2010-2011 in the amount of $3,710.19 (checks attached) which
represents payment of subsistence costs, medical cost
reimbursements and booking fees generated at the Detention Facility
for the period of April 2011. The prisoner subsistence costs were
collected under Florida Statutes 951.033.
As approved by the Board, this will be placed in the appropriate
line items to offset some Prisoner costs within the Detention
Facility.

Dear Lisa:
Please find enclosed a copy of my letter dated April 29, 2011 to
Natalie Nowak, Senior Claims Representative for Sentry Select
Insurance. This involves the fuel spill at Bascom N01Tis Drive and
Lake Jeffrey Road in C?lumbia County on May 20, 2010.
As indicated in my letter and the reply letter from Ms. Nowak dated
May 4, 2011, the parties have reached a settlement agreement
contingent upon approval by the Board of County Commissioners. The
settlement includes that Sentry Insurance will pay the sum of
$18,035.00 directly to Anderson Columbia for repair and corrective
work for the damage on the road. In addition, Sentry Insurance will
reimburse Columbia County $2,500.00 for the Cal-Tech Testing, Inc.
report.
Please try to place this on the next County Commission agenda, May
19, 2011, for the Board's consideration.

The purpose of this letter is to confirm the settlement agreement
we have reached reg~rdh:1g the above referenced claim of my client,
Columbia County, Florida, versus your iiisured, P & S
Transportation.
This claim resulted from a fuel spill of unknown quantity at Bascom
Norris Drive and Lake Jeffrey Road in Columbia County on May 20,
2010. Your insured, P & S Transportation, was responsible for:
the fuel spill. Eagle SWS, representing the responsible trucking
company involved in the.accident, was also notified and requested
to take appropriate curative action with regard to the fuel spill
on the roadway. You have also been provided a copy of the analysis
and report obtained by Columbia County from Cal-Tech Testing, Inc.
indicating the extent of damage to the roadway and the curative
action necessary for correction.
This will further confirm your company has reach an agreement with
Anderson Columbia, Inc. for the sum of $18,035.00 for the repair
and corrective work to be done. Further, on behalfofyour insured,
you will reimburse Columbia County the sum of $2,5.00.()0 as
rein1bursement for the Cal-Tech Testing, Inc. report.

submitted to the Florida Department of Law Enforcement (FDLE) to
apply for American Recovery Act-JAG grant monies to provide funding
for the Regional Drug Task Force. I respectfully request the Board
to approve this grant funding as there is no match requirement for
this grant.
As you are aware, I have been appointed by the Governor to Co-Chair
the task force assigned for this region, along with the Chief of
Police in Tallahassee. These regional task forces are being
implemented to address the problems associated with illegal pill
mill operations. Our directive is to identify, investigate,
apprehend and prosecute those within the medical and pharmaceutical
professions who facilitate the abuse of prescription drugs. This
Federal funding source has been designated by FDLE to operate these
task forces state-wide.

Problem Identification Abuse of prescription drugs presents a clear
and immediate threat to Florida?s citizens, as well as those
throughout the United States; and demands immediate action to
protect the public. Prescription drug overdose has been declared a
public health epidemic by the United States Centers for Disease
Control and Prevention.
Between January 2010 and July 2010, 98 of the nation?s top 100
Oxycodone purchasing physicians were in the State of Florida.

In 2010, 45 of the top 100 Oxycodone pharmacy purchasers in Florida
are from Broward and Hillsborough Counties - 24%/Hlllsborough; 21 %

During the first six months of 2010, 1,268 people died as a result
of prescription drug overdose. Total deaths with Oxycodone present

Investigations across the state have shown that some physicians
dispense medically unjustifiable amounts of controlled substances,
many of which are re-sold illegally to drug abusers.
Project Summary (Scope of Work) To assist local agencies in
addressing the problem of illegal pill mill operations in this
State, a multi-agency strike force will be established in each of
FDLE?s seven regions to identify, investigate, apprehend, and
prosecute those within the medical and pharmaceutical profession
who facilitate the abuse of prescription drugs. Each Strike force
will be co-commanded by a Sheriff and Police Chief within the FDLE
regional jurisdiction. Strike Forces will be supported by assets
from multiple state law enforcement and regulatory agencies,
federal and local law enforcement, regional fusion centers, and the
FDLE Office of Statewide intelligence.

Operational Objectives of the RDESFs include:
1. Target doctors, clinics, or other healthcare facilities that
prescribe or dispense federal and/or state regulated controlled
substances 11-V, without a medical necessity and outside the scope
of a legitimate medical practice in violation of federal and/or
state laws.
2. Pursue doctors and other healthcare officials who engage in
fraud against private insurance companies and federal/state public
benefit programs.
3. Seize and forfeit assets of those who benefit from involvement
in illegal enterprises (pill mills).
4. Seek restitution of investigative expenses.
Using statistical data and intelligence each RDESF will develop a
multi-agency operational plan and identify a list of doctor and
facilities operating as pain management clinics that are operating
in violation of federal and/or state law, or who are in violation
of regulatory licensing, zoning, or other state or local
ordinances. . Strike force participants will evaluate and triage
targets, identifying those for which regulatory and/or
administrative sanctions will result in shutting down the illegal
operation faster and/or more permanently than law enforcement
action. Those targeted for criminal investigation and law
enforcement action will be appropriately assigned among strike
force members.
Investigative targets will be pursued using intelligence,
surveillance, undercover agents, informants, arrest of drug abusers
at target sites, and other investigative techniques to identify and
apprehend doctors and other healthcare officials who engage in
illegal prescription or dispensing of pharmaceutical drugs. Strike
force members will also pursue administrative and regulatory
sanctions against healthcare professionals and facilities to put
illegal operations out of business in Florida and seek restitution
for insurance fraud and fraud against the Medicaid system.

regulatory agencies, federal and local law enforcement, regional
fusion centers, and the FDLE Office of Statewide
intelligence.
Operational Objectives of the RDESFs include:

2. Pursue doctors and other healthcare officials who engage in
fraud against private insurance companies and federal/state public
benefit programs.
3. Seize and forfeit assets of those who benefit from involvement
in illegal enterprises (pill mills).
4. Seek restitution of investigative expenses.
Using statistical data and intelligence each RDESF will develop a
multi-agency operational plan and identify a list of doctor and
facilities operating as pain management clinics that are operating
in violation of federal and/or state law, or who are in violation
of regulatory licensing, zoning, or other state or local
ordinances. . Strike force participants will evaluate and triage
targets, identifying those for which regulatory and/or
administrative sanctions will result in shutting down the illegal
operation faster and/or more permanently than law enforcement
action. Those targeted for criminal investigation and law
enforcement action will be appropriately assigned among strike
force members.
Investigative targets will be pursued using intelligence,
surveillance, undercover agents, informants, arrest of drug abusers
at target sites, and other investigative techniques to identify and
apprehend doctors and other healthcare officials who engage in
illegal prescription or dispensing of pharmaceutical drugs. Strike
force members will also pursue administrative and regulatory
sanctions against healthcare professionals and facilities to put
illegal operations out of business in Florida and seek restitution
fetr insurance fraud and fraud against the Medicaid system.
Budget Narrative
Salary Funds for sworn law enforcement RDESF members will be needed
to support investigative overtime. Nonsworn members may also be
required to work overtime in support of the targeting, intelligence
and data analysis and information-sharing efforts.
Funds for OPS to help support administration of the task force,
management of the task force grant, data entry or other clerical
efforts needed to ensure adequate documentation and communication

3. This PERMITIBE shall commence actual constmction in good faith

date is more than 60 days from date of permit approval, then
PERMITTEE must review the permit with the Columbia County Public
Works Director to make sure no changes have occurred in the
transportation facility that would affect the permitted
construction.
4. The construction and maintenance of such utility shall not
interfere with the property and rights of a prior PERMITTEE.
5. It is expressly stipulated that this permit is a license for
permissive use only and that the placing of utilities upon public
property pursuant to this permit shall not operate to create or
vest any property right in said holder.
6. Pursuant to Section 33 7-403( I), Florida Statutes, whenever
necessary for the construction, repair, improvement, maintenance,
safe and efficient operation, alteration or relocation of all, or
any portion of said transportation facility as determined by the
Columbia County Public Works Director and/or County Engineer, any
or all utilities and appurtenances authorized hereunder, shall be
immediately removed from said transportation facility or reset
or

relocated thereon as required by the Columbia County Public Works
Director and/or County Engineer and at the llxpense otlhe
PERMlTrEE.
7. Jn case of non-compliance with the County's requirements in
effect as of the approval date of this permit, this permit void and
the facility will have to be brought into compliance or removed
from the right of way at no cost to the County.
8. It is understood and agreed that the rights and privileges
herein set out are granted only to the extent of the County's
right, title and interest in the land to b entered upon and used by
the PERMIITEE, and the PERMIITEE will, at all times, and to the
extent permitted by law, assume all risk of and indemnify, defend,
and save harmless Columbia County, Florida from any and all loss,
damage, cost or expense arising in any manner on account of the
exercise or attempted exercise by said PERMITTEE ofthe aforesaid
right and privileges.
9. During construction, all safety regulations of the County shall
be observed and the PERMIITEE must take measures, including pacing
and the display of safety devices that may be necessary in order to
safely conduct the public through the project area in accordance
with the Federal Manual on Uniform Traffic Control Devices, as
amended for highways.
10. Should the PERMIITEE be desirous of keeping its utilities in
place and out of service, the PERMIITEE, by execution of this
permit acknowledges its present and continuing ownership of its
utilities located between _________ and within the County's right
of way as set forth above. PERMIITEE, as its sole expense, shall
promptly remove said out of service utilities whenever Columbia
County Public Works Director and/or County Engineer determines said
removal is in the public interest.

Re: Family Medical Leave Request
I have received a request for Family Medical Leave from an employee
in the Recreation Department. The employee meets the eligibility
requirements for the leave and has provided supporting medical
documentation to Human Resources. He will exhaust his annual and
sick leave prior to being placed on family medical leave. In
accordance with Federal law and BOCC County Policy, his FMLA will
run for twelve weeks, beginning May 23, 2011 and ending August 15,
2011.

Columbia High School is in support of a fireworks display after the
graduation ceremony of the class of 2011, The graduation ceremony
for the Columbia High School class of 2011 is set for Friday, Ma.y
27, 2011 at 7:00 p.m. Tb.e vendor chosen by the Senior class
parents will have to provide adequate liability insurance to the
Columbia County School .District. In addition, the vendor will have
to provide fire equipment on the site through th.e Columbia County
Fire Department, a Pyro-tech on site, and have the set back zone
set and approved by the Columbia County Board of County Commission.
It should also be understood that while our ongoing support is
given, it is done so pending all County Regu1at1011s and that the
County may pull the pennit once given at their digression at any
time.

PROFESSIONAL ENGINEER SERVICES AGREEMENT
THIS PROFESSIONAL ENGINEER SERVICES AGREEMENT made and entered into
this __ day 2011, between COLUMBIA COUNTY, FLORIDA, a political
subdivision of the State of Florida, whose mailing address is Post
Office Box l 529, Lake City, Florida 32056-1529, hereinafter
referred to as "County," and JEROJVIE J. LESZKIEWICZ, P.E., a
self-employed individual, whose mailing address is 787 SE Evergreen
Drive, Lake City, Florida 32025, hereinafter referred to as
"Engineer."
RECITALS
WHEREAS, Engineer is a Florida licensed professional engineer
properly registered in the State of Florida to provide such
services, including consulting, design and other engineering
services, License #53482; and
WHEREAS, County desires to retain the services of Engineer to
accomplish the scope of work described as follows to the extent
requested by the County: Engineering aspects of non- construction
projects specifically designated and assigned to Engineer by
County.
WHEREAS, Engineer will be an independent contractor, but paid on an
hourly basis for the services rendered to County. No County
benefits will be provided to Engineer and no payroll or other taxes
withheld as Engineer is an independent contractor.
NOW, THEREFORE, in consideration of the mutual covenants and
agreements between the parties as set forth herein, and other good
and valuable considerations, the receipt and sufficiency of which
is hereby acknowledged by the parties, they agree as follows:
l. RECITALS. The foregoing recitals are true and correct.
2. SCOPE OF WORK. Engineer agrees to perform professional
engineering and field inspector/technician services for the County
as may be specifically assigned to the Engineer and accepted by the
Engineer.
3. RESPONSIBILITIES OF COUNTY. The County's responsibilities in
connection with the work are as follows:
(a) provide to the Engineer available information, reports and
other data in possession or available to the County to assist
Engineer in performing his tasks herein described;
(b) designate a person to act as County's representative with
respect to the work to be perfom1ed under this agreement; and
(c) upon proper billing to the County, pay Engineer the agreed
hourly rate of $100.00 per hour for professional engineering
services performed, and $60.00 per hour for field
inspector/technician services performed as defined in the recitals
herein. The parties acknowledge no additional benefits will be
provided by the County to the Engineer, and Engineer shall be
responsible for payment of federal withholding tax for any income
derived from this contract. Engineer shall be entitled to cost and
expense reimbursement for word photocopying, printing and
reproduction, film, printing of photographs, and mileage for use of
personal vehicle, only to the extent the same has been prior
approved by the County.
4. RESPONSIBILITIES OF ENGINEER. The responsibilities of Engineer
in connection with the work are as follows:
(a) Engineer shall be an independent contractor and not an employee
of the County;
(b) Engineer shall not perform any work outside the scope of
services described herein without prior written authorization from
the County, and any such additional work shall be at the hourly
rate specified above;
(c) Engineer shall perform all the work and services described
herein, and shall not be authorized to subcontract any of the work
without the prior written authorization from the County;
(d) during the tem1 of this Agreement, Engineer will maintain his
status as a properly licensed engineer in the State of
Florida.
5. DOCUMENTS. Engineer shall provide the County with the original
and minimum of two (2) additional copies of documents, drawings and
data summaries and such additional copies as the County may request
at the County's expense for the reproduction of such documents. The
original of such documents are produced for the benefit of the
County and shall be the County's property, except the County agrees
it will not sell or improperly publish or display the documents in
any manner. The County shall be allowed to use and reproduce the
documents for its own use without further consent of the Engineer
and without further compensation to the Engineer.
6. PAY TO ENGINEER. The County agrees to pay the Engineer in a
timely manner within thirty (30) days of submission of properly
completed, documented, and signed invoices from the Engineer to the
County.

7. INSURANCE. Prior to beginning work on any project or scope of
work assigned to Engineer by County, Engineer shall obtain and
maintain professional liability insurance of no less than One
Million Dollars each occurrence. The policy shall contain a clause
requiring 30 days written notice to County before cancellation,
reduction or other modification of coverage. An insurance
certificate indicating at least the required minimum coverage shall
be provided to the County prior to Engineer commending work under
the tenns of this Agreement. All insurance must be obtained from
insurance companies that are registered and licensed to conduct
business in the State of Florida, and must be rated by Best as A or
better.
In the event the professional liability insurance purchased and
provided by Engineer as required by this Agreement shall be on a
"claims-made" basis, prior to the tennination of this Agreement or
the insurance policy purchased and provided by Engineer, Engineer
shall purchase, at Engineer's expense, "tail coverage" insurance
which will provide professional liability coverage to Engineer and
County for a minimum tenn of three (3) years after the tem1ination
of this Agreement or Engineer's professional liability insurance
policy, whichever event occurs later.
8. INDEMNIFICATION. In consideration of this Agreement, Engineer
shall indemnify and hold harmless County from and against any and
all claims, damages, losses, liabilities, or expenses (including
but not limited to any judgment, award, settlement, reasonable
attorney fees, and other direct out-of-pocket costs or expenses
incurred in connection with the defense of any pending, threatened
or completed action, suit or proceeding), suffered or sustained by
County by reason of any or omissions or alleged acts or omissions
or negligence related to or arising out of Engineer's activities
under the terms of this Agreement and within the scope of
Engineer's activities and services provided to the County,
including but not limited to those caused by any negligent or
willful act, error or omission of Engineer, his employees or
subcontractors.
9. TERM OF AGREEMENT. This agreement is effective from the date it
is signed by both parties and will remain in effect for the initial
term of two (2) years provided either party may tem1inate this
agreement with written notice to the other effective immediately if
the other party is in material breach of this agreement and, in the
case of a breach capable of remedy, fails to cure the breach within
sixty (60) days of receiving written notice of the breach. Either
party may cancel this agreement upon thirty (30) days prior written
notice to the other party without cause. In such event, County will
pay Engineer only for services provided to the date of tem1ination.
This agreement may be extended for two (2) additional two-year
periods by mutual written agreement of the parties. However,
notwithstanding anything herein to the contrary, Engineer's
obligation to indemnify, defend and hold harmless the County as
provided in paragraph 7 shall survive the termination of this
Agreement.

10. PUBLIC RECORDS. The parties acknowledge the County as a
political subdivision of the State of Florida is required to comply
with the Public Records Act of the State of Florida, Chapter 119,
Florida Statutes, and all other public entity provisions required
of the County as a political subdivision of the State ofFlorida as
provided by the Constitution and laws of the State of Florida.
Therefore, Engineer shall, for a minimum of five (5) years from the
expiration or termination of this Agreement, maintain all records
resulting from this Agreement which shall be made available to the
County upon reasonable written request. County shall be responsible
for reasonable costs of copying such public records.
11. GOVERt~ING LAW AND VENUE. This agreement shall be governed and
interpreted in accordance with the laws of the State of Florida and
Columbia County, Florida shall be the sole and exclusive venue for
any legal action between the parties.
12. ATTORt~EY'S FEES. In the event of a breach of this agreement,
the defaulting party shall be liable to the prevailing
non-defaulting party for all reasonable costs and attorney's fees,
including appellate fees.
13. ENTIRE AGREEMENT. This Agreement, together with the related
written and signed agreements between the parties, if any,
constitutes the entire agreement between the parties and supersedes
any and all prior or contemporaneous understandings and
representations. No covenants, term or provision of this Agreement
may be modified or waived except by writing duly executed by the
legal representative of each party.
IN WITNESS WHEREOF, the parties have executed the agreement the day
and year first above written.

item #4, and TDC meeting notices.
Citizen Marsha Moon offered comment relating to the RFQ for EMS,
and the private and commercial premium reductions resulting from
lower ISO ratings.
Citizen Toby Witt addressed EMS operations and disputed the
information provided at the February 03, 2011 BoCC meeting by
Attorney Grogan regarding EMS operations.
Citizen Michael Anderson spoke against privatizing EMS on behalf of
the Columbia County EMS Association.

! Economic Development Board/IDA Board Appointments
As was decided by the Commission, former IDA Board members wishing
to serve on the newly formed Economic Development Board ("EDB")
would be given an opportunity to do so. Five former IDA members
have chosen to serve on the EDB.
MOTION by Commissioner Williams: To reappoint Dr. Charles Hall,
Marc Vann, Gus Rentz, Suzanne Norris, and Jeff Simmons.
SECOND by Commissioner Bailey. The motion carried
unanimously.
MOTION by Commissioner Williams: To appoint Glenn Owens and Terry
Dicks to fill the two vacancies on the EDB.
SECOND by Commissioner DePratter for discussion.
Due to a public comment, Commissioner DePratter asked if the action
being taken was legal. Attorney Feagle discussed with him that he
was not aware of any law being violated by this action. A
resolution is in draft process that will address the adoption of
the EDB membership and amendments to the Administrative Code.
The motion carried unanimously.
The two commissioners appointed to serve on the Economic
Development Board are Commissioner DePratter and Commissioner
Bailey.
Staff recommended the county engage the services of a consulting
company to assist with a broad statewide search for qualified
candidates that could fill the position of Economic Development
Director.
MOTION by Commissioner Bailey: To accept staff
recommendation.
SECOND by Commissioner Williams. The motion carried
unanimously.
IOrdinances
Th~ Board has been provided with a draft template ordinance that
would be adopted for the four companies the county has employment
agreements with. This ordinance was prepared by Attorney Greg
Stuart. The evaluation issues are being identified. Staff requested
the Board set public hearing for those four ordinances on March 17,
2010.
MOTION by Commissioner Williams: "So Move."
SECOND by Commissioner Bailey. The motion carried
unanimously.

Regarding item #26, minutes from the January 20, 2011 Board of
County Commissioner's meeting. The County Manager advised that
Commissioner Frisina has made him aware that while the discussion
were taking place in that meeting regarding economic development
and the various sites identified by the Rudder Team that there are
actually 7 sites that have now been identified and condensed into 6
sites. Commissioner Frisina stated in her motion that there were
