Inti would appreciate our help!

Tucked away in a corner of the San Francisco Zoo sits the Koret Animal Resource Center for educational animals. In his own corner of the ARC lives one of the Zoo's most beautiful cats. He is a big healthy Bobcat named Inti. We say "big" because the fact sheets on bobcats say "normally" a bobcat is 9 to 25 lbs. and 26 to 41 inches nose to the tip of his stubby tail (hence the name "bob"cat). Inti is considerably larger than that

and 32+lbs. Bobcats (Lynx rufus) inhabit a range throughout the U.S. They can be found thriving from moun-tainous to swampy to desert terrain. Bobcats communicate in many respects comparably to a housecat in

that they purr, hiss, meow and growl. Their growl, however has been compared to that of their only predator, the cougar. Inti was born in May of 2002 and came to the Zoo as a kitten to replace a beloved predecessor in the Zoo's Summer Wildlife Theatre. Being a cat and, therefore, very much an individual, he unfortunately simply did not take to the leashes and harnesses necessary to make him a star. So, he has languished, pretty much out of sight, well cared for and loved by his keepers and volunteers, in his own little corner of the ARC.

Now Inti is peppy, curious and people "friendly" fellow and some time ago his keepers and some volunteers started a movement to find him more suitable and visible quarters for both his and Zoo visitors benefit. The

space has been found and the planning is progressing but, of course, the funding is sparse.

Can you help the Zoo and Inti with some time and building expertise?Any contribution would be very welcome and appreciated!

Kalb's Q&A for Contractors By David Kalb, President of Capitol Services, Inc.

‘Where there is a will there is a way’ isn’t always true, but ‘generally’ applies to some contracting op-portunities in California. We go several ‘degrees’ out of the way to show education is also ‘experience’ if you really want a contractor’s license. For college graduates still seeking employment in the current market, becoming a contractor might be a great way to move ahead as your own boss…

Q: We have the General “B” license and mostly do landscape and ‘hardscape’ work. We would like to know if we need the “C-27” additional class. We mostly handle different trades like: concrete and landscape, tile, outdoor kitchen, retaining walls, water features, and design by landscape architects. Can our company advertise that we do landscape and state we’re a General contractor that specializes in outdoor construction? Can we get a waiver of the trade exam?

A: It’s very unlikely the CSLB would grant you a waiver of the trade exam with a “B” license. However, if you held the “A”, they would at least consider granting such a request.

Regarding your next question, NO you cannot advertise that you do landscaping unless you hold the “C-27” clas-sification. For the most part outdoor tile, hardscapes, water features, walls and landscaping are not covered by the General (“B”) contractors license. Installing an outdoor kitchen is one thing you could handle with your present class and you can contract for landscaping, etc., if this is part of an overall general building project like constructing or remodeling a home. A “B” can also take a landscaping contract and sub out all the work to a licensed “C-27”.

I would recommend applying for a “C-27” license clas-sification, which is very broad. According to an associ-ate, there is very little that a “C-27” contractor can’t do, executed as a single trade, if the work “aesthetically, ar-chitecturally, horticulturaly, or functionally...” improves a property. As I indicated, an exam would be required; however, once this class is added to your license you can

advertise and perform all the trades referenced in your question. Q: My son is looking to get his own contractor’s license. He has worked a couple of years for our family busi-ness and has a college degree. I read on the Contractor Board’s web site that they will consider education in place of experience qualification. How many years credit will they give for someone who has a four-year degree in Business Administration? He intends on applying for a General building license.

A: The CSLB will give 2 years credit for a Business degree towards the 4-year experience requirement. The same would apply to someone who has a ‘degree’ in Economics, Industrial Technology, Finance, Math, Public Administration, and several other major fields of study. This 2 year “in-lieu of experience” credit should apply to General building (“B”) and all other contractor license classifications.

For anyone applying for the “B” classification with a de-gree in Civil Engineering, Construction Management or Architecture you likely be granted 3 years credit.

Anyone who has a 4-year (or advanced) degree and is looking to apply for a new contractor’s license or qualify for an additional classification, may want to contact the CSLB or my office to find out how much credit to expect for a given degree and specific classification. For in-stance, apply for the “A” class with a degree in Mechani-cal Engineering -- expect 3 years credit. Go for a “C-10” with Electrical Engineering – 3 years. Want to apply for the “C-27” with Horticulture – 3 years credit! If you are a graduate still seeking opportunity in employment, maybe this is another income source to seriously consider for your future.

By now, you’ve read my annual, year-end legislative report and are fully aware of ALL new laws that will affect your business next year, right? Good! Then you will recall that the governor just signed SB 459 (Corbett) (Chapter 706) dealing with independent contractors? As a refresher, SB 459:

Enacts a number of provisions of law related to the classification (or misclassification) of individuals as independent contractors. Specifically, this bill will:

1. Make it unlawful for any person or employer to engage in any of the following activities:

A. Willful misclassification of an individual as an independent contractor. (“Willful misclassification” is defined as avoiding employee status for an individual by voluntarily and knowingly misclassifying that individual as an independent contractor); and,

B. Charging an individual who has been willfully misclassified a fee, or making any deductions from compensation for any purpose, where the employer would have been in violation of the law if the individual had not been misclassified.

2. Provides that any person found guilty of the above violations shall be assessed a civil penalty of not less than $5,000 and not more than $15,000 for each violation.

3. Provides that any person found guilty of a repeated pattern or practice of these violations shall be assessed a civil penalty of not less than $10,000 and not more than $25,000 for each violation.

4. Authorizes the Labor Commissioner to issue a determination that a person or employer has violated the provisions related to willful misclassification.

5. Authorizes the Labor Commissioner to issue a citation to assess specified damages in addition to any other penalties or damages otherwise available at law.

6. Authorizes the Labor Commissioner to enforce these provisions administratively or in a civil suit.

7. Provides that a person or employer that violates the above provisions shall be required to post a notice on its Web site (or at the worksite if no Web site exists) that sets forth specified information for a one-year period of time.

8. Provides that if a licensed contractor engages in the violations specified above that resulted in debarment, a certified copy shall be sent to the Contractors’ License Board, which shall initiate disciplinary action against the licensee within 30 days.

9. Provides that any penalty issued under this bill shall be in effect against any successor that has one or more of the same principals or officers and is engaged in the same or similar line of business.

10. Provides that a person who knowingly advises an employer to treat an individual as an independent contractor and to avoid employee status for that individual shall be jointly and severally liable if the individual is found not to be an independent contractor. This provision does not apply to: (A) a person who provides advice to his/her employer; or, (B) a licensed attorney who provides legal advice in the course of the practice of law.

OK, now I have your attention! This new law, while intended to not entrap the unknowing, will! That is why my business colleagues and I so strenuously opposed the bill! However, “what it is, is what it is” (my, how prophetic!) and now, more than ever, we MUST find a solution to this problem!!!

To this end, I have again joined forces with my business colleagues in an attempt to see if we can find a FINAL solution that can be put into law next year. As background, we reviewed how various state agencies currently define independent contractor. Attached are the factors that the different agencies (Department of Industrial Relations, Franchise Tax Board and the Employment Development Department) utilize when analyzing whether an individual is an employee versus and independent contractor.

Our homework assignment in preparation for our next meeting on Monday, November 21st is to ascertain from our respective clients which of these listed items would be acceptable language to insert into legislation next year? So, since this COULD affect YOU, I would ask you to take a few moments to review the attached and email me as to what portions you could live with, please and/or any other thoughts or ideas that you may have. This is a very important opportunity to see if we can once and for all resolve this long time problem that has had an effect on many throughout the years.

Saws/Grinders - Portable Abrasive Saws and GrindersMany workers have been near an operating portable, abrasive saw or grinder without ever realizing their danger. Personal safety can be endangered by sev-eral functions of this type of machinery - by the power source, blade, wheel or from a disk failure or hazard from flying or airborne particles.

Before use, tools, cords and accessories should be inspect-ed to insure safe operation. The equipment operator should be protected from electrocution by a ground-fault circuit interrupter or an assured equipment grounding conductor program. No one should ever be permitted to use an electri-cal tool in wet or damp areas. Operators of compressed air and hydraulically operated tools should make certain that supply pressure does not exceed the tool manufacturer’s recommendations. Excessive pressure can rupture hoses, damage tools, and increase operating speed beyond safe limits.

Some abrasive saws are gasoline powered and should only be used in well ventilated areas. Operators of gasoline powered equipment should comply with all flammable liquid storage or transportation guidelines, and follow applicable regulations. Here are some blade, wheel and disk tips worth remembering:

•Never use an unguarded tool•Never force a blade, wheel or disk onto a tool•Never use a blade, wheel or disk that has been dropped or otherwise damaged•Never use excessive tool force•Never stand in front of an operating tool•Never exceed the safe maximum operating speed marked on the blade, wheel or diskWorkers should also be aware of the airborne health hazards which can come from abrasives and bonders in blades, wheels, or disks and also from the materials on

which the saws and grinders are used. They should be instructed in the use of any personal protective equipment, including face or eye shields and respirators, necessary to protect them from physical or airborne hazards when work-ing with or around portable abrasive saws and grinders.

Sierras y pulidoras abrasivas portátilesMuchos trabajadores han estado cerca de una sierra o puli-dora abrasiva portátil sin darse cuenta en ningún momento del peligro que corrían. La seguridad personal puede peli-grar debido a varias funciones de este tipo de maquinaria: la fuente de alimentación eléctrica, un fallo de la hoja, la rueda o el disco o el peligro de partículas en el aire. Antes de usarlas, las herramientas, los cables y los ac-cesorios deben inspeccionarse para asegurar un funciona-miento no peligroso. Los trabajadores deben recibir instrucción en el uso de cual-quier equipo de protección personal, incluidas las caretas de protección facial o las protecciones para la vista, así como los aparatos respiratorios que sean necesarios para protegerlos contra los peligros físicos o en el aire cuando trabajan con sierras o pulidoras abrasivas o cerca de las mismas.
