PROCLAMATION NO. 35112003IDGHER EDUCATION PROCLAMATION
WHEREAS, it has become necessary to lay down asystem and issue requirements that enable higher education toproduce qU!llityand skilled manpower adequately to meet theneeds of the country;
WHEREAS, it has become necessary to create ap-propriate legal framework so that research conducted byhigher education shall be problem solving and directdtowards the utilization of the potential resources of thecountry;
WHEREAS, it is necessary to provide for by law theacademic freedom and accountability of the higer educationinstitutions as well as their administration;
WHEREAS, it has become necessary to determine bylaw the directions of the private higher.education institutionsin order to promote their contribution in expanding educationand conducting research; .
NOW, THEREFORE, in "ccordance with Article 55 (1)of the Constitution of the Federal Democratic Republic ofEthiopia, it is hereby proclaimed as follows:
PART ONEGeneral
1. Short TideThis Proclamation may be cited as .'Higher EducationProclamation No. 351/2003" .
2. DefinitionsIn this Proclamation, unless the context requiresotherwise:1) "Higher Education" me~ns education offered to
students who attend programmes stated in Article 5 ofthis Proclamation after they'have completed secon-daryeducation.

2) "Institution" means a private and/or public highereducation institution.
3) "Public Institution" means a tligher educationwhose budget is allocated by the Federal Govern-ment or Regional Government, as the case may be;and providing higher education service.
4) "Private Instit\ltion" means a higher educationinstitution provi'cting higher education service and
\established by one or more individual owners or bynon-profit making associations, or founded as co-operative society or commercial association;
5) "Institution Head" means as the case may be:(a) a university president,(b) a university college president,(c) a college dean, or(d) an institute director or dean.
9) "Institution Vice-heads" means:(a) a university vice-presic;lents,(b) a university college vice-presidents,(c) a college vice-deans, or(d) an institute deputy-director or vice-deans.
7) "Academic Staff' means an employee of highereducation institution who devotes 75% of his time toteaching and 25% of l:-istime to research and shallinclude an employee of a research center of theinstitution who devotes 75% of his time to researchand 25% of his time to teaching.
8) "Government" means the Government of theFederal Democratic Republic of Ethiopia.
9) "Regional Government" means the States specifiedin Art. 47 of the Constitution of the FederalDemocratic ReplCblic of Ethiopia including AddisAbaba City government and Dire Dawa City Coun-cil Administration.
10) "Minister" and "Ministry" means the Minister ofEducation and the Ministry of Education, respec-tively.
11) "Person" means natural or juridical person.
3. Scope of Application
1) This Proclamation shall apply to any institution.2) Notwithstanding the provisions of Sub-Article (1) of
this article, this Proclamaiton shall not apply toinstitutions under religious institutions and whoseobjective and curriculum are religious.
PART TWOGeneral Provisions Applicable to all
InstitutionsSection one
Institutional Status,Requirements and Autonomy
4. Status of Institution
1) Any institution to be established pursuant to thisProclamation shall have the status of:(a) a university;(b) a university college;(c) a collage or a junior college; or(d) an institute.
2) Notwithstanding the provisions of Sub-Article (1) ofthis Article, an institution may have under it two ormore institutions with different status.

5. Levels ofCun"iculum or Training
A curriculum to be developed by any institution shallhave programmes leading to the award of'1) diploma;2) first degree;3) second degree or medical speciality; and/or4) a doctoral (phD.) degree.
6. Objectives of Higher Education
Higher Education shall have the objectives to:1) produce skilled manpower in quantity and quality
that will serve the country in diffeent professions;2) expand higher education services that are free from
any discrimination on grounds of race, religIon, sex,.
politics and other similar grounds: ,
3) provide equitable distribution of higher educationinstitutions:
4) lay down problem-solving educational and ins-titutional system that enables to utilize potentialresources of the country and undertake study andresearch;
5) provide higher education and social services that arecompatible with the needs and development of thecountry;
6) lay down an institutional system that ensures theaccountability of the institutions;
7) ensure the participation of all those concerned bodiesin administration decision-making create andpromote participator culture;
8) made efforts to develop and disseminate the cultureof respect tolarance and living together among thepeople.
7. Autonomy of Institutions1) Subject to limitations provided by other laws, any
institution shall have administrative autonomy.2) Without prejudice to the provisions of Sub-article (1)
of this Article, any institution shall have autonomyIll:(a) administration of personnel including em-
ployment:(b) financial administration;(c) subject to approval by the appropriate body
determining internal organization.(d) establishing relations with local and inter-
national countrparts.3) Subject to limitations provided by other laws, any
institution shall have academic freedom.
8. Establishiment1) Public institution under the Ministry or the Federal
Government organ shall be established by theregulations of the Council of Ministers.
2) Any public institution under the Regional Govern-ment shall be established by the law to be enacted bythe Regional Council.
3) A private institution shall be established, as the casemay be, in accordance with laws of associations,cornrnerciallaw, cooperati ves or other relevant laws.
9. Education Programmes1) Higher education offered by any institution may be
in the following programmes;(a) regular;(b) continuing and/or,(c) distance education.

10. Language of Instruction
1) The medium of instruction in any instution, expect
language subjects, shall be English.2) Short-term training may be given in any appropriate
language.3) Notwithstanding the provisions of Sub-article (1) of
this Article education for the dumb and deaf may begiven in a sign language.
11. Fiscal year
1) The fiscal year of any institution shall be the fiscal
year of the Government.2) Notwithstanding the provisions of sub-article (1) of
this Artic;.leany private. institution may have its ownfisical year.
12. Information Exchange
1) There shall be a system facilitating exchange of
information between private and public, amongprivate institutions, and among public institutions aswell as among organs and units under any institution.
2) Any institution has the duty, upon request, to provide
a worker and student who undertake researchrelating to education with information or assist tohave acess thereto.
13. Content of a Curriculum
Higher education or training offered at any institutionshall be that which focus on experience and studentparticipation; that is practice-oriented; that take theobjective sitaution of the country into consideration,encourage independent thinking, reflect modem views;and that is problem-solving,.
14. Powers and Duties
Any institution shall have tne powers and duties to:1) develop progammes of study and provide higher
education;2) produce skilled manpowr in quantity and quality on
the basis of the needs of the country;3) undertake study and research and disseminate the
findings as may be necessary;4) provide appropriate services to the society;5) establish co-operation relations with different bodies
including higher education institutions;6) award different academic diplomas including de-
grees permitted to a given level;7) give recognition or award prizes to the persons of
outstanding achievements or constructive con-tributions;
8) provide support for primary and secondary
education institutions;9)- encourage the undertaking of study and reserarch in
the priority areas.

15. Studies and Research Directions
1) Any institution shall identify research areas to be
prioritized on the basis of the needs of the country
and in consultatiQn with appropriate bodies.2) Any institution shall undertake research that:-
. (a) takes into account the needs of the country and
enables to equip with scientific knowledge;(b) equips students and trainees with basic
know lege that enables them to undertakepractical studies and research.
16. Organization Necessary to Pursue Research
Particulars on the organization and management required
to conduct study and research activities shall be deter-mined by law establishing the institution or memoran-
dum of association of the institution; and any institution
shall have an organization that enables it to conduct joint
research projects with such other institutions or scientific
and research bodies as institutions.
17. Utilization of Research Funds
1) Any Institut~n shall allocate sufficient fund for
research and study it conducts and utilize it for thepurpose intended.
2) Without prejudice to the provisions of Sub-Article(1) of this Article, any institution may conduct
research in the areas prioritized using incomes from
non-public sources..
18. Status of a University
Any institution that shall be esatblished as a university
shall be granted the name and status' 'University" by theMinistry where it fulfills the following requirements:1) has intake capacity of at least 2000 students in a
regular programme;2) has a record of at least f01'r consecutive years in
graduating students in a degree programme after
being accredited as a univesity college, or college, or
institute;. 3) able to offer education and training in a degree level
and above programmes in different professions at
least at three"1aculties, colleges, schools or institutes;4) undertakes research in different approp'iate fields
and have research products published by the ins-titution; and have facilitated means of dissemination
of the research findings to the beneficiaries;5) has teaching matenals, classrooms, libraries,
laboratories and other service-rendering facilities
necessary and that match its standard:
6. fulfills the minimum requirements of standards setby the Ministry.
19. Requirements for the Status ofa University College
The name and status of any institution to be esatblished as
a University College shall be designated as "UIllversltyCollege" by the organ holding it as owner; and subject to
Sub - Articles (1), (4), (5) and (6) of Article 18 of this
Proclamation it shall:

professions and programmes at least at three facul-ties, colleges, or schools, or institutes.
20, Requirements for Status of College
The name and status of any institution to be establishedor upgraded as college or junior college shall bedesignated "College" or "junior College" by the organ,holding it as ownership, and subject to Sub-artciles (5)
and (6) of Article 18, it shall offer higher education atleast at one faculty in degree or diploma programmes.
21. Requirements for Status of Institute
The name status of any institution established as aninsitute shall be designated as "Institue" by the organholding it as ownership, and subject to Sub-article (5)
and (6) of Article 18 of this Proclamation, shall:1) be able to give education and training in at least one

special programme.2) have a capacity in such special programme to offer
education in degree in addition to diplomas leveleducation.
SECTION TWOStaff of Institutions
22. Staff of Institutions
Any institution shall have:1) academic staff:
2) technical support-giving staff; and3) administrative support-giving staff.
23, Academic Staff
1) Any instituion may have the following academic
staff:(a) Professors, ass,)ciate professors, assistant
professors, lecturers, asistant lecturers, and
graduate assistants employed for teaching andresearch; and
(b) other employees considered as academic staff
by the decision of the Senate or, as the case
may be, by the Academic Commission:2) Any institution may take tenure or job oppor-
tunities on permanent bases as proof of efficiency.
24. Joint Employment of Academic Staff
1) Notwithstanding the provlSlons of this
Proclamation and other laws, an academic workermay be employed and serve for two or more
governmental instituions, or for government and
private institution for two or more private ins-
titution or for an institution and government organ,or for an institution and any other person.

2) Without prejudice to the provisions of this
Proclamation and any other law, or directives orregulations issued pursuant to this Proclamation, theworking hours, leaves and other similar workingconditions of a jointly hired worker shall be deter-mined by the agreement of both employers,
3) A joint employing office shall allow its counterpart
to use a certain working time of the worker.4) Without prejudice to the provisions of Sub-Article
(2) of this Article, the Ministry shall issue specific
directives on joint employment and assignment ofthe academic staff.
25. Technical Support-giving StaffAny institution may have the following technicalsupport-giving staff:1) laboratory technicians;2) research assistants; and3) technical assistants,
26, Adminisfrative Support-giving StaffAny institution shall have administrative support-giving staff outside the academic staff and technicalsupport-giving staff.
27. Rights of Academic StaffWithout prejudice to the provisions of this Proclamationand other laws, an academic teacher of an institutionshall have the following rights:1) to exercise his rights provided by law;2) to make comments on the quality and ap-
propriateness of the teaching-learning process:3) to be entitled to promotion and fringe benefits after
having. fulfilled appropriate requirements;4) to be assigned to various positions of respon-
sibilities and entitled to get further education andtraining in accordance with the law;
5) not to be held liable for his personal views andbelief;
6) to render community and consultance services, and
be entitled to take research and sabbatical leaves toconduct research and studies beneficial to theinstitution and the country in accordance withinternal regulations of the institution.
28. Duties of Academic SaffWithout prejudice to the provisions of this Proclamationand other laws, an academic worker of an institutionshall have duty to:1) produce graduates who are cultivated in democratic
culture and are competent;2) devote himself to transmit or transfer his full
knowledge and skills to the students;3) Without prejudice to Sub-Articles (1) and (2) of
this Article, an acader.lic staff of an institution shaHhave the duty:(a) to teach and render services in accordance
with the internal regulations of the institution;(b) to undertake problem-solving studies and
researches beneficial to the country;(c) not to promote political partisanship, preach
religion, impose one's beliefs and views on thecommunity and students of the instit]..ltion atteaching places and in classrooms;

(d) to counsel, assit and guide the students in accor-dance with the objectives of the institution;
(e) to participate in the services provided by theinstitution and other appropriate services renderedfor the community as well as in other affairs;
(f) to work in teams and respect ideas of his studentsand colleagues;
(g) to provide appropriate assistance to students in needof special support in accordance with internalregulations of the institution;
(h) to formulate educational and research programmethat improves the ability of the staff as well asbenefits the institution;
(i) to devote his full energy and attention to theinstitution; and provide service for another ins-titution, as may be necessary, upon the request of theinstitution;
(j) to be evaluated for the services he renders by hiscolleagues, students and the institution;
(k) to participate in teaching, counseling and otherincome generating activities of the institution.
4. Additiqnal duties of an academic teacher shall bedetermined, as the case may be, by establishing lawor memorandum of association of the institution.
SECTION THREESTUDENTS OF THE INSTITUTION
29. Rights of the Students of an InstitutionWithout prejudice to the provisions of this Proclamation,establishing law or memO!andum of association of theinstitution or other relevant laws, any student of aninstitution shall have the rights to:1) learn, understand by inquiry and know;2) receive services from the institutions as provided by
law;3) utilize the properties of the institution properly;4) evaluate and give opinions about academic teachers.
Heads and workers in relation to education ortrainings, and other rights of students in the ins-titution;
5) be represented at appropriate administrative organsand committees of the institution; particulars ofwhich shall be determined by internal regulations ofthe institution;
6>- give suggestions in the preparation of internalregulations on the administrative affairs of theinstitution;
7) give suggestions in curriculum development,revision and implementation by the institution.
30. Duties of the Students of an Institution1) Without prejudice the provisions of this
Proclamation and other relevant laws, any student ofan institutions shall have the duties to:(a) be present during classes and attend them
properly;(b) respect other persons rights protected by law;(c) observe rules and regulations of the institution;(d) utilize and handle the properties of the ins-
titution properly;(e) refrain from unethical and unlawful activities:(f) effect payment of fees in accordance with the
provisions of this Proclamation for services thathave been provided by the institution.
2) The students shall be held liable under relevant lawfor any damage they cause to the property of theinstitutions.

31. Admission of Students
Without prejudice to the provisions of this Proclamationand other relevant laws regarding the requirements ofadmission of students, any institution with requiredlevel:1) shall admit, for undergraduate studies, students
who have completed Ethiopian high schooleducation or foreign high school education that hasequivalent level as determined by the Ministry, andthose who satisfy entrance qualifications assess-ment of the instituion;
2) shall admit, for post graduate studies, students whohave completed their undergraduate studies andsatisfy entrance qualifications assessment set by theinstitution;
3) special admission procedures, to be issued pursuantto the establishment regulations of the institution,may be set for adults and experienced students.
32. Assessment of Students
1) Any institution shall design an assessmentmechanism that enables it to evaluate the abilityand level of knowledge of its students.
2) The Methods of assessment designed in accordancewith Sub-Article (1) of this Article shall be basedon the content of course or training offered to thestudent.
3) The method of assessment shall be determined bythe instituion.
33. Special Support
1) Entry assessment or admission procedure designedfor any female, disabled student, a student who hascompleted high school education in a developingRegion arid who is native of the nationality of suchRegion or a student from the nationality whoseparticipation in Higher Education is low shall bedifferent from others. They shall, during their stayin the institution, get special support; particulars ofsuch support shall be determined by the Ministry.
2) Adult students of any institution shall be providedwith support; particulars of such support shall bedetermined by the Ministry.
3) Land shall be allocated for the establishment andservice of the higher education institutions inaccordance with applicable laws and policies.

SECTION ONETHE EXECUTIVE
34. Organization of public Institutions
J) 'N,[hout prejudice to the provisions of thisProclamation, any public institution shall have:(a) its own administrative boards (hereinafter
referred to as the "Board");(b) senate, or an academic commission, as the
case may be;(c) office and other necessary rooms for the

(a) colleges,(b) schools,(c) faculties, and/or(d) research institutes
3) Each faculty, college or school of the publicinstitution shall have an Academic Commission.The Academic Commission consists of a dean, vice-deans, head of departments, students' represen-tati ves, representati ves of the academic staff to beelected by general assembly of the academic staffand other heads whose number is to be determinedby the establishing law. The powers, duties andmeeting procedure ot the Academic Commissionshall be determined by the establishing law of the
.institution or the internal regulations of the Senate.
4) Each department under public institution shall have
a department assembly consisting of all full-timeacademic staff members of the department. Thepowers and procedures of the department assemblyshall be determined by the establishing law of theinstitution and the internal regulations of the Senate.
35. Powers and Duties of the BoardThe board shall be accountable to the Ministry or theappropriate organ of the Regional Government and itshall:1) be the head of the general administration of the
public institution;2) select candidates for the posts of heads and vice-
heads of the public institutions and present to thegovernment for appointment;
3) without prejudice to the applicability of otherrelevant laws, take disciplinary action against theHead of the public institution who fails to dischargehis academic duties or appropriates money of theinstitution; and present to the government for dismis-sal;
4) approve, without prejudice to the provisions of thisProclamation, organization, policies and internalregulations of the administration and programmes ofthe public institution and follow up their implemen-tation;
5) submit to the government action plan, budget andperformance reports presented to same by the Headof the public institution; and follow its implemen-tation up on approval.
6) designate an auditor to the public institution inaccordance with relevant law and determine servicepayment;
7) formulate policies regarding employment.promotion, discipline. salary, allowances, wage andother benefits of the public institution on the basis ofbasic principles of the Federal Civil Service;
8) require the Head of the public institution to submitfinancial statements of such institution, whenever itISnecessary;
9). adopt strategic and development plan of the publicinstitution;
10) ensure the implementation of the objectives of thepublic institutions; and control that the institutionhas carried out its acti vities on the basis of principlesof participation, transparency and accountability;

11) submit proposal, as may be necessary, to theMinistry for the amendment of the law establishingthe public institution;
12) examine and give final administrative decision ongrievances against the decision of the public ins-titution or a workers of its department; particularsshall be determined by internal regulations of theinstitution;
13) approve, as may be necessary, agreements that thepublic institution concludes with local and foreignhigher education institutions relating to education;
14) determine a sign or emblem of the public institution;15) issue its own meeting procedures and internal
regulations;16) approve a title of professorship;17) without prejudice to the provisions of this
Proclamation, determine different payments relatingto education and charged by the public institution;
18) cany Qut such other necessary activities whoseparticulars shall to be determined by the establishinglaw of the public institution to realize the objectivesof such institution.
36. Board Members1) The Board shall have a Chairperson designated by
the Ministry or by the appropriate organ of theRegional Government, as may be necessary, andother members whose number and bodies theyrepresent to be determined by the establishing law ofthe public institution.
2) Without prejudice to the provisions of Sub-Article(1) of this Article, the Board consists of represen-tatives from the Regional Government where thepublic institution is set up, representatives of thebeneficiaries of the products and services of theinstitution, notable personalities as well as membersfrom the management organs of the public ins-titution.
37. Powers and Duties of the Senate
The Senate shall be accountable to the Head of the publicinstitution, and shall, in addition to those given under theestablishing law, have powers and duties to:1) determine the academic calendar of the public
institution;2) cause the beginning of programmes and courses
deemed to be necessary at public institution;3) approve, upon the recommendation of any faculty,
studies leading to awards of diplomas and degrees,and determine conditions on which diplomas arerevoked or canceled;
4) award upon the recommedation of department.faculty or other appropriate organ, honorary degreeand other prizes related to education:
5) exmine and approve recommendations from theHeads of the public institution in respect of openingor merger of a college, institute, faculty or depart-ment under the public institution with other similarcollege, faculty, institute or department and theirclosure;
-6) award senior academic promotions belmv professor-ship;

7) determine type and amount of service charges other
than tuition fees charged by the government ins-titution;
8) prepare and submit to the Board the strategic anddevelopment plan of the public institution throughthe Head of such institution;
9) issue specific directives on the basis of law andpolicies drawn up by the Board particularly onstudent administration, academic matters, procedurefor selection of academic heads, employment ofacademic staff, promotion, fri!1ge benefit, disciplineand salary;
10) issue its own procedure of meetings and internalregulations;
11) perform such other appropriate duties given by theBoard;
38. Members of the Senate
The number of members and terms of office of theSenate shall be determim d by the establishing law ofthe public institution and it shall particularly consist of:1) the Head of the public institution Chairperson2) vice-head of the public institution member3) deans of the public institution faculties, if anymem- .
ber4) registrar of the public institution member5) head librarian of the public institution member6) dean of sutdents member7) two academic staff representatives member8) two student representatives memer9) representative of women's affairs of the institution
member10) other heads designated by the Board member

39. Appointment of Head and Vice-Heads of the PublicInstituion
1) The Head and Vice-heads of the public institutionshall be appointed by the Government upon recom-mendation of the Board.
2) The candidate Head and Vice-heads of the p.ublicinstitution shall have commendable academic andmanagerial ability;
3) particulars of requirements, conditions of, andprocedures during, competition for qualificationtobe the head of the public institution shall bedetermined by the law establishing the institution.
4) The number of Vice-heads of a public institutionshall be determined by the law establishing suchinstitution.
40. Powers and Duties of the Head of a Public Institution
The Head of public institution shall the Chief Executi veof the institution and, in addition to those powers andduties given by law establishing the institution, he shall:1) administer the public institution; prepare its inter-
nal orgnization structure, policies and internalregulations of the administration and submit to theBoard;
2) execute or cause to be executed policies anddirectives issued as well as decisions and ordersgiven by the Board or institution;

3) establish relationship with local and foreign highereducation institutions in consultation with ap-propriate organs where he finds it necessary for therealization of the objective of the institution, signagreements and implement agreements concluded;
4) prepare annual plan and budget of the institution andsubmit them to the Board and if necessary to theMinistry, and implement the same upon aproval
5) utilize the income of the institution to achieve theobjectives of the institution;
6) examine and decide on disciplinary cases of workes
and students of the instituton in accordance withdirectives issued by the Board;
7) prepare and submit quarterly and annual reports on
the activities of the institution as well as othernecessary reports to the Board and to the Ministry, ifit is necessary;
8) determine on and carry out the employment, ad-ministration, disciplinary measures, salary, subsidyand benefits of the non-academic staff in line withbasic principles of the Federal Civil Service law andpolicies drawn up by the Board;
9) prepare and submit to the Board the strategic anddevelopment plan of the public institution takinginto consideration the recommendations of theSenate;
10) represent the institution in all its dealings with thirdparties;
11) open and operate bank accounts in the name of theinstitution;
12) delegate, as may be necessary, its powers to otheremployees of the institution;
13) discharge such other duties necessary for theactivities as may be entrusted to him by the Board.
41. Powers and Duties of the Vice-heads of the Public.Institutions
The Vice-head of the public institution shall, in additionto those powers and duties given to him under theestablshing law of the institution:1) consult and .assist the Head regarding the powers
and duties of the institution;2) direct the activities of the institution on behalf of
the Head being substituted by the Vice-head ofeducation affairs;
3) carry out such other activities which may bespecifically entrusted to him by the Board, Senate
or the Head.
42. Term of Office of the Head and Vice-head
Without prejudice to the provisions of law establshingthe public institution, the term of office of the Head andVice-head of the institution shall be five years.
43. Autonomy of Organs of the Institution
1) Colleges, institutes, schools or departments under apublic institution shall have autonomy in adminis-tration, finance as well as in other affairs; par-ticulars shall be determined by law establshing theinstitution.

2) The organization and administration of the colleges,institutes, schools, faculties or departments under aninstitution, the appointment of their Heads and otheraffairs shall be determined by the law establshing theinstitution.
SECTION TWODIVISION OR MERGER OF A PUBLIC
INSTITUTION
44. Division or Merger of a Public Institution
1) The Ministry, where it finds it necessary for therealization of the objectives of the institution andon request of the Board or an appropriate organ ofRegional Government, in consulation with theAgency may decide:(a) division of a public institution into two or
more public institutions;(b) merger of a public institution with another
government or with private institution by theconsent of the institution.
2) The Board shall, prior to presenting the request formerger or division as provided for in Sub-article (1)of this Article, hold a discussion on the necessity ofdivision or merger with the Head and Vice-heads,staff, students as well as with other beneficiaryparties of the institution and submit the outcomes ofsuch discussion to the Ministry.
45. Publication of Notice
The Ministry shall:1) Notify in writing of the intended merger or division
to the concemed public or private institution;2) publish a notice about merger or division in the
newspaper that has wider circulation at the placewhere the head offices of the public or privatehigher education inst;tution concerning such mer-ger or division are found or at a national levelbefore 21 days of such merger
46. Transfer of Rights and Duties
1) Where a public institution is divided into two ormore institutions pursuant to Article 44 (1) (a) ofthis Proclamation, its rights and duties shall, exceptthose forfeited due to the division, transferred to thenewly formed institutions. The extent of rights andduties transferred from the previous to the newlyformed institutions shall be determined by theCouncil of Ministers or by the regulations of theRegional Government, as the case may be.
2) The rights and duties of the institutions merged in
accordance with Article 44 (1) (b) of thisProclamation shall be transferred to the new ins-titution.
3. The divided or merged public institutions shall losetheir juridical personality from the date of theestablishment of the new institutions by law.
47. Rights of Creditors
1) Subject to the provisions of other relevant laws, the.
creditor of a divided institution or merged ins-titutions shall be the creditor of the institutionsformed as a result of division or of an institutionformed a result or merger, as the case may be.

SECTION THREEINCOME GENERATING ENTERPRISE
AND INCOME FUND
48. Establishment
An Income Generating Institution (hereinafter referredto as the' 'Enterprise' '), may be established upon therequest of the institution and approval of the Boards inany public institution.
1) The initial capital necessary for running of theEnterprise may be a budget allocated by thegovernment.
2) Without prejudice to Sub-article (1) ofthis Article,the Enterprise may have the following sources ofmcome:(a) an income gererated internally from the
services it renders and activities it carnies out;(b) a countribution made willingly by the staff of
the Enterprise;(c) donations; and(d) other income sources. .
3) Unutilized yearly income of the Enterprise shall betransferred to the next fiscal year.
50. Matters to be Determined by Law
Such and other relevant issues as activities of theEnterprise, areas of engagement, the amounts of capitalrequired to achieve its objectives, guiding principles ofadministrative matters and keeping accounts shall bedetermined by the establishing law of the institution.
51. Financial Report
Reports of balance sheet and its additional parts as wellas other income and expenditure reports of the Enter-prise shall be submitted to the Board within 6 monthsfrom the end of the fiscal year of the Enterprise.
Utilization of the Enterprise's Fund
Incomes of the Enterprise shall be used to purchasebooks and equipment and its accessories necessary toimplement various projects, implement researchprojects, award prizes to professionals of the institutionfor their outstanding performance and cover costsnecessary to realize the objectives of the institution.

53. Income Fund
1) An Income Fund (hereinafter referred to as the
"Fund") may be set up in the public institution bythe decision of the Board or the Ministry.
2) The Fund and its incomes may be used for differentcapacity building activities ofthe institution, prizesand activities whose necessity is believed andapproved by the Board.
54. ~ources of Income of the Fund
The Fund shall have the following income sources:1) Contribution made by the Enterprise;

55. Matters to be Determined by Law
Such and other matters as powers and duties of theFund, powers and duties of its organs, powers of theExecutive to implement the objectives of the Fund shallbe determined by the law establishing the institution.
SECTION FOURMISCELLANEOUS PROVISIONS
56. Cost-Sharing
1) Any student who has graduated from highereducation of the public instituion is required toshare the cost of his education, training and otherservices on the basis of cost-sharing principle.
2) Payment of cost shall be effected in the form of taxpayable from the salary or other income obtainedafter graduation.
3) The execution of the principle of cost-sharing, theamount of tax payable, due date of payment, modeof payment for students who have not beenemployed and other relevant matters shall bedetermined by regulations of the Council of Minis-ters.
4) Mode of payment of the tax by a graduate who hasan obligation under Sub-article (2) of this Articleshall be determind by directives issued by theMinistry.
5) An employer of a graduate shall, for the purpose oftax provided under this Article, have the obligationand responsibilities of withholding agent under theIncome Tax Proclamation No. 286/2002.
57. Sources of Income and Utilization
1) The sources of income of a public instituion shallconsist of:(a) An annual block grant budget allocated by the
Government;(b) Subsideies made by the Government in cash
and kind;(c) Income generated from such services de-
livered by the institution as research, con-tinuing and distance education, consultancy,art and medical services as well as from sportsand such other activities of the institution;
(d) donations and different contributions;(e) Loans; and(f) Other income-sources.
2) The Regional Governments ,Woreda Councils orany other local administration may provide finan-cial or property assistance to a government ins-titution in the Region
3) The Regional'Governments, Woreda Councils orany other organs that provided support to theinstitutions pursunant to Sub-article (2) of thisArticle, may request appropriate services from theinstitution within limits of its capacity.
4) The public institution shall utilize the incomesobtained pursuant to Sub-article (1), (a), (b) and (e)in accordance with financiallaw.

5) Without prejudice to the provisions of Sub-article(4) of this Article, the institution may use incomes it
obtains in accordaince with the plan and programmeapproved by the Board of the institution and transferthe unutilized money to the next fiscal year.
6) Subject to the provisions of relevant laws, anygovernment institution may transfer, buy, lease, ormortgage its property as determined by its es-tablishing law.
58. Books of Accounts
Subject to the provisions of other laws, a publicinstitution shall keep the record of:1) any of its income, including the source thereof;2) its expenditure;3) an audited statement of income and expenditure,
and4) a balan~e sheet and cash flow statement.
59. Auditing
1) Any accounts and utilization of finance of the publicinstitution shall be audited by an auditor designatedby the Board.
2) The audit report shall be prepared and submitted tothe instimtion Board and Ministry by the auditor.
PART FOUR
PRIVATE INSTITUTIONS'
60. Accountability of Private Higher Education Institutions
1) Private higher education institutions shall be accoun-table to the appropriate organ as provided for in thememorandum of association.
2) Notwithstanding the provisions of Sub-Artcle (1) ofthis Article, private higher education institutionsshall be accountable to the Ministry for their perfor-mance as an institution of education.
3) Without prejudice to the generality of Sub-article (2)of this Article, private higher education institutionsshall submit the following to the Ministry.(a) annual reports;(b) education, training and research plans of the
institution;(c) report of the implementation of the education
policy and national plan every two years.4) The Ministry shall carry out periodic evaluation and
supervision as may be necessary.61. Requirement for Accreditation
. Any person who desires to establish, upgrade or modify a
private institution shall not render higher education orother services without first securing a pre-accreditationand accreditation permit from the Ministry in accordancewith this Proclamation.
62. An application for Pre-accreditation Certificate
1) Any person who desire to establish, upgrade ormodify an institution may submit an application for apre-accreditation permit to the Ministry with the
- appropriate documents.

2) An application submitted under Sub-article (1) ofthis Article shall contain;(a) proposed name, main address, field of study or
academic mission of the institution;(b) objectives of the institution;(c) financial capacity of the institution;(d) name and address of the body for whcih the
institution is accountable, and terms of ac-countability for ,he Heads of the institution;
(e) type of management by which the academicand administrative affairs of the institution areto be conducted;
(t) without prejudice to what is provided by law,
admission requirements for new students andacademic programmes of the institution;
(g) such and similar details of facilities and
services required for conducting education ortraining as libraries, laboratories, classrooms,educational and research facilities and themanner in whcih they are maintained;
(h) the number and standard of education of
academic staff, technical and administrati vesupport-giving staff that the institution shouldhave or has;
(i) financial capacity of the institution ensured bycertified auditor, financial administration andcontrol system of the institution;
U) a three-year plan of the instituion;(k) the name and address of the owners of the
institution;(I) trade, investment and other similar licenses
issued by the appropriate government organs.3. The application shall be sent to the Agency thorugh
the Ministry for evaluation and comment thereon.
63, Issuance of Pre-accreditation Permit
1) The Ministry shall issue pre-accreditation permitwithin 15 days upon the receipt of recommendationof the Agency ensuring that:(a) the educational materials stated by the ap-
plicant for pre-accreditation permit areavailable or are likely to be made available andthat the curriculum satisfies the requiredquality standards;
(b) the applicant has taken conceret measures thatenable to satisfy the requirements provided bylaw and stipulated by the Ministry as well asrealize the objectives of higher edcuation;
(c) the applicant has implemented or is able to
implement requirements stipulated by theMinistry in reliable manner.
2) The Ministry shall publicize the issuance of the pre-accreditation permit to the requesting institutionthrough nation-wide mass media.
3) The pre-accreditation service permit issued by theMinistry shall be valid for one year from the date ofits issuance.
64. Content of the pre-accreditation Permit
The pre-accreditation permit issued in accordance withthis Proclamation shall at least include the following.1) Name and address of the registred institutions;

2) the status and programme of the institution;3) date of issuance and validity period;4) name and signature of the'official issuing the permit
and the seal of the Ministry.
65. Rejeaion of the Issuance of Pre-accreditation Permit
1) The Ministry shall not issue the pre-accreditationpermit where if finds from the report of the Agencythat the institution of the applicant has not metrequirements necessary to provide higher edcuationand other services.
2) The Ministry shall notify to the applicant in writingthe grounds for the rejection of the request for thepermit submitted to it in accordance with Sub-article(1) of this Article.
3) The institution that is denied of the permit underSub-article (1) of this Aricle, may reapply fulfillingthe requirements for pre-accreditaiton permit within90 days from the date of notification of such denial.
4) The Ministry shall make public the final decision onthe rejection of permit through mass media that havenation-wide circulation.
5) Any education credentials awarded by an institutiondenied of pre-accreditation permit shall be invalid.
66. Application for Grant of accreditation
1) A private institution holding a pre-accreditationpermit for a year or having no a pre-accreditationpermit may apply to the Ministry for the grant ofsuch accreditation.
2) An application sumbitted pursuant to Sub-article (1)of this Article shall contain:(a) all information available during submission of
application for pre-accreditation permit:(b) memorandum of association registered by
appropriate organ where it is a private ins-titution;
(c) name and education standard of permanentacademic staff, technical and administrativesupport giving staff of the institution;
(d) a list of students that have been enrolled eachyear in each filed of study offered by theinstitution;
(e) list of facilities and teaching aids necessary foreach progrmme offered by the instituion;
(f) amounts of money available for the realizationof the objectives of the institution and ensuredby a certified auditor;
(g) facilities necessary for the institution,including land and buildings;
(h) names and addresses of the owners of theinstitution.
3) The Ministry shall send the application to theAgency for appropriate actions within three workingdays.
67. Recomendations for Accreditation.
1. Where the Agency receives an application foraccreditation from the Ministry, it shall evaluate theactivities, performance and the measures taken by theinstitution to implement its objectives and fulfil therequirements stipulated by the.Ministry, and where itfinds that the institution has satisfied therequirements, it, through the assessment committeeestablished, shall.

(a) verify the report;
(b) evaluate the academic and administrative status
of the instituion;(c) verify the application submitted pursuant to
Article 66 of this Proclamation.2) The Agency receiving the report of the assessment
committee shall, within 3-month period, submit
recommendations to the ministry.(a) for the issuance of accreditation where it finds
that the requirements set by law and the
Ministry have been met by the ins[itution;(b) for the denial of accreditation stating clearly
in detail defects, gaps and measures to be taken,
where it finds that the requirements prescribedby law and the Ministry have not been met.
68. Issuance of Accreditation Permit and Date of Validity1) The Ministry shall, upon receiving the recommen-
dations of the Agency and after ensuring that the
institution has met the requirements, issue
accreditation within 10 working days from the date
of its receipt.2) The accreditation certificate issued by the Ministry
shall serve only for the purpose it is issued for three
years.
69. Contents of the Accreditation
The accreditation certificate issued by the Ministry shall
indicate the status, institutional and programme con-
ditions, in addition to other matters to be determined by
the Minisry. .
70. Effects of the Accreditation
Diplomas awarded by institutions with an accreditadon
permit shall have equal privileges and honour.
71. Renewal of Accreditation Permit1) Any accreditation permit shall be renewed every
three years before the beginning of academic year.2) The Ministry shall renew the accreditation permit
after ensuring that the institution has satisfied the
requirements stipulated by law and the Ministry.
3) Where the Ministry rejects a request for the renewal
of the accreditation, it shall notify to the institution
the grounds for the decision within 15 working days.
72. Charges for Accreditation Permit
Charges made by any institution for the issuance and
renewal of accreditation as well as for the promotion and
upgrading of the institution in accordance with law shall
be determind by regulations to be issued by the Council
of Ministers.
73. Issuance of a Substitute Accreditation Permit1) Any private institution may apply to the Ministry for
a substitute accreditation permit where its ac-
creditation permit is lost or damaged.2) The Ministry shall issue a substitute accreditation
permit in place of lost or damaged certificate upon
the receipt of application pursuant to Sub-Article(1) of this Article.

3) The private institution whose accreditation cer-
tificate is damaged or lost shall submit statement ofjustification for the damage or loss of the ac-creditation permit signed personally.
4) The Ministry shall issue a substitute accreditation
permit after having received appropriate statementand published such request in a newspaper having anation-wide circulation.
74. Rejection of Accreditation
1) The Ministry shall not issue an accreditation permit
where the requesting institution does not satisfy therequirements stipulated by law and the Ministry foroffering higher educaticm services.
2) The Ministry shall notify to the requesting institution
in writing grounds for rejection of such request.3) An institution denied of accreditation pursuant to
Sub-Article (1) of this Article, shall reapply to theMinistry where it satisfies the requirements.
4) The Ministry shall announce the final decision of the
denial ofaccreditation permit using mass media thathave a nation-wide circulation.
S) Any diploma awarded by an institution without an
accreditation permit shall be invalid.6) Any institution denied of accreditation permit shall
take appropriate measures that the students ortrainees it admitted continue their education ortraining at other appropriate institutions.
75. Cancellation of Accreditation Permit
1) Any accreditation permit shall be cancelled on the
following grounds:(a) Where the Agency or the Board ensures that the
accreditation permit was issued on the produc-tion of false document;
(b) Where the in;titution contravenes the
provisions of this Proclamation or any otherrelevant law;
(c) Where the institution dissolves in accordance
with any relevant law(d) Where the institution fails to rectify defects
within the time fixed in the warning giveen bythe Ministry to it for the failure to satisfy thereuirements provided for by law, or for con-travening directives issued by the Ministrypursuant to Regulations of the Council ofMinisters.
2) The cancellation of accreditation permit pursuant to
Sub-Article (1) of this Article shall be effective afterthe completion of the undergoing activities of theinstitution. However, if the institution cannot carryon such activities, it shall take appropriate measuresthat the students and trainees continue their studies atother appropriate institutions.
3) Without prejudice to the provisions of relevant laws
and Sub-Article (2) of this Article, the institutionwhose accreditation permit;is cancelled Sh'l'j notengage in new training programmes transaction.

76. Returing Accreditation Permit
1) An institution whose accreditation is cancelled in
accordance with this Proclamation shall return theaccreditation permit to the Ministry within 15 days.
2) Any institution s~all return the previous permit to the
Ministry in order to get a new accreditation permit
due to the upgrading or changing its level or merger.
77. Applicability of the Provisions of this Part
The provisions concerning accreditation of private ins-titutions in this part shall mutatis mutandis be applicable
to the accreditation of public institutions.
PART FIVEESTABLISHMENT OF THE EXECUTIVE
SECTION ONEEDUCATION RELEVANCE AND QUALITY AGENCY
78. Establishment
1) There is hereby established Education Relevance
and Quality Follow-up Agency (hereinafter referredto as the" Agency") as an autonomous organ havingits own legal personality.
2) The Agency shall be accountable to the Ministry.
79. Organization
1) The Agency shall have:(a) an Administrative Board (hereinafter referred
to as the "Board of Agency").(b) an office directed by a director; and(c) staff necessary for its activities.
2) The Agency shall have it~ Head Office in Addis
Ababa and may have branches in the Regions as maybe necessary.
80. Objectives
The objective ofthe Agency is to supervise the relevanceand quality of higher education offered by any ins-titution.
81. Powers and Duties of the Board of Agency
The Board of Agency shall:1) approve the budget and work plan of the Agency
submitted by the Director, and submit it to theGovernment, as may be necessary;
2) hear the annual report of the activities of the
institutions submitted to same by the Director, andgive directives when it finds it necessary;
3) formulate policies on the appropriateness andquality of higher education and implement sameupon approval by the Government;
4) submit to the Ministry draft policy proposal to
determine fee to be charged by the Agency;5) issue its meeting procedure and internal
regulations.
82. Powers and Duties of the Agency
The Agency shall:1) determine the salary and other benefits of its staff
upon approval of the Government;

2) ensure that higher education and trainings offered
at any institution are up to standard, relevant and
have quality;
3) ensure that higher education and training offered at
any institution are in line with economic, social
and other appropriate policies of the country;
4) issue directi ves which determine the powers and
duties of accrediation permit evaluation commit-
tees;
5) examine the application submitted to the Ministry
for pre-accreditation permit, accreditation permit
and renewal of accreditation permit in accordance
with this Proclamation and other relevant laws, and
submit its recommendations thereon to the Minis-
try within three months;
6) request when necessary, information and
opinions from appropriate organs to examine
pre-accreditation applications;7) evaluate the institutions at least once every five
years with a view to ensuring whether such
institutions are upto standard and competent, and
submit its findings to the Ministry;
8) prepare and submit to the Minister requirements
and directives that enable to determine the status of
the institutions;
9) supervise the standards and competence of the
institution; and consult the Ministry in respect of
merger or division of an instition in accordance
wih Art. 44 of this Proclamation;
10) evaluate activity or performance report of an
institution with pre-accreditation permit; and give
order to the institution upon examining and finding
that such institution has satisfied that reuirements
stipulated by law and the Minister to achieve its
objective; and submit its recommendations to the
Ministry;
11) give information to the public about the current
situation and status of the institutions periodically;
12) gather and disseminate information about the
standards and programmes of study offered by
foreign higher education institutions as well as
about their general status;
13) submit evaluation report of service fees of the
institutions to the Ministry; and submit draft policy
proposal to the Ministry in respect of fees charged
and the execution by the private institutions;
14) evaluate the relevance and quality of the ins-
titutions and their programmes as well as
qualification for accreditation on receiving service
charges.

83. Powers and Duties of the Director
The Director of the Office shall be appointed by the
Government and shall:1) direct and administer the Agency as a Chief
Exectutive of it;2) Without prejudice to the provisions of Sub-article
(1) of this Article, the Director shall:'\
(a) execute the powers and duties of the Agency
provided by law;(b) employ and administer personnel necessary
for the activities of the Agency in accordancewith relevant law;
(c) represent the Agency in all its dealings with
third parties in .accordance with relevant laws
and the directives issued by the Board;(d) de~egate his powers and duties to the em-
ployees of the Agency if he finds it necessary-for the functions of the Agency;
(e) prepare and submit to the Board the annual
.plan and budget of the Agency, and implement
same upon approval;(f) organize the office;(g) submit to the Board of Agency the annual
report on the activites of the institutions;(h) establish relationship with foreign higher
education institutions in.cooperation with
appropriate organs; and make every necessary
thing so that the indigenous institutions will
b~nefit from such relationship;(i) keep the books of accounts of the Agency;
U) discharge such other duties necessary for theimplementation of the objectives of theAgency as may be entrusted to him by the
Ministry or Board of P.gency.
84. Members of the Board of Agency
The Board of Agency shall consist of the following
members:1) Representative of the Ministry
of Education ... Chairperson2) Two representatives from the association
of government institutions member3) Two representatives from the association
of private institutions member4) Two representatives from the Ethiopian
Chamber of Commerce member5) Other three notable educationalist
assigned by the Ministry member6) The Director of the Agency member and secretary
85. Sources of Income
1) the sources of income of the Agency shall be,
(a) annual budget to be allocated by the Govern-
ment;(b) fund collected as provided by law and from
service charges of the Agency; or(c) donations.

2) The Agency shall utilize its income generated in
accordance with this Proclamation for implemen-
ting its powers and duties given to it by law.
SECTION TWO
HIGHER EDUCA nON STRA TEGY CENTER
86. Establishment
1) A higher Education Strategy Center (hereinafter
referred to as the' 'Center") is herehy estahlished as
an autonomous organ having its own legal
peronality.
2) The Center shall be accountable to the Ministry.
87. Objective
The objective of the Center is to formulating vision and
strategy in order to make higher education compatible
with the country's manpower needs as well as with
appropriate polices and with due consideration to global
situations, and advise the Government on such matters.
88. Organizational Structure
1) The Center shall have:
(a) an administrative board (hereinafter referred
to as the' 'Board of the Center")
(b) office of the Center directed by the Director,
and
(c) the necessary staff.
2) the Center shall have its Head Office in Addis Ababa
and may have branches in the Regions, as may be
necessary.
89. Powers and Duties ofthe Center
The Center shall have the powers and duties to:
1) formulate strategies that will enable the guidelines
of the higher education to be successful and com-
patible with current domestic and international
changes;
2) guide the reform guideline carried out in the higher
education sector;
3) formulate strategy that enables higher education to
address the needs of the country;
4) formulate long-term higher education strategy in
line with the development plan of the Government;
5) conduct research and studies on current policies,
practices, education and training matters and
propose viable alternatives and serve as a resource
center for reform activities;
6) give opinion of reform on the higher education
strategy and plan of the country.
7) determine the salary and benefits of staff, upon
approval by the Government.

The Board of the Center shall:

3) examine policy and strategic studies necessary to
improve higher education when presented to it by
the Director of the Center, and implement them
upon approval by the Government;
4) examine such other studies conducted on higher
education and submitted to it by the Director, and
implement them upon approval by the Government;
5) determine its own meeting procedures by internal
regulations;
6) discharge such other duties as may be entrusted to it
by the Ministry'

by directives issued by the Ministry.

94. Powers and Duties of the Ministry
The Ministry shall:
1) issue pre-accreditation and accreditation permits to
institutions in accordance with law; prepare draft
regulations or proposal about the permit service
charge and submit same to the Council of Minis-
ters;
2) ensure that the curriculum of higher education is
prepared in accordance with the standards required;
3) ensure that the admission of students to higher
education is camied out in accordance with the
requirements stipulated;
4) facilitate conditions to establish education and
research cooperation among the institutions;
5) devise means and ways of resolving administrative
and financial problems that any institutions face
with the support of the Board of the Center;
6) ensure the implementation of the education policy
and the plan higher en.ucation;
7) conduct studies to meet the needs of skilled
manpower of the country;
8) determine the equivalence of education tes-
timonials issued to students or trained students or
trainees by the institutions of other countries;
9) in co--operation with other organs, provide profes-
sional support for the investors to participate in
education sector;
10) without prejudice to the provisions of this
Proclamation, determine the requirements to be
qualified as a university, university college, college
and institute;
11) without prejudice to the provisions of this
Proclamation, any institution determine the
requirements for the programmes of diploma, first
degree, second degree, medical specialty or third
degree;
12) facilitate conditions to create information exchange
between institutions;
13) issue directives 10 respect of minImum
measurement of standards, duration of program-
mes, principles of comparision and training
coverage based on recommendations of the
Agency;

14) supervise, as may be necessary, periodically the
activities of the institutions on the basis of their
plans of education and training as well as reports
on their activities submitted to it periodically; and
take a necessary action in accordance with this
Proclamation;
15) ensure that there are performance follow-up
regulation and code of ethics for teachers and
students of the institutions:
16) prepare draft regulations of finance administration
and utilization of the government institutions and
submit same to the Council of Ministers;
17) encourage government organs, non-profit making
associations, business associations, students and
workers of the institutions, and any other ap-
propriate person to work jointly on the matters
concerning educa~ion, training, research, practical
work, initiation and dissemination of technology;
particulars shall be determined by directives;---
PART SIX
MISCELLANEOUS PROVISIONS
95. Liability
1) Any institution or person who fails to comply with
the provisions of this Proclamation and other
relevant law shall 'be civilly and criminally liable.
2) Any person who, without having acquired ac-
credited diploma, presents forged diplomas or any
institution or person who issues diplomas for
programme which is not accredited shall be held
liable civilly and criminally.
96. Obligation to Co-operate
1) Any person has obligation to cooperate for the
implementation of this Proclamation.
2) Without prejudice to the provisions of Sub-article
(1) ofthis Article, any person has obligation to give
information required for education and reserarch
purposes or cooperate for practical trainings.
97. Applicable Laws
I) Any laws establishing public institutions before the
coming into force of this Proclamation shall be
applicable so far as they are consistent with this
Proclamation and are not replaced by other law.
2) A pre-accredition permit or accreditation permit
issued before the application of this Proclamation
. shall be deemed to have been issued in accordance
with this Proclamation.

98. Inapplicable Laws
Any law or practice inconsistent with the provisions of
this Proclamation shall be inapplicable with regard to
matters provided for in this Proclamation.

100. Effective Date
This Proclamation shall enter into force on the date of its
publication in the Negarit Gazeta.
