Travel representsthePrincipalasagentsonlyandaccordinglyacceptsnoliabilityforanyloss,damage,injuryordeathwhich any

ClientmaysufferasaresultofanyactoromissiononthepartoforthefailureofthePrincipaltofulfillitsobligations,whetherin

relationtotravelarrangements,accommodationorotherwise.ThecontractinusebythePrincipal(whichisoftenconstituted by

the ticket issued b the Princi al shall constitute the sole contract between the Princi al and the Client and an ri ht of

recoursetheClientmayhave,willbesolelyagainstthePrincipal.TheTourOperatorwillprovidetheidentity,termsand

conditionsofallthePrincipalsrelevanttotheservicebeingprovidedfortheClientsbooking.ItstheClientsresponsibility to

cannotanddoesnotguaranteethattheitineraryand/oranydestinationswillcomplyinwholeorinpartwithsuchbrochure

and/ortheInternet.AnyrightofrecourseinthatregardwillbeagainstthePrincipal.

BOOKING,DEPOSIT&RESERVATION

OncetheClienthasfilledinthetravelenquiryform,respondedtoanadvertisementverballyorinwritingorviaemailorthe

Internetorhas,withoutreferencetoanyoftheaforesaid,askedformoredetails(collectivelyreferredtoastheEnquiry),about

aparticulardestination,trip,tourormodeoftravel(collectivelyreferredtoastheProposedTravelArrangements)theTour

OperatorwillprepareandprovidetheClientwithanestimate(byhand,faxor

email)(theEstimate).UpontheClientswrittenconfirmationthatthefactsandinformationcontainedintheEstimateis

correct,theTourOperatorwillprepareaquotationfortheProposedTravelArrangements(theQuotation).Anonrefundable

depositequivalenttothepercentage(theDeposit)ofthetotalestimatedvalueoftheProposedTravelArrangements(the

Price)asspecifiedintheQuotationisrequiredinordertoconfirmreservationswithPrincipals(theBooking),subjectto

paymentofthebalanceofthePriceinduecourseasspecifiedherein*.TheTourOperatorwillnotconfirmanyreservationifthe

depositandasignedQuotationarenotreceived.OncetheBookinghasbeencompleted,theClientwillbesuppliedwiththe

notwithstandingthattheamountinissuemayexceedthelimitsofsuchjurisdiction.

TheTourOperator,itsofficers,directors,servantsoragentswillundernocircumstancesbeliableforanyclaimiftheholidayis

cancelledbecauseyouhavefailedtopayontimeorasaresultofcircumstancesbeyondourcontrol.Nocompensationispayable

iftheholidayiscancelledbecausethenumberofpersonswhoagreedtotakeitislessthantheminimumnumberrequiredand

ouareinformedofthecancellationinwritin withinthe eriodindicatedinthedescri tionofthe acka e.

TOURSWhilsteveryeffortismadetooperateatourasadvertised,onoccasionitmaybenecessarytomakechangestothe

accommodation,theroutingororderofanitinerary.Unlessthechangesignificantlyalterstheholiday,compensationwillnotbe

payableforminoralterationstotheitineraryornightlyaccommodation.

manager,tourleaderorotherpersoninauthority,yourbehaviour iscausingdanger,damagetopropertyorpersistentlyaffecting

theenjoymentofothers,wereservetherighttoterminateyourholiday.Shouldthishappennorefundorcompensationwould

bepaid. TheClientagreesthathe/shewillatalltimescomplywiththeTourOperatorsorothersrequirementsinregardto

his/herconductandhe/shewillnotinanywayconstituteanuisancetoanyotherpassengeronthetour.

WATER/ELECTRICITY

SUPPLIESInmanyofthelesssophisticateddestinationswefeature,thewaterandelectricityservicesstruggletokeepupwiththe

increaseddemandsfromtourism.Limitedrainfallcanputfurtherpressureontheirprovision.Hotelsdoeverythingpossibleto

maintainfullservices.However,occasionalpowercutsand/orwaterrestrictionsmaybeexperienced.

ACCOMMODATIONINTHETROPICS

Inmanyhotels,especiallybeachresortsinsectsintherooms(eg.cockroachesetc)arealmostinevitable.Itshouldbynomeans

betakenasasignofdirtiness,simplyafactoflifeinthesedestinations.Viewsfromsomehotelroomsmaybepartlyobscured by

acceptresponsibilityifandtotheextentthatanyfailureofyourholidayarrangements,ordeathorinjury:isnotcausedbyany

faultofours,orouragentsorsuppliers;iscausedbyyou;iscausedbysomeonenotconnectedwithyourholidayarrangements

thattheseconventionsmaylimitorremovethecarrier'sliabilitytoyouandtheamountwhichthecarrierhastopayyou.You

transportprovidersorothersuppliersliabilitytoyou.Youcangetcopiesofsuchconditionsfromouroffices,ortheofficesofthe

relevantsupplier.

death,

personal

injury

illness,

must

give

us

or

our

insurerstherightsyoumayhavetotakeactionagainstthepersonororganisation responsibleforcausingthedeath,personal

injuryorillnessandyoumustcooperatefullywithusinseekingrecoveryofanypaymentwemake.

(f)Operationaldecisionsmaybetakenbyaircarriersandairportsresultingindelays,diversionsorrescheduling.FutureExclusive

Travelhasnocontroloversuchdecisions,andisthereforeunabletoacceptresponsibilityforthem.Where,asaresultof

circumstancesbeyondourcontrolweareobligedtochangeorendyourholidayafterdeparture,butbeforetheendofyour

holiday,wewillnotpaycompensationorreimburseyouforexpensesincurred.Youshouldhaveadequatetravelinsurancefor

yourholidayandclaimviayourinsurancecompanyforanylossordamagetoluggageand/orpersonalpossessions.Intheevent
