Pleaseforwardtothisoffice,astatementcertifyingRespondent'scompliance withtheterms listedintheaforementionedagreement.ThelettershouldnotethedatesonwhichRespondentssatisfiedeachof theterms listed inparagraph6,andcontaintheADRcaptionandcasenumber.Thecivilpenalty paymentshouldbesentto theattentionof theAccounting/Finance Officeof theF E C . Thecivilpenaltyundertheagreementis dueonorbeforeFebruary13,2014.Pleaseput theAD Rcasenumberonthe civilpenalty checkaswell,toensurecreditingto thecorrectcase.Asyouareaware,thesettlement agreementwillbemade partoftherecordthatisreleasedtothepublic. NEGOTIATED SE T T L E M E N Tmatterwasinitiated bytheFederalElection Commission(Commission)pursuant toinformation ascertained in the normal course ofcarryingout its supervisory responsibilities.reviewofthematter,andinan efforttopromotecompliancewiththeFederalElectionActof1971,as amended, (FECA)and resolve thismatter,theCommissionenteredinto negotiationswith Arthur Lukin representingMaragos4NYandKhaleda Malique, in his
capacity as Treasurer (the Committee or Respondents). It is understood that this will have no precedential value relative to any othermatterscoming before theCommission. VP- Negotiationsbetween theCommissionand Respondents addressed the issues raised inthisrefen'al.pie.pautie agri thematteraccordingtothefollowingterms:
1. The,Commission'suse of altemativedispute'fesoliii'tioh p^ isguided by*TheAdministrativeDisputeResolutionA ctof1996, 5 U.S.C.572 and is anextensionof2uls,ci437g. ,2. RespondentsvoluntarilyenterintothisagreementwiththeCommission.
3. The ReportsAnalysisDivisionreferred Respondents forfailingto discloseallfinancialactivityontheir 2012AprilQuarterlyReport.The Committeefileditsoriginal2012AprilQuarterly ReportonApril13,2012.OnAugust 30,2012,Respondentsfiledan amended2012 April Quarterly Reportthatdisclosed additional receipts of $794,085.56, andadditionaldisbursementsof$800,000.4. Treasurers ofpoliticalcommittees are required to report allfinancial activity, includingall.receipts, disbursements, and debts, pursuant to theF E C A .2U.S.C.434(b)(2), (4),

correctamounts.Whentheerrorwasnoted,theamendedreportwasfiledtocorrecttherecord.6.Respondents,inanefforttoavoidsimilarerrorsinthefuture,agree to: a)certifytheclosureoftheCommittee'sfederalaccountand workwithCommissionstafftoterminatetheirpoliticalcommitteestatusand reportingobligationswiththeCommissionwithin
sixty60)daysoftheeffective dateofthis agreement;and(b)pay acivilpenaltyof5,000withinthirty30)daysoftheeffective dateofthisagreement.7.Respondentsagreethatallinformation providedtoresolve thismatteristrueandaccuratetothe bestoftheirknowledgeandthattheysignthis agreementunderpenaltyofperjurypursuantto28U.S.C.1746.8. ThepartiesagreethatifRespondentsfailtocomply withthetermsofthissettlement, theissionmay submit anyunpaidcivilpenaltytotheU.S.TreasuryforcollectionorcivilactionintheU.S.DistrictCourtfortheDistrict ofColumbiatosecurecompliance.9. Thisagreementshallbecomeeffectiveonthedatesignedbyallpartiesand approvedbytheCommission.Respondentsshallcomply withthetermsofthisagreementassetoutin6above,andshallcertify compliance withtheabovesettlementterms inwritingtotheAltemative Dispute ResolutionOfficeonorbeforethedateeachtermbecomesdue.
10.ThisNegotiatedSettlementconstitutes theentireagreementbetween thepartiesonADR654(RR13L-17),andresolvesthoseissuesidentifiedinparagraph3above.Nootherstatement,promiseoragreement,eitherwrittenororal,madebyeitiierparty,notincludedherein, shallbeenforceable.
