1. Call to Order/Roll Call Sarah Lefebvre called the meeting to order at 7AM. Quorum was established.

2. Conflict of Interest Disclosure Sarah Lefebvre asked for any conflicts of interest regarding action items on the agenda. Sarah & Jeff disclosed conflicts with Knik Arm Project if becomes action item.

3. Approval of Agenda

MOTION: A motion was made by Stan Halvarson and was seconded to approve the meeting agenda as presented. No further discussion, the motion carried without objection.

4. Approval of Minutes

February 5, 2015 Amendments to minutes include: adding Deb Hickok to attendance and add that Jeff Roach declared a conflict as well as Sarah & David. MOTION: A motion was made by Jeff Roach and was seconded to approve the meeting minutes as amended from February 5, 2015. No further discussion, the motion carried without objection.

6. Seward Highway Midtown Congestion Relief Project Funding

An email from Jeff Roach was included in the meeting packet as a follow up from the Feb. 5 meeting. Project funding for the Seward Hwy Midtown Congestion Relief including 36th and Seward Intersection (PJ 54629) -- Both amend. #11 & #12 showed no funding in FFY15 and $270 million in the “after ‘15” column. This project is not part of Amend. #13 (dealing with the removal of funding from the mega projects) so the project remains in the STIP.

7. Federal Highway Transportation Fund Sarah presented the coalition letter from ACCE regarding Federal Highway Transportation fund to the Government Relations Committee on Tuesday, February 10 – the GRC also unanimously supported signing on to the coalition letter. Sarah also updated committee on the American Road Association letter she received – forwarded to Congressman Don Young and he has since signed on to a similar letter.

8. Knik Arm Crossing Letter of Concern Update

Sarah presented to the Board on Monday, February 9. Joining her from the committee was Tom George & Donna Gardino. Based on feedback Sarah distributed additional drafts from documents for the committee to review. The Board raised some concerns with the intention of the letter and requested that the committee consider those recommendations made at the meeting and bring back for consideration at the next Board meeting.

Impacts to relationship with Mat-Su Borough; do we need to take action; is letter clear and to the point about what we are stating. Board requested letter be more direct.

Tony Johansen from Great Northwest discussed project with Sarah & Clark - does not believe substantial savings to the state will result from Knik Arm – does not support the project. Committee discussed whether to proceed with any letter or not based on relationships with other legislative delegations across the state and actions regarding energy. State’s budget is limited – is this best use of state funds? Knik Arm Project has lots of funding sources to include several federal funds – state has general funds that could match – for that reason, weighing in is important. Are we getting ahead of Mat-Su Borough – where are they at right now – are they pushing for the bridge? Finishing the rail connection might be more reasonable to support related to the AKRR’s application to rail LNG in ISO tanks. Possible committee actions: 1) Submit to Board for approval but on the basis of submitting, only IF the Mat-Su delegation/area is pursuing; 2) refine letter to be comments in the STIP; 3) take no action. Multiple stakeholder positions to consider – reach out to Mat-Su folks and City of Anchorage folks. STIP 13 comments are open until Feb. 13, 2015 – funding for these projects is removed in current STIP. STIP 14 is being drafted now but may not address these projects at all.

Lisa provided next board meeting – either Feb. 23 or March 2. Topic could be discussed at GRC teleconference with Interior Delegation on Feb. 17. Sarah, Lisa (Chambers & Legislators) & Donna (Mat-Su Borough planning department regarding long-range planning) will reach out to Mat-Su to determine where they are with the project and report back to committee at next meeting. Mat-Su received $1m (earmark money) to develop long-range plan in STIP. Motion to hold letter from moving forward until reaching out to Mat-Su Borough Chambers & Planning Department and Mat-Su legislators and bring back to committee at next meeting was made by Tom George and was seconded. No further discussion took place.

NEW BUSINESS

9. Legislative Priority: Support Creation of an Alaska Transportation Infrastructure Funding Program

Sarah provided briefing on the stakeholder meetings that have occurred. Received feedback from legislators – group is going to work on a plan of action for moving forward. Four areas that need to be addressed; 1) where money would come from; 2) how secured; 3) how allocated and 4) what projects would be included? Sarah will continue to update committee as it moves forward.

10. Review Transportation-related Bills (Support/Monitor/Oppose) & Assign Committee Members to Follow

HB1 & SB 16 Arctic Policy for State – Monitor at this point HB 21 relating to transit authorities – what impact does it have? Not sure why this bill is being introduced. Jeff will research and bring information to next meeting. HB 24 relating to engineering and surveying – Donna will reach out to Rep. Kitto to find out what the importance of the bill is. HB 62 relating to off-highway driver’s licenses – how does it relate to business – rural employees of businesses transporting of goods. What is TCC’s position? HB 88 & SB 33 relating for tire fees – monitor at this point. HB 91 relating to operating motor vehicles – no impact to business – remove from list SB 19 relating to road service boundary changes – Lance Roberts discussed this at the GRC a few weeks ago; believe FNSB may have brought this forward – advocate support because all of the road service areas are expensive. Do not need to actively support.

REPORTS & COMMUNICATIONS

1. Highway STIP 13 public comment period closes tomorrow.

2. Rail AKRR presented to FEDC on Tuesday – application to apply for transportation ISO tanks on railroad has been submitted.

3. Aviation Tour of August Westin Helicopter Tour company – thank you to Stan for organizing that.

6. Executive Director Report Commend Sarah and the work group for a great presentation to the Board on Monday. Well-organized and the letter was well-written. Upcoming Army Force Reduction listening session on Feb. 24 – please save the date. US Chamber teleconference tomorrow regarding West Coast Port Labor Disputes – emailed information to the committee this morning – members are invited to call in. Lisa has registered for the call.

8. Committee Member Comments Donna’s husband is doing a report on his trip to Antarctica on Feb. 17 at 7pm at Schiable Auditorium. Clark reported that Libby Martin got a job in California yesterday.

Sarah, I talked to David Levy with the Alaska Mobility Coalition (AMC) this morning regarding HB21 Relating to Regional Transit Authorities. He said AMC was surprised by the legislation. He discussed it with the sponsor Rep. Josephson. Rep. Josephson said that the legislation was geared towards the transportation issue between Anchorage and the Mat-Su Borough. It was apparently in response to action that was taken a few years ago by Mat-Su that supported the AKRR commuter train initiative. David said the intent was to improve the transit connection between Anchorage and the Mat-Su Borough, but he does not believe much thought was given to any impacts to the rest of the state. After talking with members of the Mat-Su delegation, David is convinced that they do not support the legislation and he does not expect the legislation to go anywhere. Lisa,  Jeff Putnam checked in to this, reference following email messages from Jeff and Chris Miller.  APDC is Alaska Professional Design Council and as such represents the Architecture, Engineering, and Land Surveying community in Alaska.  Design Alaska also supports the bill and so should Chamber.  The level of support we recommend is merely to show support when asked; no overt measures, like a letter of support, are warranted.  Thanks for checking, Jack  

From: Putnam, Jeff  Sent: Thursday, February 12, 2015 8:48 AM To: Miller, Chris; Wilbur, Jack Subject: RE: HB 24 ‐ Relating to the procurement of architectural, engineering, or land surveying services under state‐funded contracts  I spoke with John Pekar, Pres Elect with APDC, to find out the backstory behind this.  APDC has been the advocate behind having this wording shown in 36.90.110 as well as 36.30.270 because they felt that the additional statements in 36.90.110 (which is a general procurement code) would reach down to local municipalities and affect their procurement procedures.  APDC has found that some local municipalities are taking the approach that 36.30.270 does not apply to them but most accept that 36.90 does.  This should benefit us and we should support it and encourage the Chamber to support it.  John is in Juneau now lobbying this provision and said that most officials he has spoken to understand and accept the language.  

From: Miller, Chris  Sent: Thursday, February 12, 2015 8:03 AM To: Wilbur, Jack; Putnam, Jeff Subject: RE: HB 24 ‐ Relating to the procurement of architectural, engineering, or land surveying services under state‐funded contracts  This language already seems to exist in the main section of the procurement code.  (from legislature website)   It seems more appropriate in this 36.30.270 section, instead of miscellaneous provisions.      

Sec. 36.30.270. Architectural, engineering, and land surveying contracts.

(a) Notwithstanding conflicting provisions of AS 36.30.100 - 36.30.260, a procurement officer shall negotiate a contract for an agency with the most qualified and suitable firm or person of demonstrated competence for architectural, engineering, or land surveying services. The procurement officer shall award a

contract for those services at fair and reasonable compensation as determined by the procurement officer, after consideration of the estimated value of the services to be rendered, and the scope, complexity, and professional nature of the services. When determining the most qualified and suitable firm or person, the procurement officer shall consider the

(1) proximity to the project site of the office of the firm or person unless federal law prohibits this factor from being considered in the awarding of the contract; and

(2) employment practices of the firm or person with regard to women and minorities.

(b) If negotiations with the most qualified and suitable firm or person under (a) of this section are not successful, the procurement officer shall negotiate a contract with other qualified firms or persons of demonstrated competence, in order of public ranking. The procurement officer may reject all or part of a proposal.

(c) This section does not apply to contracts awarded in a situation of public necessity if the procurement officer certifies in writing that a situation of public necessity exists.

(d) Notwithstanding the other provisions of this section, a procurement officer may include price as an added factor in selecting architectural, engineering, and land surveying services when, in the judgment of the procurement officer, the services required are repetitious in nature, and the scope, nature, and amount of services required are thoroughly defined by measurable and objective standards to reasonably enable firms or persons making proposals to compete with a clear understanding and interpretation of the services required. In order to include price as a factor in selection, a majority of the persons involved by the procurement officer in evaluation of the proposals must be registered in the state to perform architectural, engineering, or land surveying services.

(e) This section does not apply to a contract that incorporates both design services and construction.

Hi Lisa, Rhonda Boyles forwarded your message and Ive been out on a family emergency the past few days so apologize for the delay.  I need to do a little more research as far as a specific law and I think there may be some provisions in the Jones Act that provide for essential services to AK and insular territories but I cant cite it at the moment.  Need more time on that.    

In any case, goods to Alaska come in through Tacoma on Tote, Horizon, and to some degree Alaska marine lines and Samson tug and barge. These entities are not Pacific Maritime Association members, they are not part of the dispute with ILWU. As such, there are no direct impacts to Alaska with the ongoing contract dispute. If do not doubt there are some tangential impacts, but goods should not be slowing to Alaska.  Hope this helps.

Can you confirm that please? I participated in a US Chamber Conference Call today on the issue and they were not aware of any such legislation.
