The property tax assessed on commercial vehicles will also be replaced with a fee. The office will now register intrastate and interstate motor carriers in the newly created Commercial Vehicle Registration System. This registration does not affect farm vehicles. During the 2011 session, the Kansas Legislature passed House Bill 2557 which removed the property tax, also called the ad valorem tax, from commercial vehicles and replaced it with a commercial vehicle fee that will be collected at the time of registration. Motor carriers operating solely in Kansas as an intrastate motor carrier will receive a new license plate. Kansas Commercial Motor Vehicle Office Rolls Out a New System, Changes Fees for Commercial VehiclesOn Jan. 1, the Kansas Department of Revenue Commercial Motor Vehicle Office rolled out a new system that will increase compliance with federal and state departments of transportation. The property tax assessed on commercial vehicles will also be replaced with a fee.

The office will now register intrastate and interstate motor carriers in the newly created Commercial Vehicle Registration System. This registration does not affect farm vehicles.

During the 2011 session, the Kansas Legislature passed House Bill 2557 which removed the property tax, also called the ad valorem tax, from commercial vehicles and replaced it with a commercial vehicle fee that will be collected at the time of registration.

Motor carriers operating solely in Kansas as an intrastate motor carrier will receive a new license plate. The new white and purple plate marked “Commercial” will provide an easy reference for law enforcement. The Federal Motor Carrier Administration (FMCSA) announced it is extending by one year, until Jan. 30, 2015, it requires interstate commercial driver’s license (CDL) holders retain paper copies of their medical examiner’s certificate and continue to make the document available for review upon request at the roadside by federal and state commercial motor vehicle inspectors. In Dec. 2008, FMCSA issued a Final Rule modernizing, streamlining, and simplifying record keeping obligations for drivers, carriers and state governments by requiring a driver’s medical certification record be merged with state-issued CDLs. States received support from FMCSA to implement the necessary IT system upgrades and merge the records into one, online database – the Commercial Driver’s License Information System (CDLIS).

FMCSA announced the one-year extension to protect commercial drivers from being cited for violations because some states are not yet in full compliance with the new system.

You are still required to complete the medical self-certification by January 30, 2014. This extension applies to having your medical card in your driver qualification files and on your person.

FMCSA Announces One-Year Extension of Retaining your Paper Medical Card

A proposed rule mandating the use of electronic logging devices is expected to be published in the Federal Register on Jan. 29, according to a monthly Department of Transportation report, which says the rule is projected to clear the White House’s Office of Management and Budget (OMB) on Jan. 17. The report also says the rule will have a 60-day comment period lasting until April 1.

The Federal Motor Carrier Safety Administration’s drug and alcohol clearinghouse rule is also set to clear the OMB Jan. 17, and the DOT report projects that the rule will be published in the Federal Register Jan. 31.

E-log Mandate, Driver Database Rules Expected This Month

Beginning May 21, 2014, drivers’ required medical examinations must be performed by examiners who have successfully completed the required training and testing and have been placed on the National Registry of Certified Medical Examiners. This requirement has NOT been delayed. FMCSA is currently in the process of training and testing examiners in anticipation of the May deadline.

However, ATA is very concerned that too few examiners will complete the process or geographic coverage problems will exist (e.g., no examiners available in rural areas). ATA is monitoring the growth of the registry and will be communicating with FMCSA soon to express its concerns, provide options and solutions, and urge prompt agency action.

Trucks traveling in California face more stringent engine emissions requirements in 2014. Some limited exemptions are available but otherwise the following requirements are in effect.• Owner-operators with trucks having 1996-2006 engines are subject to new requirements which mandate retrofitting with CARB-approved diesel particulate filters (DPFs) or replacement with trucks having 2007 or newer engines.• Fleets with three or fewer trucks need to have at least one truck equipped with a DPF and register any unfiltered trucks with the California Air Resources Board (CARB).• Fleets with more than three trucks need to have trucks with 1996-2006 engines retrofitted with DPFs or replaced with trucks having 2007 or newer engines, unless they previously registered to phase-in compliance.• Drayage trucks operating in and out of the state’s ports or rail yards need to have 2007 or newer engines.

• Transport refrigeration units (TRUs) with 2006 engines need to have these engines or units replaced with newer models or retrofitted with DPFs.

Drivers, dock workers, mechanics, office personnel - they are among the thousands of people each day who contribute to a strong, efficient transportation industry in Kansas.

Many of these individuals are pursuing studies toward a higher education. The Kansas Motor Carriers Association Foundation would like to help some of these students in their efforts by providing scholarships to those seeking higher education (college, community college, vocational/technical training) in a transportation related field.

Scholarship recipients will be selected on the basis of their academic achievement, community involvement and financial need. The Foundation will provide financial assistance for college and trade school students. Scholarships may be used to meet such expenses as tuition, books, and housing.

Eligibility: Applicants must be high school graduates or seniors. They must also be attending school full-time, 12-hours per semester. Applicants, including previous KMCA Foundation Scholarship recipients may apply each qualifying year.

Application: A student seeking a scholarship should complete the application form and send it to the KMCA Foundation along with a recent professional photograph (photocopies will not be accepted) with your name and current year on the reverse side, a certified copy of your year-end transcript, one to three letters of recommendation and an accompanying letter of intent. This letter should include information on current and planned studies, career goals, interests, and the reason for applying for the scholarship. A checklist is provided at the bottom of the application.

Deadline: Applications must be received by 5:00 p.m. on April 1, 2014 for consideration in scholarships for the 2014-2015 academic year. There will be NO EXCEPTIONS. It is the applicant’s responsibility to complete all requirements. Incomplete applications will not be processed. Applications will not be permitted by fax or e-mail. Applications must be mailed to: KMCA, PO Box 1673, Topeka, KS 66601.
