Maps showing the overall enterprise zone (exhibit A) and a legal description (exhibit B) are included for reference and as a part of the required Resolution. SUBJECT: Resolution #19-06 Authorizing the Submittal of an ITEM#: 4.1 Application for the Re-Designation of the Coquille Valley Enterprise Zone.

BACKGROUND

The Coquille Valley Enterprise Zone, which was designated on July 1, 2008 statutorily sunsets on June 30, 2019 and is due for re-authorization. Re-authorization requires the concurrence of all the enterprise zone sponsors, which are: City of Bandon, Port of Bandon, City of Coquille, Port of Coquille River, City of Myrtle Point and Coos County. All sponsoring parties are in agreement with the re-authorization.

The boundary remains the same, with one addition of property located at the north end of the Bandon Dunes Golf Resort.

Maps showing the overall enterprise zone (exhibit A) and a legal description (exhibit B) are included for reference and as a part of the required Resolution.

Primarily, enterprise zones exempt businesses from local property taxes on new investments for a specified amount of time, which varies among the different zone programs.

Sponsored by city, port, county, or tribal governments, an enterprise zone typically serves as a focal point for local development efforts. There are currently 73 enterprise zones creating better opportunities for business investment across Oregon: 56 rural and 17 urban. Local governments are responsible for creating, amending, managing, and renewing most of these zones, until June 30, 2025.

Standard Program

Special Programs

In addition, some enterprise zones offer special business tax incentives.

• Long-term Rural Enterprise Zone Facilities Available in most rural designations, the long-term program extends property tax abatement to as many as 15 years on new facility improvements and installations. Any type of business activity is eligible, but these incentives depend on local approval and varying levels of minimum investment, job creation and employee compensation at the facility, depending on location.

• Electronic Commerce Zones Several enterprise zones have received special status to further encourage electronic commerce, or "e-commerce," investments.

• Tribal Zones Federally-recognized Tribes in Oregon may have any of the Tribe's land designated as a "reservation enterprise zone." The Tribal government is the zone "sponsor." A Tribe also may create a special "partnership" zone through an agreement with a local government. Both designation types include a state income tax credit for any type of business to offset the Tribal taxes that it might pay.

Additional information on Oregon's Enterprise Zones is included for reference.

FISCAL IMPACT

To date, in Bandon, only the Face Rock Creamery has taken advantage of Enterprise Zone incentives. Fiscal impact is determined on a case-by-case basis.

RECOMMENDATION

Although seldom used here in Bandon, the Enterprise Zone offers incentives to business development that are beneficial and could be leveraged with future economic development efforts. I recommend support of the re-authorization.

RESOLUTION NO. 19-06

A RESOLUTION OF THE BANDON CITY COUNCIL AUTHORIZING THE SUBMITIAL OF AN APPLICATION TO THE OREGON BUSINESS DEVELOPMENT DEPARTMENT FOR

RE-DESIGNATION OF THE COQUILLE VALLEY ENTERPRISE ZONE

WHEREAS the City of Bandon is sponsoring an Enterprise Zone designation jointly with the Coos County, City of Coquille, City of Myrtle Point, Port of Bandon, and Port of Coquille River, and

WHEREAS the City of Bandon and other sponsors have formally advised and received consultation from the Oregon Business Development Department {OBDD) according to ORS 285C.078, and

WHEREAS the municipal corporations, school districts, special service districts, that receive operating revenue through the levying of ad valorem taxes on real and personal property in any area of this enterprise zone were sent notice and invited to a public meeting on April 1, 2019, reg~rding its designation, in order for the sponsoring governments to effectively consult with these other local taxing districts, and

WHEREAS this enterprise zone has a total area of 9.35 square miles; it meets other statutory limitations on size and configuration, and it is depicted here on a drawn-to-scale map (Exhibit A), and its boundary is here described (Exhibit B), and

WHEREAS the City of Bandon shall fulfill its duties and implement provisions jointly with other cosponsors under ORS 285C.105 or elsewhere in ORS Chapter 285C and related parts of Oregon Law, including but not limited to having appointed a local enterprise zone manager, and to preparing a list or map of local, publicly owned lands and buildings in this enterprise zone for purposes of ORS 285C.110, and

WHEREAS designation of this enterprise zone does not grant or imply permission to develop land inside it without complying with jurisdictional zoning, regulatory and permitting processes and restrictions; nor does it indicate any intent to alter those processes or restrictions, except as otherwise done in accordance with Comprehensive Plans as acknowledged by the state of Oregon Land Conservation and Development Commission (LCDC), and

WHEREAS the availability of enterprise zone exemptions to businesses that operate hotels, motels or destination resorts would help diversify local economic activity and facilitate the expansion of accommodations for visitors, who in turn will spend time and money in the area for business, recreation or other purposes, and

WHEREAS the City of Bandon is interested in encouraging new business investment, job creation, higher incomes for local residents, greater diversity of economic activity, and the City of Bandon appreciates the impacts that the designated enterprise zone would have and the property tax exemptions that eligible business firms might receive therein.

NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:

Under ORS [285C.065/285C.245], the City of Bandon does hereby re-designate an Oregon enterprise zone to be named: The Coquille Valley Enterprise Zone, jointly with Coos County, City of Coquille, City of Myrtle Point, Port of Bandon, and Port of Coquille River. the boundary and area of which are described in the exhibits.

CCD Business Development Corporation is authorized to submit documentation of this enterprise zone re-designation to OBDD on behalf of the zone sponsors for purposes of a positive determination in favor under ORS 285C.074.

Re-designation of this enterprise zone takes effect on July 1, 2019, the date that the latest resolution of a sponsoring or consenting government is adopted, or later, as so stipulated by OBDD in its determination pursuant to any revision and resubmission of documentation. CCD Business Development Corporation is jointly appointed as the local zone manager for this enterprise zone.

Subject to grant of approval by the director of OBDD, the City of Bandon would jointly waive the distance maximum of 15 miles between separate areas within the Enterprise Zone under ORS 285C.120 (2) for purposes of this Re-designation.

The City of Bandon, as a sponsor of the Enterprise Zone exercises its option herewith under ORS 285C.070 that qualified property of and operated by a qualified business as a hotel, motel or destination resort shall receive the property tax exemption in the Zone, and that such business firms are eligible for purposes of authorization in the Zone.

ADOPTED by the City Council and APPROVED by the Mayor of the City of Bandon, this 3rd day of June 2019.
