In today’s context no employer can discharge or dismiss a delinquent workman even for a serious misconduct without following an elaborate procedure for taking disciplinary action. There is chance that - a case may be filed with the Industrial Court the proceedings would soon begin. In many cases, the employer is found to be at fault, not because of unfair termination, but rather lack of proper preparation or documentation of the termination and its procedures. Companies today need to take extra precaution to protect themselves from costly disciplinary action proceedings and legal entanglement, which is where Domestic Inquiry comes in. The organization must demonstrate to the court that they had taken into account other options before termination was considered. Consequently, proper documentation and conduct by the company will ultimately determine whether the actions taken by the organization is justified or otherwise.
