Transportation in a Global Economy
On behalf of the Executive and Board of Directors of the Canadian Transport Lawyers Association, I cordially invite you to attend the 2012 CTLA Annual Conference (CTLA2012) in Toronto, Ontario, from September 26 to 29, 2012. This year we are pleased to offer a three-day educational programme, featuring legal and industry experts from across the US, Canada and Mexico, who will analyze and explain the complex issues confronting the transportation industry in today's global economy. The programme will include a blend of plenary sessions and smaller, more focussed break-out sessions that will run concurrently. Our trans-national speakers will present a comparative analysis of the laws and legal practices that affect the transportation industry in North America.
Our conference is open to lawyers, paralegals and other professionals who have an interest in transportation law.

Our venue for the conference, the InterContinental Hotel (Yorkville) is literally steps away from several iconic cultural spots. Be sure to check out the Art Gallery of Ontario, sporting a new Frank Gehry facade and imaginatively redesigned interior: an important part of Toronto's ongoing architectural renaissance.
On your way back to the hotel, take a streetcar up Spadina Avenue, right through the heart of Chinatown. Drop in on the eclectic vintage clothing stores of Kensington Market, and then browse the hip fashion selections on trendy Queen St. W. Enjoy the hustle and bustle of Bloor Street, Toronto's elegant "mink mile" of high-end boutiques. Spend a day with a personal shopper at Holt Renfrew's flagship store.
And if all of that just sounds like more exertion than you need right now, go for a leisurely stroll through the nearby Rosedale Valley, or a quiet jog down Philosopher's Walk and all around the University of Toronto's historic St. George Campus. Or take a streetcar down Spadina and a 15-minute ferry ride to the tranquil Toronto Islands, one of the city’s most treasured green spaces and a popular recreational destination.

A. Piracy: The reach across the Seas Your choice of session A or B
James P. Thomson, Partner (moderator) Bersenas Jacobsen Chouest Thomson Blackburn LLP, Toronto ON
Simon P. Barker Peterborough ON
Steven W. Block, Partner Foster Pepper PLLC, Seattle WA
The term 'piracy' is one that is frequently misused and one that is much romanticised. Maritime piracy today is a serious resurgent security issue that threatens the economies of all trading nations. The deployment of multinational naval forces off the Horn of Africa has created the perception that maritime piracy today is exclusively a Somali problem. This is far from the case. Piracy is said to be the world's 3rd oldest profession, and this current phase of maritime piracy is deeply embedded within social, political and economic structures that have altered with the acceleration of globalization.
The panel will review the history of piracy, will explore the challenges facing those combating piracy today and will discuss the approaches taken by countries such as Canada and the United States of America, as well as the insurance community, to address the re-emergence of piratical activity on the waterways of the world.
B. Cross-Border Carriage by Road

B. Cross-Border Carriage by Road
(continued)
Canada's most significant trading partner is of course the United States. The vast majority of that trade moves by way of cross-border trucking. This panel will review the laws governing claims for cargo loss, damage and delay. Rui Fernandes will address the Canadian liability regime for carriers and brokers. Gordon McAuley will in turn provide the American perspective.
As disputes arise one party may assert the application of one country's law over the other. The panel will also address conflicts of law issues and their resolution in the cross-border trade context.

When there are so many priorities to juggle, it can be hard to keep all your balls in the air. That’s why it’s important to take time to laugh, and enjoy a night out at The Second City, the world’s premier improvisational and sketch comedy theatre. Nobody handles their balls better than The Second City’s troupe of talented performers. So grab a drink and enjoy, because We’ve Totally (probably) Got This!

John J. Sullivan, Partner Hill Rivkins LLP, New York NY
A not unusual fact scenario leaves a consignee with no goods and everyone blaming someone else. This panel will digest the origin of an international shipment, the safeguards that should be in place to protect the load, and when the load disappears, who is responsible.

Lawrence M. Friedman, Partner Barnes, Richardson & Colburn, Chicago IL
A discussion regarding the two perimeter security plans unveiled by Prime Minister Stephen Harper and U.S. President Barack Obama in December 2011: the Action Plan on Perimeter Security and Economic Competiveness and the Action Plan on Regulatory Cooperation. This initiative flows from a commitment made in February 2011 by both leaders to address the concerns of ensuring a safe and efficient border. The stated goal is to tighten border security while speeding up travel and trade and aligning regulations between the two countries. Our panelists will share their views as to what transborder trade will look like, once the agreements are fully implemented in the future.

Terry Groff, V-P & General Counsel Vanguard Logistics Services, Los Angeles CA

11:15-12:00
A. Freight Forwarders & Logistics Your choice of session A or B
(continued) This panel will discuss the various bureaucratic roadblocks that are endemic in the global marketplace. Customs laws appear to be black and white, but bureaucrats often apply an interpretation that places the freight forwarder offside and subject to fines. The panel will also discuss legal, insurance and risk management issues confronting the freight forwarder community, including the emerging trend of increased demurrage charges by carriers, and the frequent theft of empty ocean containers.
B. Truck Casualty
Rui M. Fernandes, Partner Fernandes Hearn LLP, Toronto ON
Dr. Ashley Dunn, Project Engineer Scientific Expert Analysis, Inc., Columbus OH
A discussion regarding accident investigations and reconstructions.
12:30-14:00
Luncheon – with keynote speaker
David Miller, Counsel, International Business & Sustainability, Aird & Berlis LLP
David Miller was Mayor of Toronto from 2003 to 2010 and Chair of the influential C40 Cities Climate Leadership Group from 2008 to 2010. Under his leadership, the City of Toronto became widely admired internationally for its environmental leadership, economic strength and social integration. He is a leading advocate for the creation of sustainable urban economies. In addition to being a strong and forceful champion for the next generation of jobs through sustainability, David advises companies – and governments – on practical measures to make this happen.
19:00-22:00
The Academy of Spherical Arts – Dinner and Pool
Our optional Friday night event at The Academy of Spherical Arts, a converted Victorian factory in the heart of Toronto's trendy Liberty Village, will include a Canadian-themed buffet dinner, Scotch nosing, a full-service bar, live entertainment and plenty of billiards for the pool sharks among you.
This venue dates back to 1890, and between 1905 and 1959 it was home to the Brunswick Balke Collender Company and the Samuel May Company, Canada's oldest purveyors of billiard tables, cues, balls and all manner of accessories. In its day, this was the largest pool table manufacturer in the British Empire. Many of the antique billiard tables, cues, balls and scoreboards that you will see around you at this venue were actually handcrafted here, decades ago. One of the tables was commissioned by the late Duke of Windsor, during his brief reign as King Edward VIII.
CTLA is proud to present vocalist Shakura S’Aida, a truly international artist whose involvement in the Canadian music scene has been ongoing for the almost 25 years. Along the way, she has enriched the jazz, blues and classic R&B communities with her soulful voice, enthusiastic personality and commitment to her deep soul music.

For your leisure time while here in Toronto, we recommend… ART GALLERY OF ONTARIO. With more than 5,000 works in 110 galleries, the AGO’s recent transformation includes a
physical expansion of the Gallery by 97,000 sq. ft., the addition of more than 10,000 new works of art to the already
vast collection, and a 47 per cent increase in art viewing space. Designed by renowned Toronto native Frank Gehry,
the architectural genius behind the Disney Concert Hall and the Guggenheim Museum Bilbao, the layout is open, airy
and easy to navigate, with sweeping staircases that link the floors together. The extensive use of glass allows for
magnificent views of the city from every direction, including Grange Park. The entrance on Dundas Street leads
visitors directly into Walkers Court, the hub of the AGO, and the Grange, the Gallery’s first home.
EDWARDS GARDENS & THE TORONTO BOTANICAL GARDEN. On Saturday, September 29, at 10:30 AM, Heritage
Toronto is offering a tour of this beautiful natural heritage area. Learn how it evolved from Alexander Milne’s
pioneer farm and mill to Rupert Edwards’ 1942 country estate, to today's public park and garden education centre.
After the tour, take in the activities and displays of TBG’s "Harvest Festival." For details, visit
http://www.torontobotanicalgarden.ca. Start point: Toronto Botanical Garden, 777 Lawrence Ave E at Leslie St.
Meet at entrance kiosk in SW corner of parking lot. Approx. 1 ½ hours.
EXPLORE YORKVILLE. Take a leisurely stroll along Bloor Street, and down Hazleton, Yorkville and Cumberland
Avenues. Yorkville’s quaint Victorian architecture houses dozens of restaurants, boutiques and art galleries. The
dining and shopping is upscale and the galleries represent some of the finest Canadian and international artists.
Behind the glitzy exteriors, you just might catch a glimpse of Yorkville’s bohemian roots: in the 1960s, this was the
Canadian capital of the hippie movement, nurturing many young musical talents, including Joni Mitchell, Neil Young
and Gordon Lightfoot, and some of Canada’s best –known and best-loved literary figures.

HISTORICAL DISTILLERY DISTRICT. The Distillery District was a functioning whiskey distillery in the 1800s, and it
played a key role throughout the days of prohibition. You’ve seen its cobblestone streets and dour, Victorian
architecture in countless movies. Today it’s a pedestrian-only arts village, with antique shops, excellent cafés and
restaurants, galleries and more.
HIT THE BEACHES. Stroll along magnificent Woodbine Beach just south of the funky shops and cafés of Queen St.
E., or hop on a ferry to the Toronto Islands. Both are perfect for a quiet jog or bike ride. Ferries for the Islands leave
from the docks at 9 Queen’s Quay West, located south of Queen’s Quay between Yonge St. and Bay St.
SCOPE OUT THE ’HOODS. Toronto is a city of diverse neighbourhoods waiting to be explored, including Chinatown,
Little Italy, Cabbagetown, Greektown on the Danforth, University of Toronto’s St. George Campus, Rosedale, Forest
Hill, the financial district, and so many more. Ask the hotel concierge for info about group and private walking tours
THEATRE. Shows playing during your visit to Toronto include: War Horse — Queen for a Day (the Musical) — Tap
Dogs — Writing Home — Between the Sheets — No Great Mischief. Also, if you are prepared to travel slightly
farther field, check out the listings at the Stratford Festival and the Shaw Festival (Niagara-on-the-Lake).
X-MEN MASTER: GORDON SMITH. The Toronto International Film Festival celebrates Canadian effects and design
stat Gordon Smith's work on the X-Men films in this new exhibit, taking place at the TIFF Bell Lightbox, 350 King St.
W. Gordon Smith is responsible for the on-screen creations of Wolverine and his claws, the feral villain Sabretooth,
Nightcrawler's distinctive black-blue skin and long tail, and the scaly blue appearance of shape-shifter Mystique.
