presence of the local Department of Transportation. Keep an emergency vehicle, lights, flares, air horns, and signs available on the work site in case there is an accident or other emergency. inspect all of your tools, equipment, and signage to ensure that they function properly. Ensure that all mobile equipment has a backup warning device or use spotters with radios when moving equipment.

Road workers should be visible to all other workers in the area and to the motorists passing by. Wear warning garments such as vests, jackets, shirts or pants in orange, strong yellow-green, or fluorescent colors. In rainy weather, wear orange, strong yellow-green, or yellow rainwear.

During hours of darkness, your warning garments should be retroreflective, meaning that light shined on the clothing from a headlight or a work light will reflect back toward the driver or user to increase visibility. The retroreflective material should be visible from at least 1,000 feet. Your clothing should have at least one horizontal stripe of retroreflective material around the torso. White clothing with retroreflective material is also allowed.

Cuando los trabajadores construyen, hacen mantenimiento, reparan o ejecutan otras tareas en calles o carreteras públicas, deben estar protegidos contra los peligros del tráfico y los vehículos de transporte. Se puede utilizar una amplia variedad de medidas de control, tales como señales, luces y otros dispositivos, junto con patrullaje continuo, desvíos y barricadas, dependiendo del tipo de camino y de los trabajos que se realizan.

Bill Deadline Fast ApproachingBY: Phil Vermeulen, Legislative Advocate

Friday, February 14, 2011Also In This Update•Two Important Bills We Are Sponsoring•Employers to Face UI Tax IncreaseNext Friday, February 18th, is the deadline for new bill introductions. I will begin reporting on the important ones that affect your business once the deadline has past. Of course, we will have several important ones "in the hopper" as well. While most will be introduced over the course of the next week, one is already in print, AB 249 (Bill Berryhill).

Under existing law, if your contractor's license lapses for any reason while performing any type of construction work, not only does the prime contractor (or owner if you are the prime) not have to pay you, he/she can require full payback of the money that has already been paid to you! While the intent of this law is to obviously ensure that you remain in full compliance at all times, it is much too Draconian and has become a legal "excuse" for an owner or a prime not to pay!

Our bill, AB 249, ONLY applies to commercial and public works projects (residential will remain as is). It would change the law to allow for nonpayment to ONLY the time that the contractor was unlicensed. Obviously, this is not a full solution, but it is significantly better than existing law; AND, it is politically something that we can and will get through the process. Furthermore, once we get this bill into law, we can work on other changes.

Local Hiring Requirements Have you noticed how cities around the state (like Los Angeles and San Francisco) are passing local hiring ordinances that require that bidders must use a certain percentage of workers from specific zip codes from within their community? So too, many cities are now starting to provide a 3-5% bidder's advantage to local contractors? While well-intentioned (depending upon your view!), these "fences" drive up costs and significantly reduce competition for myriad reasons.

My colleagues and I are working on a bill that will address these issues. Unfortunately, the authority provided in existing law gives Charter Cities significant power to establish their own laws. In recognition of this fact, our bill will likely focus on removing these requirements for any local projects that use ANY state funds (which most do!!).

Employers to Face UI Tax IncreaseUnemployment continues to soar above 12% in California and 1.7 million residents received Unemployment Insurance (UI) benefits in 2010. The State has borrowed up to $9.8 billion from the federal government to pay out a record $23 billion in unemployment benefits. Now the Obama administrations’ budget contains a proposal that would give states the option to increase taxes on employers to fund their UI shortfall.Obama’s plan would increase the minimum tax wage base from $7,000 to $15,000. These federal minimum tax wage base has remained at $7,000 since 1983. The federal tax rate used for unemployment insurance would be cut in half, meaning the federal government would not see an increase in revenue from the adjustment. The proposal gives states the choice of increasing taxes, cutting benefits or a combination of both. Although these proposals would not go into effect until 2014, their approval will impact future decisions employers make regarding hiring and salary increases. In addition, the Obama budget proposal would halt the automatic tax increases imposed on employers when they the money borrowed reaches a certain level. This trigger is based on a State’s effort to pay the interest and principle of a federal UI loan. California has accrued a debt of $9.8 billion dollars from loans they have received from the federal government of which interest is due September 2011. Governor Brown has proposed that the interest be paid by borrowing money from the State Disability Fund, which is paid by employees. These proposals fall far short of addressing the massive UI deficits that over 20 states are facing. Tax increases in the middle of a recession will only prolong efforts for a true economic recovery. Instead of federal UI extensions and tax increases, the federal and state government should focus on improving the business climate and helping foster job growth. Permanent high-wage jobs are key to turning this economy
