In 1933, during the reign of King Rama VII (King Prajadhipok), the Law School and Chulalongkorn University’s Department of Political Science were, at the royal command, merged into a single department - the “Faculty of Law and Political Science” - within Chulalongkorn University.

Indeed, it is in 1933 that a need was felt by the Government, formed in the constitutional monarchy regime, to have institutions providing tertiary education as in civilised countries and offering people extensive educational opportunities up to the doctoral level so that the knowledge derived would be exploited in the interest of the State. Along this line, the Government put forth specific enactment called the “University of Moral and Political Science Act, B.E. 2476 (1933)”, establishing the “University of Moral and Political Science”, which is now “Thammasat University”. Under this Act, the Faculty of Law and Political Science (the Law School and the Civil Service School), then attached to Chulalongkorn University, was relocated into the University of Moral and Political Science, with Dr. Pridi Banomyong as the founding Rector. At its inception, the University of Moral and Political Science provided only one programme of study - the “Bachelor of Jurisprudence” degree programme, with emphasis on legal subjects. Later, in 1949, the University was restructured into 4 separate faculties. It is in that year that the “Faculty of Law” was officially put in place.

Thailand underwent a significant reform of legal systems during the reign of King Rama V (King Chulalongkorn). Under advice of Monsieur Gustav Rolin Jacquemyns (Praya Apairaja Siamanukulkija), a doctor of law from Belgium, who was then a counsellor of Siam, there emerged an idea of setting up a law school. Thereafter, when His Royal Highness Prince Rapeepatanasak (Kromaluang Raja Buri Direk Ridha) returned to Thailand upon graduation with a law degree from the University of Oxford, England, the Prince established, for the first time of its kind, a law school unofficially within the Minister of Justice in 1897.

King Rama V also established within the Royal Palace an administration school for providing children of royal servants with training in the administration of State affairs in order that the well-trained youngsters would serve the State in different regions of the country. In 1910, during the reign of King Rama VI (King Mongkut), the administration school was, at the royal command, elevated into the “King Rama V’s Civil Service School” which provided more comprehensive education. Later, in 1916, His Majesty King Mongkut established a university called “Chulalongkorn University”, divided into various departments, in remembrance of His Majesty’s father, King Chulalongkorn. Later, the formerly established Civil Service School was transferred to become a department of Chulalongkorn University, called the Department of Civil Service, which was subsequently renamed as the “Department of Public Administration” and the “Department of Political Science” respectively.

At that time, the studies in the fields of law, civil service, public administration or political science did not lead to a degree. Those having accomplished the courses of study and passed the final exams at the law school were awarded a certificate and would be offered a professional status as a “barrister-at-law” whilst those having completed and passed the final exams required by the Department of Civil Service, Public Administration or Political Science of Chulalongkorn University would receive only a certificate.

In early days, admission of students to all faculties of Thammasat University required no selection process (hence, the ‘open-university’ status) and indeed required no compulsory attendance. In 1960, there was issued the Regulation on Bachelor’s Degree Programmes, pursuant to which students at the Faculty of Law were since then admitted through entrance examination.

In 1962, it was believed by the University that students contemplating a bachelor’s degree programme should first be equipped with fundamental knowledge. A requirement was therefore introduced to the effect that students of all faculties should, in their first year, pursue fundamental subjects before proceeding to their majors at their faculties.

In 1972, the Faculty of Law made available, for those having completed a non-law first degree, the law programme called the “Bachelor of Law Degree for Graduates” Programme (formerly, the “Evening Programme”), under which students would have to take merely compulsory law subjects required to be taken by 2nd year, 3rd year and 4th year law students of the regular programme. Upon completion of those law subjects, students would equally be granted the “Bachelor of Law” degree. This special programme has been in operation until now.

At graduate studies levels, the Faculty of Law has offered the Master of Law (LL.M.) and Doctor of Law (LL.D.) degrees until now, with regular revision of curricula to ensure academic excellence. In effect, the LL.D. degree programme and the LL.M. degree programme have most recently been revised in 1996 and 2001 respectively. The revised LL.M. degree programme offers 8 fields of study, viz, Private Law, Criminal Law, Public Law, International Law, Business Law, International Trade Law, Taxation Law and, finally, Environmental Law and Natural Resources Law.

In addition, the Faculty of Law offers another 2 graduate programmes - (1) Graduate Programme in Public Law (1997) and (2) Graduate Programme in Business Law (the revised programme, 2004). The Graduate Programme in Business Law offers specialisation in various areas, namely, human resources management law, business financing law, intellectual property law, business tax law, and risk management and insurance law.

Since 1971, the Faculty of Law has revised its curricula. The most recent revision is visualised in the Bachelor of Law degree curriculum in 2004.

In 2009, the English–language Master of Law degree programme (Business Laws) was launched by the Faculty. In effect, in the following academic year, Master of Arts in Public Law will be put in operation additionally.

Philosophy and Objectives

PhilosophyThe Program is designed with the philosophy and objectives to enable law personnel to develop their capacity

up to international level for equivalent and effective business relations with foreign partners as well as to introduce a high level of legal studies to be recognized worldwide. The Program is also aimed to achieving international cooperation between the Faculty of Law, Thammasat University and law schools of other universities where exchanges of law students and faculty members are being or to be carried out.

ObjectivesIt is undeniable that rapid economic and social developments of Thailand is inevitably related to those of the

world. Such developments result in a number of students planning to persue their master and doctoral degrees abroad particularly in English speaking countries. The Faculty of Law, Thammasat University, with its qualified faculty members and reputation as the long time leading legal institution in the country, deems it appropriate to offer the Master of Laws Program in Business Laws (English Program) as an alternative for the students who can enjoy their stay in the country and at the same time master their law degree of international standard with the following objectives.

1. To generate graduate personnel who are capable of learning, researching and analyzing laws on their own2. To generate graduate personnel who have knowledge and skills at international level of laws and English

language for their legal profession3. To generate graduate personnel of knowledge and capacity of high standard particularly students in Plan A

Form Kor 24. To generate graduate personnel who specialize in the field of business laws in response to the needs of

both academic and professional expertise in both private and public sectors.5. To generate graduate personnel of good ethics and governances and lawyers’ code of ethics capable of

applying Thai legal knowledge and experience to develop Thai society and country

Applicants’ Qualifications

1. Applicants must have earned a bachelor degree of laws from universities accredited by Thammasat University with cumulative GPA of 2.75 or and upper or been selected by the Implementing Committee on Graduate Program in Business Laws (English Program) together with a letter of recommendation from an academic advisor or a lecturer taught in a bachelor level or a superior in support of consideration.

2. Applicants must have passed law and/or English tests as required by the Board of Graduate Program of the Faculty of Law.

3. Applicants must have other qualifications as required by Thammasat University Regulation on Graduate Studies B.E. 2553 as amended (No.4) B.E. 2555.

recruitment

1. Applicants must have passed the admission in accordance with the criteria specified by Thammasat University and the Faculty of Law under which GPA in a bachelor level and a letter of recommendation will be considered. If the Admission Committee deems appropriate, certain applicants may be invited for an additional interview in support of consideration.

2. Applicants must have passed the TU-GET test of the Language Institute, Thammasat University or TOEFL or IELTS as required by the Faculty of Law and Thammasat University with the scores valid not exceeding 2 years as of the date of application provided that the TU-GET scores are 500 and upper or TOEFL scores are 500 and upper for paper-based test or 173 and upper for computer-based test or 61 and upper for internet-based test or IELTS scores are 5.0 and upper, or as approved by the Admission Committee upon approval of the Implementing Committee on Graduate Program in Business Laws (English Program).

Learning system

The Program is a part-time two-semester system. Classes are conducted in the evening of Monday through Friday from 17.30-20.30 hours. There are two compulsory semesters in an academic year. Each of such semesters consists of 15-16 weeks of classes. Summer semester may also be available covering not less than 8 weeks provided that extra hours are added for each class in order to make cumulative hours equal to those required for classes in normal semesters. Summer classes, however, are not compulsory.

The program is conducted entirely in English.The Program offers two plans of study as follows.

1) Plan A Form Kor 2 offers the fulfillment of required courses and a thesis. Plan A Form Kor 2 requires not less than 39 credits consisting of not less than 24 of which are for certain required courses and 15 credits of which are for a thesis.

2) Plan B, on the other hand, offers the fulfillment of required courses and an independent research. Plan B requires not less than 39 credits consisting of not less than 33 of which are for certain required courses and 6 credits of which are for an independent research.

Thesis (required only for students in Plan A Form Kor 2)

1. Thesis registration is allowed only when a student has registered the required courses of not less than 2 normal (compulsory) semesters or earned not less than 12 cumulative credits with the cumulative grade point average of not lower than 3.00.

2. A thesis must be written in English.3. Dean of the Faculty of Law shall appoint a thesis advisor (and co-advisor, if any) who shall be responsible

for giving advice on the thesis to the student under his/her/their supervision provided that such thesis advisor and co-advisor shall have the following qualifications.

a. A principal advisor must be a full-time member of the Faculty of Law having doctoral degree or equivalent or holding an academic position not lower than an associate professor in a given or related field and having experience in conducting researches which are not parts of the study for academic degree.

b. A co-advisor (if-any) may be a full-time member of the Faculty of Law or a qualified outside scholar having doctoral degree or equivalent or holding an academic position not lower than an associate professor in a given or related field and having experience in conducting researches which are not parts of the study for academic degree.

Thesis examination 1) Thesis Examination Committee shall be appointed and the examination shall be conducted in accordance

with relevant regulations of Thammasat University.2) A student may request a thesis examination only when he/she has passed the required English language

examination.3) Thesis examination shall be conducted in English.4) Thesis examination shall be conducted in accordance with the rules and regulations of Thammasat

University. Passage of thesis examination with an S level requires a unanimous vote of the Thesis Examination Committee.

Independent Study1. Independent study registration is allowed only when a student has registered the required courses not less

than 2 normal (compulsory) semesters or earned not less than 12 cumulative credits with a cumulative grade point average of not lower 3.00.

2. An independent study must be written in English.

Comprehensive examination (required only for students in Plan B)1. Comprehensive examination shall take place only when a student has registered and passed the required

courses of at least 15 credits with cumulative grade point average not lower than 3.00. A student is required to pass a comprehensive examination out of three attempts which a student is entitled to have otherwise his/her name will be removed from the student register.

2. Comprehensive examination shall be conducted in English language and in accordance with the Regulations of Thammasat University.

English language examination shall be in accordance with the Regulations of Thammasat University on Examination of Foreign Languages for Graduate Students B.E. 2539.

Duration of Study

The duration of study in this Program shall not exceed 4 academic years of normal (compulsory) semesters.

In each semester, students are required to register for courses and/or thesis not less than 3 credits and not exceeding 12 credits provided that other registrations shall be in accordance with the Regulations of Thammasat University on Graduate Studies B.E. 2553 as amended (No.4) B.E. 2555.

Grading system1. Grading of examination of each course is divided into 9 levels designated and evaluated per credit in

accordance with the Regulations of Thammasat University on Graduate Studies B.E. 2553 as follows.

2. Credits earned shall be counted only from credits of each course earning S or not lower than C level. Courses either compulsory or elective earning D or F level shall be counted for calculation of a grade point average of a given semester and a subsequent cumulative grade point average.

3. A student earning a U or D or F level in any compulsory course shall only be allowed to register the same course once again and for the latter registration, the student must earn an S or not lower than C level otherwise his/her name shall be removed from the student register.

If the course mentioned in the preceding paragraph is an elective one, the student may register the same course or a different course as a substitute thereof.

A student earning not lower than C level in any course shall not be entitled to register the same course.4. Grading of a thesis or independent research is divided into 2 levels namely S (satisfied) and U (unsatisfied).

Only a thesis or independent research earning an S level is qualified to pass and earn credits.5. Grading of English language and comprehensive examinations is divided into 2 levels namely P (passing)

and N (not passing). Only a student earning P level is qualified to pass.6. Other requirements shall be in accordance with the Regulations of Thammasat University on Graduate

Studies B.E. 2553 as amended (No.4) B.E. 2555.

Graduation

LL.M. Students of Plan A Form Kor 2 1. A student has fulfilled all required courses of the Program with the cumulative credits of not less than 39

credits, 15 of which are for compulsory courses, 9 of which are for elective courses and 15 of which are for a thesis.

2. A student has earned a grade point average of not lower than 3.00. 3. A student has earned a P (passing) level for English language examination in accordance with the

requirements of Thammasat University, namely TU-GET scores of not less than 550 or TOEFL of scores of paper-based test of not less than 550 or of computer-based test not less than 213 or of internet-based test of not less than 79 or IELTS scores of not less than 5.5.

4. A student has earned an S level for a thesis. 5. A thesis must be published or at least processed to be accepted for publication in a journal or academic

circulation or proceedings.

LL.M. Students of Plan B 6. A student has fulfilled all required courses of the Program with the cumulative credits of not less than 39

credits, 15 of which are for compulsory courses, 18 of which are for elective courses and 6 of which are for an independent study.

7. A student has earned a grade point average of not lower than 3.00. 8. A student has earned a P (passing) level for English language examination in accordance with the

requirements of Thammasat University namely TU-GET scores of not less than 550 or TOEFL scores of paper-based test of not less than 550 or of computer-based test of not less than 213 or of internet-based test of not less than 79 or IELTS scores of not less than 5.5.

Eligible students enrolled in Thammasat University, Faculty of Law’s Master of Laws Program in Business Laws (English Program) may opt to participate in the “Sandwich Program” under the cooperation with the University of Wisconsin-Madison Law School. The purpose of the said cooperation is to enable students to obtain both, the Thammasat University, Faculty of Law’s Master of Laws Program in Business Laws (English Program) and the University of Wisconsin LL.M. in Legal Institutions in an efficient and low cost manner:

(a) Students enrolled in the Thammasat University, Faculty of Law’s Master of Laws Program in Business Laws (English Program) will be able to earn up to six credits towards the University of Wisconsin’s LL.M. in Legal Institutions degree from coursework taken by Thammasat University while they are accepted and enrolled students in the Thammasat University Faculty of Law’s Master of Laws in Business Laws (English Program);

(b) Professors from the University of Wisconsin-Madison Law School will come and teach about five units (or credits) per year at the Thammasat University. These five units (credits) will count towards the University of Wisconsin’s LL.M. in Legal Institutions. The tuition fees shall be paid directly to the University of Wisconsin-Madison Law School for Baht 5,500 approximately per unit (or credit). Upon completion, a certificate will be awarded by the University of Wisconsin-Madison Law School;

(c) Certified students who are admitted to the University of Wisconsin’s LL.M. in Legal Institutions will then take a minimum of 13 credits in residence at the University of Wisconsin-Madison (one semester);

(d) Certain scholarship from the University of Wisconsin will be available to students who are admitted to be in resident at the University of Wisconsin-Madison.

Thammasat University once again opens the door of opportunity for law graduates to join Thammasat University’s Master of Busi-ness Law Program (English Program), a collaboration with America’s top law school, the University of Wisconsin at Madison. We produce quality legal personnel who are the driving force of the nation. Hailed as the most cost-effective business law English program in the country, the Thammasat-Wisconsin sandwich program was developed for ten years before it was officially launched in 2009. Eighteen out of sixty-four enrolling students in Thammasat University’s Master of Business Law Program (English Program) have been accepted by the University of Wisconsin-Madison with transferable credits for another degree of LL.M. in Legal Institutions.

Contribution to National Development Apart from academic strength, contributions to national develop-ment are a value the program seeks to instil in students of varying backgrounds. Dean of the Faculty of Law of Thammasat University, Assoc Prof Dr Surasak Likhasitwattanakul, stressed that the program aspires to provide academic excellence for students while committing itself to social responsibility, the founding value of Thammasat University. The dean said that the Thammasat-Wisconsin business law program aims to create new elites who are capable of working as legal consultants for interna-tional organizations, yet adhere to the university’s mission to drive the country forward. Thammasat will likely expand the sandwich program to undergraduate level and to other fields of legal studies deemed useful for the develop-ment of Thailand in the globalized world.

Innovative Educational Venture Our Master of Business Law Program (English Program) is innovative in a sense that it is the first program in business law taught fully in English, and it is the first time that the University of Wisconsin has offered its courses toward the LL.M. in Legal Institutions outside the United States. The collaboration between the two leading universities is especially beneficial for law students and enthusiasts who want to take their legal expertise to another level without resigning from their full-time jobs. Close ties between Thammasat University and the University of

Wisconsin and their devotion to academic excellence are integral to the success of the program which represents the future of legal educa-tion, according to Director of the East Asian Legal Studies Center, the University of Wisconsin, Prof Charles R Irish. The professor added that the sandwich program would effectively prepare students for the legal job market against the backdrop of globalization. Not only Thammasat University’s LL.M. but students will be able to get the University of Wisconsin’s LL.M. with one semester of physical residence in the United States.

What did you gain from the graduation within two years at the LL.M.(EP) of Thammasat University?

I truly learned a lot from this program where it had not only provided me with knowledge but also valuable experience. Through

the guidance of professors, my experience in legal practices has been widened. I also learned the research methodology, which is advantageous for improving myself and also for my further education.

What is your expectations of studying at UW? / How would you apply the knowledge to your work / career plan?

Studying at UW will be a good opportunity to widen my experience both in academic and social aspects. I will definitely be

able to learn from lawyers of several backgrounds, thoughts and practices which I believe conducive to strengthen a
