No. 7/2014EDEN DISTRICT MUNICIPALITY: CLOSURE OF A PORTION OF MINOR ROAD 7239 (WITTEDRIFT), PLETTENBERG BAYUnder section 3 of the Roads Ordinance, 1976 (Ordinance No 19 of 1976), I hereby declare that the portion of the existing public road (Minor Road7239) described in the schedule and situated in the Eden District Municipality area, the location and route of which are indicated by means of anunbroken blue line marked A-B on plan RL.52/9, which is filed in the offices of the Assistant Executive Manager: Road Network Management,9 Dorp Street, Cape Town and the Municipal Manager, Eden District Municipality, 54 York Street, George shall be closed.

Fourth Supplementary valuation (SV04) to the 2012 General Valuation Roll for the financial year 2014/15

Notice is hereby given in terms of section 49(1)(a)(i) of the Local Government: Municipal Property Rates Act, Act 6 of 2004, hereinafter referredto as the ‘Act’, that the Fourth Supplementary Valuation Roll (SV04) to the 2012 General Valuation Roll for the financial year 2014/15 is open forpublic inspection at the venues as stated below from 20 June 2014 until 30 July 2014. The forms for the lodging of objections are obtainable atthese venues. In addition the valuation roll is available on the Council’s website from 20 June 2014 (the address is provided below).

Properties were selected to appear on the Fourth Supplementary Valuation Roll (SV04) to the 2012 General Valuation Roll in terms of section 78(1)of Act if the property a) was incorrectly omitted from the Valuation Roll; b) has been included in the municipality after the last general valuation;c) has been subdivided or consolidated after the last general valuation; d) has undergone a substantial increase or decrease in market value sincethe last general valuation; e) was substantially incorrectly valued in the last general valuation; f) must be revalued for any other exceptional reason;g) of which the category has changed.

In terms of section 49(1)(a)(ii) of the Act, any property owner or person who so desires may lodge an objection with the municipal manager inrespect of any matter reflected in, or omitted from the valuation roll, in the abovementioned period. Objections may only be lodged in respect ofproperties valued on the SV04 Roll. The owners of these properties will be notified of their SV04 valuations in writing at the postal address currentlyheld on the City’s database.

Attention is specifically drawn to the fact that in terms of section 50(2) of the Act an objection must be in relation to a specific individual propertyand not against the supplementary valuation roll as a whole. Vierde Aanvullende Waardasielys (SV04) tot die 2012- Algemene Waardasielys vir die 2014/15-boekjaar

Ingevolge artikel 49(1)(a)(i) van die Wet op Plaaslike Regering: Munisipale Eiendomsbelasting, Wet 6 of 2004, hierna die ‘‘Wet’’ genoem, worddaar hiermee kennis gegee dat die vierde aanvullende waardasielys (SV04) van die 2012- algemene waardasielys vir die 2014/15-boekjaar vanaf 20Junie 2014 tot 30 Julie 2014 vir die publiek by die lokale hieronder ter insae lê. Die vorms vir die indiening van besware is by hierdie lokalebeskikbaar. Die waardasielys is ook vanaf 20 Junie 2014 op die Raad se webwerf beskikbaar (adres hieronder).

Eiendomme word ingevolge artikel 78(1) van die Wet op die vierde aanvullende waardasielys (SV04) van die 2012- algemene waardasielys geplaasindien dit: a) foutiewelik uit die waardasielys gelaat is; b) na die laaste algemene waardasie by die munisipaliteit ingesluit is; c) na die laaste alge-mene waardasie onderverdeel of gekonsolideer is; d) ’n wesenlike toename of vermindering in markwaarde ondergaan het sedert die laaste alge-mene waardasie; e) in die laaste algemene waardasie aansienlik verkeerd gewaardeer is; f) om enige ander buitengewone rede herwaardeer moetword; g) waarvan die kategorie verander het.

Ingevolge artikel 49(1)(a)(ii) van die Wet kan enige eiendomsbesitter of ander persoon wat wil binne die gemelde tydperk ’n beswaar by die muni-sipale bestuurder indien oor enige saak wat op die waardasielys verskyn of daaruit weggelaat is. Besware kan slegs ten opsigte van eiendomme watop die SV04-lys gewaardeer is, ingedien word. Die eienaars van hierdie eiendomme sal skriftelik van hul SV04-waardasies in kennis gestel wordby die posadres wat tans op die Stad se databasis is.

Aandag word spesifiek gevestig op die feit dat ’n beswaar ingevolge artikel 50(2) van die Wet met ’n spesifieke, individuele eiendom verband moethou en nie teen die aanvullende waardasielys as ’n geheel ingedien kan word nie. Die vorms vir die indiening van besware is by die lokale hier-onder genoem beskikbaar en kan van die webwerf afgelaai word. ’n Afsonderlike beswaarvorm moet vir elke eiendom ingevul word.

1.2 Relief measures related to categories of properties

1.2.1 Residential properties

(i) In respect of all properties that are valued up to and inclusive of land and improvements, a property rating limitationis applied by granting such properties in terms of the MPRA an exemption of:—

1.3 Relief measures related to income

1.3.1 Upon submission before 30 September of each year ,of acceptable proof of these requirements, the persons in theincome groups set out below will be granted a rebate of:

(i) Income group less than R43 560 per annum Max p.m R3 630 40.00%

(ii) Income group less than R52 275 per annum Max p.m R4 356 30.00%

(iii) Income group less than R62 726 per annum Max p.m R5 227 20.00%

For the purposes of 1.1.3 Agricultural property owners must apply on a prescribed application for a rebate asdetermined by the municipality. The applications together with the SARS exemptions certificate, must reach themunicipality before end October preceding the start of the municipal financial year in which relief is sought.

For the purposes of 1.1.4 Public benefit organisations as provided for in the Rates Policy may apply for theexemption of property rates, subject to producing a SARS Tax exemption certificate as contemplated in Part 1 of theNinth Schedule of the Income Tax Act, 1962. The applications together with the SARS exemptions certificate, mustreach the municipality before end October preceding the start of the municipal financial year in which exemption issought.

For the purposes of 1.1.4 Registered Nature reserve as provided for in the Rates Policy may apply for the exemptionof in property rates, subject to the conditions of section 17(e) of the MPRA being met, applications must reach themunicipality before end October preceding the start of the municipal financial year in which exemption is sought.

For the purposes of 1.1.4 Sport Clubs/Sport Fields not operating from municipal property, an application accompaniedby the constitution of the club, a management resolution as well as copy of the members list must reach themunicipality before end October preceding the start of the municipal financial year in which the special rate is sought

For the purposes of 1.3.1 a property owner will be defined as follow: ‘‘A registered owner of a rateable property whoinhabits and controls the property and is responsible for payment of rates on the property’’;

For the purposes of 1.3.1 the income of the property owner will be determined as the total income of the owner andhis/her spouse from all sources, plus income of all resident children from all sources.

If a Category of a property is not included in these tariffs, the tariff for Business would be applied.

1.4 Relief measures related to specific purposes

1.4.1 Social or economic conditions of the area where the property is situated e.g. an area declared by the national orprovincial government to be a disaster area within the meaning of the Disaster Management Act, No. 57 of 2002

2014/2015 FINANCIAL YEAR : FINAL CAPITAL AND OPERATING BUDGET AND FIXING OF PROPERTY RATES, TARIFFS AND FEES

For general information notice is hereby given in terms of the stipulations of Section 22(a)(i) of the Local Government: Municipal Finance Management Act, 2003 (Act 56/2003) and Section 21A of the Local Government: Municipal Systems Act, 2000 (Act 32/2000) that the Local Council has approved the Final Capital and Operating Budget for the 2014/2015 financial year on 30 May 2014 and that the under mentioned tariffs will increase as follows with effect from 1 July 2014 :-

“ 2.1 That the Annual Budget of the Municipality for the financial year 2014/2015; and indicative for the two projected outer years 2015/2016 and 2016/2017 be approved as set out in the following schedules:-

2.2.1.1 Rebates in respect of residential properties will be granted in accordance with the Municipality Rates Policy to owners of properties who meet the following criteria –

2.2.1.1.1 The property must be occupied by the owner; 2.2.1.1.2 The rebate will be available to one property only in cases where

more than one property is owned by the applicants; 2.2.1.1.3 The owner must be older than 60 years; 2.2.1.1.4 The rebate shall be granted on properties where the municipal

valuation is less than R450,000.00.

2.2.1.2 The rebate referred to in the previous paragraph shall be dependent on the monthly household income as follows:-

Tariff Policy

1. Tariff Principles

The municipality shall, as far as circumstances reasonably permit, ensure that the tariffs levied in respect of the foregoing services further generate an operating surplus each financial year of up to 20%.

In addition, the municipality shall levy monthly basic charges for the services concerned, and these charges shall be fixed for each type of property as determined in accordance with the detailed policies set out below. Generally, consumers of water and electricity shall therefore pay two charges: one, relatively minor, which is unrelated to the volume of consumption and is levied because of the availability of the service concerned; and another directly related to the consumption of the service in question

In adopting what is fundamentally a two-part tariff structure, namely a fixed basic charge coupled with a charge based on consumption, the municipality believes that it is properly attending to the demands which both future expansion and variable demand cycles and other fluctuations will make on service delivery.

2. Tariff Types

(3) Inclining block tariff: this tariff is based on consumption levels being categorised into blocks, the tariff being determined and increased as consumption levels increase. This tariff will only be used to subsidised free basic services and prohibit the exorbitant use of a commodity.

3.1.1 WATER

3.1.2 ELECTRICITY

Current policy wording:

o Provision for subsidising the poor shall be made as follows:

Clients who are willing to have their capacity restricted to 15 Ampère and who have been supplied with a prepaid meter.

Council shall continue to maintain a list of indigents. These clients would have to comply with the conditions for subsidised tariffs after which they will receive 50 kWh/m (or as may be determined from time to time) free of charge, which shall be covered from the Equitable Share.

3.1.3 REFUSE REMOVAL

(c) Where properties can make use of a refuse removal service an availability tariff will be payable. The tariff will be a proportional calculation of the deemed fixed cost.

3.1.4 SEWERAGE/EMPTYING OF CONSERVANCY TANKS

(b) Method of calculation

(i) Properties used for residential purposes will pay a fixed

tariff per month irrespective of the number of toilet pans

or urinals, such fixed tariff will also be applicable where

no municipal sewerage network exists. This tariff will

entitled owners of conservancy tanks to one removal per

month.

(ii) All other categories will pay a variable cost based on the

number of toilet pans or urinals and the variable cost

allocated to that particular category.

(iii) Residential properties (requiring more than one removal

per month) , business premises and farms where no

municipal sewer network exists shall pay a tariff per half-

hour (30 minutes) or portion thereof.

(c) Where properties are not connected to the sewerage service or can reasonably be connected to the service an availability tariff will be payable. The tariff will be a proportional calculation of the deemed fixed cost.

3.2 Calculation of minor Tariffs

The following services shall be considered as economic services, and the tariffs levied shall cover 100% or as near as possible to 100% of the budgeted annual operating expenses of the service concerned:

• maintenance of graves and garden of remembrance (cremations)

• housing rentals

• rentals for the use of municipal halls and other premises (subject to the proviso set out below)

• building plan fees

• sales of plastic refuse bags

• sales of refuse bins

• cleaning of stands

• electricity, water, sewerage: new connection fees

• sales of livestock and plants

• photostat copies and fees

• clearance certificates

• removal of garden and other refuse

• town planning applications

• Camp-site tariffs

Council may annually during the budget process determine a different tariff for hall rentals depending on the purpose of the rental or the organization by which it is rented by.

4. NOTIFICATION OF TARIFFS, FEES AND SERVICE CHARGES

(1) The council will give notice of all proposed tariffs considered at the annual budget meeting (where draft budget was tabled) 10 working day succeeding the date of such a meeting.

(2) A notice stating the purport of the council resolution, date on which the new tariffs shall become operational and invitation for objections will be displayed by the municipality at a place installed for that purpose.

5. SERVICES DEPOSITS A consumer deposit will be required for every new service agreement. The deposit will be calculated as follow:

5.1. to include the basic fees of sewerage and refuse to be charged on a monthly basis to the account for two (2) months and;

5.2. in the case of conventional (Read) meters the expected consumption for water and/or electricity for two months (i) Household (20 kl) electricity (500kwh) (ii) Businesses as per comparable business or upon advice from Technical

5.3. The deposit to be accepted as a general municipal services deposit and will not be service specific
