Iam in receipt of your DO Letter dated 13.07.2012 regarding notifying the rules

for payment of unemployment allowance.

It is brought to your notice that the rules for payment of unemployment aJ1Q}Yfl.l1cS!_fQI

Karnataka State has already been framed long-ago i.e. in the initial stages of the

implementation of the Scheme and also amendment during 2009 has been issued subsequently.

In fact. these copies are already sent to Government of India and also in the recent meeting of

the Performance Review Committee (PRC) held at New Delhi for NREGA. this was brought to

the notice of meeting and also copies of the same were made available. The same is being

followed in the implementation.

Albeit. I am sending copies of the rules framed for payment of unemployment

allowan~e for Karnataka State for your kind ready reference.

Where6s the draft lA the Karnataka State Payment of Unemployment Allowance Rules2006 -. was published in Part IV-A of the Karnataka Official Gazette on 16.5.2006 invitingobjections and suqqesuons to the said draft from the general public within 15 days of itspublication in the official gazette. -

And whereasthe said Gazette was made available totheqeneral public on16.5.2006.

And whereas no objections or suggestions has been received by the State Governmentin respect of the said draft. .

Now, therefore in exercise of the powers conferred by Sub-Section (t) of the Section 32and Sub-Section (6) of the Section 7 ofthe National Rural Employment Guarantee Act 2005(Central Act 42 of 2005), the Karnataka Government hereby makes the following rules namely

'l. Short Title and Commencement:

1) These rules may be called The Karnataka State Unemployment Allowance PaymentF{ules, 2006.

2) They shail come into force from the date of its publication in the Official Gazette.

2. Definltlons In these rules, unless the context otherwise requires -

(1) 'Act' means the Natlonal Rural Employment Guarantee Act, 2005 (Central Act 42 of.2005)

. (2) District Programme Co-ordinator means the Chief Executive. Officer cif the ZillaPanchayat in the district

(3) 'Fund' means the Karnataka State Employment Ouarantee fund established. underSec.21 of the Act .

(4) 'PrcqrammeOfftcer means the Executive Officer of theTaluk Panchayat in the Taluka. ,

(5) 'Scheme' means the 'Karnataka Rural Employment Guarantee Scheme' notifiedunder Section 4 of the Act.

(a) 'State Council' means the Karnataka State Employment :Guarantee Council constitutedunder these Rules '.

(7) 'Unemployment Allowance' means payment made und€;r, Section 7 of the Act.

3, Tlie Grama Panchayatshaf be the cOl11pet~ntauthorityt~ p;£y;unernploymEmt allowance inaccordance with theScheme formulated under Section 4 'of tti~Act. .

ii., New works of any irnplementinq agency including the Grama Panchayat cannotbe started on the grollnd that there are less than 50 labourers available: ,

Hi. There are no works of afforestation that can be commenced all the date whenthe registered labour has to be provided with work or in the period when the

'labour has demanded work;b. The liability for payment of unemployrnent ellowance has ceased with ~egard to the

provisions of sub-section (3) of section 7 of the Act. 'c. The Central Government has ordered stoppage of funds under Sub- Section (~~}of the

Section-27 of the Act. '

7. Unemployment Allowance not to reduce employment entitlement of.household:• • .: t •

In any household, which has been provided with unemployment allowance, thehousehold shall continue to be eligible to be provided on demand with a minimum of '100 days' 'work in a financial year. .

8. Establishment of Unemployment Allowance Fund:;"; . '. .

Unemployment Allowance Fund shall be 'a component of the Karnataka State EmploymentGuarantee Fund. The State Covernrnent shall provide monies to the said Fund to meet theclairnsof unemployment allowance payable under the Act.

9. Monthly Report of disbursements from the Fund:

1. The Program Officer: shall make a monthly report of the expenditure under theunemployment allowances, fund in Form-4E of the Scheme to the District Program Co-ordinator and the State Government. .

2. The Custodian of the State Fund shall make a monthly report of the expenditure andreleases made in the unemployment allowance fund for the consideration of the statecouncil in Form-5B of the Scheme.

unemployment allowance he shall be paid the same not later than fifteen days from the date onwhich unemployment allowancdwas due. In the event of any delay, the reCipl~ntssh~ll beentitled to compensation 'as provided :in the Para 30 of schedule II of the Act.' ,

.'. . \. : . - .12. Wage .rate: Payment, of unemployment allowance shall be one fourth of the wage rate for- '. ; . .' .the flrst thirty days during the financial year and half of.the wage rate for the remaining periodof the financial year.

13. Lapses' of Progral!l~,m.e·'officer: The Programme .Offlcer after sanctioning theunemployment allowance, shall" initiate disciplinary proceedings against those who,~,re found, ' .tesponsible for amount paid, as unemployment allowance in violation' of the provisions. theamount shall be recovered after the due enquiry. The enquiry proceedings should be completedwithin 90 days of the receipt of payment of unemployment allowance." .
