The purposes of the United States Team Penning Association are to engage those with an affinity for the western lifestyle in the sports of team penning and ranch sorting and to develop resources and services for the benefit of USTPA members and growth of the sport.

USTPAMission Statement

January 28, 2011 Dear Members, In an effort to provide our membership with clarity and an explanation of the Executive Officers’

and Board of Directors’ intentions and actions concerning the recent settlement of the legal

actions involving the former USTPA Executive Director, Melissa SuzAnn Spindor, I would like to

offer you the following information:

On December 1, 2009, Ms. Spindor was terminated for non-performance. At the time of her

termination she was offered $4,000.00 and asked to sign a standard release form. She refused.

On February 2, 2010, Ms. Spindor filed a lawsuit against the USTPA for payment of alleged

compensatory time and accrued vacation time amounting to $25,200.00 plus attorneys fees.

In defense against this action, the USTPA hired legal representation to defend the claims made

by Ms. Spindor. Ms. Spindor had no written employment contract and our defenses included

various legal reasons why she was not entitled to any compensation after her termination by the

USTPA. Through the course of the next few months, several witness depositions were taken and the

USTPA began to internally investigate records of Ms. Spindor’s employment and financial

dealings related to the USTPA.

In late October 2010, Ms. Spindor’s attorney made an initial offer-of-settlement. The USTPA

rejected that offer and pursuant to the law countersued her for damages revealed in our internal

investigation. The counter suit alleged acts and omissions that we believe constituted breaches

of her fiduciary duties, as well as fraud. The counter-suit specifically included accusations of:

1. Misuse of her position for personal benefit;

2. Use of Association funds for personal use;

3. Making deals with vendors for personal gain;

4. Transferring monies between accounts to cover losses without the knowledge or approval of

the USTPA Executive Board.

After the countersuit was filed Ms. Spindor’s attorney requested to schedule at least two more

witness depositions. Each deposition cost the USTPA between $3,000.00 and $5,000.00 as well

as the ongoing hourly legal fees required to respond to the filings of Ms. Spindor’s legal

representation and pursue our claims against her.

Although we felt the law was on our side and we could ultimately win, the financial burden of

pursuing this outweighed our willingness to continue, and what we believe was in the best

interest of the USTPA. Thus, after several weeks of negotiations and to avoid the time and

expense of more depositions and trial preparation being incurred, the USTPA agreed to settle with Ms. Spindor for $6,000.00. Our Settlement Agreement included provisions that dismissed all claims by both parties and did not admit to any wrongdoing or liability of any of the allegations in the lawsuit. The final dismissal of all proceedings was signed by the Court on December 31, 2010. In all, the USTPA spent $23,198.45 defending itself and prosecuting the claims in this matter and $6,000.00 in settlement costs, totaling $29,198.45. This has been a very painful process for the Executive Officers, the Board of Directors, our staff, and for all of our members. No one is happy with the outcome of this matter but we have certainly learned from the process and are committed to moving our Association forward by leading with integrity. I hope that we can now put this issue behind us and concentrate on enjoying the sports of Penning and Sorting. Sincerely, Jake Wells, DVM President, USTPA

From January 8 through the 11th, USTPA members gathered in Colorado to participate in the area’s most prestigious Penning and Sorting classes. Starting off at the Jefferson County Fairgrounds in Golden, Colorado, beautiful weather was soon overcome by a strong winter storm that stopped some competitors from even making it to the show. Dangerous winds and heavy snowfall made for treacherous mountain drives and freezing temperatures drove some from their trailers to the comfort of area hotels. As snow fell throughout the show days, horses and riders crowded into the heated arena for protection from the elements. Inside, the competition was tough though, as 718 teams steadily competed for the USTPA Champion buckles and a total purse of $98,764.00. After two busy, long days of classes in Golden, hearty USTPA volunteers gathered at the National Western Stock Show complex in Denver on Sunday night to set-up pens for Monday morning classes.

Snow continued to fall on the mountain skyline and excitement built in anticipation of the finals of the Open Pick 2/Draw2 and the #11

Pro-Am-Novice classes that would run during the PBR performance on Monday and Tuesday nights. In those showcase events, USTPA members energetically supported their fellow riders as the top 10 finalists showed off their working cattle skills to a generous crowd. Special recognition was paid to the family team of Sparky Chase and his daughters Maggie and Elle during the finals. Sparky and his girls qualified to ride in the Open Pick 2/Draw 2 and placed 4th in the average. At only 13 years old, Elle Chase also qualified to ride in the finals of the Open Pick 2/Draw 2 with Ken Krebsbach and Adam Nelson. With a literal bang of fireworks, the 2011 USTPA National Production Show at the National Western Stock Show concluded on Tuesday night. As members packed up their horses and headed back out into the cold, the show proved to attract those that were not only tough enough to ride but tough enough to drive, even if they did have to wait for the roads to clear.

the helmet heads – we think it’s great!”

This group of rising stars is no stranger to the show pen. Since its inception five years ago, the Signal Hill Ranch riders have garnered a number of personal and publicly recognized victories, with a small collection of Vinton trophy saddles to prove it. The group is most widely recognized at shows by their safety helmets, a trademark Kathy said they are not ashamed to be known by.

“The helmets are kind of my own

crusade,” Kathy said. “Liability laws require anyone under the age of 18 to wear a helmet when they’re riding on my premises or under my supervision. We’re not sad that people call us the helmet heads – we think it’s great!”

Signal Hill’s program began as a direct result to the popularity of teaming Penning and Ranch Sorting at another of Kathy’s joint enterprises, the Bee Cave Riding Center for instruction on hunter/jumper, dressage, and Western

disciplines. Having introduced some of the Western riders to Team Penning, it wasn’t long before Team Penning lessons were in demand. Kathy and Eddie saw the potential for a novice program and so began Signal Hill.

While some people may see the Signal

Hill

group as an all youth group, there is no age stipulation to beginning or ending lessons. Kathy notes it is “more of a horse club than a youth organization.” Boarding is available, but not a requirement. In fact, owning a horse is not a requirement – Kathy can provide a horse for students interested in learning to ride but do not have their own horse.

Although she was an experienced rider, Kathy had only been Team Penning a year before Signal Hill

However, the hat Kathy proudly associates herself with now is a helmet. Kathy and husband Eddie own and operate Signal Hill Ranch, in Austin, Texas, where Kathy teaches instructional team penning lessons to interested adolescents and novice adults.

was up and running. However, she had a zeal for encouraging and teaching youth to ride, whether it was basic ‘how to’ lessons or

progressing in a certain discipline. Her longtime involvement with youth began with her three daughters. Kathy raised them to share her appreciation and passion for horses by getting involved with youth organizations like the 4-H Club and their high school equestrian team. However, it didn’t stop there as Kathy continues her involvement with youth and novice riders through the Bee Cave Riding Center and Signal Hill.

“I truly enjoy teaching riding lessons. [The students] come in with a fantasy of what riding a horse will be like, and it’s fun to watch them learn to do it,” Kathy said. “Anything I’ve ever started with kids and horses has just been about being positive and helping them

achieve that dream. It’s a good pathway for kids to grow up in.”

One of the most rewarding aspects of Kathy’s job is watching her group reach their goals and develop into better riders. For them, shows bring out the fun and enthusiasm they experience at Signal Hill, and that has lead to a deeper appreciation for the sport, each other, and their fellow competitors.

Taking care of a horse gives children a sense of accountability. They find out how to manage their time and ultimately learn to be responsible for another living creature – a life lesson they won’t learn through a game console.

“There is nothing like the bond between a horse and child that can bring a child through trials and tribulations

and keep them grounded in their morals,” Kathy said. “I think kids that can care for a horse are able to go on and be successful.”

Kathy is a living example of just that. Growing up with four siblings, she worked her way through school and earned a nursing degree from the University of Michigan. She grew up riding and showing horses in various areas, from reining to showing Arabians. Eddie introduced her to Team Penning six years ago, and she’s been hooked since then. Together, they have several horses they ride including a two-year-old mare Kathy trained. They also own plenty of “backup” horses for newcomers to ride.

Kathy is also excited to announce a new cell phone application set to release in mid-February. It is an extension of her Web site, www.ridinghorses.com, and will be a series of hour-long video lessons that focus on ways to improve both showmanship and basic riding techniques. Through the portability of a cell phone, riders can watch and practice these videos from the back of a horse, which is ideal for “backyard riders” and those who

are unable to get help for training. Of course, any youth interested in learning to team pen are welcome to sign up for lessons with Kathy out at Signal Hill. Just be ready to put on a helmet.

Committee Reports 2011 World Championship Show Committee Larry Kuyper, ChairThe 2011 World Championship Show Committee has been appointed and is actively planning on another phe-nomenal Finals. The team is composed of David Rainey, Nick Mills, Bryan Blackman, David Stansbury, Marsha Hunt and Larry Kuyper as Chairman.

Formally titled the Wrangler 2011 USTPA World Championships, presented by the Monroe-West Monroe Convention and Visitors Bureau, the show will be held in West Monroe, Louisiana and will include a full slate of USTPA classes, as well as AQHA. The Convention and Visitors Bureau of West Monroe is again financially supporting USTPA. In negotiations with the arena’s management, we have addressed some issues from last year ranging from no other events on the premise while our show is occurring, to insuring that it is easier for our members to remove and dispose of manure. It is the committee’s commitment to build on the success of 2010.

Please feel free to contact anyone on the committee with ideas or suggestions for 2011 World Championship. I cannot guarantee that we will be able to do everything suggested but we are committed to doing what is in the best interest of the majority of the participants.

The USTPA is proud to recognize our leading riders in each rating throughout the year and recognize our Year-End World Champions and Reserve World Champions. Leading rider rankings are calculated on a point based system. The top rider with the most points in each rider rating at the end of the show year is the USTPA Year-End World Champion of that rating and receives a USTPA World Champion bronze trophy. The rider in each rating with the second highest amount of points earned during the show year is the USTPA Year-End Reserve World Champion of that rating and receives a USTPA Reserve World Champion bronze medallion. Will ‘It’ Please God? by Margaret McLain

Obviously the first question is what is “it”? That would be anything you are about to do, say, or think. More exactly put: “Will what I am about to do, say, or think be pleasing to God?”

Christians often wonder what God’s will is for them in life. That’s answered throughout Scripture and very specifically in Ephesians. But a simpler way to express it came out in a sermon by our associate pastor the first of the year which I believe is a great way to start 2011 and the first article for this year. If we would simply ask ourselves at each decision or choice in our daily lives, “will it please God?”

Deuteronomy 30:19-20 talks about choices. “I call heaven and earth as witnesses today against you, that I have set before you life and death, blessing and cursing; therefore choose life, that both you and your descendants may live; that you may love the LORD your God, that you may obey His voice, and that you may cling to Him, for He is your life and the length of your days.”

A city family decided to try life in the wide-open spaces. They bought a Western ranch. Some friends came to visit a month later and asked them what they had named the ranch. The father said, “Well, I wanted to call it Flying-W and my wife liked Suzy-Q, but one of our sons liked the Bar-J and the other preferred the Lazy-Y. So we decided to call it the Flying-W, Suzy-Q, Bar-J, Lazy-Y Ranch”. Their friend asked, “Well…where are your cattle?” The man replied, “None of them survived the branding!” Some choices and

decisions aren’t the best for man or beast.

The teacher asked her preschool class, “Now, how many of you would choose to go to heaven?” All the children except Tommy raised their hands. The teacher asked Tommy why he wouldn’t make the choice to go to heaven. Tommy answered, “I’m sorry, but I can’t make that choice. My mother told me to come right home after Sunday School.” Sorry, I thought that was cute.

But the point is the same. Throughout life and actually each day, we make hundreds of thousands of choices. Some are very simply non-life changing choices while others are very much more important. How do we make those decisions? Do we consult our friends? Do we talk with family? How do we decide? You might hear a pastor tell you, “Pray about it.” That’s an excellent plan but then you might wonder how will I know or hear God’s answer?

One way, of course, is to have been reading His Word (the Bible) in the first place. That is God talking to us. But perhaps you haven’t been doing that on a consistent basis which I hope will change this year. Begin with Ephesians (that entire letter inspired by God and penned by the Apostle Paul is excellent reading). For some specific instructions, begin with Chapter 3 verse 17 through Chapter 6 verse 20. There is such a wealth of knowledge and instruction on God’s way to live.

Then I believe asking the question which is the title of this article will help you daily decide which direction and which choice

to make which will lead to life as indicated in Deuteronomy. Will this action, word, or deed be pleasing to God?

Along the way of life we do make many wrong decisions but they are instructive also as this young thirty-two year old newly appointed president of a bank was told by the venerable Chairman of the Board. The “youngster” wanted advice. The old man said two words: “Right decisions!” The young man responded, “That’s really helpful, and I appreciate it, but can you be more specific? How do I make right decisions?” The old man said, “Experience.” Again, the young man said, “Well, that’s just the point of my being here. I don’t have the kind of experience I need. How do I get it?” Then, came the terse reply, “Wrong decisions?” And so it goes, we don’t always make the best choices but experience, too, will lead us even more to God.

We are blessed in this country, so far, to still have freedom of religion. It can be defined as the God-given right for each individual to make the ultimate choice of going to hell the human way or going to heaven God’s way through accepting Jesus Christ as Lord and Savior. A person must individually and outwardly make that choice. That choice is the one MOST pleasing to God.

May you have a blessed New Year making choices that will be pleasing to God, your Creator.
