MOTION TO COMPEL
on March 28, 1979, Houston Lighting & Power Com-
pany (" Houston") filed answers and objections to Central
Power and Light Comapny's ("CP&L") Second Set of Interroga-
tories and Request for Production of Documents ("Second
Interrogatories"). On April 20, 1979, CP&L filed its
Motion to Compel Houston Lighting & Power Co. to Answer
Interrogatories (" Motion") with respect to certain ques-
tions in the Second Interrogatories, to which Houston
responds as follows:

the District Court transcript refers to Mr. Simmons' con-
ceptual study and the Stagg study, both of which have been
furnished to CP&L. Otherwise, no studies of the kind
inquired into in Interrogatory No. 16(b) of the Second
Interrogatories exists.
2. Attorneys for Houston and CP&L have conferred
with respect to the answers to Second Interrogatory Nos.
18 and 19. Houston has furnished CP&L with the specific
identities of the entities described in CP&L's Second
Interrogatory Nos. 18 and 19 that Houston could identify
after a good faith and reasonable inquiry of its employees.
An attorney for CP&L has reviewed Houston's contract files
of those entities and designated documents therein for
copying.
3. Houston is not aware of any studies,
analyses or records of documents of the kind described
in Second Interrogatory No. 20. It is possible that
documents responsive to Second Interrogatory No. 20 exist
within Houston's contract files. Houston has made a good
faith and reasonable effort to ascertain the identity of
any contract file that might contain such documents. How-
ever, Houston has been unable to find any employee with
a recollection that any contract file contains documents
responsive to Interrogatory No. 20. Nevertheless, the
contract files, which were reviewed by CP&L prior to the

District Court case, are available for CP&L's further
inspection.
4. With respect to Plaintiffs' Exhibit 814,
the persons who participated in the preparation of said
Exhibit and the documents related thereto are also the
persons who had knowledge of such documents at or about
the time of their preparation. Those persons are: John
Meyer, K. L. Williams, R. M. McCuistion and Mike Connolly.
Exhibit 814 was generated early-on in Houston's attempt
to evaluate the PTI Report. The persons listed above
were attempting to evaluate the PTI Report and had knowl-
edge of the creation of Exhibit 814 by virtue of that
evaluation.
5. Mr. D. E. Simmons answered CP&L's Second
Interrogatories. In the process, Mr. Simmons sought and
received information from the following persons: R. M.
McCuistion, D. D. Sykora, R. L. Evans, R. E. Doan, K.
Hinckley, Laura Warnasch, E. A. Turner and J. D. Greenwade.
