CSLB to Offer E-Mail Notification System

For the second time in four years, the Contractors State License Board (CSLB) received the prestigious National Association of State Contractors Licensing Agencies

(NASCLA) “Innovation in Regulation Award.”

Each year, the Innovation in Regulation Award is presented to a contractor licensing agency to recognize the creativity and excellence it has demonstrated through its regulation practices. CSLB received the award for the comprehensive efforts of its Service and Repair Criminal Investigation Task Force’s ability to harness and bring to justice a service and repair company, named SRVS Charge Inc. For many years, the company conducted fraudulent business practices and defrauded thousands of consumers out of millions of dollars for substandard electrical, plumbing, and warm-air heating, ventilating, and air-conditioning repairs.

Economic changes hit California and the entire country in the past couple of years and the Contractors State License Board (CSLB) has been no exception. Nevertheless, CSLB’s exceptional leadership and staff continue to go above and beyond expectations in order to maintain programs and services necessary to provide consumer protection and to support you, our contractors who drive the vitality of California’s economy.

The biggest challenge CSLB faced last year during its 80th anniversary was an executive order that shut down all offices three work days (the

first three Fridays) every month. The lost time and previous staff cuts mean that this board now operates with the equivalent of 110 fewer full-time staff positions than it did nine years ago. That’s a loss of 22% of CSLB’s staff resources.

With a diminishing operations budget, CSLB is continually seeking ways to use innovative programs and partnerships to operate more efficiently. One of those many steps will be in transitioning this publication. CSLB’s California Licensed Contractor (CLC) newsletter has always been available on its Web site but, in order to affect cost savings, future CLC newsletters will not be printed and mailed. The online version will be your only resource. We encourage you to go to our Web site to sign up and receive an e-mail alert when the next newsletter is available.

This edition of the CLC newsletter is packed with important information that highlights many significant changes in construction and contractor requirements and regulations. We hope you will find the information immediately useful to your construction business and wish you success in 2010.

CSLB’s Automated Phone Response System is chock full of contractor information options (see page 10). But, sometimes you need to speak directly with a Licensing Information Center representative. Longest Wait TimesTraditionally, the longest wait times are on Monday and Tuesday mornings, or on the first day after a holiday. Wait times can also be a bit longer during CSLB staff lunch

CSLB thanks four noteworthy Board members for their service and dedication to the people of California and the construction industry. Their time, work, and energy while serving the Board will be missed.

“Each of these four members made unique contributions during their time on the Board,” said CSLB Registrar Steve Sands. “The effects of their important work will be felt for years to come.”

James Miller, of Big Bear Lake, was appointed by Governor Arnold Schwarzenegger to the Contractors State License Board in September 2005. Mr. Miller served as both chair and vice chair during his tenure on the Board. Since July 2007, Mr. Miller has served as Director of Building and Planning for the city of Big Bear Lake. From 2002 through 2007, he served as Director of Building and Safety for Riverside County. Prior to that time, Mr. Miller was the Development Services Director for the city of Murrieta, the Building Official for the city of Pomona, and the Regional Manager and Building Inspector for Riverside County.

Cynthia Mitchell, of Shingle Springs, was appointed to the Board by Governor Schwarzenegger in March 2006. Ms. Mitchell served as chair, vice chair, and secretary during her tenure. She has served as president and chief executive officer of Citadel Tile and Marble since 1993, and is the president and chief executive officer of GCM Business Solutions, as well as a member of the North State Building Industry Association and the Ceramic Tile Institute. She is an appointed committee member of the Trade Builder Alliance Council for the California Building Industry Association and a past president of the California Professional Association of Specialty Contractors.

Stephen Matich, of Yucaipa, was appointed to the Board by Governor Schwarzenegger in April 2006. While on the Board, Mr. Matich served as chair of the Legislative Committee and played a key role in the passage of many legislative bills. Since 1992, Mr. Matich has

CSLB Recognizes Outgoing Board Membersserved as president of Matich Corporation, a family-owned construction business specializing in engineering contracting, and has been employed by the company since 1980. In addition, Mr. Matich is a member of the Associated General Contractors and Asphalt Pavement Association.

Bernadette Medrano, of Santa Ana, was appointed to the Board by Governor Schwarzenegger in December 2006. She has served as executive director of a non-profit organization, the Santa Ana Education Foundation, since 2002. Ms. Medrano previously was a fleet manager for Hyundai Motor America from 1992 to 2000. She serves on the Board of Directors for the Vanguard University Foundation and the KOCE Community Advisory Board.

We thank you for your meritorious service to CSLB and the State of California.

Commission to disconnect several toll-free telephone numbers used to promote the illegal schemes, an unprecedented CSLB action. Under the terms of the settlement, the company was ordered to pay $3 million in penalties and restitution, and must abide by numerous business and operation guidelines that are part of a permanent injunction.

NASCLA President Carolyn Lazenby presented the plaque to CSLB Registrar Stephen P. Sands at the group’s annual conference last fall, in Nashville, Tennessee. The ceremony took place before representatives of more than 30 national contractor state licensing agencies, as well as construction firms, contractor trade associations, and others affiliated with the construction industry.

In 2006, CSLB’s Enforcement division received the NASCLA award for innovation related to its efforts to eradicate illegal construction.

Paul Schifino, of Los Angeles, is a contractor member appointed to CSLB by Governor Arnold Schwarzenegger in January 2010. Mr. Schifino is the owner and president of both Anvil Steel Corporation and Junior Steel Company. From 1992 to 2006, Mr. Schifino was a partner for the law firm Schifino and Lindon, associate attorney for Strook and Strook and Lavan from 1990 to 1992, and adjunct professor at Georgetown University from 1987 to 1989. He is also a member of the American Institute of Steel Construction. Mr. Schifino and his wife are both Ambassadors of the Weizmann Institute of Science, an international center for scientific research, located in Israel. Mr. Schifino’s term continues through June 1, 2013.

Mark A. Thurman, of Newport Beach, was appointed to the Board by Governor Schwarzenegger in January 2010 as a contractor member. Mr. Thurman has been president of ARB Structures, Inc. since 2004. Previously, Mr. Thurman was president of Pepper Construction Company Pacific from 1989 to 2004. He also served as a firefighter specialist for the Orange County Fire Authority from 1980 to 1988, and as project manager for Miles and Kelley Construction Company from 1975 to 1980. Mr. Thurman is a member of the Associated General Contractor of California’s Board of Directors, Urban Land Institute, Design-Build Institute of America, and International Council of Shopping Centers. Mr. Thurman’s term continues through June 1, 2013.

Ruben Zuniga, of Los Angeles, was appointed to the Board by Governor Schwarzenegger in March 2010, as a labor representative. Mr. Zuniga has served as an administrative assistant for the Southwest Regional Council of Carpenters since 2006, and was its business representative from 1990 to 1996. He also served as a financial secretary for Local 630 in Long Beach from 1996 to 2005. Mr. Zuniga’s term continues through June 1, 2012.

As stated in the California Mechanical Code, a building permit is required for warm-air heating, ventilating, and air-conditioning (HVAC) installations and modifications including, but not limited to, the following:

• New HVAC installation,

• HVAC change-out/remodel/replacement including the air-handler, coil, furnace, or condenser,

• Relocation of an existing HVAC unit,

• Removal of an HVAC unit or system, and

• Adding ducting.

Building permits are necessary to ensure construction is performed according to state and local code, and safety standards. Failure to obtain a permit is a violation of California law and exposes the homeowner to additional cost and liability.

If a contractor fails to get a permit or performs contracting work on a project requiring a permit, they are in violation of the law and will be disciplined by the Contractors State License Board (CSLB), based upon Sections 7110 and 7090 of the California Business and Professions Code. Disciplinary action includes the assessment of civil penalties of up to $5,000 per citation and/or the suspension or revocation of their license.

At its quarterly meeting on June 11, 2009, the CSLB Board voted unanimously to place a high priority on enforcing building permit requirements. As a result, CSLB issued an industry bulletin on November 30, 2009, alerting the industry that it would accelerate building permit enforcement efforts in January 2010.

In addition, CSLB is part of the Performance Alliance, which is committed to reducing energy used by heating, ventilation, and air-conditioning systems. The alliance is also responsible for assuring compliance with the new amendments to Title 24, effective January 1, 2010, that require enhanced duct sealing, and refrigeration and airflow rates.

Please be advised that CSLB is rigorously implementing an enforcement plan to help ensure that licensed contractors are complying with the new Title 24 requirements.

Contractors with large off-road vehicle fleets (more than 5,000 horsepower) will not risk $10,000 fines per vehicle, per day for not being in compliance with retrofit requirements or cleaner diesel engines that were set to take effect March 1, 2010. According to the California Air Resources Board (ARB), no authorization has been given from the United States Environmental Protection Agency (U.S. EPA) to enforce the emission-related requirements of the diesel regulation.

ARB will determine whether further changes to its off-road diesel regulations are warranted.

ARB modified its off-road diesel regulations in July 2009 to allow contractors with large fleets, and who were hard-hit by the industry’s economic slump, to delay implementation for two years due to reduced activity and/or previous reductions in the horsepower of their vehicles. Large fleet operators must still report reduced activity and horsepower to ARB.

While retrofit and new engine requirements have been delayed, ARB’s off-road diesel regulation requirements for reporting, idling, labeling, and sales disclosure remain in effect and are fully enforceable. Large fleets were still required to comply with the April 1, 2010, deadline to report their reduced activity and reduced horsepower. Changes to the California Code of Regulations on December 30, 2009 resulted in:

• An amendment to the C-45 Sign contractor license to clarify that a C-45 contractor can contract for any type of sign projects;

• An update to the C-46 Solar contractor classification to reflect current terminology and allow for future innovation in the solar industry;

• An update to the contractor advertising regulation that requires the license number be included in electronic transmissions; and

• Deletion of the code regarding re-examinations for individuals seeking contractor licenses because it was inconsistent with the Business & Professions Code.

Violators of New Federal Lead Paint Standards Face Hefty Fines

The 2008 Building Energy Efficiency Standards (Title 24, Part 1 and 6), which require grater energy efficiency in all residential and non-residential buildings, became effective January 1, 2010. These new energy standards primarily concern requirements for highly reflective, cool roofs and insulation, and climate control and lighting methods that use less energy. Beginning October 1, 2010, all low-rise residential buildings requiring field verification for the Home Energy Rating Systems Program must meet the 2008 standards.

Tougher Title 24 Energy Standards Now in Effect

Contractors or their employees with lead-safety certification from the California Department of Public Health (DPH) may take a four-hour U.S. EPA-accredited course to achieve federal compliance. The firm must then apply to U.S. EPA for firm certification. If a DPH-certified inspector or risk assessor determines that a home constructed before 1978 is lead-free, the federal certification is not required.

Certification as a renovator costs $300 and is good for five years. Certification forms are available at www.epa.gov/lead, or you may call 800.424.LEAD (5323). Listings of accredited training providers are also available on this Web site. Training course costs vary by provider.

Beginning April 22, 2010, contractors face fines of up to $37,500 for not complying with federal regulations aimed at protecting them and consumers from exposure to dust created from lead-based paints. The requirements apply to contractors working on all construction prior to 1978 that contained lead-based paint.

In many structures, lead paint has been covered by lead-free paint. However, remodeling or demolition will disturb the underlying lead-based paint, causing potential harm to workers and consumers.

To comply with this new law, contractors working in pre-1978 buildings must receive training from a U.S. EPA-accredited training provider. The contractor or one of his or her employees must

Even in these tough economic times, California contractors have stepped forward to help the next generation of construction managers receive proper training to lead the industry. Thanks to their generosity, CSLB has been able to issue grant checks to four universities this year, totaling almost $150,000.

The grants come from the Construction Management Education Sponsorship Act (CMESA) that was established by the state legislature in 1991.

One of this year’s checks went to the Construction Management (CM) Department at Cal Poly State University in San Luis Obispo. “We are indebted to the thousands of licensed contractors in California who have made these funds available through their generous donations to this program,” said Professor Allan Hauck, Ph.D., CPC, Cal Poly’s CM Department Head. “We can only hope to return the favor by providing them with the best educated professionals who will lead future generations of employees committed to this industry.”

Contractors—are you protecting yourselves, your workers, and clients when handling natural gas piping, appliances, and equipment? Natural gas

represents a potential risk at any construction site, and the changing properties of odorized natural gas can pose a serious safety hazard.

Odorized natural gas may lose its scent due to “odor fade,” which diminishes the detectable odor of gas in the air. Odor fade occurs more frequently in new steel pipe and in pipe of larger diameter and longer length where there is more space to dissipate. However, odor fade can also occur in plastic pipe and smaller pipe installations, as well.

Any type of pipe that leaks underground can result in odor fade, due to the surrounding soil’s absorption of the natural gas. Rust, moisture, liquids, and other substances in the pipe may also lessen the effect of the odorant, as well as the gas’s composition, pressure, and flow.

The United States Department of Transportation and the California Public Utilities Commission provide rules and regulations for odorizing natural gas. Even when gas companies comply with these laws, odor fade may occur due to the chemical and/or physical properties in both plastic and steel pipes.

Odorized Natural Gas Safety Alert

CSLB wants contractors to be aware of free classes designed to help General Engineering (“A”) and other contractors navigate new State Water Resources Control Board (SWRCB) permit requirements.

General Engineering and other contractors involved in projects on one acre or more of land must comply with new requirements in the Construction General Permit (CGP) issued by SWRCB.

The new permits regulate the amount of allowable storm water discharge from construction sites to ensure sediment doesn’t negatively impact the quality of rivers and streams. Some new requirements include: controlling runoff, preventing fuel and oil leaks, containing fertilizers and top soil, and making inspections and repairs during storms.

Beginning July 1, 2010, Order Number 2009-009-DWQ (http://www.waterboards.ca.gov/water_issues/programs/stormwater/docs/constpermits/wqo_2009_0009_complete.pdf ) will require contractors to test the amount of storm water discharge being released to ensure it is within acceptable limits. Failure to do so could result in fines of up to $37,500 per day.

Training about copper pipe corrosion and its effects on wastewater is available for plumbers of all experience levels through the Bay Area Clean Water Agencies, a joint power agency designed to help reduce copper discharged in the San Francisco Bay.

The training is aimed at reducing materials and chemicals that lead to copper pipe corrosion and are discharged into the environment, and also provides information on how to maintain standards that meet wastewater treatment agency permit requirements. Contractors bidding for work with San Bay Francisco Area wastewater treatment agencies will find this information especially useful.

Copper is toxic to plankton, shellfish and other species in the San Francisco Bay. Copper pipe corrosion has been identified as the primary source (60%) entering the Bay Area wastewater treatment plants.

Consulting Engineer to the Bay Area Clean Water Agencies (BACWA) and the Bay Area Pollution Prevention Group (BAPPG), and Santa Clara University lecturer, Stephanie Hughes, ChE P.E., provides a presentation to contractors on how to design and install copper pipe to reduce corrosion. Ms. Hughes encourages all plumbing industry professionals to review two fact sheets: “Good Plumbing Practices Protect San Francisco Bay,” a fact sheet for installers and plumbers, and “Preventing Corrosion Protects San Francisco Bay,” a fact sheet for designers.

CSLB is enhancing its broad enforcement efforts in 2010 with more focus on workers’ compensation, mechanic’s lien, and building permit violators. Now, more than ever, licensed contractors need to follow state contracting laws.

Workers’ Compensation“We understand that businesses need to cut expenses, but cheating on workers’ compensation insurance is illegal,” says Steve Sands, CSLB Registrar. “Employees are left unprotected if they get hurt, and contractors who break the law have an unfair business advantage over those who follow the rules. Fraud also drives up the price of insurance for all of us.”

CSLB is conducting stings in 10 counties, working with the Department of Insurance’s (DOI) Premium Insurance Fraud Task Force (which includes local district attorneys and law enforcement) to combat unlawful insurance practices. This enforcement is in response to a significant increase in the number of workers’ compensation complaints against licensed contractors. The contractor stings are designed to uncover workers’ compensation insurance fraud, such as under-reporting employees, uninsured employees, premium fraud, cash pay, and unlicensed activity.

Contractors are required to carry workers’ compensation insurance to cover permanent and temporary employees with job-related injuries. Additionally, all Roofing (C-39) licensees are required to carry workers’ compensation insurance, even if they do not have employees.

filing a Certificate of Workers’ Compensation Insurance from the insurer or Certificate of Self-Insurance from the Department of Industrial Relations. Additionally, contractors must provide proof of workers’ compensation insurance to CSLB within 90 days of the contractor hiring an employee. Contractors with no employees must provide CSLB with an Exemption from Workers’ Compensation form.

Penalties for not carrying workers’ compensation insurance are steep. A first offense results in a $10,000 fine and up to one year in county jail, as well as possible stop orders on work projects with fines of $1,000 per employee on the payroll at that time, up to $100,000. Contractors are also liable for workers’ compensation claims filed by uncovered employees, and associated penalties, including possible civil litigation. Lack of workers’ compensation insurance may result in the suspension of a contractor’s business license. Work performed after the suspension of a license is considered unlicensed activity.

Mechanic’s LiensNew mechanic’s liens laws will become effective on January 1, 2011. Contractors who don’t comply could face fines or jail time. These new laws are especially important in light of an accelerating trend of contractors placing mechanic’s liens on each other’s businesses.

The new law, created by Assembly Bill 457, requires that contractors, subcontractors, and suppliers serve a Notice of Mechanic’s Lien on the owner of the property and furnish a proof of service affidavit signed by the person serving the notice. Failure to serve the lien

notice and confirm proof of service will cause the mechanic’s lien to be unenforceable.

Building Permits and Energy Efficiency EnforcementCSLB is renewing its statewide enforcement of building permit and Title 24 requirements in partnership with local building officials. Members of the industry are encouraged to obtain permits, and CSLB will share information with contractors on how to apply for a building permit online.

Building permits offer protection to consumers by maintaining current building and safety standards. Contractors without the required building permit are financially liable for injuries related to their project. Additionally, local building officials may issue a “Stop Work” notice and fine the property owner – a fee that the contractor may be liable to pay. Civil penalties include up to $5,000 per citation and/or suspension or revocation of the contractor’s license.

Today’s economy may look bleak to many, but California contractors are finding ways to keep their businesses afloat as the hard-hit construction industry recovers from the recession. Contractors are becoming creative and returning to business basics, namely customer service, in order to get ahead.

A business practice, known as “express van services,” provides customers with a broad palette of construction trade skills, whether for new projects or repairs. One such company that has found success doing this is Welte Construction in San Leandro. “Some of my friends who are in the contracting business are seeing a 25 percent loss,” says owner Bill Welte. But, since November 2009, his company has seen a three-to-four percent profit, despite record losses in the industry.

“It’s been a good year for us, but it hasn’t been painless.” Like many companies, Welte had to make the difficult decision to lay off employees. Once the company reevaluated and changed its focus to the express van services of smaller home improvement jobs like plumbing and electrical repair, the profit margin started to move in the right direction. Customers then began to recognize the company’s range of expertise, and new opportunities for bigger construction and remodeling projects followed.

Economy Inspires Change in Business PracticesCreating Customer Buzz

According to Welte, this business practice has become increasingly popular and is becoming more recognizable throughout the state. “We want our customers to think of us as a small company that’s big enough to meet all of their needs. The secret to being successful in this economy is customer care. We’ve all been through these cycles, but you always have to go back to your roots with customer service. It’s definitely the buzz word.”

Other California contractors are reevaluating their business models in order to create new opportunities, as is evidenced by the increase in new CSLB license classifications. While original license applications are down about 13 percent over the past fiscal year, CSLB has recorded up to a 20 percent increase in added classifications over the past two years.

underground utility lines while working on digging projects. People digging often make risky assumptions about whether they should get their utility lines marked due to concerns about project delays, costs and previous calls about other projects. These assumptions can be life-threatening.

The Common Ground Alliance (CGA) is the national association that works with all industry stakeholders to prevent damage to underground utility infrastructure, and ensure public safety and environmental protection.

Failure to get digging clearance from CGA can result in a delay of your project or a potential safety hazard – not to mention financial liability. Digging without the proper clearances is also illegal. Even small projects, like planting shrubs or trees, can disrupt utility lines.

State law requires you to call for a clearance at least two full working days before you begin digging. Your dig permit is not valid until you have a Dig Alert ticket number. If any of the utilities in the area have facilities your project might disrupt, they will mark the dig area before the project begins. If not, they will advise you there are no conflicts.

The pre-dig regulations are part of California Government Code Section 4216, a construction-related law. Because of that, CSLB can fine you, or suspend or revoke your license for negligent violation of the law, which is punishable by up to $10,000 in fines. If you knowingly violate this law, you can be punished by up to $50,000 in fines.

Licensees take note! It’s important for you to submit your renewal application and fees as soon as possible after receiving your CSLB license renewal notice.

A CSLB license expires on the last day of the month in which it was issued. CSLB sends a renewal application notice to each licensee 60 days before the expiration date. In that notice, the licensee is advised that it may take up to four weeks for CSLB to process the renewal once it is received. If the licensee waits too long, it is likely that the renewal won’t be processed before it expires. If a license expires, the licensee cannot legally perform any construction work until CSLB processes their renewal paperwork.

CSLB has a goal of processing renewal applications within two weeks after they are received and, traditionally, has met that goal. A majority of licensees send in their paperwork within one month of receiving their notice and don’t have a problem getting their license renewed on time.

The odds of missing your license renewal deadline increase if you wait too long to submit your paperwork. CSLB receives an influx of renewals during the last couple of weeks of each month, meaning it can take longer to process applications toward the end of any month. Over the past 13 months, CSLB has averaged 1.5 weeks to process a renewal application.

It is important to note that CSLB cannot accommodate requests for a “rush” on renewal processing. Renewal applications are processed according to the date they are received. The Contractors State License Board (CSLB) has received an influx of telephone calls and letters from contractors who have been unable to secure a contractor bond or who are faced with significant rate increases. Contractors are required to maintain a surety bond (contractor’s bond) for the benefit of consumers who may be damaged as a result of defective construction or other license law violations, and for the benefit of employees who have not been paid wages that are due to them (Business and Professions Code §7071.5).

Before an active contractor license can be issued or renewed, the licensee must have a current contractor’s bond or approved alternative to a bond on file with CSLB in the amount of $12,500.00. CSLB has no authority over the bond premium amount or the cancellation criterion offered by a
