The GE subjects need not be taken all in one year. They can be taken across the years.
The GE subjects may be taught in any language or combination of languages that the HEI deems appropriate.
The Supreme Court En Banc, during its session of April 21, 2015, acted on the following matters in its Agenda, among others:
1. In the matter of G.R. No. 217451 (Dr. Bienvenido Lumbera, Pambansang Alagad ng Sining, et al. v. Pangulong Benigno Simeon C. Aquino III, at Punong Komisyuner ng Komisyon sa Lalong Mataas na Edukasyon/Commissioner on Higher Education [CHED] Dr. Patricia Licuanan), the Court, in a Resolution dated April 21, 2015,
GRANTED the prayer contained in a Petisyon para sa Certiorari at Prohibition (May Kasamang Kahilingan Para saTemporaryRestraining Order at/o Writ of Preliminary Injunction) and, without necessarily giving due course to the Petisyon, issued a TEMPORARY RESTRAINING ORDER (TRO) effective immediately and continuing until further orders from the Court ENJOINING the respondents from implementing and enforcing the provision of Commission on Higher Education Memorandum No. 20, series of 2013, insofar as it excluded from the curriculum for College Filipino and Panitikan as core courses.
The dispositive portion of the Order reads:
Acting on the Petition for Review on Certiorari with Prayer for Temporary Restraining Order and Writ of Preliminary Injunction, the Court resolved, without giving due course to the petition, to:
a) REQUIRE the petitioners to comply with the rules relative to the filing of copies of the petition and its annexes in printed and soft copies;
b) REQUIRE the respondents to COMMENT on the petition within a NON-EXTENDIBLE period of ten (10) days from notice hereof and
c) ISSUE a TEMPORARY RESTRAINING ORDER, effective immediately and continuing until further orders from this Court, enjoining the respondents from implementing and enforcing the provisions of Commission on Higher Education Memorandum No. 20, series of 2013, insofar as it excluded from the curriculum for college Filipino and Panitikan as core courses.
The CHED Memorandum No. 20 challenged in this case prescribed the new General Education Curriculum for college; it reduced the GEC to a minimum of 36 units and, pertinent to the Petisyon, did not include Filipino as a subject in the core courses and deleted Panitikan (Literature) as a core subject.
Petitioners allege failure of the CHED to conduct consultative sessions with colleges and universities prior to the issuance of the Memorandum. They also allege that the Memorandum violates several provisions of the Constitution, among them Article XIV (Education, Science and Technology, Arts, Culture and Sports) and Article XIII (Social Justice and Human Rights).
