16. WOORDOMSKRYWING

"BYDRAER”''Bydraer" sluit in enige persoon van watter ras ook al wat inge-

volge 'n diens- of vakleerlingskap- of leerlingskapkontrak by 'n werk- gewer in diens is in enige nywerheid, onderneming, bedryf, beroep of werksaamheid, maar sluit nie die volgende in nie:-(1) Persone wie se verdienste R26 000 per jaar oorskry.(2) Persone wat vir minder as 'n voile werksdag of minder as agt

uur, na gelang van watter ook al minder is, in enige afsonderlike kalenderweek by 'n werkgewer in diens is.

(3) Die cggenoot of eggenote van ’n werkgewer wat by daardie werkgewer in diens is.

(4) Bediendes as sulks in diens in private huishoudings.*(5) Persone wat die Republiek binnekom om 'n dienskontrak uit te

voer indien by die beeindiging daarvan die werkgewer daardie persoon volgens Wet of volgens die dienskontrak of volgens enige ander ooreenkoms moet repatrieer, of daardie persoon aldus die Republiek moet verlaat.

(6) Persone in diens in landbou behalwe persone uitsluitlik of hoof- saaklik in diens in bosbou.

(7) Persone wat by geleentheid en nie vir die doel van die werk­gewer se besigheid in diens geneem word nie.

(8) Seisoenswerkers, d.w.s. persone wat in ’n nywerheid in diens is wat die Minister van Mannekrag by kennisgewing in die Staats-

(9) Persone aan wie artikels of materiaal deur 'n werkgewer uitge- gee word om op ’n plek wat nie onder die beheer van die werk­gewer staan nie, opgemaak, afgewerk, vir verkoop reggemaak 6f andersins bewerk te word.

(10) Persone wie se verdienste slegs uit 'n aandeel in ontvangste bestaan of enkel op 'n kommissiebasis bereken word.

(11) Persone op die vaste diensstaat van die Staatsdiens.(12) Persone wat in die vaste diens van S.A. Vervoerdienste is of

by die Dienste in sy gereelde nie-Blanke dienspersoneel in diens is.

(13) Persone wat by 'n provinsiale administrasie in diens is en tot die Regeringsdienspensioenfondsbydra.

(14) Persone wat ingevolge artikel 23 van die Wet op Onderwys- dienste, 1967, artikel 12 van die Wet op Onderwys vir Kleur- linge, 1963, en artikel 12 van die Wet op Onderwys vir Indiers, 1965, vir alle doeleindes ten opsigte van pensioen- en uitdiens- tredingsvoordele behandel word asof hulle poste beklee wat in- gesluit is in 'n afdeling van die Staatsdiens waarna in artikel 3(1 )(a) van die Staatsdienswet, 1957, verwys word.

(15) Beamptes op die vaste diensstaat van die Parlement.(16) Sekere klasse persone wat kragtens artikel 2(5) van die Wet uit-

gesluit is.

“W ERKGEWER”'n Werkgewer is 'n persoon (of firma) wat ’n bydraer in diens het.OPMERKING — As ’n persoon by twee of meer werkgewers in

diens is sal hy slegs as bydraer beskou word ten opsigte van daardie werk wat na die oordeel van die Direkteur-generaal: Mannekrag sy normale werk is. Ten einde hieroor te besluit sal, benewens ander omstandighede die bedrag van verdienste van elke werkgewer ont- vang in aanmerking geneem word.

VERDIENSTE

"Verdienste" beteken enige betaling in kontant of in natura, of beide in kontant en in natura, gedoen of verskuldig aan enige per­soon wat op enige wyse hoegenaamd uit diens ontstaan, dog omvat nie enige kommissie of aandeel in ontvangste, oortyd, enige addisio- nele betaling bereken op die hoeveelheid of omvang van die werk wat gedoen is nie (uitgesonderd enige bedrag wat volgens Wet of an­dersins as minimum besoldiging gewaarborg word) of enige spesiale betaling, bonus of toelaag nie.

Die waardes van voedsel en/of huisvesting wat deur 'n werkgewer aan ’n bydraer voorsien word en wat bygereken moet word by die be- paling van "verdienste” word bereken volgens die skaal van 17 per- sent ten opsigie van voedsel en 8 persent ten opsigte van huisves­ting van die weeklikse of maandelikse bedrag van kontant ver­dienste van 'n bydraer.

Enclosed please find a ropy of U.F. 1 amd U.F.35, duly completed and signed.

With regard to point 4 of U.F. 1, the End Conscription Campaign is a voluntary organisation not for gain and does not have an executive body.The name inserted is that of one of the national employees. I trust that is in order.

The organisation failed to register as an emplyer in 1986. This has been rectified with the Receiver of Revenue. However, the two national employees for the period l/0i/86 - 3l/l2/86 , have oeen added on the U.F. 85 form, Laurence Nathan and David Shandler. At present both of them hava resumed their academic studies and thus are no longer emplyed. Pleasa could you advise us what their current status would he with respect to your department.

The organisation is willing to pe,' in s;v=ors for the above mentioned employees but trust that no penalties will be incurred.

Enclosed please find a cheque for the amount of R129. 60 in payment for

UIF during the period January 1986 - December 1986. During this period

ECC employed 2 full time workers at the rate of R600.00 a month. The

calculated amount due for each employee is R5.40 over a period of twelve

months. This gives the total of R129.60.

I have alao enclosed a cheque for the amount of R31.57 in payment for all

the employees contribution for the month of August 1987. We have just

employed a third full time worker, as from the 1st August 1987, and I have

included her contribution in the total amount of R31.57.

I will furnish your office with the new employee's details as soon as possible

as well as submitting the identity numbers of the two employees for 1986.
