These products will be removed from eligibility for GSP for the subject countries on November 1, 2019, unless the President grants a waiver for the product for the subject country in response to a petition filed by an interested party. The 50 percent CNL, however, does not apply to a product if a like or directly competitive product was not produced in the United States in any of the preceding three calendar years. List II identifies GSP-eligible articles from BDCs that are above the 50 percent CNL, but that are eligible for a de minimis waiver of the 50 percent CNL since total U.S. imports of the product are less than $24 million. Articles eligible for de minimis waivers are automatically considered in the GSP annual review process, without the filing of a petition. Petitions to deny de minimis waivers can be submitted in accordance with the requirements set out in the referenced Federal Register notice. In addition, public comments in support of de minimis waivers are invited in accordance with the requirements set out in the referenced Federal Register notice. List III identifies GSP-eligible articles from certain BDCs that are currently not receiving GSP duty-free treatment, but that may be considered for GSP redesignation based on 2018 trade data and consideration of certain statutory factors. 2019 GSP Annual Product Review: 2018 Import Statistics Relating to

Competitive Need Limitations (CNLs), De Minimis Waivers, and Product Redesignations

This document contains the lists referred to in a forthcoming notice published in the Federal Register entitled “2019

Generalized System of Preferences (GSP): Notice of Annual Product Review and Country Review; Deadline for Filing Petitions.”

These lists are provided for informational purposes only. Interested parties are strongly encouraged to independently research the

2018 trade statistics, using the U.S. International Trade Commission’s (USITC) “dataweb” site, which can be found at

https://dataweb.usitc.gov/.

List I identifies GSP-eligible articles from beneficiary developing countries (BDCs) that exceeded a Competitive Need

Limitation (CNL) by having been imported into the United States in 2018 in excess of $185 million, or in a quantity equal to or

greater than 50 percent of the total U.S. import value for this product in 2018. These products will be removed from eligibility for

GSP for the subject countries on November 1, 2019, unless the President grants a waiver for the product for the subject country in

response to a petition filed by an interested party. The 50 percent CNL, however, does not apply to a product if a like or directly

competitive product was not produced in the United States in any of the preceding three calendar years.

List II identifies GSP-eligible articles from BDCs that are above the 50 percent CNL, but that are eligible for a de minimis

waiver of the 50 percent CNL since total U.S. imports of the product are less than $24 million. Articles eligible for de minimis

waivers are automatically considered in the GSP annual review process, without the filing of a petition. Petitions to deny de minimis

waivers can be submitted in accordance with the requirements set out in the referenced Federal Register notice. In addition, public

comments in support of de minimis waivers are invited in accordance with the requirements set out in the referenced Federal Register

notice.

List III identifies GSP-eligible articles from certain BDCs that are currently not receiving GSP duty-free treatment, but that

may be considered for GSP redesignation based on 2018 trade data and consideration of certain statutory factors. Petitions for

redesignation can be submitted in accordance with the requirements set out in the referenced Federal Register notice.

List IV identifies articles from BDCs that currently have had a CNL waiver in effect for five years or more, but have

exceeded 150 percent of the CNL threshold or 75 percent of total U.S. imports as described in section 503(d)(4)(B)(ii) of the Trade

Act of 1974 (19 U.S.C. 2463(d)(4)(B)(ii)). These products will be removed from eligibility for GSP for the subject countries on

November 1, 2019, unless the President grants a continuation of the CNL waiver for the product for the subject country in response to

a petition filed by an interested party.

On March 4, 2019, the President announced his intent to terminate the designation of India and Turkey as BDCs. (For more

information, see https://ustr.gov/about-us/policy-offices/press-office/press-releases/2019/march/united-states-will-terminate-gsp.)

Interested parties may submit comments or petitions regarding any products listed below from India or Turkey; once their GSP
