Licenses for Limited Liability Companies (LLCs) Coming

The passage of Senate Bill 392 (and various provisions of the Contractors State License Law including B&P Code Sections 7071.65 and 7071.19) authorizes CSLB to issue contractor licenses to limited liability companies (LLCs). The law says that CSLB shall begin processing LLC applications no later than January 1, 2012. The LLC will be required to maintain liability insurance of between $1,000,000 and $5,000,000, and post a $100,000 surety bond in addition to the $12,500 bond already required of all licensees. A Message from the Board Chair

As I mentioned in the last CLC newsletter, CSLB is using technology wherever possible as a cost-effective means to deliver information faster and to a larger audience. Due to budgets cuts, CSLB has suspended the distribution of a printed newsletter. This will likely be the last newsletter you receive in the mail. The best way to receive your CLC newsletter in the future is by signing up through CSLB’s “E-Mail Alerts.” The E-Mail Alert sign-up button is available on every page of CSLB’s website and enables you to select which CSLB communications you’d like to automatically receive: news and industry bulletins, meeting

announcements or newsletters. If you are aware of anyone who does not have immediate access to the Internet, we encourage the use of public libraries.

I am pleased to report that CSLB is maintaining its enforcement efforts against unlicensed operators and the underground economy through weekly construction site sweeps or sting operations. In the most recent statewide effort, known as the California Blitz, CSLB and its local and state partners caught 135 unlicensed individuals in 10 different cities during a three-day operation. Expanding partnerships with such agencies as the Department of Industrial Relations, Department of Insurance, and Department of Homeland Security help broaden CSLB’s enforcement and education reach—all part of helping to level the contracting playing field.

One area that’s still a bargain in our struggling economy is the cost of a contractor license—about $ .82 per day for renewing licensees and about $1.09 for new applicants. The fees will increase on July 1, 2011 to about $1.00 per day for renewing licensees and about $1.22 for new applicants; a small price to pay for enforcement of fair contracting practices, statewide testing, and licensing operations that support the integrity of our industry. Read more on page 9.

A new licensing opportunity will take place by the end of this year. For the first time, limited liability companies (LLCs) will be able to apply for a contractor license. This was made possible with the passage of Senate Bill 392 and becomes effective no later than January 1, 2012. Policy and procedural information on LLC licenses will be available on the CSLB website later this year.

ensure a level playing field for licensees who follow workers’ compensation laws. A Stop Order takes effect immediately, but can be appealed. Employees who lose pay due to a work stoppage shall be payed by the employer up to 10 days’ pay for time lost. Failure to comply with a Stop Order will be a misdemeanor, punishable by up to 60 days in jail and/or a fine of up to $10,000.

Mechanic’s Liens

In order for a mechanic’s lien to be valid, the person serving the mechanic’s lien must also provide a proof of service affidavit or the lien will be unenforceable, per Assembly Bill 457 (Civil Code Section 3084):

“...The bill would require a proof of service affidavit to be completed and signed by the person serving the Notice of Mechanic's Lien, and it would be included as part of the mechanic's lien or claim of lien. The bill would provide that a failure to serve the mechanic's lien, including the Notice of Mechanic's Lien, as required, would cause the mechanic's lien to be unenforceable as a matter of law.”

Criminal

AB 2372 Penal Code Section 487 amended

This law changes the threshold from $400 to $950 to charge the crime of grand theft for stealing money, labor, real or personal property.

Other Workers’ Compensation

SB 313 Labor Code Section 3722 amended

This bill, signed in 2009, increases the potential penalty for failure to have a workers’ compensation policy from $1,000 to $1,500 for each employee not covered. Fines are administered by the director of the Department of Industrial Relations.

AB 2305 Business and Professions Code Section 7125 and Insurance Code Section 11665 amended

The bill extends until 2013 the requirement for C-39 Roofing contractors to carry a workers’ compensation policy, even if he or she has no employees.

Environmental

AB 1343 Public Resources Code Chapter 5 added to Part 7, Division 30

Effective April 1, 2012, contractor outreach and education will begin regarding recycling of architectural paint. Implementation of this recycling program could include an assessment on the future sale of paint.

CSLB/Consumer Protection Boards

SB 294 Business and Professions Code Sections 7000.5 and 7011 amended

This bill extends CSLB’s existence as a consumer protection board from January 1, 2011 to January 1, 2012.

SB 1491 Business and Professions Code Sections 7028.6, 7028.7, 7028.9 and 7058.5 amended

This bill requires that a citation for acting as a contractor or salesperson without a license or registration be issued within four years, or 18 months of a complaint for the violation, whichever is later. The bill also allows for contractors applying for an original license to complete and return electronically the required open book exam about asbestos.

AB 1659 Government Code Section 9147.7 added

This law abolishes the Joint Committee on Boards, Commissions and Consumer Protection and replaces it with the Joint Sunset Review Committee. CSLB’s sunset review process remains unchanged.

AB 2130 Business and Professions Code Section 22 amended and Section 101.1 and Division 1.2 repealed

This law is a companion bill to AB 1659, replacing the Joint Committee on Boards, Commissions and Consumer Protection and replacing it with the Joint Sunset Review Committee.

AB 2500 Business and Professions Code Section 114 amended and Section 114.5 repealed

The bill amends current law allowing people licensed by Department of Consumer Affairs’ boards and bureaus to reinstate their license without examination or penalty if serving in the California National Guard or United States Military during a period of war. The new law repeals the section defining war and extends the reinstatement provision for licensees who can prove they were serving on active, military duty. Requests must come not more than one year after discharge or the end of active duty.

CSLB-Sponsored Legislation

CSLB-sponsored legislation includes:

• A bill to require that a workers’ compensation exemption to be filed every time the license is renewed (AB 397);

• Indemnification for CSLB industry experts (SB 865); and • A requirement that CSLB be notified within 90 days of the

disassociation of the responsible managing officer or employee, and allowing in limited circumstances a 90-day period to replace the qualifier (AB 1091).

Other Bills Introduced Related to License Classifications

• SB 886 would specify that outstanding liabilities to the State Fire Marshal could affect a contractor’s license. The bill also calls for enacting a program for certification and regulation of sprinkler fitters to be set up by the State Fire Marshal.

• AB 465 would require those seeking a business license for landscaping or gardening to provide proof of CSLB licensure and workers’ compensation insurance or exemption from it, or a signed acknowledgement of the consequences of doing contracting work without a license.

Other Bills Related to Contracting and Business

• AB 249 would continue to allow a consumer to recover all costs for a home improvement project for work completed while an individual was unlicensed. However, for residential projects over four units, a consumer would only be allowed to recover compensation paid when the contractor did not possess a license.

• SB 190 would make further technical changes to the mechanic’s lien law overhaul passed in 2011, and would require that a person forfeit his or her lien rights if labor or materials not furnished to the property in question are included in the lien claim.

The number of complaints received by CSLB’s Intake Mediation Center about poorly written contracts and contracting agreements that have not been documented on paper is increasing.

Spare yourself and your customers a lot of grief by beginning a project with a written contract that spells out the consumer’s expectation and what you will be charging to live up to those written expectations. Contracts for home improvement should be done with Business and Professions (B&P) Code Section 7159 in mind.

Always Make Sure It’s in Writing

If additional work or changes to the original contract are added, make sure change orders to the contract are completed in writing, and signed by both you and the consumer, as specified in B&P subsections 7159(d) and 7159.6.

A well-written, detailed contract with all material descriptions and work expectations provides a clear understanding to your client about their legal obligation to pay for your home improvement services, and helps preserve your lien rights if a disagreement occurs.

New laws and regulations that could affect your contracting business are taking effect later this year or in the coming years. A number of issues currently in the legislative and regulatory process could also impact contractors.

Carpet Reclamation and Recycling

The California Carpet Stewardship Law (AB 2398 http://www.leginfo.ca.gov/pub/09-10/bill/asm/ab_2351-2400/ab_2398_bill_20100930_chaptered.html) was chaptered in 2010. Beginning July 1, 2011, a Carpet Stewardship assessment fee of five cents per square yard will be placed on all carpet sold in California for the purpose of establishing methods for carpet reclamation and recycling. Beginning on April 1, 2012, wholesalers and retailers will only be able to purchase carpet from manufacturers who are in compliance with AB 2398. Civil penalties of $1,000 per day, or up to $10,000 for knowing failure to comply, negligence or intentional violations of this law may be assessed. Off-Road Diesel Regulations

Following a public hearing in December 2010, the California Air Resources Board made a major change to its regulation of off-road diesel emissions, and pushing back compliance dates. The new dates are:

• Large fleets (more than 5,000 hp): January 1, 2014• Medium fleets (2,501-5,000 hp): January 1, 2017• Small Fleets (2,500 hp or less): January 1, 2019

Legislation that has been introduced this year could further change off-road diesel regulation implementation dates

(SB 724); another bill, AB 128, would allow those fined for violating the regulations to suspend fines until they are in compliance with the

regulations.

The Contractors State License Board (CSLB) was established in 1929 as the Contractors License Bureau under the Department of Professional and Vocational Standards. Today, CSLB is part of the Department of Consumer Affairs.

A fifteen-member board appoints CSLB’s executive officer, or Registrar of Contractors, and directs administrative policy for the board’s operations. CLSB’s Board includes nine public members (non-contractors, one of which must be a local building official and another a representative of a senior citizens’ organization), five contractors, and one labor representative. The Governor makes eleven appointments and four are made by the Legislature (two by the Senate Rules Committee; two by the Assembly Speaker). The Board holds regularly scheduled public meetings throughout the state. The meetings provide the public with an opportunity to testify on agenda items and other issues.

CSLB licenses and regulates contractors in 43 license classifications that constitute

About Your BoardCalifornia’s construction industry. Currently, there are more than 300,000 contractor licenses in the state. The Registrar oversees approximately 400 employees who work at the headquarters office in Sacramento and field offices throughout the state.

Headquarters staff receives and processes applications for new contractor licenses, additional classifications, changes of license records, and license renewals. Staff also reviews and maintains records of disciplinary actions initiated by the field offices, provides verified certificates of licensure used in court or other legal actions, and provides the status of licensure and other support services. Headquarters directs the activities of field offices, and initiates all disciplinary actions resulting from investigations.

Identical information is available through CSLB’s automated public information line, 1.800.321.CSLB (2752), which operates 24 hours a day. Callers can determine whether a contractor’s license is valid by entering the contractor license number. The information provided includes the licensee’s business name, license status, classifications held, business type, and CSLB disciplinary actions (if any). Also available is recorded information on licensing and examination procedures, complaint procedures and how to obtain information on a complaint that has been referred for legal action, the location and hours of CSLB offices, and current topics, such as recently passed laws or regulations. Callers can also order forms, applications, and other publications.

CSLB has taken its enforcement efforts against unlicensed operators who advertise in various online and print media outlets a step further. Business and Professions (B&P) Code Section 7099.10 enables CSLB to notify the state Public Utilities Commission to have an illegal advertiser’s telephone line disconnected. These disconnect actions began as a pilot project in July 2010. CSLB consumer services representatives or

programming technicians first identify potential illegal advertising by unlicensed operators. If they determine the ad leads to a phone number where unlicensed contracting services are being offered, a citation is recommended.

Advertising Illegally Can Get Your Phone Disconnected

Fire Protection Contractor Convicted The Executive Officer of American Fire Protection (suspended license #726110), is facing a long prison sentence after a major CSLB investigation turned up evidence that he was providing substandard, faulty fire protection systems to more than two dozen Tulare County businesses. Jurors in Tulare County found Danny Victor Williams, 47, of Camarillo, guilty of 29 felony and 26 misdemeanors counts. The CSLB investigation, which included partners from Tulare County law enforcement, led to the arrest of Williams and his partner, Ken Gordon Speck, 48, of Exeter, in 2009.

Jurors found Williams guilty of 26 felony counts of maintaining impaired fire protection systems, one felony count each of grand theft, diversion of construction funds and conspiracy, and 26 misdemeanor counts of violating State Fire Marshal regulations for automatic fire extinguishers. In addition, the jury found a special allegation true that while committing the crimes, Williams took, damaged, or destroyed property valuing more than $65,000.

The investigation determined that Williams trained Speck to service fire protection systems in the unlawful, unsafe manner. Speck pleaded guilty to five felonies and two misdemeanors in June 2010.

Williams’ CSLB license has been suspended since 2009 as a result of CSLB’s investigation. American Fire Protection, based in Camarillo, may have engaged in similar, fraudulent fire equipment services in other central valley areas, the San Francisco Bay Area, and in the central coast region. Company representatives dressed in uniforms similar to those worn by firefighters and claimed to be fire marshals or say they were referred to the business to service hood and duct systems before they were slated for inspection or repair. They used high-pressure intimidation tactics to sell the services and in some instances targeted businesses owned by immigrants.

That recommendation is further investigated by enforcement representatives who are assigned to the Intake Mediation Center. If warranted, the citation is issued. After 15 days, if the citation has not been appealed and the line is not voluntarily disconnected, the order to disconnect the phone line becomes final. The Public Utilities Commission is notified of the final order, and the PUC then notifies the telephone service provider to disconnect the number that is being used for illegal contracting activity.

CSLB’s Statewide Investigative Fraud Team unit and field investigators also report their contact with illegal operators who list a telephone number in their advertising to the CSLB Intake Mediation centers to prepare disconnect orders.

who refuse to pay these referral fees are losing out on business and are victims of an uneven playing field.

California Business and Professions Code Section 7157(d), says referral fees are considered to be illegal inducements, a violation of Contractors State License Law. If, after investigation, a license is found to be in violation of the law, CSLB may take a formal administrative disciplinary action and/or refer the matter to the local authorities for criminal prosecution.

B&P Code Section 7157(d) – Prohibited Inducement; reads as follows:

“(d) No contractor shall pay, credit, or allow any consideration or compensation of any kind to any other contractor or salesperson other than a licensee for or on account of the performance of any work of improvement or services, including, but not limited to, home improvement work or services, except: (1) where the person to or from whom the consideration is to be paid is not subject to or is exempted from the licensing requirements of this chapter, or (2) where the transaction is not subject to the requirements of this chapter.

New California Air Resources Board (ARB) regulations designed to reduce our state’s greenhouse gas emissions and enhance existing local and federal regulations became effective January 1, 2011. Owners and operators of refrigeration systems that use more than 50 pounds of high global warming potential (GWP) refrigerants, as well as contractors, must comply with these new practices.

The new rules are expected to benefit businesses through cost savings due to reduced refrigerant consumption. Commercial businesses that use more than 50 pounds of GWP refrigerant are large facilities such as supermarkets and large grocery stores, food and beverage processors, cold storage warehouses, and those using industrial-process cooling.

Commission of any act prohibited by this section is a misdemeanor and constitutes a cause for disciplinary action.”

Penalties for Home Improvement Inducements

The first offense could result in a citation with civil penalties ranging from $100 to $1,000. Subsequent violations will prompt an accusation that could result in further penalties, up to revocation of your contractor license.

New ARB Refrigerant Regulations for Commercial Systems

using high-GWP refrigerant or sells, distributes and/or reclaims high-GWP refrigerants.

Classifications affected by these regulations include C-38 Refrigeration, “A” General Engineering, “B” General Building, C-20 HVAC and C-36 Plumbing contractors.

Under the new regulation, system owners and operators must conduct leak detection, monitoring, and record-keeping procedures, use U.S. EPA-certified technicians, repair leaks prior to recharging, and can only dispose cylinders after they have been properly evacuated. Distributors, wholesalers and re-claimers can only sell high-GWP refrigerants to certified technicians or their employers.

An automatic fire sprinkler system in new one- and two-family dwellings became mandatory in California on January 1, 2011. In line with the 2009 International Building, Fire and Residential Code, this change comes from modifications to the California Building Code through the State Building Standards Commission. 

“A” General Engineering, “B” General Building, and C-36 Plumbing contractors should be aware that under current California Business and Professions Code (B&P Code) statutes and regulations only the C-16 Fire Protection classification is legally permitted to: lay out, fabricate and/or install fire protection systems. (B&P Code §7057(c) and 7026.12)

Other construction trades can provide work up to the fire protection system only (known as the “T,” where the structure’s main water system intersects the fire sprinkler system), where the fire protection system is a multipurpose system providing both domestic water distribution and fire protection.

The new residential code does not affect home remodel, only new construction; however, there are currently about 160 local ordinances related to residential fire sprinklers. Check with your local jurisdiction before beginning any projects.

A Only a C-16 contractor or owner-builder. In a multi-purpose system, a C-36 contractor would be required to install the domestic water distribution system; the C-16 contractor would install at the point of connection where the fire sprinkler branch connects to the domestic water line.

Q Does the C-36 contractor need to hold a C-16 license?

A A C-36 contractor is permitted to install the domestic water distribution system; however, in order to install the fire protection portion, as described above, a C-16 license is required.

Q Can a C-36 contractor or his/her employees install both the domestic water distribution system and fire sprinkler system of a multipurpose system where a C-16 “oversees” the installation?

A No, the contractor responsible for installation would have to hold a C-16 license.

Q Can a C-16 contractor design both domestic and the fire protection system?

A If the system is designed as a multi-purpose system, a C-16 could only design the fire protection portion of the system. (If the multi-purpose system is served by only one pipe, the portion of the system that would have fire protection elements must be designed by the C-16 contractor.)

A CSLB partnership with the San Diego County District Attorney’s Office, aimed at curbing construction fraud against the elderly, helped lead to the arrest of Raul Casillas, 49, of Chula Vista, in December 2009. Casillas pleaded guilty to unlicensed contracting that defrauded at least three elderly homeowners. He plead to two felony counts of elder financial abuse, one felony count of using another person’s contractor license, and a misdemeanor count of not having his own contractor license. The

Don’t Paint Yourself into a CornerAn increased number of inquiries and complaints have been received lately in CSLB’s Intake Mediation Center about required licensure for muralists. Muralists who undertake jobs valued at greater than $500 (labor and materials) to paint on a permanent structure are subject to state contractor licensing laws under Business and Professions Code Section 7026.

It is within the scope of the C-33 Painting and Decorating license to paint a mural on the surface of a permanent structure. However, an individual who limits his or her practice to that of an artist might be more appropriately covered by the D-64 Non-specialized contractor designation (within the C-61 Limited Specialty contractor classification).

To qualify for a C-33, a person must pass the state law and business exam, in addition to the trade exam related to painting. “D” licensees are only required to pass the law and business exam.

CSLB Partnership Pans Outinvestigation showed Casillas scammed at least five San Diego County residents out of hundreds of thousands of dollars, either abandoning the projects or performing substandard work.

In one case, it is believed Casillas accompanied a 79-year-old woman to her bank and persuaded her to transfer $300,000 from her savings into a checking account. From that amount she withdrew $10,000 in cash and gave it to Casillas. She also took out a

$50,000 cashier’s check for an individual she did not know. On other occasions, Casillas was seen in the bank addressing the victim as “Mom,” and writing in her check book register, answering questions that were directed towards the victim, and escorting her by the arm out of the bank. Much of Casillas’ work has been found to be in violation of building codes and poses a potential fire hazard.

A judge ordered Casillas to pay about $175,000 in victim restitution.

Statewide Program Helps Licensees Go (and Earn) Green

Drilling overhead is one of the more physically demanding jobs in construction, as it involves holding an eight-pound vibrating drill and pressing it upward with 55 pounds of force for a minute or longer for a single hole. Even during a small commercial project, hundreds of holes can be required to install various electrical, plumbing, sprinkler, or HVAC systems.

Overhead drilling can cause pain and injury to nerves and muscles in the shoulder, arm, neck, and back. The symptoms often begin gradually, but over time they can lead to more serious injuries, which can leave skilled workers unable to work, sometimes permanently.

Injuries from repetitive overhead drilling can be debilitating, but they are preventable. Here are some tips to consider before you drill from the California Department of Public Health and the University of California Ergonomics Program:

• Drill from a platform, not a ladder. A platform gives a worker more flexibility and support to position their body as they drill, and to reach around obstacles. It also reduces the risk of falling if a drill bit binds and knocks the worker off balance.

• Use an “overhead drill press”. Engineers and physicians at the University of California, San Francisco have created this tool to

Overhead Drilling: Making a Tough Job Easieralleviate the strain of overhead drilling. The overhead drill press holds the drill at the top of a column, and uses a hand-wheel and gears to raise the drill to the ceiling. It can drill into ceilings 15 feet high, and accommodates most “square” roto-hammer drills. You can learn more and see video and photos at http://ergo.berkeley.edu/research/overhead_drill.php.

• Use the right drill. Take advantage of new technology by using lighter drills with vibration-reducing designs. Use a drill with a clutch to prevent sudden twisting of hands and wrists if the bit jams. Be sure to use sharp bits, which reduce the force required to drill.

• Alternate overhead work with others to prevent fatigue. Spread out the hours of forceful overhead work. Share the work among co-workers to allow muscles to recover. Also, take frequent breaks from overhead work to give your muscles and joints time to recover. Keep your hands and body warm while on the job.

• Communication is key. If you or a co-worker is feeling any pain, be sure to tell someone immediately and get medical care. By law, employers are required to address on-the-job injuries.

C-20s – Winter Coolant Charges – Title 24 energy efficiency standards require verification of refrigerant charge in some residential air-conditioner installations, but this can not always be accomplished when the outdoor air temperature is below 55 degrees Fahrenheit. To avoid delaying final inspections and certificates of occupancy, an agreement form is now available from the Western HVAC Performance Alliance that states the installer, HERS rater, and homeowner-builder will commit to having the system revisited when the weather is warmer so the building official can perform final inspection in colder weather.
