Financial Management Services & Private Management Services

NSW Trustee & Guardian provides financial

management services for private financial managers and for people with decision

making disabilities.

About NSW Trustee & GuardianNSW Trustee & Guardian provides financial management services to people who have a disability that affects their capacity to make decisions. This may be due to mental illness, brain injury, intellectual disability, dementia or other disabilities.

NSW Trustee & Guardian is appointed by a court or tribunal to provide financial management services. NSW Trustee & Guardian can be appointed in two ways:

1. to provide direct financial management services for an individual

2. to provide authorisation and direction to private financial managers.

Private managers are individuals or trustee companies who have been appointed, by a Court or Tribunal, to manage the financial affairs of an individual with a disability that affects their ability to make financial decisions.

NSWTG is an independent statutory authority legally appointed to protect and administer the financial affairs and property of people unable to make financial decisions for themselves (where there is no other suitable person able to assist).

How does NSW Trustee & Guardian become involved?An application for a Financial Management Order is usually made to the New South Wales Guardianship Tribunal or Supreme Court (Equity Division, Protective) by someone with a genuine concern for the welfare of a person who is having serious difficulty managing their own affairs. In most instances the applicant is a family member, friend, social worker or health care professional.

A Financial Management Order is a legal decision of the Tribunal or Court to appoint NSW Trustee & Guardian or a private individual under the direction of NSW Trustee & Guardian to manage the affairs of a person.

In certain circumstances the Mental Health Review Tribunal can make an order appointing NSW Trustee & Guardian.

Services providedA wide range of legal, technical, financial, specialist disability and other services are provided by NSW Trustee & Guardian, such as:

• protecting assets and legal rights

• organising an adequate cash flow to pay bills

• liaising with financial and legal institutions

• making investments

• facilitating the buying and selling of a home.

Fees and chargesNSW Trustee & Guardian is a government organisation that relies in part on charging fees to provide services. These fees are used to provide a wide variety of professional skills and expertise to manage the financial affairs of people under management.
