An inventory of the Estate of Thomas Wimberley Deceased

To thirty hed [head] of cattels, seven sheep, eleven horses and mars [mares], thirty one

goos [geese], fore [four] negros: two wenches, one boy and one gerl [girl], five fether

beds and fimitur [furniture], fore iron pots and two pot hucks [hooks], five puter [pewter]

basons [basins] and fore dishes, a dozen of spoons, seven . . . . . . . . . . . . . . . . .

ten hids [hides] of lether, fore raw hids [hides], two pales [pails], one bison [basin], three

tubs, three . . . . . . . . , two frier pans, two tables, one hand mill, one grind stone, fore

narrow axes, nine hoes, one case of knifes and forks, one small persel [parcel]of wool and

a small persell [parcel] of flax, one w .. . come {comb] and 3 lot? of hamis [harness?],

This deed appears to have been executed when Lewis Wimberly sold land inherited from his father, Thomas Wimberly, and prepared to make the move to Chatham County, North Carolina.

TRANSCRIPTION OF THE RECORDED COPY OF THE WILL OF LEWIS WIMBERLY 3 March 1817 /proven August Term 1817 Smith County, Tennessee, Will Book 4 : 118-122

Be it known to all men that I Lewis Wimberly of the County of Smith and being in low state of body but in perfect mind do make and ordain this instrument of writing to be my last will and testament.

1st I give and bequeath or rather lend unto my beloved wife Polly Wimberly my plantation being on a three hundred acre tract whereon I now live with all priviledges [sic] belonging thereof during her natural life or widowhood also including farming utentials [sic] household and kitchen furniture including every species of property that I am now possessed of except some articles as I shall hereafter name.

Secondly the property that I give my daughter Polly Yates I consider it to be her full portion of my estate 3rd I consider the property that I have given unto my daughter Sally Bird to be her full portion of my estate Fourthly I consider the property that I have allready gave unto my daughter Betsy Yates to be her full portion of my estate Fifthly the property I have allready gave unto my son Isaac Wimberly I consider it to be his full portion of my estate Sixthly the property that I have before gave unto my son Noah Wimberly I consider it to be his full portion of my estate Seventhly the property that I have allready gave unto my daughter Winney Winfrey I consider it to be her full portion of my estate Eighthly the property that I have allready gave unto my son Hardy Wimberly I consider to be his full portion of my estate. Ninthly the property that I have allready gave unto my daughter Edy Boren I consider to be her full portion of my estate. Tenthly my daughter Roady Miller I give and bequeath unto her ten dollars worth of property to be her full legacy in my estate Eleventhly I give and bequeath unto my son Enoch Wimberly ten dollars worth of property to be his full portion of estate Twelvethly I give & bequeath unto my daughter Patsy Barker one bed as she has allready received to be her full portion of my estate Thirteenth I give & bequeath unto my son Lewis Wimberly ten dollars worth of property to be his full portion of my estate Fourteenthly I give & bequeath unto my daughter Dicca Wimberly ten dollars worth of property to be her full portion of my estate Fifteenthly I give & bequeath unto my son Elijah Wimberly my land & plantation as before mentioned after the death of his mother as to full possession of on condition that he takes good care of his younger brother & sisters in providing for their natural support until such times as they may become of lawful age also to furnish youngest? sons Thomas Wimberly & Washington Wimberly with one hundred dollars each in property when they may become of lawful age also my daughters Susannah Wimberly Betsy Wimberly & Milly Wimberly I give & bequeath unto each of them ten dollars worth of property to be made out of my estate whenever they or either of them may marry or become oflawful age on condition that Elijah Wimberly my son shall or may fail to stay with his mother & provide & take good & sufficient care of the family before named according to the times meaning as before inserted [?] he is to have only an equal part of said land with his other two brothers Thomas Wimberly & Washington Wimberly I also nominate & appoint James Montgomery & Josiah Howel my executors in this my last will & testament In witness whereof I have hereunto set my hand & seal this 3rd day March AD 1817 Enter lined before assigned Test John Dorris Fieldinfil Hankins Elijah m:rk Wimberly State of Tennessee Smith County
