1. Notice Inviting Tender
CEPT University (referred as a “Client” hereafter) is inviting sealed quotations from established,
reputed and experienced firms to construct new bore-well at CEPT University.

Terms:
A. Complete set of tender document will be available on CEPT University website
http://cept.ac.in/tenders from 15/05/2019 to 07/06/2019.
B. Interested parties are needed to attend pre-bid meeting session as mentioned above at
“bid submission address” to get brief idea about the services.
C. It is advisable to refer all tender documents carefully before submitting the tender.
D. Bid submitted other than specified format and without earnest money deposit will be
straightaway rejected without any prior information.

E. The envelopes containing the two bid documents must be separately labeled as “offer for
new bore-well construction - technical bid” and “offer for new bore-well construction -
financial bid”. Third envelop should contain the Tender fee and EMD (separate DD/pay-
order respectively) in valid format.
F. All the three envelops as above shall be inserted in another envelop with name and
address as mentioned below and envelop shall be labeled as “offer for new bore-well
construction”. Complete bids must be submitted in hard copy format only on or before
the date, time and at the following address.

G. CEPT University will not be responsible for any delay in bid submission caused by
courier/post.
H. For any query related to scope of work, terms and other information mentioned in tender

I. CEPT University reserves right to accept or reject any bid, and to cancel the bidding
process and reject all bids, at any time prior to award of contract, without incurring any
liability to the affected bidder or bidders.
2. Eligibility Criteria
2.1. Bidder must possess statutory requirement:

2.2. Bidder should have valid license for construction of new bore-well (if any).
2.3. Bidder should have experience in construction of new bore-well at reputed and
established organizations not less than 05 years.
2.4. Bidder should have average annual turnover of Rs. 20 lakh for last 3 financial years.
Balance sheet certified by chartered accountant for last 3 financial years to be
furnished.
2.5. Bidder should not have been black listed by any central/state govt. /Autonomous
body/PSU. Declaration to be furnished.
If any of the information provided by the bidder is found to be incorrect or fake, the contract
will be terminated and EMD/security deposit will be forfeited.

Section-I Instruction to Bidders
4. Rates, Taxes and Prices:
4.1. Bidders should quote unit price in the prescribed financial bid format as per Annexure-F
4.2. Prices quoted shall be exclusive of all taxes but inclusive of all other statutory charges,
allowance, transportation charges and management fees etc.
4.3. Prices quoted and accepted shall be valid for the period of contract and will be binding
on the bidder. No variation will be permitted in quoted prices during the contract period.
5. Tender Fee:
5.1. Tender fee to be prepared in favor of “CEPT University” through demand draft/pay order
only.
5.2. Tender fee submitted by bidder is non-refundable and will not be refunded in any case.
6. Earnest Money Deposit (EMD):
6.1. EMD to be prepared in favor of “CEPT University” through demand draft/pay order only.
6.2. EMD for unsuccessful bidders will be refunded within 30 working days from the date of
award of contract.
6.3. EMD can be forfeited if the bidder fails to commence the work as per contract schedule.
6.4. There will be no Interest payable on EMD.
7. Bid validity
7.1. Proposal will remain valid for 90 days from the date of submission.
8. Bid submission
8.1. The technical and financial bids must be submitted in separate sealed covers in the
format as prescribed in the Annexures at the end of the document.
8.2. Bidders are advised to visit the campus well in advance from the date fixed for
submission of the tender. A bidder shall be deemed to have full knowledge of all the
relevant documents, site, and nature of work.
8.3. Proposals with EMD and other require documents only be considered for further
evaluation process.
8.4. Proposals received after the prescribed time and date shall be rejected.
9. Bid Opening
9.1. Initially the technical bid will be opened for initiating technical evaluation.
9.2. Technical bid evaluation shall include financial strength, technical competency and
work experience etc. detailed procedure for technical bid evaluation described in
clause no.10.
9.3. Financial bid of those bidders, who gets qualified in technical bid evaluation, will only be
considered.
9.4. Client is not bound to accept the lowest bid and may reject any proposal or any part of

the proposal without assigning any reason therefore.
9.5. The president, CEPT University reserves the right to reject whole or any part of the
proposal and to split up the requirements or change any of the conditions without
assigning any reason.
10. Bid Evaluation
10.1. Technical bids will be opened by technical evaluation committee and as mentioned in
below table-1, marking will be done for each criterion after verifying the valid and
relevant supporting documents submitted by bidder.

Minimum 70 marks will be mandatory to qualify for financial bid opening.
10.2. During the evaluation process, if requirement of any additional information arises, bidder
will be asked to furnish the same in stipulated time duration.
10.3. Once the technical bids evaluation process gets completed, financial bid of qualified
bidders will be opened for further process.
10.4. It is not necessary that contract will be awarded to the lowest bidder. CEPT decision will
be final in taking a final call for contract.

11. Security Deposit & Retention Money:
11.1. EMD of successful bidders will be retained as security deposit.
11.2. An amount of 5% of final certified bill amount will be kept as retention money for the
period of 1 year from the date of submission of certified final bill.
11.3. Security deposit and retention money can be forfeited if bidder fails to deliver required
items and services as per contract conditions.
11.4. Security deposit will be released after completion of bore-well construction alongwith
final bill payment and retention money will be refunded within 2 months after
successfully completion of 1 year from the date of submission of certified final bill. There
will be no interest payable on it for the said period.
12. Award of Contract
12.1. The Service contract will be awarded to the successful bidder whose bid has been
considered most suitable in terms of technically and financially for the said work.
12.2. Client reserves the right to cancel or revise or modify the contract terms without giving
any reasons.
12.3. President, CEPT University shall be the final authority to reject full or any part of the
Contractors/contractors contract, which is not confirming to the specifications and
other terms and conditions. No payment shall be made for unsatisfactory service(s).
13. Payment Terms
13.1. Mobilization advance of Rs. 50,000/- to be paid against submission of Proforma invoice
after release of work order and mobilization of rig/drill machine at site.
13.2. Advance payment for goods purchase willl be paid of 75% of its purchase cost against
submission of copy of goods purchase invoices and delivery at site.
13.3. On successfully completion of bore-well and against submission of certified final bill rest
bill amount will be paid (except retention money).
13.4. An amount of 5% of total work order value will be kept as retention money and shall be
released alongwith security deposit after successfully completed of 1year period from
the date of submission of certified final bill.
13.5. All the payments shall be paid within 15-21 days of bill submission and satisfactory
completion of above mentioned conditions for each bill type.

Section – III: Conditions of Contract
15. General Conditions of Contract-
15.1. The Vendor shall be solely liable for all payment/dues of the Workers employed and
deployed by it. The Vendor shall fully indemnify CEPT University against all the
payments, claims, and liabilities whatsoever incidental or directly arising out of or for
compliance with or enforcement of the provisions of any of the labor or other laws to
the extent they are applicable to establishment /work in CEPT University
premises/facility.
15.2. Any liability arising on client due to Vendor’s work shall be deducted from the bills of
the Vendor and if the full amount is not recovered then the same shall be recovered
from the security deposit of the Vendor. Client will not be accountable for any liability
towards the workers of the Vendor.
15.3. Client reserves the right of altering the specifications of works of adding to or removing
any items of work or of having portions of the same carried out departmentally or
otherwise and such alterations and variations shall not violate this contract.
15.4. In the event of the Vendor fails to execute the work under contract in whole or in part
an alternative arrangement will be made by client at the risk and cost of the Vendor
besides applicable fine/ penalty.
15.5. The Vendor shall be liable to pay compensation against any loss and damage caused
to property of client or its students by the Vendor or his staff.
15.6. The Vendor shall personally be responsible for the conduct of his staff and in case of
any complaint received against any staff; Vendor will be under obligation to change
the worker when instructed by authority. The Vendor shall observe all the laws and will
be responsible for any prosecution or liability arising from breach of any of those laws.
Client will not hold any responsibility with regard to staff on the role of the Vendor what
so ever.
15.7. The Vendor and his staff shall follow the rules and regulations of the institute in force
and instructions given to them from time to time. Client reserves right to take action
against the Vendor for violating the same.
15.8. Vendor’s staff shall follow necessary record procedures performed by security
endorsements at entry points of client premises while entering and existing the client
premises.
15.9. Any action on the part of the Vendor to influence any officer of the institute or
canvassing in any form shall make the bid liable for rejection.
15.10. Vendor will be fully responsible for any accident or mishaps involving workers engaged
by the Vendor and the Vendor would pay claims made on this part. The Vendor shall
indemnify the institute from any claims arising out of accidents, disabilities of any nature
or death arising out of provisions under law, or any other nature in respect of all workers
engaged by the bidder. The staff engaged by Vendor for working at client premises
must be covered under accidental and life insurance by Vendor and supporting
document to be submitted with client.
15.11. Vendor shall ensure that the personnel deployed by it are disciplined and do not
participate in any activity prejudicial to the interest of the Client /Govt. Of India/any
State/or any Union Territory.

15.12. In case of any theft or pilferages, loss or other offenses, Vendor should investigate and
submit a report to client and maintain liaison with the police. FIR will be lodged by
client, wherever necessary. If need be, joint inquiry comprising of both the parties shall
be conducted and responsibility fixed.
15.13. For any dispute regarding any work order terms, decision of The President-CEPT
University will be final and binding to Vendor.
15.14. Vendor will have to communicate the name of his authorized person, who shall be
present on the works, and shall be authorized to sign the material requisition, receive
instruction given verbally or on the order book, on behalf of the vendor.
15.15. Vendor will have to get prior approval from client’s officer Incharge for any disposal of
material/ground water on site, without pre-approval no disposal will be permitted on
site.
15.16. For any additional work Prior-approval from client will be mandatory before starting of
work.
16. Special Conditions of Contract
16.1. Vendor has to start the work within 1 week and to complete the work within 3 weeks
from release of work order.
16.2. The vendor shall at their own expenses make all necessary provisions for housing, water
supply, and sanitary arrangements for their workers as well as for works and shall pay
direct to the authorities concerned, all rates and taxes.
16.3. The vendor shall make their own arrangements for the necessary approach, road, for
transport of their materials and be responsible for the compensation on account of
damage to CEPT university property till completion of work.
16.4. All the royalty charges, Octroi and other duties & all taxes will be paid by the vendor;
CEPT University will not be liable for such expenses.
16.5. Any material that required to store in CEPT University premises should be kept in
organized manner and should not obstruct routine working. No unnecessary material
should be stored in CEPT University premises. Approval of storage of any such material
should be taken in advance.
16.6. Any un-approved material found stored on CEPT University premises shall be removed
immediately failing to which CEPT University have the right to remove it, at the risk and
cost of the vendor and even to destroy it.
16.7. Any extra work that is required to be done other that stipulated in work order; must be
discussed and approved from CEPT University representative for settlement of extra
work claim.
16.8. On completion of the work, the site shall be cleared by the Vendor within the stipulated
period of time, and shall be handed over in its original state to CEPT University.
16.9. Damage to work clause:
The vendor is solely responsible for all materials, machinery, tools and any temporary
structure made to carry out the work till the time work is completed and handed over
as per the standard and specification mentioned in contract. Until the handover of
work, the vendor will take all necessary precautions to keep all the aforesaid works,
materials, machinery, and plant tools.

16.10. Any components or part of the work shall not be given to any subcontractor without
approval of the competent authority of the CEPT University. The whole responsibility of
the execution of the work, as per the terms and conditions of the contract, will entirely
rest of the main contractor. The main contractor shall always keep his responsible
representative, preferably a technical hand, on work site with powers to sign M.R.s and
take necessary decision and implement the instructions issued in the interest of efficient
execution of the works.
16.11. The Officer-in-charge will fix the hours of work shall be executed beyond that period,
during night time or in absence of the Officer-incharge of his authorized agent.
16.12. Vendor will be asked to present the sample of materials, and the approved samples
will be preserved at the site of work, and no charge in the approved sample will be
allowed, without the written permission of the CEPT University representative.
16.13. In any work is not executed according to the specifications, and the directions of the
CEPT University representative, the same will be rejected, and the contractor has re
execute the same without any financial implication to the CEPT University.
16.14. Contractor need to submit all necessary information prescribed format shown in
Annexure-I to client after completion of project.
17. Warranty Terms
17.1. Vendor will be fully responsible for providing free of cost service for any breakdown
happened during period of 1 year from date of submission of certified final bill.
17.2. Warranty /Guaranty for equipment and materials used for Bore-well will be applicable
as per manufactures terms but not less than 1 year.

Annexure-C: Agreement Pro forma (Draft)
AGREEMENT for providing Security services at CEPT University and its premises at Navrangpura Ahmedabad Agreement No. Dt:- This agreement made on (date of agreement) between CEPT University (hereinafter called as
“client”) of the one part and m/s. _______________________________________ (hereinafter called the
"Contractor") on the other part.
Whereas the client being desirous of having provided and executed certain works mentioned,
enumerated or referred to in the scope of work and other conditions of the "proposal" and
acceptance thereof, copy hereto annexed, all of which are deemed to form part of this
contract and are included in the terms contract whenever herein used.
And whereas the company accepted the tender of contractor for New bore-well construction at
CEPT university. The provision and the execution of the said work at the rates stated in the
“financial bid” (hereinafter called the "contract price ") which is annexed. The contracted value
works out to Rs.______ (rupees _____). Reference (bid proposal and related correspondence)
Now this agreement witnessed & it is hereby agreed and declared as follows:
1. In consideration of the payments to be made to the contractor for the work to be executed
by t, the Contractor does hereby covenant with the client that the Contractor will duly
provide, execute, and complete the said work within the period specified in the contract,
perform all other acts to be implied there from or may be reasonably necessary for the
completion of the said works and in the manner and subject to the terms and conditions or
stipulation mentioned in the contract.
2. The works shall be executed as per terms & conditions laid down in the tender document.
3. Security deposit and retention money.
a) After successfully qualified for award for contract, earnest money deposit submitted by
Contractor at the time of bidding process will be retained as security.
b) 5% of total bill amount (exclusive of taxes) will be kept as retention money.
c) Security deposit will be released after completion of bore-well construction alongwith final
bill payment and retention money will be refunded within two months after successful
completion of 1 year from the date of submission of certified final bill, there will be no
interest payable on it for said period.
d) Wherever the contracts are rescinded, the security deposit and retention money can be
encased and the balance work will got done separately.
e) The original Contractor shall be debarred from participating in the bidding process for
executing the balance work. If the failed Contractor is JV or a partnership firm, then every
member/partner of such a firm would be debarred from participating in the bidding
process for the balance work either in his/her individual capacity or as a partner of any
other JV/partnership firm.

The cost of stamp paper on this account shall be borne by Contractor.
4. All disputes arising out of this agreement and all question relating to the interpretation of this
agreement shall be decided by the CEPT University and the decision of the CEPT University
shall be final.
