WHEREAS, an easement for sewer purposes and septic tank over Lot 5 of Waterville Heigh s, was given to the City by deed from the Southern Title and Trust Company, as grantor, dated June 15, 1927 and recorded August 31, 1927,,in Deed Book 1350, at page 392, which easement i on file in the office of the City Clerk of said City under Document No. 211525; and

WHEREAS, another easement for sewer purposes over the same property was given by deed to the City from _the Southern Title and Trust Company, as grantor, dated June 29, 1929 and recorded August 14, 1929.- in Deed Book 1557, at page 433, which easement is on file in the office of the City Clerk of said City under Document No. 247175; and .

' WHEREAS, ~t appears that the first easement does not fit the conditions on the ground, that the act~al sewer!line on the above mentioned property was built on the easement descri ed in the second deed! that the portion of the first easement for a septic tank has never been used byithe City, that no u~e of it is contemplated and that said easement~or a septic tank describ¢d in thelfirBt deed-hereinabove mentioned has no value and should be abandoned NOW, THEREFORE,

BE IT RESOLVED, By the Council of The City of San Diego, as follows: That the Mayor of said City be, and he is hereby authorized and empowered to execute

for and on behalf of The City of San Diego a quitclaim deed to San Diego Associates, Inc., a corporation, a.B' grantee, quitclaiming the unused portion of the easement heretofore· ae­qui red by the City· by deed from the Southern Title and Trust Company, dated June 15, 1927 ·' and recorded August 31, 1927 in the Cognty Recorder's Office in the Coupty of San Diego in Deed Book 1350,. at page 392, over the property described as follows:

,That portion of Lot 6 of Waterville Heights, according to Map thereof No. 748, filed i 1'1 the office of the County Recorder of San Diego County, described as follows:

Beginning'at a point on the southerly prolongation of the east line of said.58th Stree distant 210 feet south from the north line of said Lot 5 (measured along the southerly pro­longation of the east line of said 58th Street); thence at right angles west a distance of 10 feet; th~nce at right angles south a distance of 80.feet; thence at right angles east a distance of lO.feet to the southerly prolongation of the east line of said 58th Street; thence northerly along the southerly prolongation of the east line_ of said 58th Street, a distance of 80 feet to the point of beginning. · ·

GRANTING .PROPERTY OWNERS PERMISSION TO GRAD~ PAVE AND OTHERWISE IMPROVE 58TH STREET, •· TROJAN AVENUE, VALE WAY AND MEADE AVENUE.

BE IT RESOLVED, By the Council of the City'of San Diego, as follows: 1 ·

That in accordance with the petition filed in the office.of the City Clerk of sai~ity on March 11, 1948, under Document No .. 384027, permission is hereby granted to the signers of said petition, property owners, to grade, pave and otherwise improve portions of 58th Street Trojan Avenue, Vale Way and Meade Avenue; said work to be done by private contract and in ac cordance with the plans, drawings, typical·cross-sections and specifications therefor furnis ed by the City Engineer of. said City and filed in the office of said City Clerk under Document No. 384028. · : · ·

. Provided, that as a part of said work, said property owners shall construct· an~ install sufficie11t and prOJE r fences, guards and barriers to. safeguard said street, and shall also construct all necessary cortdui ts·, drains, pipes, catch-basins and gutters for the proper drainage of said street, between said points. ·

In case any electric poles or apparatus, .or any public service pipes or. c,ondui ts are encountered in the course of such private improvement, the person making such improvement sh 11 serve notice upon the person, company.or corporation owning or controlling such public util­ities, to lower, remove or protect the same before such private improvement shall be·made.

That all of said work shall be done under the direction and to the. satisfaction' of the City Manager and Director of Public Works of said City, and all surplus dirt shall be deposi ed at the places designated by said City Manager and Director of Public Works.
