A. PURPOSE OF STATEMENT

This statement has been prepared to assess potential heritage impacts of a proposed subdivision of Longleat Farm into two lots.

B. GROUNDS OF STATEMENT

“Longleat” is listed as a heritage item. This has been established through a search of Schedule 5 of Hawkesbury LEP 2012.

C. LIMITS OF STATEMENT

This statement is based on the material at Part E1, and an inspection of the site in April 2017.

E. CONTEXT E1. DOCUMENTARY

Land Titles The land is part of a 100acre grant (Portion 79) to Daniel Horton, and part of 40 acre grant to Catherine Bootle (Portion 80) made in June 1823 and February 1841, respectively.

2. Extract AO Map 39767- Parish of Kurrajong. Approximate location of “Longleat”.

The land was converted to Real Property under Primary Application 9507 by Catherine Sarah Chignall of Forest Lodge, wife of Horace Chignall, banker in November 1894, and Certificate of Title Volume 1158 Folio 172 [CT1158-172] issued to her on 26th March 1895.

Catherine Sarah Chignall leased part of the land to George Hewett of Kurrajong, farmer dated 1st July 1893.

The property was transmitted to Amelia Jane Mansell, wife of John Arthur Mansell of Sydney, civil servant in May 1913. It was then transferred to Henry Edward Peck in June 1913. The land was subdivided under Deposited Plan 7565 endorsed in April 1914 (see Appendix). Peck sold off a number of lots between 1914 and 1920.

Lots 9,10,11&12 were sold to Robert Casper Goldston of Manly, barrister-at-law and CT 3145-241 issued to him on 6th January 1921. This parcel of land was transferred to Hubert See of Kurrajong, orchardist in October 1923, and then to Victor Clouting of Dulwich Hill, orchardist, by the mortgagee exercising power of sale in May 1932. It was transferred to Henry Hugh Dennis of Windsor, poultry farmer and orchardist, in May 1946, and then to Norman George Hunt of Woonona, dairy farmer in November 1948. In December 1954, Hunt sold the land to Bruce Livinge Reid of Kurmond, dairy farmer and Margaret Ellen Reid, his wife.

CT 3145-241 was cancelled and CT 8413-175 (for Lots 10, 11 & 12) issued to the Reids in November 1962, who sold the parcel to Henry Thomas Alce of Northbridge, brewery general manager on 30th November 1962. Lot 11, DP 7565 was sold to Ivone Kirkpatrick of Dural, accountant in December 1979 after which the title was cancelled and CTs 14061-20 & 21 issued for Lots 10 & 12, respectively.

CT 14061-21 was issued to Henry Alce on 20/02/1980 for Lot 12, DP 7565 and it was transferred to Margaret Louise Master of Kurmond, journalist in May 1980. The lot was subdivided under DP 747089 in June 1987 and computer folios created for Lots 2 and 3 of that DP with the residue being a road. Computer Folio 3/747089 records a transfer in July 1987, a transmission application in February 1988 and a transfer in September 1991. E2. The exterior is clad in stretcher-bond dry-pressed bricks (see also chimney at image 30, below) which indicates that the house was most probably built in the early 20th century.

The style of the window joggle and the fact that the double-hung windows are of a single pane type (with no evidence of muntins) would suggest that the windows date from the early 20th century.

I have examined a survey prepared by McKinley Morgan and Associates [MMA], consulting surveyors:

The proposed boundaries of Lot 11 more or less follow existing fence lines, and the material and visual impact of the subdivision will be negligible.

Clause Comment (1) Objectives

The objectives of this clause are as follows: (a) to conserve the environmental heritage of Hawkesbury,

(b) to conserve the heritage significance of heritage items and heritage conservation areas, including associated fabric, settings and views,

(c) to conserve archaeological sites,

(d) to conserve Aboriginal objects and Aboriginal places of heritage significance.

(2) Requirement for consent

Development consent is required for any of the following:

(a) demolishing or moving any of the following or altering the exterior of any of the following (including, in the case of a building, making changes to its detail, fabric, finish or appearance):

(i) a heritage item,

(ii) an Aboriginal object,

(iii) a building, work, relic or tree within a heritage conservation area,

(b) altering a heritage item that is a building by making structural changes to its interior or by making changes to anything inside the item that is specified in Schedule 5 in relation to the item,

(c) disturbing or excavating an archaeological site while knowing, or having reasonable cause to suspect, that the disturbance or excavation will or is likely to result in a relic being discovered, exposed, moved, damaged or destroyed,

(d) disturbing or excavating an Aboriginal place of heritage significance,

(e) erecting a building on land:

(i) on which a heritage item is located or that is within a heritage conservation area, or

(ii) on which an Aboriginal object is located or that is

within an Aboriginal place of heritage significance,

(f) subdividing land:

(i) on which a heritage item is located or that is within

a heritage conservation area, or (ii) on which an Aboriginal object is located or that is

within an Aboriginal place of heritage significance.

It is proposed to subdivide the land on which “Longleat” is situated.

(3) When consent not required

However, development consent under this clause is not required if:

(a) the applicant has notified the consent authority of the

proposed development and the consent authority has advised the applicant in writing before any work is carried out that it is satisfied that the proposed development: (i) is of a minor nature or is for the maintenance of the

heritage item, Aboriginal object, Aboriginal place of heritage significance or archaeological site or a building, work, relic, tree or place within the heritage conservation area, and

Consent is required.

(ii) would not adversely affect the heritage significance of the heritage item, Aboriginal object, Aboriginal place, archaeological site or heritage conservation area, or

(b) the development is in a cemetery or burial ground and

the proposed development: (i) is the creation of a new grave or monument, or

excavation or disturbance of land for the purpose of conserving or repairing monuments or grave markers, and

(ii) would not cause disturbance to human remains,

relics, Aboriginal objects in the form of grave goods, or to an Aboriginal place of heritage significance, or

(c) the development is limited to the removal of a tree or other vegetation that the Council is satisfied is a risk to human life or property, or

(d) the development is exempt development.

(4) Effect of proposed development on heritage significance

The consent authority must, before granting consent under this clause in respect of a heritage item or heritage conservation area, consider the effect of the proposed development on the heritage significance of the item or area concerned. This subclause applies regardless of whether a heritage management document is prepared under subclause (5) or a heritage conservation management plan is submitted under subclause (6).

(5) Heritage assessment

The consent authority may, before granting consent to any development:

(a) on land on which a heritage item is located, or

(b) on land that is within a heritage conservation area, or

(c) on land that is within the vicinity of land referred to in

paragraph (a) or (b),

require a heritage management document to be prepared that assesses the extent to which the carrying out of the proposed development would affect the heritage significance of the heritage item or heritage conservation area concerned.

The proposed development is to land on which a heritage item is situated.

This document has been prepared having general regard to the guideline document “Statements of Heritage Impact” as published by the Heritage Branch of the NSW Office of Environment & Heritage.

(6) Heritage conservation management plans

The consent authority may require, after considering the heritage significance of a heritage item and the extent of change proposed to it, the submission of a heritage conservation management plan before granting consent under this clause.

The preparation of a Conservation Management Plan is not warranted by the nature of the existing building and the proposed development.

(7) Archaeological sites

The consent authority must, before granting consent under this clause to the carrying out of development on an archaeological site (other than land listed on the State

Heritage Register or to which an interim heritage order under the Heritage Act 1977 applies):

(a) notify the Heritage Council of its intention to grant

consent, and

(b) take into consideration any response received from the Heritage Council within 28 days after the notice is sent.

(8) Aboriginal places of heritage significance

The consent authority must, before granting consent under this clause to the carrying out of development in an Aboriginal place of heritage significance:

(a) consider the effect of the proposed development on the heritage significance of the place and any Aboriginal object known or reasonably likely to be located at the place by means of an adequate investigation and assessment (which may involve consideration of a heritage impact statement), and

(b) notify the local Aboriginal communities, in writing or in such other manner as may be appropriate, about the application and take into consideration any response received within 28 days after the notice is sent.

The subject place is not identified as being of Aboriginal significance.

(9) Demolition of nominated State heritage items

The consent authority must, before granting consent under this clause for the demolition of a nominated State heritage item:

(a) notify the Heritage Council about the application, and

(b) take into consideration any response received from the Heritage Council within 28 days after the notice is sent.

The subject place is not identified as being of State significance.

(10) Conservation incentives

The consent authority may grant consent to development for any purpose of a building that is a heritage item or of the land on which such a building is erected, or for any purpose on an Aboriginal place of heritage significance, even though development for that purpose would otherwise not be allowed by this Plan, if the consent authority is satisfied that:

(a) the conservation of the heritage item or Aboriginal

place of heritage significance is facilitated by the granting of consent, and

(b) the proposed development is in accordance with a heritage management document that has been approved by the consent authority, and

(c) the consent to the proposed development would require

that all necessary conservation work identified in the heritage management document is carried out, and

(d) the proposed development would not adversely affect the heritage significance of the heritage item, including its setting, or the heritage significance of the Aboriginal place of heritage significance, and

Conservation incentives are not sought.

(e) the proposed development would not have any significant adverse effect on the amenity of the surrounding area.

Hawkesbury Development Control Plan Part C. Chapter 10

10.5.10 Subdivision a) Where a subdivision proposal contains a heritage item, the heritage item and any other associated outbuildings

should be retained on the same allotment.

Comment: the house, garden, associated sheds, tennis court and dam are to be located on proposed Lot 12 (see subdivision diagram at p7, above).

b) An appropriate setting or curtilage for the heritage item should be defined whilst taking the following into

consideration: (i) The original form and function of the heritage item.

Comment: “Longleat” is to be retained as is and relate to proposed Lot 12.

(ii) Any outbuildings, gardens, trees, fencing, gates and archaeological sites.

Comment: the existing outbuildings, gardens, trees, fencing and gates are to be retained as they are. There are no known archaeological sites on the land.

(iii) Adjoining development and allotments.

Comment: the adjoining development and allotments are outside the visual curtilage of “Longleat” and won’t be affected by the proposed subdivision.

(iv) Access points and orientation.

Comment: the existing access points and orientation are to be retained.

(v) Any visual links.

Comment: the proposed Lot 11 is visually screened from “Longleat” by relatively dense vegetation- see image 17, p5, above.

c) In order to determine whether the proposed curtilage of the heritage item is appropriate, the subdivision plan should

show the proposed building envelops for each proposed allotment.

Subdivision will not be supported where the curtilage or setting of the heritage building on or adjoining the site would be compromised.

Comment: It is intended that the building envelope is in the approximate position of the existing cottage. The curtilage/ setting of the heritage item will not be compromised, given the separation distance and intervening vegetation as demonstrated in images 14, page 4, and 17, page 5, above.

d) Where practicable, any visual linkages and the original access arrangements to the heritage item should be

retained.

Comment: Visual linkages were assessed in the photographic survey (see images 10,14 and 17, above). The vegetation screens the visual linkages between the heritage item and the proposed new lot. The current access arrangements are to be maintained.

e) The amalgamation of sites is generally discouraged in heritage conservation areas because it obscures the

original subdivision patterns and can result in unsympathetic development, particularly in terms of form and scale.

Comment: The place is not within a conservation area.

f) Lot boundary changes within heritage conservation areas must demonstrate that:

(i) The setting of an existing significant building on the site or the setting of development on adjoining sites

is not compromised.

Comment: The place is not within a conservation area.

(ii) Significant features of the existing site or adjoining sites, including streetscape and landscape features, trees, fences, outbuildings and gardens are not adversely impacted.

Comment: No significant features of the current site nor on adjoining sites will be affected by the proposal. (iii) The change to lot layout is in keeping with the character of the area.

Comment: It is apparent from a viewing of the cadastre on aerial photographs that similar subdivisions have occurred in the area.

H. CONCLUSION

The historical research shows that “Longleat” has been the subject of progressive amalgamations, subdivision and re-subdivisions over the years, with the current land associated with the house the subject of a subdivision under DP 747089 in June 1987. Many of the owners up until the purchase by Victor Clouting in May 1932 appear to have been “absentee landlords”, although the sole lease that appears in the documentation is that by Catherine Chignall to George Hewett in July 1893, which expired in July 1913, and the land was sold to Henry Edward Peck of Kurrajong Heights in June 1913 (See CT 1158-172). A brief assessment of the house itself reveals that its outward fabric and appearance suggests that it was built in the early 20th century, although it is conceivable there was an earlier structure there that has been incorporated into the existing house. The proposed subdivision follows existing features on the land and has been shown to be of little potential heritage impact. In my opinion, the proposed subdivision is supportable in terms of its potential heritage impacts, and is part of the ongoing process of a reduction in size of such holdings.
