A CONVERSATION ON CONSTRUCTIVE ENGAGEMENT June 7, 2018, Thursday, 8:30 AM to 12:30 NN The Oriental, Palo, Leyte PRELIMINARIES Nino Verzosa, Program Manager of INCITEGov, elaborated on the project and mentioned that the trainings conducted for the EU-Strengthening Social Protection Project focused on leadership, organization development, participatory governance and finally, constructive engagement. However, it has been noted that the discussion on constructive engagement was limited to the collaborative track which assumes that the government is willing to work and cooperate in the monitoring process, co-developed with the CSOs providing key data and information and breeding dialogue between and among stakeholders and duty bearers. But given the current situation and context of democratic backslide and experiences on the implementation of the trained citizen-led Community-based Monitoring Action Groups or (CBAMGs) in the province of Eastern Samar, Northern Samar, Western Samar and Masbate, using the framework of constructive engagement, who encountered unanticipated resistance from the local government chief executive officials. Accordingly, these experiences have necessitated the process to revisit constructive engagement in the context of narrowing democratic space. Furthermore, the Consortium wishes to start the conversation and reflection of the other side of Constructive Engagement- An outside track or confrontational role that might be the demanded strategy in some non-receptive LGUs and National agencies. This need has been agreed by the Project Advisory Board which will eventually provide the CSOs / CBAMGs with a wider range of tools and strategies for the practice of constructive engagement. Bringing in the experience of the Samahan ng Nagkakaisang Pamilya ng Pantawid (SNPP) who has a vast experience in their advocacy to sustain and institutionalize the 4Ps program using the collaborative and confrontation tracks aims to revisit and deepen the concept of Constructive Engagement in the times of democratic decline / backsliding with local community leaders To officially open the program, Ms. Natividad Silorio, Senior Area Manager of PLAN International recounted the stories during Typhoon Haiyan, highlighting the partnership established with DSWD, and underlined the remarks of the funders, the European Union, who were astounded with the efforts witnessed from the CBAMGs during the rehabilitation period after the typhoon. She noted that future collaborative initiatives have been suggested because the CBAMGs have shown and proven, that small and marginalized groups have the capacity to implement and effectively provide support to those who are in need. With this in mind, she pointed out that the project ultimately aims to equip the CBAMGs or citizens in general, the necessary strategies and tools on how to productively deal and engage

PRESENTATION OF THE CONSTRUCTIVE ENGAGEMENT CONCEPT

Ms. Corazon Victoria “Dinky” Juliano-Soliman, Social Protection Lead of INCITEGov presentedthe concept of Constructive Engagement, its goals, principles, approaches, and strategies.

She opened her discussion with a translation of the concept of Constructive Engagement intoFilipino, thereby introducing its possible new definition. It was defined as, “isang makatarunganat mabungang ugnayan sa mga institusyon ng lipunan” which is a process of engagement basedon the principle of a justified basis that can only be tagged as fruitful if it leads to a positivechange in the community.

“Ngayon, karaniwan ang ugnayan po ay lalong lalo na na ating mga mamamayan ay nasadalawang institusyon. Ang institusyon ng pamahalaan at ang institusyon ng mgakalakalan o ang mga business iyan ang dalawang institusyon na ating kaugnay para angdaloy ng ating pamumuhay ay maayos kaya ang ibig sabihin ho niyan yung tinatawagnating constructive engagement nakatayo ho doon sa prinsipyo na ugnayangmakatarungan at mabunga. Kaya kung titingnan natin ang ugnayan ng mabunga atmakatarungan yun ang magdadala sa atin sa positibong pagbabago ng ating mgakalagayan ngayon”.

Indeed, the government is one of the main institutions that greatly influence a citizen’s way oflife, however, the recognition of the power and experience that a citizen holds as the chiefcomponent in the process of constructive engagement that permits a greater good for all, notjust for the few, must be emphasized. It is also important to note that a part of the citizen’spower is shared with the officials whom they voted into power. Therefore, in times of injustice,an organized body must introduce pressure against these local officials.

“Hawak ng mamamayan o citizens itong prosesong ito at ito ay isang proseso na angkapangyarihan ng mamamayan ang siyang nagdadala ng daloy at siyang tumutungo o sakabutihan ng nakakarami mahalaga ho yun na ang kapangyarihan ng organisadongpwersa ay nagdadala ng positibong pagbabago para sa kagalingan o kapakanan ngnakakarami hindi para sa iilan lang kaya mahalaga po na pinag-uusapan natin angconstructive engagement…. ibig sabihin kung binoto natin sila – ito ang kapangyarihannatin, may bahagi tayong ibinigay sa kanila na sabi natin naniniwala kami na ikaw aytutulong para magkaroon ng mga batas ng mga programa na magbibigay ng kapakanan,ng maayos sa kapakanan ng nakakarami kaya ko binibigay ang bahagi ng kapangyarihanna yan.

Ms. Dinky presented a framework that highlights the roles of NGOs and other organized bodies.First, NGOs must voice out their opinions and provide advice on the implementation of thedifferent programs which can be characterized as the monitoring aspect that is being executedby the CBAMGs. Next, to secure sustainability, the advice must be institutionalized andtransformed into laws, ordinances, or resolutions, through the process of lobbying. However,there are cases in which local officials who are in-charge of the decision making are notconvinced and they cannot be in agreement with the citizens; this calls for campaigning, astrategy that is no longer restricted to the meeting room, but is now extended to the streets. Thecharacteristics of being an active citizen are manifested in these strategies, however, it requiresevidence. Local officials can only make decisions if the process of illustrating active citizenshipis based on hard and clear evidence.

Ms. Dinky discussed that engagement with government can be established in two possiblespaces. Claimed space is a civil society-initiated engagement, while invited space is government-initiated. In the case of claimed space, NGOs assert their rights and responsibility to be involvedwith the decision-making process. The National Anti-Poverty Commission can be considered asan example. On the other hand, the government recognizes and invites CSOs to participate in thelocal or municipal development councils. As an example, NAGA City established a people’scouncil that offered organizations an opportunity to participate in the decision-making process.The effort was later transformed into an ordinance.

Experience wherein claimed and invited spaces were both present.

Ms. Gemi Muramatsu, Advocacy Officer of PLAN International clarified that based on theframework presented, are there any instancec wherien the evidence and interests are balancedand at the same time confrontation and collaboration is also balanced?

Ms. Dinky responded that in terms of the experience in pushing for the agrarian reform, afterthe 1986 revolution, the organizations under the Congress for People’s Agrarian Reform –which composed of the farmers organizations, PAKISAMA and other groups coordinated andlobbied with legislators for the Philippine Agrarian Reform Code.

“Una, ang magsasaka mismo merong mga iba nagsabi hindi yan ang ganap batas namagbibigay ng ganap na na gusto namin. May mga grupo na ganun. Hindi rin masaya angmga may-ari ng lupa na nasa loob na ng kongreso kasi mahahati na ang karamihan nalupa nila at ito ang parang punto ko lang doon sa gagawin na mungkahing polisiya siyamerong mga magiging masaya merong hindi pero ang pinakamahalaga, Gaano karamiang mga benepisyo para ang naging desisyon at ang parang naging titingin uusad namanang Marami naman ang mga benepisyo bagamat hindi naganap ang ginagawa pa ngrepormang agraryo na isang example na kumilos ang lahat ng aspektong ito pero ang susidoon sila ang nagsimula ang mga organisadong magsasaka ng iba't ibang grupo sa isangiba't ibang grupo iba't-ibang tinutungtungan ng mga politikal. Kaya nagawa ang

Comprehensive Agrarian Reform law nang matapos gumawa ng panibagong batas paratapusin ngayon hindi na ko masyadong nakakasunod sa mga usapin ng repormangagraryo. Alam ko marami pang isyu na kailangan hanapin doon”.

After which, the focus was directed to the current context of local groups and officials. It hasbeen identified that the challenge in relation to the non-receptiveness emanated from the localofficials who demonstrated a more aggressive and agitated personality, which discourages afruitful interaction and thus results in the narrowing space for engagement. In addition to this, the delivery of the social services slowed down. The delivery of socialpension and other programs has been delayed for almost a year in certain areas. The role of theCBAMGs was intensified in terms of demanding the execution of the programs from theirrespective local officials in a composed but substantial manner. Ms. Dinky underlined thesignificance that citizens must understand that the persistent and active engagement with thegovernment can reduce the possibility of an autocratic rule. Moreover, Ms. Dinky noted the improtance of data gathering and validation to come-up withviable recommendations to improve public service delivery.

“So iba't ibang pamamaraan ng pagkuha ng datos at mahalaga po na binibigyang orastalaga ang pagpaplano. Mahalaga ang oras na talagang dinedetalye para sa ganun angstratehiya ay tunay na mabisa. Ito po ang importante ng paghahanda sa kahit anong mandiyalogo nadadaanan ninyo sa antas ng Barangay, sa antas ng munisipyo probinsya okaya ng pambansa importante ngayon na makita natin na itong paraan ito ay isang pagsisigurado na maging mabunga at mabisa ang ugnayan. So, sino ba dapat ang nandoon?Ito ngayon ang mahalaga. Siyempre ang mga mamamayan kasama sa kung ano man angissue ako ano man yung gusto nating maparating mahalaga ang lahat ng mga sektor naapektado. Tapos maganda rin kung meron tayo kasama mga merong mga teknikal nakaalaman. Yung teknikal na kaalaman iyon ang magbibigay ng halimbawa sa atinpagrestore, hindi ba bahagi ng ating pagsisigurado eh meron ka environmentalassessment. Pwede ba magtanim dito? Hindi ba ito danger zone? So bakit hindi pwede?Dapat may ebidenisya na ang magbibigay lang ay teknikal na eksperto.”

There is also a need for technical experts and strengthened coordination between and amongorganizations and the government. The government should initiate institutionalizing, andestablishing policies and programs through consultations with different sectors and experts.

“kinakailangan meron kayang mga teknikal na kausap na magbibigay sayo ng payokailangan nandun din ang asosasyon ng mamamayan tulad ng religious organizations,professional organizations, at syempre yung mga ating mga hinalal at mga institusyon.Silang mga bahagi po sa pagtitingin ano ang kanyang magiging posisyon dito sa polisiyaat programa na ating minumungkahi to kong ilagay natin sa Barangay lahat po nang mga

itong grupo na nasa Barangay kung gusto po ninyong magkaroon ng halimbawa ngmaganda siguro magkaroon tayo ng isang palaruan sa mga bata para hindi silanakakalat kung saan-saan. Makokonsulta ang lahat yan para sa ganun isang buongprograma at isang buong proseso ang makakagawa dahil lahat ay nagbigay.”

In the constructive engagement process, there is a need to initially present evidence-basedinformation to be able to present reliable data, this will be supported through dialogues formingconsensus between and among individuals and steakeholders supporting identified advocacy.

Ms. Dinky opined that for the past years, limited funding and support were given to socialservices of the government. There was a gap on the delivery of services specially on the delay ofrelease of Pantawid, non-membership and access of the marginalized to PhilHealth benefits etc.,these gaps were identified to support the pronouncement of the administration on the non-continuity of the 4Ps program and transfering its fund to livelihood. She added that the solutionto these gaps should be program enghancement through people empowerment, the CBAMGsshould work together to strengthen social protection programs.

There was incident of transactional government, narrated as: “Oh ganito, ibibigay ko sa iyo basta hindi ka aangal.Ibibigay ko sayo ito, ibibili ko sayo ito,papakainin kita, basta wag kang mag criticize sa akin. Yun ang transactional , papayag kao sige ho akina na, hindi na ako magsalita. Ibig sabihin bibili ka, pumayag kang ibenta mo,Iyan ang transactional subalit kung ito ay gagawin natin makatarungan at mabunganakatungtong sa karapatan ng mamamayan. Palagay ko yun yung tendency nakikitanatin sa pamahalaan at tipong mapipigilan kasi alam niyo karamihan ang alam niya saakin eh galing ako sa pamahalaan, DSWD Secretary, pero yung ibang nakakakilala saakin, sampung taon lang ako sa gobyerno, bago ho noon, NGO ho ako talaga, CSO at alamng marami na ito talaga ang aking ginagawa, community organizing.”

To end her discussion, Ms. Dinky noted that it is important to identify strengths and weaknesesof the government and different stakeholders and be able to constructively engage withgovernment towards better public service delivery.

“Sa aking pagtingin, mahalaga na ating kilalanin ang ating kalakasan na kapag tayo ayorganisadong kumikilos at hinahanap lang kung ano ang tama at nakatungtong sakarapatan palagay ko hindi tayo mawawala doon sa tunguhinnatin magkaroon ngmaayos at maunlad na buhay ang ating mga pamilya at ang ating mga komunidad.Maraming salamat, magandang umaga po.”

SHARING OF SNPP EXPERIENCES

To discuss the practical application of constructive engagement in the current context ofdemocratic backslide, Samahan ng Nagkakaisang Pamilya ng Pantawid or SNPP, will presenttheir experience in lobbying for the institutionalization of the Pantawid Pamilyang PilipinoProgram.

SNPP Experience was entitled as: Ituloy ang Kwento ng Pantawid: Pagtataya sa Pangarap ngMahihirap, A Constructive Engagement Experience.

Ms. Jeana Catacio started here presentation by introducing the SNPP. She noted that SNPP is anindependent registered organization of parent leaders and beneficiaries of 4Ps. It started in5M’s-Marikina, Malabon, Makati, Mandaluyong and Manila and undergoing throughmembership expansion in CALABARZON, Region 3, 4B, 1, 7 and Region 8 – which aims todeepen the appreciation of the program and gather support for the institutionalization of thePantawid. Moreover, Ms. Jeana Discussed that the objective of SNPP includes the following:

• Babantayan at ipagtatanggol ang programa at mga tagumpay ng Pantawid• Magsisilbing boses ng mga mahihirap tulad namin• Aalagaan at kakalingain ang kapwa naming mga benepisyaro, at lahat ng mga

mahihirap• Isulong at maipasa ang Batas Pantawid• Magbuo ng isang epektibo at tunay na nakatutugon na programa para sa mahihirap

Ms. Jeana noted the importance of the 4Ps program that empowers the women in the society. Itsconditionalities provided support to nutrition, education and health of each of the familymembers specially the children.

Ano nga ang 4Ps? Bakit nga ba ito ipinaglalaban ng SNPP? Sabi nga po namin, Pwedenaman po kaming nasa loob ng bahay namin maglinis magluto, maglaba, mag alaga peromula po kami ay napasali sa 4PS at saka nakita talaga namin na napakaganda nitongprogramang ito. Ito po ay kondisyonal na tulong pinansyal para sa mga pinakamahirapna Pilipino upang pagbutihin ang kalusugan, nutrisyon at edukasyon ng mga batang mayedad hanggang 0 to 18 years old ng gulang talaga pong sinasabi namin na obligasyonnatin ang mga magulang, kasi may mga ka bene tayo dito na nasa CBAMG, na sinasabinamin na obligasyon natin na pakainin at paaralin ang ating mga anak pero yungprograma binigyan tayo ng tulong hindi tayo ginagawang tamad kung hindi gusto tayongbigyang ayuda upang makaahon tayo sa kahirapan para mga anak natin maitawid natintalaga naman na ang nutrisyon ng mga anak natin ay mahalaga sa atin na mga nanay nagusto natin ibigay natin ang the best sa kabila ng ating kahirapan.

Ms. Jeana emphasized the need to stop the inter-generational cycle of poverty through humancapital investment and development.

“Ang kondisyon na binibigay ng programa ay hanggang hayskul kasi po sa atingmahihirap napakahirap itawid lalo na po sa panahon ngayon lalong lalo na po ngayon natayo nasa TRAIN law. Napakahirap talagang tumawid kaya nga, isa po sa mga layunin ngSNPP ay babantayan at ipagtanggol ang programa at mga tagumpay ng pantawid. “

SNPP will serve as the voice of the marginalized sector, to raise grivances to the governementand improve the 4Ps program.

“Sabi namin kailangan tayo mahihirapang magsilbing boses ng mga mahihirap katuladnatin dahil kung wala pong mahirap na magsalita na ito ang kailangan saibaba, ito poang kailangan na tulungan ng pamahalaan na bigyan ng ayuda kasi nga po yung 4.4million minsan natatakot, Takot po silang mareklamo natatakot sila dahil baka mamayamawala sila sa programa napag-alaman po namin sa mga trainings and seminar sa pagdiyalogo na hindi po tayo matatanggal as long as tayo po ay naging compliant sa mgakasunduan.”

SNPP opens the mind of the citizen to the responsibilities of the government. They conducteddifferent activities to reach out and disseminate information on different programs of thegovernment through attendance to different active citizenship development, planning ofgovernment programs and lobbying with different institutions. Ms. Jeana emphasized that thegroup believed the power in numbers.

Through different lobbying strategy and constructively engaging with government, and makingthe people aware of their rights and entitlements, Ms. Jeana highlighted that SNPP was able to:

“Kaya nga po SNPP, nagpapatuloy, napapalawak o magpapalawak ng 4Ps dahil pomapagtagumpayan ang SNPP. Ito po ang aming mga na pagtagumpayan. Pagpapanatiling 4Ps kasi po may mga hamon na tayo ay matapos na. Pagpapatuloy ng health care parasa 1.3 million dahilmeron po ditong pag-aaral na 1.3 million ay mapupunta na lamang saatransitioning families, wala na po silang health grant at rice subsidy na makukuha. Ito poay napagtagumpayan ng samahan, nailobby, naibigay para sa lahat ang health grantdahil hindi po kasama ang PhilHealth. Napakahalaga po ng health card sa bawatbenepisyaryo, ito po prevention para hindi magkasakit at mga binibili ng mga bitamina at

ang bigas po buwan-buwan at mula po sa bigas na literal ito ay naging 600 cash buwanbuwan at patuloy na pakiilahok sa mga pagdinig sa mga pagsasabatas ang 4Ps.”

As an update, Ms. Jeana noted that the 4Ps bill is now on the second reading at the House ofRepresentatives. She noted that SNPP representatives were always present during the course ofthe hearings, they also conducted innovative strategy in lobbying i.e., Zymba sa Senado.

To support the presentation of Ms. Jeana, Ms. Analiza Natalio presented the challenges andlearnings of their journey towards institutionalizing the 4Ps. She noted the following:

She noted that grassroots leaders and people’s organization should be willing and able toorganize regardless of threath. There is a need to freed the beneficiaries from fear of beingdelisted, strengthen linkage with government and stand to vouice out the advocacy.

Mr. Ruby Alvarez from Sta. Margarita, Samar : What are the sanctions for those beneficiarieswho were non-compliant with the conditionalities of 4Ps?

- As Ms. Jeana answered, there is an existing grievance hotline. DSWD should conduct andvalidate griveances in accordance to the internal rules of the program. SNPP submittedposition papers to respective agencies and beneficiaries should also be watch dogs totheir co-bene.

Ms. Grace from Leyte Family Development: What are the concrete steps to face the challenges inpushing for advocacy? How do you monitor the grievances? How do you make sure na angperang talaga intended for children ay talagang pumunta para sa kanila?

- Ms. Ana notede that as a new coalition/registered group, there was an existing MOAwith DSWD NCR to facilitate FDS. There might be instances where the children were notable but the group and its member should help each other to meet the conditionalities.The group/members can conduct dialogues with regional office. What are the facilitating factors to achieve and come-up with DSWD-NCR MOA? - The goal and objectives of the organization should be clear. Dialogues should be

continuously done. Viable results of engagement should ebe presented as well as theevidence-based information on the impact of the project should be present.

- Yung 4Ps, 7 years na hinahanapan na ng bunga, elementary pa ng mga anak namin. Sowala pa tayong kasagutan para sa hinihingi nila hintayin po nila, katulad ng mganakatapos na tayo ng K to 12 na high school na makapaghanapbuhay na gaya ngpresident na anak niya nakakatulong sa kanya kaya siguro mabuting tinginan ang resultang iyon bago tayo hiningian ng bunga pa ganun din ang SNPP sabi nga nagpapalawak,naghahanap pa gustong bumuo na mas makakatulong sa kapwa natin mahihirap.

CBAMG from Catubig, Nothern Samar shared their experience in working and constructivelyengaging with their barangay in monitoring social protection programs. She noted that there isa need for CSOs to be heard even at the Barangay level, dialogues should be documentedproperly.

- In terms of constructive engagement- we are relationship-based as strategy. Ferdinand, CBAMG from Northern Samar shared his reaction to SNPP and his intent for PWDorganizations to be strengthened and organized. Will there be possibilities of extending thebeneficiaries and include the PWDs?

- The SNPP experience in lobbying with the legislature and the resolution 1522 that liftsthe enrollment of beneficiaries to the Pantawid Program. So, yun po ang kahalagahan ng pagpush ng SNPP to institutionalize the program kasi iyonpo yung hindi na po napabilang dapat po talagang mapabilang dahil yun po ang nakitanamin sa ground So yun po ang isang hakbang nagawa ng SNPP na iyon nasabi po naminsa kanila Na napakarami pa po katulad sa mga area niyo Yung mga binanggit na poKanina na kung saan dapat ma-target doon. - There is a really need for strategic lobbying and be critical. - Even if the government officials rejects the proposals and recommendations, the

advocacy story should be continued. Bakit wala? One of the participants highlighted the need to identify and claim civic space in the government.Civil society organizations should take part in the Municipal Development Councils. In focusingwith good governance, organizations should work together and partner with local governments.There will be certain instances where government will not be open and responsive and the civilsociety should be ready to accept and push for their advocacy regardless of the biases.

The participant asked Ms. Dinky for some advice/words of encouragement in constructivelyengaging with government.

He mentioned the importance of the collective effort of every member of the community toreach out with government – there should be different strategies and approach to communicateand coordinate. SNPP’s experience exemplified constructive engagement and bringing theadvocacy to institutionalize social protection program in the table of the responsible agenciesand offices of government – they have the courage to overcome political biases. Sir Ianemphasized the importance of continuous learning, and education, information dissemination –we have to be clear with our goals. ###
