A CONTRACT IS. . .It is an agreement which creates

and obligation. It is an agreement with sufficient consideration to do or not to do a particular thing.

It is the meeting of minds between two persons whereby one binds himself with respect to the other, to give something or to render some service.

REQUISITES OF A CONTRACT1.Consent of the contracting

parties.2.Object certain which is the subject

matter of the contract.3.Cause of the obligation. (The cause means the consideration of the contract which induces a contracting party to enter into the contract. Consideration is something given in return for a promise.)

KINDS OF CONTRACT1.Express Contract – the agreement

is formal & stated either verbally or in writing. It is a contract wherein the terms of agreement are declared by the parties in writing or verbally at the time it is entered into.

B. Informal Contract – It is not required by law to be in written form.EXAMPLE. . .An agreement to have a party.

2.Implied Contract – a contract wherein the agreement in fact is presumed or inferred from the acts of the party. It may also arise from mere consent of the parties, such contract is valid and enforceable. It is the contract wherein the agreement is made indirectly through the actions of the contracting parties.

A form of an implied contract is an implied warranty provided automatically by law. An implied warranty means that when a product is purchased, it is guaranteed to work for its ordinary purpose. For example, a refrigerator is fit to keep food cool.

control the disposition of one’s property to the effect after his death.

Testator – a person who died leaving a will.

Heir – a person who inherits property. Witness – one who testifies in the

making of the will. Holographic Will – a will which is

entirely written, dated, & signed by the hand of the testator himself.

WHO MAY MAKE A WILL?All persons who are not expressly

prohibited by law.

WHO ARE DISQUALIFIED TO MAKE A WILL?Persons of either

sex under 18 years of age cannot make a will.

ACKNOWLEDGEMENT OF WILL

Every will must be acknowledged before a notary public by the testator and the witnesses. If the testator is deaf, or deaf-mute, he must personally read the will if able to do so, otherwise he shall designate two persons to read it and communicate to him in some practical manner the contents thereof. If the testator is blind, the will shall be read to him twice, one by one of the subscripting witness and again by the notary public before whom the will is acknowledged.

WITNESS TO THE WILLAny person of sound mind of 18 years

old and more, not blind, deaf, or dumb and able to read and write, may witness the execution of the will.

Any person not domiciled in the Philippines & those who have been convicted of falsification of document, perjury or false testimony are disqualified from being witness to the will.
