Anlage 11. Standard-Bedingungen für einen hypothekarisch gesicherten Agrarkredit aus öffentlichen Mitteln

The Land Registration (Special Areas) Ordinance, 1959

(hereinafter called "the Borrower") hereby charges his interest in the land com­prised in the above-mentioned title with the payment to The Land Development and Settlement Board, a body corporate established by the Agriculture (Amend­ment) Ordinance, 1960, (hereinafter called "the Board") of the principal sum of Shillings and interest thereon from the day of 196 at the rate of 6l/2 per centum per annum.

(e) Not to keep livestock on the land without the prior consent in writing of the Board which may impose such conditions regarding the nurober and type of livestock as it may think fit.

(f) That all moneys payable by virtue of any such insurance as aforesaid shall be paid in the first instance to the Board and shall be applied, at the Board's option, either in rebuilding or reinstating the buildings and im­provements or in paying to the Board pro tanto the balance of the princi­pal sum and interest then still unpaid.

(g) That if the Borrower fails to comply with any of the agreements on his part contained or implied herein the Board may spend such money as may be necessary to remedy the breach thereof and may add the amount so spent to the principal sum secured by this charge and thereupon the same shall be deemed for all purposes to be part of such principal sum and shall bear interest accordingly.

(h) To reside personally on the land.

4. The whole of the money at any time remaining owing hereunder shall become immediately due and payable: (a) where default is made by the Borrower for one month in the payment of

any sum hereby agreed to be paid on the expiration of such period of one month,

(b) if there be any breach by the Borrower of any other of his agreements at the time when such breach comes to the notice of the Board.

Anlage 13. Muster der Übertragungsbedingungen für eine Kleinsiedlerstelle

I hereby offer you Parcel No. m the above-mentioned Sdteme upon the following terms and conditions viz:

Title: Freehold, subject to the following conditions: 1. (a) The land shall only be used for agricultural purposes.

(b) The land shall not be subdivided, dtarged, Iet, leased or transferred without the prior consent in writing of the Commissioner of Lands.

(c) The allottee shall within twelve months of the date upon whidt he takes possession of the land, to the satisfaction of the Land Development and Settlement Board: (i) cultivate at least one acre of arable land: (ii) erect a dwellinghouse of suitable materials, and (iii) erect a fence of suitable materials or plant a hedge around the peri­

meter of the land. (d) Upon any breach of these conditions the land shall become liable to for­

feiture to the Crown but sudt forfeiture shall not be enforceable by re­entry, suit or otherwise unless a notice shall have been served on the pro­prietor of the land: (i) specifying the particular breadt complained of: and (ii) if the breadt is capable of remedy, requiring the proprietor to remedy

the breadt: and (iii) in any case, requiring the proprietor to make compensation in money

for the breach, and the proprietor shall have failed, within a reasonable time thereafter, to remedy the breach, if it is capable of remedy, and to make reasonable compensation in money.

2. There is reserved to the Crown during the period from the date hereof to the date of execution of the transfer of the land: (a) the right to enter upon the land for the purpose of constructing, laying,

sinking, erecting, inspecting, repairing and maintaining pipe-lines, canals, rams, reservoirs, cattle-troughs, pump-houses, boreholes, dams, wells and other structures or installations necessary for the efficient supply of water to the land and all other pieces of land on the estate of which this piece of land forms part,

(b) the right to provide such ways of access as may be necessary for and irr­cidental to sudt matters as aforesaid and the access thereto and to rivers by persons and cattle from adjoining and neighbouring pieces of land.

Provided that the Crown shall have regard, where possible to the interest'l of the allottee in deciding the position or alignment of any of such rights.

3. The transfer to the allottee shall include: (a) the grant to the allottee and his successors in title of sudt easements over

adjoining or neighbouring pieces of land as shall at the date of transfer have been provided in accordance with the last preceding clause and are necessary for the proper enjoyment of the land hereby allotted, and

4. It is expressly declared and agreed that all plant, equipment and works in­stalled laid or constructed by or on behalf of the Crown on the land hereby allotted shall be and remain the property of the Crown and its successors.
