Accordingly,Defendant’sPCRAclaimthatsentencingcounselwasineffectivefor failing to refute the Commonwealth’s position that Defendant was a hardened criminal, incapable of rehabilitation, and in need of incapacitation is without merit. Defendant’sargumentthatsentencingcounselshouldhavepresentedadditionalevidencetotheCourttosupporthisposition,suchasthedocumentsheattachedtohisReplytoCommonwealth’sAnswer/MotiontoDismiss,filedNovember8,2018,isfoundtobewithoutconsequence.AreviewoftherecordshowsthatJudgeNaglewaspresented with the same or similar documents prior to sentencing. There was a forty-eight-pagePre-SentenceReport,includingsupportingdocumentsandevaluations,thatdetailed Defendant’s life, childhood abuse, family and social history, education, mental health,anddrugandalcoholabusehistory.AtsentencingJudgeNaglestated,“Ididreadfrompagetopageandcovertocoverthepresentenceinvestigativereportthatwaspreparedbytheprobationdepartment.”(N.T.,11/6/13,p.10).ThedocumentsPCRAcounsel attached as exhibits were additional supporting documents of the information JudgeNaglealreadyhadinhispossession,andsentencingcounselwasnotineffectivefornotprovidingcumulativedocumentation.

Defendant’sclaimthatcounselwasineffectivefornotarguingthisevidencedifferentlytotheCourtisalsowithoutmerit.Eveniftherewasadifferentapproachsentencingcounselcouldhavetakenusingthisevidence,itdoesnotmeanthatcounselwasineffective.Viewingthetotalityofthecircumstances,includingPCRAcounsel’scurrentargumentsregardingtheevidence,thisCourtdeemssentencingcounselwaseffective,andtheCourthadtheevidenceavailabletomakeawell-informedsentencingdecision.

Defendant’snextPCRAargumentisthattheCourtdidnothavereliableinformation at the time of sentencing since it was stale and inaccurate. He presented mental health records from the Chester County Prison to argue that the mental health diagnosis presented at sentencing was inaccurate. We disagree.

The history in this case shows that the murders occurred on December 3,2011.DefendantenteredhisguiltypleaonAugust23,2013.Thepre-sentenceinvestigationwascompleted,andareportwasissuedonOctober31,2013.DefendantwassentencedsixdayslateronNovember6,2013andre-sentencedonMay12,2014.ItmustberememberedthatDefendantparticipatedinthepre-sentenceinvestigationprocessandprovidedtheinvestigatorwithadetailedbackgroundinformationabouthislife.TherewerealsoamultitudeofrecordsattachedtothereporttogivetheCourtanextensivepictureofDefendant’slife.Whilesomeoftheattachedrecordswereasoldas2008,includingthepsychologicalassessmentperformedbyDr.BruceE.Mapes,the report also included information about Defendant up to the date of the murders. TheinformationwascompiledbetweenthedateoftheguiltypleaonAugust23,2013andthedateofthereport,October31,2013.Defendantwassentencedsixdayslater.Itcertainlywasnotstale.TherecordsandreportsthatwereattachedtothereportprovidedafullpictureofDefendant’slifeleadinguptothesentencing.Thereportalsonoted Defendant’s then current mental health assessment as set forth by Chester County Prison.

DefendantattachedtohisNovember8,2018pleadingreportsfromtheRockfordCenterdatedin2002and2004inanattempttodiscreditthemorerecentreportsthatwereattachedtothepre-sentenceinvestigationreport.Thisisnotlogical.NorisitlogicalforDefendanttouseChesterCountyPrisonmentalhealthassessmentsheetsfrom2013inanattempttodiscreditpriormentalhealthassessments.Defendantfails to set forth an expert report to argue that the prior reports and assessments were incorrect.Hemakestheallegationswithoutanyproofandarguesthatsentencingcounselwasineffectiveforfailingtomakethesamespeculativearguments.

Anindividual’smentalstatemaybecontinuallydevelopingandchangingthrough the years. There is no dispute that at the time of the murders Defendant wasnotbeingtreatedforhismentalhealthissues.Afterhisarrestandconfinementin Chester County Prison, he began mental health treatment and was prescribed medication.JudgeNaglewasfullyawareofthisinformationatthetimeofsentencingand Defendant’s PCRA claim is found to be without merit.

Defendant’snextPCRAargumentisthatsentencingcounselwasineffectivefor failing to set forth a Miller/MontgomeryargumentonbehalfofDefendant.In2012,the United States Supreme Court decided Millerv.Alabama and held that mandatory life imprisonment without parole for those under the age of eighteen at the time of their crimesviolatestheEighthAmendment'sprohibitiononcruelandunusualpunishments.567U.S.460,479,132S.Ct.2455,2469(2012).In2016,theUnitedStatesSupremeCourt decided Montgomeryv.Louisiana, and held that decision in Millerv.Alabama, announcedanewsubstantiveconstitutionalrulethatwasretroactiveonstatecollateralreview.577U.S.190,212,136S.Ct.718,736(2016).

First, it must be noted that Montgomeryv.Louisiana was decided after DefendantwassentencedonNovember6,2013andre-sentencedonMay12,2014.Sentencingcounselcannotbeheldineffectiveforfailingtoargueaboutacasethathad not been decided. Second, the Miller and Montgomerydecisionsbothinvolveddefendants who were under the age of eighteen at the time of their crimes. There is no dispute that Defendant was nineteen years old at the time of the murders. Therefore, Miller and Montgomery are not applicable to the case at hand.

InDefendant’sJune21,2021ReplytotheCommonwealth’sSupplementalAnswer, he agrees that the Millerv.Alabama holding does not apply to Defendant sinceheisnotajuvenilelifer,norwashesentencedtolifeimprisonment.However,heargues that the underlying rationale and science behind the decision should be applied toDefendant.Hearguesthatsincethebraindoesnotfullydevelopuntilage25,youngadultscantakeactionsthatarerash,impetuous,andunthinkingaboutconsequences.HebelievesthatthoseactionscanbeaccentuatedinapersonlikeDefendantwhoislearning-disabledandheavilyusedcontrolledsubstances.

The United States Supreme Court examined the rationale and science behind its decision to limit the holding to defendants under the age of eighteen at the time they committed their crimes. The Miller holding has been examined by numerous Courtssince2012andhasnotbeenextendedtodefendantsovertheageofeighteenat the time of their crimes. For example, the defendant in Commonwealthv.Lee used

similarargumentsinanattempttohavetherationalandsciencebehindtheMiller case extended to her case. Commonwealthv.Lee,206A.3d1,8(Pa.Super.2019).EventhoughLeewasovertheageofeighteenatthetimeshecommittedhercrimes,sheaskedtheSuperiorCourttoexpandtheholdinginMiller to apply to her by alleging “characteristicsofyouth”thatrenderedhercategoricallylessculpable.Id.Leecitedto“immaturebrain”studiestoarguethatherbrainwasunderdevelopedatthetimeofhercrime, and therefore, she could not form the requisite intent for second-degree murder. Id.at9.LeearguedthattheMillerrationaleshouldbeappliedtohercasetoprovideanexception to the PCRA time-bar. Id.

While the Lee Court’s focus was on the PCRA time-bar exception, which is notapplicabletothecaseathand,therationaletheSuperiorCourtappliedtotheaboveargumentsisinstructive.TheLeeCourtstated,“Thereisnoquestionthescientificstudies and principles underlying Millerinformeditsholding.OurSupremeCourt,in BattsII,7reviewedMiller, Roper8 and Graham,9 and discussed those principles atlength.Theexpressagelimit,however,thougharguablynotcriticaltotheMiller holding, is, in our opinion, essential to an orderly and practical application of the law. Conceptually,theremaynotbeanystatisticallysignificantdifferencebetweenthementalmaturityofa17-year-oldandan18-year-old,oran18-year-oldanda19-year-old,andsothe question becomes, where do we draw the line?” Lee,206A.3dat9.

Quoting the United States Supreme Court, the LeeCourtstated,“Drawingthelineat18yearsofageissubject,ofcourse,totheobjectionsalwaysraisedagainstcategoricalrules.Thequalitiesthatdistinguishjuvenilesfromadultsdonotdisappearwhenanindividualturns18.Bythesametoken,someunder18havealreadyattainedalevelofmaturitysomeadultswillneverreach.However,alinemustbedrawn....Theageof18isthepointwheresocietydrawsthelineformanypurposesbetweenchildhoodandadulthood.Itis,weconclude,theageatwhichthelinefordeatheligibilityoughttorest.”206A.3dat9-10,quotingRoperv.Simmons,543U.S.at574,125S.Ct.1183.

Defendant’s PCRA argument similarly asserts that the science and rationale behind Miller should be applied in this case. This Court will not extend the Miller scienceandrationaletoyoungadultsovertheageofeighteen.ItisclearthattheAppellate Courts and the United States Supreme Court purposely set forth the age limit for this argument, and this Court will not extend the ruling. Sentencing counsel cannot befoundtobeineffectiveforfailingtosetforthargumentsbeyondthecurrentstatusofthelaw.ItmustalsobenotedthatJudgeNaglewaswellawareofDefendant’sageatthetimeofthemurdersandDefendant’smental,intellectual,andcognitivestateatthetimeofsentencing.JudgeNaglewascertainlyawareoftheMiller line of cases that included thescienceofbraindevelopmentinyoungadults.Therefore,allofthisinformationwouldhavebeenconsideredbyJudgeNagleatthetimeofsentencing.Therefore,Defendant’s PCRA arguments are found to be without merit and must be denied.

Defendant’snextPCRAargumentisthattrialcounselwasineffectiveinadvisingDefendanttopleadguiltytoamaximumsentenceforonecountofthirddegree murder as this opened Defendant to the possibility of the same sentence on thesecondcountofmurder,whichtheCommonwealthmaynothavebeenabletoproveduetoDefendant’smentalstate.Thisappearstobeachallengetothepleaand negotiated sentence Defendant that entered on the count of third degree murder ofvictimCuahuctemoBedolla,withthenegotiatedsentenceoftwentytofortyyearsimprisonment, and subsequently a challenge to the open guilty plea on the count of thirddegreemurderofvictimJoseRodriguez.DefendantappearstohaveabandonedthisissueandargumentinhissubsequentPCRApleadings;howeverinthedutyofthoroughness, this Court shall address it.

Asdiscussedabove,DefendantpledguiltytoonecountofthirddegreemurderofvictimCuahuctemocBedolla,onecountofthirddegreemurderofvictimJoseRodri-guez,andonecountofcriminalconspiracytocommitthirddegreemurder.Head-mitted to the facts in support the plea and was sentenced pursuant to a negotiated plea agreementonthethirddegreemurderofvictimCuahuctemocBedolla.HeenteredanopenguiltypleatothirddegreemurderofvictimJoseRodriguezandconspiracyandwas sentenced by the Court.

Specifically,theGuiltyPleaColloquyFormexecutedbyDefendantstatesthatheadmitted that the following facts did occur:

OntheeveningofDecember3,2011,defendantJamesJonesconspiredwithmultipleindividuals,includinghiseleven(11)othercodefendants,mostofwhomweremembersofSurenos13,toattackmembersofarivalgang,theVikings,whowereattendingapartyoccurringat1641BaltimorePike,NewGardenTownship,ChesterCounty,Pennsylvania.Heandhiscodefendantstraveledto1641BaltimorePikewiththeintentionofattackinganymemberoftheVikingsfoundatthislocation.Thedefendantandhiscodefendantsagreedtoengageinthisattackpriortotheircollectivearrivalatthataddress.Furthermore,priortotheirarrival,thedefendantknewthatsomeofhiscodefendantswerearmedwithweapons,includingknives,sticksandpoles.Manyoftheweaponswereinplainviewofallofthecodefendants.Thedefendanthimselfwasarmedwithalargeknife.

Thedefendantandhiscodefendantswentto1641BaltimorePikeintwoseparatecars.Wheneveryonearrived,thedefendantandhiscodefendantsgotoutofthevehiclesandsplitintotwogroups.Eachgroupwentaroundadifferentsideofthetraileraspartofacoordinated,armedattack.JamesJoneswaspartofoneofthesegroups that came around the trailer. With wanton and willful disregard totheriskthathisconductwouldcausedeathorseriousbodily,thedefendantandhiscodefendantsoverwhelmedandphysicallyattackedtwopeople,CuahuctemoBedollaandJoseRodriguez.Duringthisassault,BedollaandRodriguezwerestabbedmultipletimes.BothBedollaandRodriguezdiedasaresultofthesestabwoundsandasaresult of this assault.

Mr.Joneswasdirectlyandactivelyinvolvedinthisphysicalassault.Indeed,byhisownadmission,Mr.JonesstabbedCuahuctemoBedollaatleastthreetimes.BloodfromMr.RodriguezwasfoundonthebladeofMr.Jones’sknifeandonasneakerhewaswearing.

Mr.JonesacknowledgeshisdirectresponsibilityforthedeathofCuahuctemoBedollaandacknowledgeshisresponsibilityforthedeathofJoseRodriguezasanaccompliceandco-conspirator.

AttheAugust23,2013pleahearing,theattorneyfortheCommonwealthstatedasfollows:

MS.CARDAMONE:Thefactofthepleasareasfollows:OntheeveningofDecember3rd,2011JamesJonesconspiredwithmultipleindividualsincludingelevenotherco-defendantsmostofwhomwereSerrano13attackmembersofarivalgang,theVikings,

whichwereattendingapartyat1641BaltimorePike,NewGardeninChester County.

Thedefendantandhisco-defendanttraveledto1641BaltimorePikewiththeintentofattackinganymemberoftheVikingsfound at this location. The defendant and his co-defendant agreed to engageinthisandtalkedpriortotheirarrivalatthataddress,priortothearrival,knewthatsomeofhisco-defendantswerearmedwithweapons,knives,sticksandpoles.Manyoftheweaponswereinplainviewofalloftheco-defendants.Thisdefendanthimselfwascarryingalargeknifewhenhewenttothesceneofthisassault.

Thedefendantandhisco-defendantwentto1641BaltimorePikewiththeintentofattackinganymemberoftheVikingsfoundatthis location. The defendant and his co-defendant agreed to engage in thisandtalkedpriortotheirarrivalatthataddress,priortothearrival,knewthatsomeofhisco-defendantswerearmedwithweapons,knives,sticksandpoles.Manyoftheweaponswereinplainviewofall of the co-defendants. This defendant himself was carrying a large knifewhenhewenttothesceneofthisassault.

Thedefendantandhisco-defendantwentto1641BaltimorePikeintwoseparatecars.Wheneveryonearrivedthedefendantandco-defendantgotoutofthevehicleandsplitthisintotwogroups.EachgroupwentaroundthesideofthetraileraspartofthecoordinatedattackJamesJoneswaspartortheoneofthesegroupsthatcamearoundthetrailerwithwantonandwillfuldisregardandthatriskwould cause death or serious bodily injuries.

Thedefendantandco-defendantoverwhelmedandphysicallyattackedtwopeople,CuahuatemoBedollaandJoseRodriguez.Duringthisassault,Mr.BedollaandMr.Rodriguezwerestabbedmultipletimes.BothMr.BedollaandMr.Rodriguezdiedasaresultofmultiplestabwoundsasaresultofthisassault.Mr.Joneswasdirectlyandactivelyinvolvedinthisphysicalassault,byhisownadmission,Mr.JonesstabbedCuahuatemoBedollaatleastthreetimes.

Moreover,bloodfromMr.Rodriguez,thevictim,wasfoundonthebladeoftheknifecarriedbyMr.JonesaswellasonasneakerthatMr.Joneswaswearing.Mr.JonesacknowledgeshisdirectresponsibilityforthedeathofCuahuatemoBedollaandacknowledgeshisresponsibilityforthedeathofJoseRodriguezasanaccompliceandco-conspirator. They are the facts in support of this plea, Your Honor.

knowingly,intelligentlyandvoluntarilygiven.IwatchedcarefullyyourdemeanorduringthecourseofthecolloquyandIdobelievethatyourpleasareknowingandvoluntaryinthiscase.

(N.T.,8/23/13,pgs.7-19). Inexchangeforenteringguiltypleastothreecounts,theremainingtwelve

counts were withdrawn by the Commonwealth. Defendant’s allegation that counsel wasineffectiveforadvisingDefendanttopleadguiltytothirddegreemurderwithatwenty to forty year negotiated sentence because it opened Defendant to the possibility ofthesamesentenceontheothercountofthirddegreemurderiswithoutmerit.Itwas

perfectlyclearthatDefendantdecidedtotakehischancewiththesentencetheCourtmay impose after an open plea. Defendant was aware of the maximum sentence of forty years to that charge, as that is the sentence he agreed to on the same charge.

Defensecounselvigorouslyarguedatsentencingthathissentenceonthesecond third degree murder charge should be in line with the sentences his co-defendantsreceived.Theseargumentsweredirectlyrelatedtotheculpabilityofeachof the co-defendants and the role they played in the crimes. The Court’s rejection of defense counsel’s argument because it found Defendant to be the most culpable among alltheco-defendantsdoesnotmeancounselwasineffective,nordoesitmakecounsel’sadvicetoenterthepleaineffective.

IfDefendantwenttotrialandwasconvictedofthefirstdegreemurdercharge,hewouldhavereceivedlifeimprisonment,pursuantto42Pa.C.S.A.§9711(a).IfDefendant was found guilty of conspiracy to commit murder of the third degree, he wasfacingamaximumsentenceoffortyyearsimprisonment,pursuantto18Pa.C.S.A.§1102(d)and18Pa.C.S.A.§905(a).IfDefendantwasfoundguiltyofmurderofthethirddegreeofvictimCuahuctemocBedolla,hewasfacingamaximumsentenceoffortyyearsimprisonment,pursuantto18Pa.C.S.A.§1102(d).IfDefendantwasfoundguiltyofmurderofthethirddegreeofvictimJoseRodriguez,hewasfacingamaximumsentenceoffortyyearsimprisonment,pursuantto18Pa.C.S.A.§1102(d).

IfDefendantwasfoundguiltyofvoluntarymanslaughter,asafelonyofthefirstdegree,hewasfacingamaximumsentenceoftwentyyearsimprisonment,pursuantto18Pa.C.S.A.§1103.IfDefendantwasfoundguiltyoftwocountsofinvoluntarymanslaughter,amisdemeanorofthefirstdegree,hewasfacingamaximumsentenceoffiveyearsimprisonmentoneachcount,pursuantto18Pa.C.S.A.§1104.IfDefendantwasfoundguiltyoftwocountsofaggravatedassault,afelonyofthefirstdegree, he was facing a maximum sentence of twenty years imprisonment on each count,pursuantto18Pa.C.S.A.§1103.IfDefendantwasfoundguiltyoftwocountsof simple assault, a misdemeanor of the second degree, he was facing a maximum sentenceoftwoyearsimprisonmentoneachcount,pursuantto18Pa.C.S.A.§1104.IfDefendantwasfoundguiltyoftwocountsofrecklesslyendangeringanotherperson,a misdemeanor of the second degree, he was facing a maximum sentence of two years imprisonmentoneachcount,pursuantto18Pa.C.S.A.§1104.IfDefendantwasfound guilty of riot, a felony of the third degree, he was facing a maximum sentence of sevenyearsimprisonment,pursuantto18Pa.C.S.A.§1103.IfDefendantwasfoundguiltyofpossessinginstrumentsofcrime,amisdemeanorofthefirstdegree,hewasfacingamaximumsentenceoffiveyearsimprisonment,pursuantto18Pa.C.S.A.§1104.

Therefore,evenifDefendantwasfoundnotguiltyofthefirstdegreemurdercharge, if he was found guilty of all the other charges and the imprisonment sentences weretorunconsecutively,Defendantwasfacingamaximumoftwo-hundredandtenyearsimprisonment.Basedonthetotalityofthecircumstances,includingthestrongevidenceagainstDefendantforthesemurders,defensecounsel’sadvicetoentertheguiltypleawasnotineffectiveandDefendant’sPCRAargumenttothecontraryiswithout merit.

Defendant’sfinalPCRAargumentconcernscharacterwitnessstatementshereferencedinhisAugust26,2019SupplementalReplytoCommonwealth’sAnswer/MotiontoDismissandattachedtohisJune21,2021pleading.Heallegesthatwithoutthetestimonyofthecharacterwitnesses,theCourtdidnothavealltheevidenceitneededtoproperlysentenceDefendant.ThePennsylvaniaSupremeCourthasheldthat“[t]herearetworequirementsforreliefonanineffectivenessclaimforafailuretopresentwitnesstestimony.Thefirstrequirementisprocedural.ThePCRArequiresthat,tobeentitledtoanevidentiaryhearing,apetitionermustincludeinhisPCRApetition‘asignedcertificationastoeachintendedwitnessstatingthewitness'sname,address,date of birth and substance of testimony.’” Commonwealthv.Reid,99A.3d427,438(Pa.2014),citing42Pa.C.S.A.§9545(d)(1)andPa.R.Crim.P.902(A)(15).“Thesecondrequirementissubstantive.Specifically,whenraisingaclaimforthefailuretocallapotentialwitness,toobtainrelief,apetitionermustestablishthat:(1)thewitnessexisted;(2)thewitnesswasavailable;(3)counselwasinformedorshouldhaveknownoftheexistenceofthewitness;(4)thewitnesswaspreparedtocooperateandwouldhavetestifiedondefendant'sbehalf;and(5)theabsenceofsuchtestimonyprejudicedhim and denied him a fair trial.” Reid,99A.3dat438,citingCommonwealthv.Carson,741A.2d686,707(Pa.1999).

Defendant has failed to comply with these requirements. Defendant did not fileacertificationorevenallegethathetoldsentencingcounselaboutthepotentialcharacterwitnesses.Eventhoughthereweresevencharacterwitnesslettersattachedtothepleading,Defendantsuppliedacertificationfromonlyoneofthosesevenindividuals.ThecertificationsubmittedbyDefendant’sbrother-in-lawGregoryEscobarstatesthatafterDefendantwasconvicted,Mr.EscobarwenttoseecurrentPCRAcounsel,Mr.Brown.Mr.Escobar’scertificationstatesthat,“Mr.BrownrequestedthatIobtaincharacterlettersforMr.JonesandIhavecontactedmanypeople,whoeithersentcharacterletterstomeorsentthemdirectlytoMr.Brown.Ididnotadvisethesepersonsthattheyhadtotestify,butIrequestedthattheyprovidesuchcharacterletters.However,ifIhadbeencalledasacharacterwitness,Iwouldhavebeenreadywillingandabletodosoandwouldhavefreelydoneso.Infact,iftheCourtneedsmetotestifyduringtheseproceedingsIwilltestifynotonlyastohischaracter,butastomyprocuringallthecharacterlettersforJamesJones.”

Mr.Escobar’scertificationisclearthathewasincontactwithcurrentPCRAcounsel and fails to allege that he went to see or contacted Defendant’s counsel at the timeofconvictionandsentencing.TheremainingcharacterwitnessstatementsdonotstatethattheywerepreparedtocooperateandwouldhavetestifiedonDefendant'sbehalf at sentencing. The character statements do not state whether or not they wereaskedtotestifyorsubmitcharacterlettersatthetimeofsentencing.Nordothecharacterstatementsstatethatiftheywereasked,theywouldhavedonesoatthetime.IthasbeenapproximatelysevenyearssinceDefendantwassentencedandapproximatelysixyearssincehewasresentenced.Thatisasignificantamountoftimeforpotentialwitnessesto“comearound”andnowbewillingtotestifytosomethingthattheymaynothavebeenwillingtotestifytoin2013and2014,closertothe

murders. Defendant has failed to meet his PCRA burden of proof and his issue must be denied.

Inconclusion,Defendant’sPCRAclaimthatsentencingcounselwasineffectiveisfoundtobewhollywithoutmeritandmustbedismissed.Sincesentencingcounselwasdeemedeffective,appellatecounselcouldnotbefoundtobeineffectiveforfailingtoraisetheseissuesonappeal.
