October 30th, 2003“…I’ll never forget being trapped, buried alive like that.”

Daniel Dougherty
Dougherty Depo., pg. 54...I believe I fell like five stories and landed on my face. And then I work up—I mean, I fell again after that. And I woke up next to Johnny Caldwell. And we were all right at the edge of Floor Number 4.
Daniel Dougherty
Dougherty Depo., pg. 55Q. So you remember your face hitting. Do you know what the surface was that your face hit?
A. Concrete, hard concrete.
Q. Hard concrete?
A. Yes
Daniel Dougherty
Dougherty Depo., pg. 56-57Q. Were you able to talk to one another?
A. I could talk to Johnny. That was it.
Q. Do you remember what you said to him or he said to you?
A. I was trying to tell him that we were going to live, even though I didn’t think we were. He was crying. I was bleeding all over his face. He was pinned on his back.
Q. How close were you to one another?
A. I was holding his hand. I was basically right on top of him.
Q. Why were you holding his hand?
A. Because he was crying.
Q. You were trying to comfort him?
A. Yeah.
Daniel Dougherty
Dougherty Depo., pg. 57-58Q. And what did you experience while you were in that position?
A. I experienced dying a couple of times, I think. They left the pump on and me and Johnny were drowning in the wet concrete. It just kept pouring on top of us. I was – my whole body was numb. I figured I had broken my neck.
Q. Were you feeling pain at that point in your neck?
A. A lot of pain. Well, my whole body was numb except for my knee. My knee hurt a lot. But from my neck down, I was completely numb.

Defense Damages Experts
"Given the number of operations he's had, I don't feel that going back into the concrete business or occupation of that type requiring that type of physicality is sensible. Appropriate occupational reassignment and/or retraining needs to be pursued... I don't think occupations requiring heavy or prolonged use of his legs or extended overhead activity would be particularly sensible."
Defense examiner orthopedic surgeon, Gary N. Goldstein, M.D., March 10, 2005

"In summary, the diagnoses are:
1. Posttraumatic Stress Disorder, previously of moderate severity but resolving and now of mild severity;
2. Adjustment Disorder with Depressed Mood, Mild to Moderate.
It is this examiner's opinion that he is in need of continued [mental health] treatment.“
Defense examiner psychologist, Gerald Cooke, Ph.D., March 9, 2005.
