Re-use of Public Sector Information – Review of Directive 2003/98/EC – [SEC(2009) 597]

The publication commenced the next review period that will run for three years from 2009 through to 2012.

The European Commission 5th Ministerial eGovernment Conference:(Malmö, Sweden on the 18th November 2009)

The importance of the re-use of PSI was endorsed and re-iterated. (Almost 10 years since the March 2000, Lisbon Treaty)

Under paragraph 11 of the Declaration, public administrations should therefore:

“Increase availability of public sector information for re-use. We will increase availability of public sector information for reuse, in accordance with the spirit of and the conditions established by Public Sector Information Directive 2003/98/EC. We will encourage the reuse of public data by third parties to develop enriched services that maximise the value for the public. New demand-led information products and services enabled by the reuse of public sector information will support the transition of Europe to a knowledge-based economy.”

The European Commission actions continued:

On the 23rd March 2010 the European Commission led PSI Group launched four working groups to assist the Commission with preparatory actions for commissioning a PSI economic measurement study and a PSI economic study on charging models. The working groups completed their work on 9th May 2010.

• Is Europe’s One-stop Shop on Public Sector Information re-use

• The platform is funded by the European Commission for a period of two years from 1st March 2009 through to the 28th February 2011.

• Four public meetings: Stockholm (Nov 09), Madrid (June 2010), London (Nov 2010)

• The platform is a European Commission service contract – the service is provided to support all PSI stakeholders .

The Commission stated in the Communication:

Terminating Exclusive Arrangements

The Commission will closely scrutinise observance of this obligation. It will launch an exercise investigating the extent of such arrangements in summer 2009.

Member States to:

- Ensure full and correct implementation and application of the Directive

- Terminate exclusive arrangements as prescribed by the Directive

- Apply licensing and charging models that facilitate the re-use of PSI

- Ensure fair competition between public sector bodies and re-users

In addition, Member States are encouraged to promote the identification and ready availability of information resources and to set up quick and inexpensive conflict resolution mechanisms.
