Morgan Lewis Retail Did You Know? This edition of Morgan Lewis Retail Did You Know? examines how the Coronavirus Aid, Relief, and Economic Security (CARES) Act impacts companies in the retail and hospitality sector, which has been severely impacted by the coronavirus (COVID-19) pandemic due to the government-mandated shutdown of “non-essential businesses” in some states, as well as the decrease in customer traffic given the uncertain economic climate. Companies in the retail and hospitality sectors should carefully consider the eligibility requirements for CARES Act relief measures.https://www.morganlewis.com/pubs/cares-act-provides-important-relief-for-retail-hospitality-companies-cv19-lf

Relief Funds - NationwideFederal CARES Act Small Business Loans:
The CARES Act will provide economic relief for restaurants. Under the CARES Act, the government will provide $350 billion in loans to Small Business Owners. The intent of the loans are to help small businesses keep their employees on their payroll during the crisis and restore it after the crisis.
Key points of the Small Business Loans (Paycheck Protection Program - PPP):• Restaurants are eligible.• Lenders will give consideration for being in business
before Feb 15, 2020.• Up to $10 million each, all for companies with 500
or few workers; up to 2.5x average monthly payroll.• The 500-employee threshold includes all
employees: full-time, part-time, and any other status. For restaurants, the 500-employee count is based on the number of workers at each physical location. So a restaurant franchisee or multi-concept group with 600 employees across five properties would still qualify.
• For example, an employer with an average monthly payroll of $900,000 would be eligible for a loan of $2.25 million.
• Loans are made through participating banks and large credit unions (SBA certified lenders).
• The loan will be fully forgiven if the funds are used for payroll costs, interest on mortgages, rent, and utilities.
• If not forgiven, loan payments will be deferred for six months, with a maturity of 2 years and an interest rate of 1%.
• The details can be found here for SBA Relief options.
Economic Injury Disaster Emergency AdvanceUp to $10,000 with funds made available within days of a successful application, this loan advance will not have to be repaid. https://www.sba.gov/funding-programs/loans/coronavirus-relief-options/
Economic Injury Disaster Loan ProgramSmall business owners in all U.S. states and territories are currently eligible to apply for a low-interest loan due to Coronavirus (COVID-19). https://disasterloan.sba.gov/ela/
SBA Express Bridge LoansExpress Bridge Loan Pilot Program allows small businesses who currently have a business relationship with an SBA Express Lender to access up to $25,000 with less paperwork. These loans can provide vital economic support to small businesses to help overcome the temporary loss of revenue they are experiencing and can be a term loans or used to bridge the gap while applying for a direct SBA Economic Injury Disaster loan. If a small business has an urgent need for cash while waiting for decision and disbursement on Economic Injury Disaster Loan, they may qualify for an SBA Express Disaster Bridge Loan.
IRS Payroll-Tax ReliefTreasury, IRS and Labor announce plan to implement Coronavirus-related paid leave for workers and tax credits for small and midsize businesses to swiftly recover the cost of providing Coronavirus-related leave. The Act provided paid sick leave and expanded family and medical leave for COVID-19 related reasons and created the refundable paid sick leave credit and the paid child care leave credit for eligible employers. Eligible employers are businesses and tax-exempt organizations with fewer than 500 employees that are required to provide emergency paid sick leave and emergency paid family and medical leave under the Act. Eligible employers will be able to claim these credits based on qualifying leave they provide between the effective date and December 31, 2020. Equivalent credits are available to self-employed individuals based on similar circumstances.https://www.irs.gov/newsroom/treasury-irs-and-labor-announce-plan-to-implement-coronavirus-related-paid-leave-for-workers-and-tax-credits-for-small-and-midsize-businesses-to-swiftly-recover-the-cost-of-providing-coronavirus
