    All rules heretofore made and prescribed by theBarristers' Board in pursuance of the Legal Practi-tioners Act, 1893, and its amendments, are hereby re-pealed, but no proceedings, acts or things done underany of the repealed rules before these rules come intooperation shall be invalidated or affected by such repeal;and all complaints, proceedings and applications initi-ated before these rules come into operation shall becarried on so far as practicable according to the pro-visions of these rules, and subject thereto accos-ding tothe provisions of the repealed rules applicable theretowhich foi- that purpose shall be deemed to continue inforce notwithstanding the repeal thereof.

    In the interpretation of these rules-''Secretary'' shall mean the Secretary fm the time

    being of tile Board;''Chaii-man'' shall include the Chairman elected to

    preside at any meeting of tile Board in theabsence of the Attorney General.

    Part II.Election.

    Subject as hereinafter provided, the annual elec-tion of the five elected nsembers of the Board shallbe held on the fist Tuesday in tile month of Aprilin each and evei-y year.

    Tile Secretary of tile Board shall IlOt less thantwenty-eight nor more than thirty-five days before theday for holding such election post written notice ofsuch election to all practitioners entitled to vote.

    Every practitioner desirous and being qualified tobecome a member of the Board shall not less thantwenty-one days before the date of the election forwardto the Secretary ivi-itten notice of his intention to seekelection, countes-signed by at least one practitioner en-titled to vote.

    If there are no more candidates than the num-ber of vacancies, such candidates shall be declaredelected at a meeting of the Board to be held not laterthan the date pi-escribed fm the election of membersof the Board in that year. In such event it shall notbe necessary to hold the meeting referred to in rule8 (d).

    If these are moi-e candidates than the numberof vacancies, the method of election shall be as fol-lows:-

    The Secretary shall at least ten days beforethe day of the election post to eae'h prac-titioner entitled to vote a ballot paper con-tahung the names of all candidates.

    Practitioners desirous of voting shall leave thenames of all candidates for whom they desireto vote intact and score through the remain-ing mlames with a pen or pencil and shallretnrml the ballot paper to the Secretary inan envelope sealed and endorsed ''BallotPaper,'' so as to reads him not later thantwelve o'clock noon on the date of the elec-tion.

    No practitioner shall have more than one votefor each of the five vacancies.

    A meeting of the Board shall be held on theday of the election at a time and placeto be appointed by the Board. At suchmeeting all ballot papers shall be openedby the Chairman and the Board shall havesole and exclusive right to determine thevalidity om- otherwise of any ballot paper.Tile candidates receiving the largest numberof votes shall be declared elected. In caseof an equality of votes between two 01 morecandidates, the Chairman shall be entitled toa casting vote or votes.

    9. The five elected members of the Board shall takeoffice on the day following the first Tuesday in Aprilof the year of their elcctiou and shall go out of officeon the first Tuesday in April in the following year.

    10. The names of the successful candidates and ofevery pelsoil nominated as a member of the Board underthe provisions of the Act shall be published in theGovermmcnt Gazette as soon as practicable.

    11. The omission by the Secretary to send or postto or the non-receipt of any notice under Rule 5 or ofany ballot paper by any practitioner within the timeaforesaid or at all shall not in any manner invalidateor affect the election.

    Part III.Meetings.

    12. Meetings of the Board shall be held when andas often as necessary and shall be convened by theSecretary whenever required in writing by the Chairmanor any two members of the Board.

    13. Meetings shall be convened by posting or deliv-ering to each member twenty-four hours' written noticestating the time and place of such mectiag. The omis-sion to post or deliver any such notice within suchtime or at all, or the non-receipt thereof, shall in nomanner affect or prejudice anything done or agreed toat any meeting.

    14. If a quorum of members be not present withinfifteen minutes of the time for which the meeting isconvened, it may be adjourned to such time and placeas those present shall determine.

    15. At all nicetings of the Board voting shall be byshow of hands, unlms in any case a ballot shall becalled for by any two members present.

    16. No resolution arrived at or act, matter, or thingdone or authorised by or at any meeting shall be ic-scindeci or amended at any snbscquent meeting unlesseither notice of such intended rescission 01 amendmentbe given in the notices conveiiihg the meeting at whichsuch rescission or amendment is proposed, or an abso-lute majority of the total members of the Board votein favour of such rescission or amendment.

    17. Minutes of every meeting shall be kept by theSecretary and such minutes when signed by the Chair-man of the same or any subsequent meeting shall bebinding and conclusive for all purposes.

    Part IV.Articled Clerks.

    Division 1Registration of Articles of Clerkship.18. Every persomi desiring to enter into articles for

    a term of five years shall lodge with the Boardan application in form A in the Schedule;evidence as to the date and place of his birth;evidence as to his nationality;a certificate as to character ill Form B in the

    Schedule signed by two practitioners of atleast two years' standing and in practice;

    evidence that he has passed the matriculationexamination prescribed by the University ofWestern Australia for candidates enteringupon time course for the degree of Bachelorof Laws, or some other examination whichwould be accepted by the said University illlieu thereof, or has matriculated or graduatedat or passed the matriculation examinationof any University in Great Britain or Ire-land, or time Commonwealth of Australia orthe Dominion of New Zealand: Provided

    with the requirement of this sub-rule.that the Board may for good cause dispense

    19. Every person desiring to enter into articles fora term of two years shall lodge with the Board

    all application in form C in the Schedule;evidence as to the date and place of his birth;evidence as to his nationality;a certificate as to character in Form B ill the

    Schedule signed by two practitioners of atleast two years' standing and in practice;

    evidence that he has taken a degree in lawat a University aisd in the manner prese'ribedill paragraph (ci) of section 15 of the Act.

    20. The Board may approve 0r reject the applica-tion or nlav require further evidence or inforniationon any matter relating thereto.

    21. (1) If time Board approves the application, theapplicant shall within one month of being notified ofsuch approval produce his articles of clerkship to theSecretary for registration, and if he shall fail to doso, time Board 's approval shall cease to be effective,provided that the applicant may lodge his articles withthe Secretary at any time prior to the Board's approvaland the Board may direct registration thereof as at thedate of such lodgnieut.

    (2) No articles shall be registered umsder this Divi-siomi of these rules until the applicant has paid to theSecretary the sum of £12 12s.

    22. If a clerk who is serving under articles for aperiod of five years takes during such period a degreein law at a university and in the manner prescribed inparagraph (0) of section 15 of time Act, the Boardmany, upon the application of all parties to such articlesand on being satisfied of tue material facts, order thatthe term of such articles be reduced so tlsat the termshall expire on the second anniversary of the takingof such degree, and thereafter these rules shall applyas if the articles for a period of two years had beenregistered as at the date of the takisig of such degree,but no further registration fee shall be payable.

    22A. (1) In relation to articled clerks who haveserved in the armed forces at any time since the third(lay of September, 1939, and whose articles were regis-tered before enlistment therein, a period of such ser-vice equal to one-third thereof, but not exceeding 12months shall be deemned to he equivalent to actual andbone flOe service under articles of clerkship to a prac-titioner for the purposes of the Act.

    In relation to persons u-ho have so served insuch forces, a period of 12 months, being the periodimmediately preceding graduatioms and being portionof time period of two years required by section 15 oftile Act to be served by graduates may be served beforegraduation and while attending the University of West-ern Australia as students of law, and such period of12 nmontiis so served shall be deemed to be actual andbona flOe service under articles of clerkship to a prac-titioner for the purposes of tIme Act.

    (a) Any person desirous of taking the benefitof this rule shall make application to the Board accom-panied by an affidavit by the applicant setting out allthe facts and dates relied on by him, and the apphi-cant shall produce for time inspection of the Board hiscertificate of discharge froni the armed forces, state-ment of service, or other similar document.

    An application under paragraph (1) of thismule shall be accompassieci by a certificate from theapplicant's principal verifying the period or periods ofhis service under articles.

    Any application under paragraph (2) of thisrule shall be accompanied by a certificate from time Deanof tile Faculty of Law in time University of WesternAustralia, stating the date on which the applicant wasenrolled as a student iii such Faculty, and verifyingthat he is tiil so enrolled on the date of application.

    Division 2.Assignment and Cancellation ofArticles.

    23. (1) An application for the registration of anassignment of articles of clerkship shall be in FormD in time Schedule.

    The Board may approve or reject the applica-tion or may reqmmire further evidence or informationon any matter relating thereto.

    If the Board approves time application, the appli-cant shall within one nmonths of being notified of suchapproval produce time assignment to time Secretary forregistration, amid if lie shall fail to do so, the Board'sapproval shall cease to be effective, provided that theapplicant may lodge time assignment with the Secretai-yat any timne prior to the Board's approval and theBoard may direct registration thereof as at the dateof such lodgment.

  • 24. (1) If a practitioner to whom a clerk is articledshall, before the expiration of such clerk's service, ceaseto be entitled to have all articled clerk, the clerk mayapply to the Board to cancel the said articles andapprove the registration of fresh articles for the ins-expired balance of the term of the former articles.Such applicatiosi shall he in Form E in the Schedule.

    (2) The Board may approve or reject the applica-tion or may require further evidence or information onany matter relating thereto.

    (3. If tile Board approves the application, theapplicant shall within one month of being notified ofsuch approval produce the fresh articles to the Secre-tary for registration, and if lie shall fail to do so theBoard's approval shall cease to be effective, providedthat the applicant may lodge the fresh nrticles withthe Secretary at any time prior to the Board's ap-proval and the Board may direct registration thereof asat the date of such lodgment.

    25. If the Board, whether as time result of a reportby a prac'titioiser or otherwise, has reason to believethat a clerk has ceased to perform valid service underins articles, the Board may call upon the clerk toappear before tIme Board at a specified time and placeto answer such allegation, and after hearing the cleric,time Board may order that any specified period shallnot be counted as service under articles for time pin-poses of the Aet and these rules.

    26. In thc case of an application to tile Board tocancel articles under section 14C of the Act, the appli-cation shall proceed as nearly as possible in accordancewith time rules relating to the hearing of complaintsagaiiist practitioners, the applicant being treated asthe complainant and the other party to the articlesbeing treated as the practitioner complained against.

    27. (1) If a clerk is articled to a practitioner whois practicing outside the City of Peth, the Boardmay by order allow the clerk to serve a portion of hisarticles with a practitioner iii tile City of Perth (here-ismafter called ''the city practitioner'

    (2) Service by the clerk in accordance with time termsof suds order shall be deemed to be service cinder hisarticles, but ally certificate relatimsg to the period ofthe service performed with the city practitioner mustbe signed by the city practitioner.

    (3) Such an order shall not oblige the clerk to con-tinue with the city practitioner for the period mcmi-tioned in the order, nor shall it oblige the city prac-titioner to retail time clerk for such period, nor shallit relieve tIme practitioner to whonm the clerk is articledfrom any obligation under the articles, but in respectof thepeliod actually served by the cleric with the citypractitioner the city practitioner shall be liable underthe Act and these rules as if the clerk were articledto him.

    (4) The maximum period for which an order may bemade under this rule is

    iii the case of fiv years' articlestwo years;in the ease of two years' articlesone year.

    (5) A city practitioner shall not take or retain aclerk under tlus rule winle lie has two clerks articledto him.

    (6) An application for such all order shall be inForm F in the Schedule.

    Division 3.Examinations.28. A clerk serving under articles for a period of

    five years shall during the course of such articles passthe following examinations:

    (a) Intermediate Examination, comprising(1) Legal History and Constitutional Law.

    Sources and development of the Law(Common Law Equity Legislation,etc.), history and jurisdiction of timeseveral Courts.

    Federal and State Constitutions andEnglish Constitutional Law and Con-Vemitiolis.

    (2) Real PropertyThe principies of the law' ofReal Property, and time nature, creation,disposition and devolution of estates andinterests in laud.

    (3) Personal Property.The principles of thelnw of Personal Property amid rights andobligations relating thereto.

    (b) Final Examination, Part I., comprising :-(1) Real and Personal Property.

    Nature creation, disposition aud devolu-tion of estates and interests in land,and eonveyancing in respect of gen-eral law and Torrens Systemic titles.

    Principles of the law of Personal Pro-perty, including a more detailed know-ledge of Bills of Sale, Hire Purchaseagreements, Partnerships and Bank-ruptcy than is required for the Inter-mediate Examination on PersonalProperty.

    (2) Contracts and Company Law.General prin-ciples of law of contract, including agency,carriage by laud and sea, insurance, nego-tiable instruments, sale of goods, surety-ship. Company law iii Western Australia.

    Torts.Torts and obligations arising fromcivil wrongs at common law.

    (4) Criminal Law.Crimes and offences punish-able summarily.

    (e) Final Examination, Part II., comprising:Equity.General principles and maxims of

    equity.

    Private International Law.General prin-ciples of private International Law as abranch of English law, and including theapplication of such principles with statu-tory mnodifications between the otherStates of the Coinmo nwealth.

    Practic'e.Practice and procedure in alljurisdictions of the various Courts havingjurisdiction in Westerms Australia (includ-ing the High Court).

    (4) Evidence and Legal Immterpretation.Prin-ciples of time law of evidence and tIme rulesrelating -to legal interpretation.

    29. (1) A clerk shall not sit for the Final Exam-ination, Part I., until he has completed three years'service under articles, nor within eleven months of sit-ting for the Intermediate Examination.

    (-2) A clerk shall not sit for the Final Examination,Part II., until lie has completed four years' serviceunder articles, nor within eleven months of sitting forthe Final Exaniination, Part I.

    30. (1) A clerk serving cinder articles for a periodof tw'o years shall, during the course of such articles,pass a Graduate's Examination in the following sub-jects :-

    Practice and procedure (including pleading)of the High Court, Bankruptcy Court andSupreme Court in all their jurisdictions, andof the inferior courts of Western Australia.

    Conveyancing.

    (2) A cleric shall not sit for the Graduate's Exam-ination until he lies completed one year and threenionthms' service under articles.

    31. Examinations shall be livid in the mouths ofApril and October in each year, and shall be conductedby such person or persons in suc'h manner and at suchtimes and places as the Board may from time to timeappoint or direet.

    32. (1) A cleric wishing to sit for an examinationshah lodge with the Secretary

    an application in Form G in -the Schedule;a certificate from every practitioner with

    whom he has served his articles in Form Hin the Schedule.

    (2) The clerk shah with his application pay to theSecretary the following fees:

    (a) For the Intermediate Examiimation-4 4s.(h) For every other examination-55 5s.

    A separate application must be lodged and aseparate fee paid on every occasion on which a clerkwishes to sit for an examination.

    (4) An application to sit for an examination inApril must be lodged not later than the last day of thepreceding February, and an application to sit for anexamination iii October must be lodged not later thanthe last day of the preceding August.

    33. Upon a clerk passing an examination, the Boardshall issue to kim a certificate in Form I in theSchedule.

    34. In the event of a clerk failing to pass duringthe currency of his articles the Final ExaminationPart II. or the Graduate's Examination, as the casemay be, the term of such articles shall he deemed tobe extended for all the purposes of time Aet and theserules until lie shall have passed such examination.

    35. The Board may, in its discsetion, abridge anyof the periods prescribed iii tins Division of this Partof these rules.

    Division 4.Miscellaneous.36. The Secretary shall keep the following records:

    A record of all articles of clerkship and assign-ments thereof, including the names of the parties, thedate of execution and the date of registration, andalso of all orders and directions made or given by theBoard relating thereto.

    A record of the examinations for which a clerksits and the result thereof.

    A card index showing the names of all prac-titioners with whom clerks are serving articles, and thenames of such clerks.

    A card index showing the names of all clerkswho are serving articles, and the names of the practi-tioners with whom the articles are being served.

    37. At ally time while a lcrk is serving underarticles the Board may require him and any practitionerto wlmoni he is or has been articled to answer verballybefore time Board or in writing such questions touch-ing the eonduet of the clerk, or as the Board shallthink fit, and thereupon the clerk and the practitionershall be bound to answer accordingly.

    38. An application by an articled clerk under sec-tion 13 of the Act shall be in Form J iii the Schedule.

    Part V.Managing Clerks.

    39. Every applicant for approval as a managingclerk shall lodge with the Board

    an application in Form K in tile Schedule;evidence as to the date and place of his birth;evidence as to his nationality;a certificate as to character in Form L in

    the Schedule signed by two practitioners ofat least two years' standing and in practice,neither of whom shall he a practitioner bywhom the applicant is or has at any timebeen employed as a clerk oi- managing clerk;

    evidence of the length of time that he hasbeen employed as a clerk or managing clerkin the office of a practitioner or practition-ers practising in Western Australia or else-where and the nature and general descrip-tiosi of the work done by him during theperiod of his employment;

    a certificate by tile practitioner by whom lieis employed at the time of the applicationthat the applicant is in hns opinion a fitand proper person to be approved as a man-aging clerk and setting out the practition-er's grounds for such opinion;

    the sum of ten guineas.40. The Board may approve or reject the applica-

    tion, or may require further evidence or informationon any matters relating thereto.

    41. Every applicant for approval as a managing clerkand the employer or employers of such applicant shallsupply to the Board or the Secretary such further infor-mation or evidence as the Board may from time totime require and shall, when or as often as required,attend in person before the Secretary or Board andshall answer verbally or in writing all such questionsas may be put to them.

    42. If time Board approves the application, it shallfix thai date, not being mel-c than twelve months priorto time date of time application when the applicant'semployment as managing clerk shall be deemed to havecounnenced and shall notify the fact of such approval,togetlmem- with such date to the applicant.

    43. No managing clerk shall be entitled to sit forhis final examination unless

    lie has applied for and obtained the appi-ovalof the Board under time preceding provisionsof this Pait;

    lie satisfies the Board that lie has for a periodof three years at least after the date whenIns employment as managing clerk com-menced been continuously and i-egulai-ly em-ployed as a managing clerk in the employ-ment of a practitioner or practitioners inactual practice.

    44. The Final Examination for managing clerksshall comprise tile Final Examination, Part I. and theFinal Examination, Part II., prescribed for articledclerks undem- Part IV., Division 3, of these rules.

    45. A managing clerk shall not sit for the FinalExamination, Part II., within eleven months after hehas passed the Final Examination, Past I., but he shallnot be entitled to em-edit for having passod time FinalExamination, Part I., unless lie shall have passed theFinal Examination, Part II., within two years and onemonth from the date when lie passed tIme Filial Exani-imiatiosm, Part I.

    46. A managing clerk who wishes to sit for eitherthe Filial Exanunation, Past I., or the Final Examina-tion, Past II., shall lodge with the Sccretasy-

    an application ill Formic M in the Schedule;a certificate in Form N in the Schedule, from

    every practitioner by whom lie has beenemployed as a managing clerk since the dateof his application for approval nudes- theprevious provisions of this Part;

    a fee of five guineas.

    47. The provisions of mules 31, 32 (3) and (4) ,33and 35 shall apply lnutatis imsutandss to a massagingclerk sitting for his Final Examinations under the pro-visions of this Part.

    48. TIme Secretary shall keep the following rccordsrelating to managing clerks:

    A record of all applications for approval asmnanaging clerks under time previous provi-sions of this Part, including the date ofeach application, the date of appi-oval bythe Board, the date when the applicant'semployment as managing clerk shall beilceuied to have commenced, the name of themanaging clerk, and the practitioner or prac-titioners by whom he is employed, and alsoall orders and directions mad-n or given bythe Board relating to such nianaging clerks.

    A i-eeord of the examinations for which amanaging clerk sits and the result thereof.

    A card index showing the names of all prac-titioncms by whom managing clerks are em-ployed, and the names of such managingclerks.

    A cam-d index showing the names of all mnaa-aging clerks approved by the Board, and thenames of time practitioneis by whom they areemployed.

    49. The Board may at any time require a managingclerk approved by the Boasd and any practitioner bywhom lie is or has been employed to answer verballybef os-c the Board or in writing such questions touchingthe conduct of the managing clerk, oi- as the Boardthinks fit, and them-eupon the managing clerk and thepractitioner shall be bound to answer accordingly.

    50. If at any time a managing clerk approved bythe Board changes his employment, he shall forthwithnotify the Secretai-y of such change and the name ornames of the practitioner or practitioners by whom hehas come to be employed.

    Part VI.Admission of Practitioners.

    51. Every applicant for adnussion as a practitionerunder section 15, paragraphs (a) or (b) of the Act,shall at least three calendar months before he appliesto the Court for admission, lodge with the Secretary-

    an affidavit iii Form 0, together with theexhibits referred to;

    a certificate of his admission to practise inevery court in which lie has been admittedto practise; and

    a certificate from the Registrar or other properofficer of every court in which lie has there-tofore been admitted to practise that at thedate of such certificate not being more thanfour months prior to the date of the lodgingof the affidavit referred to iii paragraph (i)of this rule the nanle of the applicant wasstill on the rolls of the court and that Icehad never at any time been struck off orsuspended, nor been the subject of a con'-plaint by any person to the Court other thanas disclosed in such certificate;

    a certificate from the Secretary or otherspousibie officer of any committee or bodyhaving authority to deal with complaintsagainst any person entitled to practise -fore any such Court;

    (a) that the applicant has not at amy time beenthe subject of any complaint to such com-mittee or body or,

    (h) if the applicant has been the subject of anysuch complaint giving details of all com-plaints against the applicant, including
