Five Year Reviews are required by CERCLA for sites where remedial actions do not allow for unlimited use and unrestricted exposure

Land Use Control Implementation Plan (LUCIP)
DoD Definitions:
Land Use Control: Any physical, legal, or administrative mechanism that places restrictions on the use of, or limits access to, real property to prevent exposure to contaminants above permissible levels
• Institutional Controls (IC’s): Administrative and/or legal controls
• Engineering Controls (EC’s): Physical controls put in place to prevent exposure such as fencing/signage etc.

Land Use Control Implementation Plan (LUCIP)
LUCIP: Identifies the environmental LUCs that
are required at JB MDL to protect human health
Documents the responsibilities and procedures for establishing, maintaining, tracking, and enforcing LUCs
“Living” document updated annually
Meets both DoD and EPA requirements for implementing LUCs under CERCLA(but covers all Environmental Restoration Sites at JB MDL)

Land Use Control Implementation Plan (LUCIP)
1. Pre-Decision Document Sites Includes sites which are under investigation or remedy evaluation No formal Decision Document and LUCs at these sites are not legally required and considered
elective; but, the AF has established a LUC Awareness Program for these sites LUC Awareness Program
Purpose: Limit exposure to both known and potentially contaminated media Includes: Installation Development Plan (a.k.a Master Planning); GIS and AF Database Tracking Systems; LUC
Training and Awareness; Waivers to Construct and Dig Permits; MEC Sweep Requirement Policy; and Annual Inspections
2. Post-Decision Document Includes sites for which a Decision Document is in place Design document requires LUCs to protect human health and LUCs are mandatory Sites are subject to the LUC Awareness Program and all site-specific LUCs identified in the
Decision Document
3. No Further Action Includes sites that qualified for Unlimited Use and Unrestricted Exposure Sites require no LUCs or any other management by the AF

August 2016: EPA is reviewing the 2015/2016 LUCIP Update October 2016: Conduct Annual Inspections January 2017: Submit the 2016 LUC Compliance Summary
Report (includes the findings of the inspections and any noted deficiencies) for EPA and DEP review and approval
March 2017: Begin 2017 LUCIP Updates Every 5 years: Findings of the Annual Inspections and LUC
Compliance Summary Report used in the CERCLA Five Year Review to evaluate the effectiveness of the remedy

Meeting held with NJDEP 13 July 2016 FS will include evaluations of remedies for both TCE (OT016 and
WP005) plumes ST015 will be recommended for no further action
Technologies carried through for remedy evaluation include: Air Sparge/Soil Vapor Extraction Permeable Reactive Barriers Monitored Natural Attenuation Numerous technologies evaluated but not advanced for peat/lignite area
A remedy is under consideration that would Restore most of the aquifer to Class I PL standards in approximately 10
years Contain a 2 acre area where lignite/peat/clay is acting as a continuing
source until it is depleted (~100 yrs)

Sampling is anticipated to be conducted in the Fall of 2016

Proposed remedy is No Action at SA018 (ANC-2 Disposal Area) and Institutional Controls and groundwater monitoring at LF016 (Range Landfill)
Record of Decision (ROD) is in preparation – will include responsiveness summary addressing oral and written comments received during the Public Meeting held 12 May and the 30 day comment period
