IftheunitisatastageofconstructionwhichwillenabletheVendortopermitthePurchasertomakecolourandmaterialchoicesfromtheVendor’sstandardselections,thenthePurchasershallhaveuntilthedatedesignatedbytheVendor(ofwhichthePurchasershallbegivenfifteen(15)dayspriornotice)toproperlycompletetheVendor’scolourandmaterialselectionsform.IfthePurchaserfailstodosowithinsuchtimeperiod,theVendormayirrevocablyexercisethePurchaser’srightstocolourandmaterialselectionshereunderandsuchselectionsshallbebindinguponthePurchaser.NochangeswhatsoevershallbepermittedincoloursormaterialsoselectedbytheVendor,exceptthattheVendorshallhavetherighttosubstituteothermaterialsanditemsforthoseprovidedinthisScheduleprovidedthatsuchmaterialsanditemsareofequalqualitytoorbetterthanthematerialanditemssetoutherein.

PursuanttothisAgreementorthisScheduleorpursuanttoasupplementaryagreementorpurchaseorder,thePurchasermayhaverequestedtheVendortoconstructanadditionalfeaturewithintheUnitorBuilding.IftheVendorisnotabletoconstructsuchextra,thentheVendormay,bywrittennoticetothePurchaser,terminatetheVendor’sobligationtoconstructtheextra.Insuchevent,theVendorshallrefundtothePurchaserthemonies,ifany,paidbythePurchasertotheVendorinrespectofsuchextra,withoutinterestandinallotherrespectsthisAgreementshallcontinueinfullforceandeffect.

TheVendorshallhavetherighttosubstituteotherproductsandmaterialsforthoselistedinthisSchedule,representedtothePurchaserorprovidedforintheplansandspecificationsprovidedthatthesubstitutedproductsandmaterialsareofaqualityequaltoorbetterthantheproductsandmaterialssolistedorsoprovided.ThedeterminationofwhetherornotsubstitutedmaterialsandproductsareofequalorbetterqualityshallbemadebytheVendor’sarchitect.
