For identification of posts for reservation for Persons with Disabilities (PwD) in terms of DoP&TO.M. No. 36012/24//2009-Estt dated zo" March, 2014 pursuant to the judgement of Hon'bleSupreme Court in the matter of Union of India and Ors vs National Federation of Blind &Ors, it hasbeen decided to constitute a committee consisting of the following Members:

A copy of the DOPT's a.M. No. 36012/24/2009-Estt. (Res.) dated20/03/2014 is enclosed herewith for information and necessary action. TheDoPT has informed that National Federation of Blind has filed a contemptpetition in the Hori'ble Supreme Court, which is to be heard on 16.02.2015.

2. A meeting was held in DoPT on 05.02.2015 in the above regard. Themeeting was attended by Joint Secretary (P&A) from this Ministry. It wasdecided in the meeting that the required information in the followingproforma will be sent to DoPT by 09.02.2015: -

In purauanoeof the judiQl,C!llt dated 08.10.2013 of the Hon'b1e SuprezneCourt in the matter of Civil Appeal No.9096 ot2013 (ari~ out ofSLP(civil)No.7541 of 2009] titled Union of India & Anr, VB. National Federation ot:Blind &; Ora, this Department issued O.M No. of even dated 31'11 December,2013 modifying para 14 of this Deputment's O.M dated 29.12.2005 to thefollowing oxtmt •

3. Vide this Departnlent'& OM of even number dated_24th Februari,2014,it was informed that the Petitioner i.e, National Federation of the Blind hasfiled an application in the Hon 'hIe High Court of Delhi and the Hon 'bIe HighCourt has directed to file a status report giving details of steps taken toimplement the judgement of the Hon'ble Supreme Court inclu~g the

appointments made, if any. Owing to inadequate response from theMinistries/Departments, progress report on implementation of thejudgement of the Hon'ble Supreme Court could not be placed before theHon'ble High Court during the last hearing held on 12th March, 2014. TheHon 'ble High Court of Delhi has given three weeks time to file the statusreport which has to be complied with.

4. All the MinistriesjDepartments/Organisations of the Government ofIndia are requested to compute the reservations for persons with disabilitiesat the earliest and immediately identify the poets for disabled persons andi.niplement the same without default. However, the following points may bekept in view while computing reservarionai-

(i) Three percent of the vacancies in case of direct recruitment to GroupA.B,C and 0 shall be reserved fur persons with disabilities of which 1%each shall be reserved for persons suffering fr-om (i) blindness or lowvisicn, {U) hearing impainnent and fill) locomotor disability or cerebralpa.l8y; in the posts identifiod for each disability. Three percent of thevacancies in case of promotion to Group D and Group C posts in whichdirect recruitment, if any, does notexoeed 75% 8ha11 be reserved. forpersona with disabilities of Wbicb. 1% each shall be reserved for personssuffering from '(i) blindness or tow viaion. (ii) bearing impairment and (iii)locomotor disability or cerebral pal$y; in the posts identified for eachdiaabUity;

(fi) The computation of reservation for persons with di~bJlities has to becomputed in cue of Group A, a, C and D poats in. identical manner viz."computing 3% reservation on total number of ~candes in the cadrestrength". The 'Hon'b1e Supreme Court baa further directed to c:omputethe number of vacancies ava1lab1e in all the "'establishments" and furtheridentify the posts for disabled penon8 within a period, of three monthsfrom Q8.10.2013 and implement the same without default.

(ill) As regards eft'ecting reservation, Para 15 of this Department's O.M.No.36035/3/2004-Eatt(Rea) dated the 29th .December, 2005[http;1 {pemnin.nic.in>)o OMs&9rders» P(otablishmrnt (Reservation)>>Persons with Diaabilitieli] , intet' alia, stipulates that all estabJishmentsshall maintain aeparate 100 point reservation roster registers in thepreaeribed formant {or detennining/ effecting reservation for the disabled- one each for Group A poate filled by direct recruitment, Group B postsfilled by direct recruitment, Group C posts filled by direct recruitment,Group C poets filled by promotion. Group 0 posts filled by directrecruitment and Group D posts til1ed by promotion. PointS 1,34 and 67of the roster shall be earmarked reserved for pereons with disabilities -one point each for three categories. The Head of the establishment shalldecide the categories of disabilities for which the points 1, 34 and 6.7willbe reserved keeping in view all the relevant facts.

(iv) Whereas reservation policy for SCsjSTs/OBCs is post based, thereservation policy for persons with disabilities is vacancy based.

(v) List of identified posts for the persons with disabilities issued by theDepartment of Disability Affairs, Ministry of Social Justice andEmpowerment vide Notification No.16-15/2010-DD.III dated the29lhJuly. 2013 is available at the website of the Ministry of Social Justice andEmpowerment.

5. Keeping in view the above. all the Ministries/Departments/Organisationsof the Government of India are requested to furnish details of vacanciesavailable and posts identified for persons with 4isabilities in all the cadresunder their control including attached offices, subordinate offices, publicsector undertakings, Government Companies, Cantonment Board, etc in thefollowing formatr-
