EXPRESSION OF INTEREST

setting up of M-sand units
Notice is hereby given inviting applications from eligible applicants to lease out the right
of quarrying of minerals from the identified feasible areas for a period of 10 years and may be
extended for another 10 years from the date of execution of the lease deed at the sole discretion of
the Granting Authority. The right of quarrying will be given through e-auction process. The details
of areas proposed for EoI are given below:-

Terms and conditions, time lines for participation in the EoI are provided in the document.
Those who are interested and eligible can participate in the EoI, only after online purchase of the
tender document on payment of a non-refundable EoI fee of INR 5,000/- per lease. After online
payment of the EoI fee, the applicant shall send a copy of the receipt to [email protected] for
acknowledgment of the same.
Last last date for submission of the applications is 16.00 Hours IST on 30.04.2016. Any
further communications, amendments etc. shall be available on the website of Directorate of Mines
and Geology: www.mines.ap.gov.in. The DMG reserves the right to:
(i) Reject any or all applications without assigning any reasons whatsoever,
(ii) Reschedule/postpone the submission date(s) due to any unforeseen
circumstances at any stage of the EoI process.
(iii) Cancel the EoI notification without assigning any reasons whatsoever.

1. INTRODUCTION
1.1 The Government of Andhra Pradesh has introduced M-Sand policy as per G.O. No. 38
dated 17.03.2016 and amendments made thereunder with a view to conduct auction of the
identified leases in the state of Andhra Pradesh.
1.2 DMG will identify the areas suited for setting up of M-sand units, fix the boundaries with
geo-coordinates of the identified lease area.
1.3 Existing lease holders who own crushers or not, are also invited to participate in the EoI
if they are interested in setting up of M-sand units.
1.4 Applicant can also identify any mineral bearing area apart from the list provided in the
EoI and propose for setting up of M-sand units.
1.5 Existing M-sand unit holders are also invited to participate in the EoI and select for the
leases they are interested in.
1.6 The incentives provided in the M-sand policy will be applicable for the units established
within the state of Andhra Pradesh.
1.7 The Request for Proposal (RFP)/ Notice Inviting Tender (NIT) will be issued for auction
of the identified leases using an online electronic platform through MSTC.
2. EXPLOITAITON OF MINERAL BEARING AREAS
2.1 The identified leases will be auctioned for a period of 10 years and may be extended for
another 10 years from the date of execution of the lease deed at the sole discretion of the
Granting Authority at the second stage, that is, RFP stage.
2.2 The proposed M-sand unit capacity should be preferably more than 200 TPH. The installed
plant can be considered against maximum of 50 Ha Lease extent. If the applicant is
interested in more lease extent, the minimum capacity (TPH) of the M-sand unit to be
installed should be in that proportion, that is, 4 times of the lease extent in Ha. The
production of M-sand has to be done in minimum three stages like-
a) Primary crushing
b) Secondary crushing and
c) Vertical shaft impacting
However the lessee may establish a modernized plant with latest equipments/ technology
involving the above stages.

2.3 The successful tenderer shall start the mineral production from quarries within a period of
nine months and M-sand production within a period of one year from the date of executing
the lease deed. The lease deed will be terminated and security deposit shall be forfeited if
fails to comply the same. However the tender inviting authority may extend the above
period for another three months (twice) for the reasons to his satisfaction, where the lessee
is not at fault for such delay.
2.4 The lessee should produce at least 75% of annual mineral production as per approved
quarrying plan and Environment clearance. The lessee failing to produce the minimum
assured quantity is liable for payment of royalty for such shortfall quantity.
2.5 If the depth of the mining exceeds six meters then section 2 & 3 of the Mines Act, 1952
shall be complied with by the lessee.

4. INTENT/ PURPOSE
4.1 Government of Andhra Pradesh wishes to promote establishment of M-sand units within
the State through auction of the selected Mineral bearing leases. Applicants at their option
may submit their EOIs for one or more of the leases, details of which are provided in the
document.
Applicant can also identify any mineral bearing area apart from the list provided in the EoI
and propose for setting up of M-sand units. Applicants can apply only as a single entity
and not as a consortium.
4.2 In case of an Applicant applying for more than one location/ lease, they should indicate
their location preference. However, the auction of the mining leases will be at the sole
discretion of DMG.
4.3 An Applicant must submit its EOI keeping in view the establishment of M-sand units and
production of M-sand as per the G.O. No. 38 dated 17.03.2016 and amendments made

thereunder.
5. INVITATION FOR EXPRESSION OF INTEREST (EOI)
5.1 Expression of Interest (EOI) is invited from the interested parties having adequate
experience, expertise, technology and financial capabilities, for the Development of
Mineral bearing leases for setting up of M-sand units, covering exploration & mining,
crusher plants for the minerals and segregation of M-sand.
6. SUBMISSION OF EXPRESSION OF INTEREST (EOI) DOCUMENTS
6.1 The EOI in the prescribed format along with the Demand Draft or Remittance Slip towards
EOI Fee (as indicated in Annexure I) in a sealed cover duly captioned as “EOI for setting
up of M-sand units”, shall be submitted either in person or by post, on or before the last
date of submission as per the EOI.
6.2 The EOIs shall be opened at 1700 hrs IST on the same day in the presence of the
representative of the Applicants, provided such person representing the Applicant produces
a letter of authorization.
6.3 EOIs received after the scheduled time shall be rejected and if received by post will be
returned.
6.4 The EOI should contain a covering letter, signed by the authorized signatory of the
Applicant as well as the other information required, as per the formats given in this EOI
document.
6.5 Applicants shall attach relevant documents/brochures/corporate literature in as part of their
EOI. EOIs without the required information or enclosures are liable to be rejected.
6.6 DMG, Andhra Pradesh reserves the right to reject any or all the EOIs received, without
assigning any reason thereof. DMG also reserves the right to amend/ modify the contents
of the Notification or withdraw or cancel the whole process including the issue of Request
for Proposal (RFP).
6.7 DMG reserves the right to evaluate the EoIs received on such criteria, as it may consider
appropriate and fit for shortlisting of Applicants for issue of the RFP. The decision of DMG
in this regard is final and binding on the Applicants.
6.8 DMG reserves the right to issue RFP to the shortlisted Applicants and/or issue a fresh
advertisement for RFP as it deems fit in the given circumstances. No Applicant submitting
the EOI shall have any right to question the methodology adopted by DMG and its decision
would be final.

6.9 Mere submission of EOI does not vest any right in the Applicant for being shortlisted.
7. EOI EVALUATION CRITERIA
The evaluation criteria of EOIs for short listing of applicants for is as below:
7.1 The Applicant has to provide the details of Stone Crusher/M-sand units held by the
applicant or proposed units with copies of necessary license/consent and permission
documents.
7.2 The Applicant having experience of successful planning and implementation of similar
quarrying, crushing and screening operations in India shall be preferred. The experience
certificate certified by Statutory Auditor must be enclosed.
7.3 The Applicant shall be an Indian National or an Indian company as defined in clause (20)
of section 2 of the Companies Act, 2013 (18 of 2013).
7.4 The Applicant shall be an Indian registered Income Tax assesse Individual/ Firm/
Company with a positive Net Worth of not less than Rs. 1.00 Crore at the end of the year
excluding this year i.e. as on 31.03.2015
7.5 If same applicant is participating in more than one lease area, the applicant shall satisfy the
eligibility criteria individually and cumulatively. For example for one lease net worth is
Rs.1.00 Crores and for 2 leases, the net worth has to be 2.00 crores if he applies for 2
leases. If this is not met and only one of the lease eligibility criteria is satisfied then the
application will be considered only against one of the leases applied at the discretion of the
tendering authority.
7.6 The applicant shall disclose all the leases for major and minor minerals held by the
applicant in the state of AP as on the date of the EoI and shall not be in arrears of mineral
revenue to the state government
7.7 The Applicant shall provide a declaration stating that no criminal cases are booked against
the bidder.
Explanation:
a) The net worth shall be the sum of paid up share capital and the free Reserves as
per the audited Balance Sheet of the immediately preceding financial year viz.
2014-15 for a Company.
b) The net worth for an Indian National will include bank deposits, national saving
certificates, post office deposits, valuation certificate of the assets issued by a
Chartered Accountant.

c) The Applicant shall provide the following documents for adherence to 7.3 and 7.4
Copies of IT returns for last three years along with copy of PAN card and
Aadhar.
A notarized affidavit on Rs 100 NJS paper declaring the leases for major and
minor minerals held by the bidder in the state of AP and no mineral revenue
dues to the Government of AP.
A notarized affidavit on Rs 100 NJS paper declaring that no criminal cases are
booked against the bidder.
8. IMPORTANT TERMS AND CONDITIONS
8.1 Any company or partnership firm, registered in India, may participate in the EOI.
8.2 All costs in relation to preparation and submission of the EOIs, including costs incurred on
site visit, attending pre-bid conference, making presentation to the technical committee and
other costs associated with EOI submission shall be borne by the Applicant.
8.3 The RFP will be issued post the EOI evaluation stage. While the RFP will contain all the
details required for submission, evaluation and other terms and conditions for selection,
the Applicants are requested to note that the terms and conditions of RFP, inter-alia,
include:
a. The selected bidder will undertake exploration and quarrying and/or setting up of
crusher units for producing M-sand.
b. All the required fees, costs and expenses towards executing mining leases shall be
borne by the selected bidder.
c. The selected bidder shall bear all the costs for preparation of mining plans, EC, etc. if
any.
d. All the Central and State Acts, Rules and relevant policies for setting up the plants,
operation and marketing including Andhra Pradesh (Mineral Rights) Tax Act, 1975
(A.P. Act 14 of 1975), Andhra Pradesh Minor Mineral Concession Rules, 1966 and
The Andhra Pradesh (Andhra Area) District Boards Act, 1920 etc. and amendments
thereunder, shall apply.
9. OTHER INFORMATION
9.1 Applicants shall bear their own cost for attending the site visits.
9.2 DMG will organize a pre-bid conference as per the schedule. Details of the pre-bid

conference will intimated separately.
9.3 The EOI Fee for participating in the EOI shall be payable in the form of online remittance
to the account of DMG – the details of the same are provided in Annexure I. The same
should be received in the accounts before 1600 hrs on the last date of submission of EOIs.
9.4 The EOI shall be submitted in hard copy in a sealed envelope/cover, which shall be
captioned as “EoI for setting up of M-sand units” and also have the full communication
details of the Applicant, including email and mobile phone number of the authorized
contact person of the Applicant for this EOI.
9.5 It is hereby clarified that this request for EOI is only an attempt to reach out to the investors
who are interested in setting up of M-sand units or having similar mining experience. Only
such individuals/ organizations willing to explore the possibilities setting up M-sand
units in AP are requested to submit their EOIs and by no means this EOI or its
contents shall be construed to mean an offer with binding terms.

Fraud and Corrupt Practices
The Applicants and their respective officers, employees, agents and advisers shall observe the
highest standard of ethics during the EOI process and subsequent processed. Notwithstanding
anything to the contrary contained herein, DMG may reject an EOI, or disqualify an Applicant
without being liable in any manner whatsoever to the Applicant if it determines that the Applicant
has, directly or indirectly or through an agent, engaged in corrupt practice, fraudulent practice,
coercive practice, undesirable practice or restrictive practice during the EOI or subsequent process.
Without prejudice to the rights of DMG hereinabove, if an Applicant is found by the DMG to have
directly or indirectly or through an agent, engaged or indulged in any corrupt practice, fraudulent
practice, coercive practice, undesirable practice or restrictive practice during the EOI or
subsequent process, such an Applicant shall not be eligible to participate in any EOI/ tender/ RfP
issued by DMG during a period of 2 (two) years from the date when such Applicant is found by
DMG to have directly or indirectly or through an agent, engaged or indulged in any corrupt
practice, fraudulent practice, coercive practice, undesirable practice or restrictive practices, as the
case may be.
For the purposes of the above clause, the following terms shall have the meaning hereinafter
respectively assigned to them:
a) “corrupt practice” means (i) the offering, giving, receiving, or soliciting, directly
or indirectly, of anything of value to influence the actions of any person connected with
the EOI process (for avoidance of doubt, offering of employment to or employing or
engaging in any manner whatsoever, directly or indirectly, any official of DMG/
Government of Andhra Pradesh who is or has been associated in any manner, directly or
indirectly with the EOI process or has dealt with matters concerning the EOI or arising
therefrom, before or after the execution thereof, at any time prior to the expiry of 1 (one)
year from the date such official resigns or retires from or otherwise ceases to be in the
service of DMG/ Government of Andhra Pradesh, shall be deemed to constitute
influencing the actions of a person connected with the EOI process);
b) “fraudulent practice” means a misrepresentation or omission of facts or suppression of
facts or disclosure of incomplete facts, in order to influence the bidding process;
c) “coercive practice” means impairing or harming, or threatening to impair or harm, directly
or indirectly, any person or property to influence any person’s participation or action in
the bidding process;
d) “undesirable practice” means (i) establishing contact with any person connected with or
employed or engaged by DMG or the Government of Andhra Pradesh with the objective
of canvassing, lobbying or in any manner influencing or attempting to influence the EOI
process; or (ii) having a Conflict of Interest; and
e) “restrictive practice” means forming a cartel or arriving at any understanding or
arrangement among Applicants with the objective of restricting or manipulating a full and
fair competition in the EOI and subsequent process.
